Regulations on the deployment of mobile communication systems IMT

on the frequency bands 824-835 MHz, 869-915 MHz, 925-960 MHz,

1710-1785 MHz and 1805-1880 MHz

WHEREAS, the Law on Radio Frequency Spectrum dated November 23, 2009;

Pursuant to the Law on Telecommunications dated November 23, 2009;

Based on Decree No. 132/2013/ND-CP dated October 16, 2013 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Information and Communications;

Pursuant to Decree No. 25/2011/NĐ-CP dated April 6, 2011 of the Government detailing and guiding the implementation of certain provisions of the Law on Telecommunications;

Pursuant to Decision No. 71/2013/QĐ-TTg dated November 21, 2013 of the Prime Minister promulgating the national radio frequency spectrum plan;

At the proposal of the Director of the Radio Frequency Management Department,

The Minister of Information and Communications issues this Circular regulating the deployment of mobile communication systems IMT (including IMT-2000, IMT-Advanced and subsequent versions, as defined by the International Telecommunication Union - ITU) on the frequency bands 824-835 MHz, 869-915 MHz, 925-960 MHz, 1710-1785 MHz and 1805-1880 MHz.

Article 1. Scope of Regulation and Applicability

Article 1. This Circular regulates the deployment of mobile communication systems IMT (including IMT-2000, IMT-Advanced and subsequent versions, as defined by the International Telecommunication Union - ITU) on the frequency bands 824-835 MHz, 869-915 MHz, 925-960 MHz, 1710-1785 MHz and 1805-1880 MHz.

Article 2. This Circular applies to telecommunications enterprises that have been granted licenses to use the frequency bands specified in Clause 1 of Article 1 of this Circular and relevant agencies and organizations.

Article 2. Deployment regulations for mobile communication systems IMT

1. Based on the frequency usage license for the bands 824-835 MHz, 869-915 MHz, 925-960 MHz already issued, telecommunications enterprises are permitted to deploy additional standard IMT mobile communication systems (WCDMA and subsequent versions) in these bands.

2. Based on the frequency usage license for the bands 1710-1785 MHz, 1805-1880 MHz already issued, telecommunications enterprises are permitted to deploy additional standard IMT mobile communication systems (LTE, LTE-Advanced and subsequent versions) in these bands.

3. Telecommunications enterprises deploying experimental or operational standard IMT mobile communication systems in the frequency bands specified in Clause 1 of Article 1 of this Circular must hold a Telecommunication Network Testing License using radio frequency bands; a Public Telecommunication Network Establishment License; a Telecommunication Service Provision License; and a corresponding Frequency Band Usage License in accordance with current laws.

Article 3. Implementation Provisions

Article 14. This Circular takes effect from April 20, 2015

Article 15. The Director of the Office, the Directors of the Radio Frequency Management Department and the Telecommunications Department, heads of agencies and units under the Ministry of Information and Communications, and related organizations and individuals are responsible for implementing this Circular.

Article 16. During implementation, if there are difficulties or obstacles, agencies, organizations, and individuals are requested to promptly report them to the Ministry of Information and Communications (Radio Frequency Management Department) for consideration and resolution./.
