CIRCULAR
Regarding the amendment and supplementation of certain articles of the Examination Regulations for Secondary School Graduation issued together with Circular No. 10/2012/TT-BGDĐT dated March 6, 2012 of the Minister of Education and Training.

Pursuant to Decree No. 36/2012/NĐ-CP dated April 18, 2012 of the Government stipulating the functions, tasks, powers, and organizational structure of ministries and ministerial-level agencies;
Pursuant to Decree No. 32/2008/NĐ-CP dated March 19, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Education and Training;
Pursuant to Decree No. 75/2006/NĐ-CP dated August 2, 2006 of the Government detailing and guiding the implementation of certain provisions of the Law on Education; Decree No. 31/2011/NĐ-CP dated May 11, 2011 of the Government amending certain provisions of Decree No. 75/2006/NĐ-CP dated August 2, 2006 of the Government detailing and guiding the implementation of certain provisions of the Law on Education; Decree No. 07/2013/NĐ-CP dated January 9, 2013 of the Government amending point b Clause 13 Article 1 of Decree No. 31/2011/NĐ-CP dated May 11, 2011 of the Government amending and supplementing certain provisions of Decree No. 75/2006/NĐ-CP dated August 2, 2006 of the Government detailing and guiding the implementation of certain provisions of the Law on Education;
Upon the proposal of the Director of the Testing and Quality Assurance Department, the Minister of Education and Training issues this Circular to amend and supplement certain articles of the Examination Regulations for Secondary School Graduation issued together with Circular No. 10/2012/TT-BGDĐT dated March 6, 2012 of the Minister of Education and Training.
Article 1. Amending and supplementing certain articles of the Examination Regulations for Secondary School Graduation issued together with Circular No. 10/2012/TT-BGDĐT dated March 6, 2012 of the Minister of Education and Training, as follows:
1. Paragraph d Clause 5 Article 18 is amended and supplemented as follows:
“- The invigilator in the examination room:
+ Organizing, guiding, and supervising candidates in the examination room to comply with the Examination Regulations and examination rules;
+ Receiving examination papers from the Chairman of the Examination Board and distributing them to candidates in the examination room; signing on scratch paper and answer sheets of candidates;
+ Sealing and handing over surplus examination papers to the Chairman of the Examination Board or a person authorized by the Chairman of the Examination Board in the examination room;
+ Collecting candidates' answer sheets, checking the number of answer sheets and pages, arranging them in order of registration numbers, putting them in bags, and submitting them fully to the Chairman of the Examination Board or a person authorized by the Chairman of the Examination Board;
+ Preparing minutes and recommending disciplinary actions against candidates who violate the Examination Regulations.”
2. Article 20 shall be amended and supplemented as follows:
“Article 20. Items allowed in the examination room
Candidates may only bring writing pens, pencils, compasses, erasers, rulers, calculators without additional memory cards that cannot be used for word processing, Atlases of Vietnam Geography for Geography subjects (published by the Vietnam Educational Publishing House, not marked or written on), and recording devices solely for recording information without transmitting it and without receiving direct audio or video signals if there is no additional equipment.”
3. The title of Chapter V is amended and supplemented as follows:
“MARKING, REVIEWING, RECHECKING AND REEXAMINATION”
4. Point b Clause 4 Article 23 is amended and supplemented as follows:
“b) Deputy Chairperson of the Marking Board: Leading the testing department, secondary education department, and continuing education department of the provincial education and training department or the leadership of general education schools. The Chairperson of the Marking Board assigns Deputy Chairpersons of the Marking Board to oversee marking of each subject and review according to Article 25a of these Regulations.”
5. Adding Article 25a after Article 25 as follows:
“Article 25a. Reviewing and rechecking
1. Reviewing
a) Each Marking Board shall have an independent reviewing team for subjective examination papers.
b) Composition of the reviewing team:
- The team leader is the Deputy Chairperson of the Marking Board; the Chairperson of the Marking Board may appoint another member of the Marking Board as Deputy Team Leader if deemed necessary;
- Team members are staff and teachers with good moral character and expertise.
c) Duties and powers of the reviewing team:
- Conducting reviews of at least 5% of the total number of subjective examination papers for each subject, following the progress of the Marking Board;
- Reporting review results and making recommendations to the Chairperson of the Marking Board at the end of each marking session;
- Directly working with marking teams and examiners as directed by the Chairperson of the Marking Board (with meeting minutes recorded).
2. Rechecking
a) In cases where necessary, the Minister of Education and Training may issue a decision to establish a Rechecking Board for subjective examination papers of the Marking Boards;
b) The Rechecking Board bears ultimate responsibility and reports to the Minister of Education and Training on the final handling of examination scores.”
6. The first paragraph of point b Clause 1 Article 29 is amended and supplemented as follows:
“b) Achieving individual and team awards in cultural and artistic competitions; physical education and sports competitions; defense education games; experimental and practical subject competitions (Physics, Chemistry, Biology); creative and scientific research competitions; international letter-writing contests organized by the education sector in collaboration with relevant sectors at provincial level or higher for secondary school students:”
7. The first paragraph of point b Clause 1 Article 34 is amended and supplemented as follows:
“b) Achieving individual and team awards in cultural and artistic competitions; physical education and sports competitions; defense education games; experimental and practical subject competitions (Physics, Chemistry, Biology); creative and scientific research competitions; international letter-writing contests organized by the education sector in collaboration with relevant sectors at provincial level or higher for secondary school students:”

“Article 42a. Handling Information on Negative Incidents During Examinations
1. Providing information and evidence of violations of the Examination Regulations:
a) Persons providing information and evidence of violations of the Examination Regulations must bear legal responsibility for the authenticity of the provided information and evidence, and must not abuse such actions to negatively impact the examinations;
b) Persons with evidence of violations of the Examination Regulations have the responsibility to submit the evidence to the designated authority within seven days from the end of the last day of the examination for processing; they must not disseminate the information to others in any form.
2. Authorities responsible for receiving information and evidence of violations of the Examination Regulations:
a) National or Provincial (city) Examination Steering Committee;
b) Educational inspection bodies at all levels.
3. For organizations and individuals receiving information and evidence of violations of the Examination Regulations:
b) Promptly implement measures to prevent negative practices and violations of the examination regulations based on provided information;
c) Handle according to their authority or report to competent agencies or individuals for handling those individuals or organizations that violate the examination regulations."
9. The first part of point a, Clause 1, Article 43 shall be amended and supplemented as follows:
"a) If officials, civil servants, or public employees involved in examination work commit acts in violation of the examination regulations, they will be subject to disciplinary action pursuant to Decree No. 34/2011/ND-CP dated May 17, 2011 of the Government on disciplinary sanctions against civil servants and Decree No. 27/2012/ND-CP dated April 6, 2012 of the Government on disciplinary sanctions against public employees and their liability for compensation and restitution, in one of the following forms:"
10. Point b and point c, Clause 2, Article 43 shall be amended and supplemented as follows:
"b) Suspend the examination and invalidate the results of the entire examination if there is a violation of any of the following deficiencies:
- Bringing into the examination room materials, items contrary to the provisions of Article 20 of this Regulation or weapons, explosives, flammable substances, beer, alcohol, communication devices, or items containing information that could be exploited for cheating during the examination;
- Receiving pre-prepared answers from others;
- Passing scratch paper or examination papers to other candidates or receiving scratch paper or examination papers from other candidates;
- Intentionally not submitting examination papers, using another person's examination papers or scratch paper to submit as one's own examination papers or having identical examination papers due to copying each other's work.
c) Invalidate examination results and prohibit examination participation for a period of 1 to 2 years if there is a violation of any of the following deficiencies:
- Assaulting invigilators, examiners, or service personnel of examination boards, marking boards, or review boards;
- Causing disturbances leading to loss of security and order in the examination area, with serious consequences for the examination;
- Falsifying examination application forms or having someone take the examination on one's behalf;
- Violating the provisions set out in point b, Clause 1, Article 42a."
Article 2. This Circular takes effect from April 6, 2013.
Article 3. The Director of the Office, the Director of the Testing and Quality Assurance Department under the Ministry of Education and Training; Heads of relevant units under the Ministry of Education and Training; Chairpersons of People's Committees of provinces and centrally-run cities; the School Administration Bureau - Ministry of National Defense; Directors of provincial education and training departments; Rectors of universities and academies; Principals of university and college institutions; Principals of ethnic minority boarding schools directly under the Ministry of Education and Training are responsible for implementing this Circular./.
