Regarding amendments and supplements to certain provisions of the Regulation on registration, preservation, and utilization of results from scientific and technological tasks
issued together with Decision No. 03/2007/QĐ-BKHCN
dated March 16, 2007, by the Minister of Science and Technology

Pursuant to Decree No. 28/2008/NĐ-CP dated March 14, 2008, promulgated by the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Science and Technology;
On the basis of Resolution number 67/NQ-CP dated December 24, 2010 of the Government regarding simplifying administrative procedures within the scope of management functions of the Ministry of Science and Technology;
Considering the proposal of the Director of the National Scientific and Technological Information Center,
The Minister of Science and Technology stipulates:
Article 1. Amending and supplementing certain provisions of the Regulation on registration, preservation, and utilization of results from scientific and technological tasks issued together with Decision No. 03/2007/QĐ-BKHCN dated March 16, 2007, by the Minister of Science and Technology as follows:
1. Amend and supplement Clause 2, Article 3 as follows:
"2. Results from scientific and technological tasks that must be registered include materials reflecting the results of scientific and technological tasks, including: comprehensive research result reports; specialized reports; consolidated data sheets from surveys and investigations; process technology description forms (Annex I); maps; drawings; photographs."
2. Amending and supplementing Clause 2 and Clause 3 of Article 4 as follows:
"2. Ministries, agencies equivalent to ministries, and government agencies (hereinafter referred to as ministries or sectors) shall designate or authorize subordinate agencies with appropriate functions to be the registration agency for grassroots-level scientific and technological tasks within their respective jurisdictions."
"3. The registration agency of provinces and centrally-administered cities is the Department of Science and Technology of the province or centrally-administered city, responsible for registering provincial and grassroots-level scientific and technological tasks within their respective localities."
3. Amending and supplementing Clause 3 and Clause 6 of Article 6 as follows:
"3. Each scientific and technological task must submit one set of registration result files, including:
a) One Registration Result Form (Annex II) for each scientific and technological task. For scientific and technological tasks where the results can be implemented as technology, an additional Process Technology Description Form (Annex I) is required;
b) One paper copy of the Comprehensive Research Result Report (completed after the official acceptance of the scientific and technological task), Consolidated Data Sheets from Surveys and Investigations, maps, drawings, and photographs. The paper copies of the Comprehensive Research Result Report and Consolidated Data Sheets from Surveys and Investigations must be bound in hard covers with square spines;
c) One electronic copy of the Comprehensive Research Result Report, Consolidated Data Sheets from Surveys/Investigations, branch project reports, and research special topics. The electronic copy must use Word format (extension .doc) or Excel format (extension .xls) or Acrobat format (extension .pdf). For Word and Excel formats, Vietnamese Unicode fonts (Times New Roman) according to TCVN 6009:2001 must be used. The electronic copy must be recorded on optical discs and must not be password protected;
d) Proof of filing an application for protection of intellectual property rights (if applicable)."
"6. The registration agency shall examine the file, issue a Registration Certificate (Annex III) within five working days from the date of receipt of complete files as stipulated in Clauses 3, 4, and 5 of this Article. In cases where the file requires supplementation, the registration agency shall notify the organization or individual in charge of implementing the scientific and technological task in writing within five working days from the date of receipt of the file. If the registration agency does not receive a valid supplementary file within ten working days from the date of request for supplementation, it has the right to refuse issuance of the Registration Certificate."
4. Amend and supplement Clause 2 of Article 7 as follows:
"2. The registration agency shall examine the file, issue a Registration Certificate (Annex IV) within fifteen working days from the date of receipt of the file as stipulated in Clause 1 of this Article."
5. Amending and supplementing Annex II on the Sample Registration Form as follows:
- Removing "Item 12. Confidentiality of information";
- Removing the requirement to list the following items at Item 13: Registration Form; Meeting Minutes of Acceptance; Summary Report; Film; Video Tape; Floppy Disk.
Article 2. Replacing the phrase "National Scientific and Technological Information Center" with "National Scientific and Technological Information Agency" in the provisions of Decision No. 03/2007/QĐ-BKHCN dated March 16, 2007, and the Regulation on registration, preservation, and utilization of results from scientific and technological tasks issued together with Decision No. 03/2007/QĐ-BKHCN.
Article 3. The Director of the National Scientific and Technological Information Agency, the Head of the Ministry's Office, Heads of Departments: Planning and Finance, Science and Technology of Economic and Engineering Sciences, Social and Natural Sciences, High Technology, Heads of units under the Ministry, Heads of agencies, organizations, and individuals concerned are responsible for implementing this Circular.
Article 4
1. This Circular takes effect from June 6, 2011.
2. Agencies of political organizations, political-social organizations, the Supreme People's Procuracy, the Supreme People's Court, the Office of the National Assembly, and the Office of the President may study and apply the Regulation on registration, preservation, and utilization of results from scientific and technological tasks issued together with Decision No. 03/2007/QĐ-BKHCN dated March 16, 2007, by the Minister of Science and Technology and this Circular amending and supplementing certain provisions of the Regulation based on specific needs and conditions.
