Circular No. 04/2016/TT-BKHĐT stipulates the forms and templates of documents to be used in the registration of social enterprises according to Decree No. 96/2015/NĐ-CP dated October 19, 2015 of the Government detailing certain provisions of the Enterprise Law.

CIRCULAR

Regulations on forms of documents to be used in registering social enterprises pursuant to Decree No. 96/2015/NĐ-CP dated October 19, 2015 of the Government detailing certain provisions of the Enterprise Law.

Pursuant to the Enterprise Law No. 68/2014/QH13 dated November 26, 2014;

Pursuant to Decree No. 96/2015/NĐ-CP dated October 19, 2015 of the Government detailing certain provisions of the Enterprise Law;

Pursuant to Decree No. 116/2008/ND-CP dated November 14, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Planning and Investment;

At the request of the Director of the Central Institute for Economic Management;

The Minister of Planning and Investment issues this Circular regulating forms of documents to be used in registering social enterprises pursuant to Decree No. 96/2015/NĐ-CP dated October 19, 2015 of the Government detailing certain provisions of the Enterprise Law.

Article 1. Scope of Regulation and Applicability

1. This Circular details the forms to implement registration procedures for social enterprises pursuant to Decree No. 96/2015/NĐ-CP dated October 19, 2015 of the Government detailing certain provisions of the Enterprise Law (hereinafter referred to as Decree No. 96/2015/NĐ-CP).

2. This Circular applies to enterprises, agencies, organizations, and individuals specified in Clause 2, Article 1 of Decree No. 96/2015/NĐ-CP.

Article 2. Forms for implementing registration procedures for social enterprises

The following forms are attached to this Circular:

a) Form 1: Commitment to implement social and environmental goals;

b) Form 2: Notice of change in the content of the Commitment to implement social and environmental goals;

c) Form 3: Notice of termination of the Commitment to implement social and environmental goals;

d) Form 4: Notice of receipt of aid and sponsorship;

e) Form 5: Notice of change in the content of receipt of aid and sponsorship;

f) Form 6: Report on assessment of social and environmental impact.

Article 3. Implementation Organization

1. This Circular takes effect from July 1, 2016.

2. During the implementation of this Circular, if there are any difficulties, relevant agencies, organizations, and individuals shall promptly reflect them to the Ministry of Planning and Investment for further guidance.
