CIRCULAR

Regulations on the maximum postage rate for public service activities in newspaper distribution

Pursuant to the Law on Prices dated June 20, 2012;

Pursuant to the Law on Posts dated June 17, 2010;

Pursuant to the Press Law dated December 28, 1989 and the Law Amending and Supplementing Certain Provisions of the Press Law dated June 12, 1999;

Pursuant to the Government Decree No. 177/NĐ-CP dated November 14, 2013 detailing and guiding the implementation of certain provisions of the Price Law;

Based on Decree No. 132/2013/ND-CP dated October 16, 2013 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Information and Communications;

Pursuant to the Prime Minister's Decision No. 45/2015/QĐ-TTg dated September 24, 2015 on providing public postal services and public services in newspaper distribution activities;

At the proposal of the Director of the Post Department,

The Minister of Information and Communications issues this Circular regulating the maximum postage rate for public service activities in newspaper distribution

Article 1. Maximum Postage Rate for Public Service Activities in Newspaper Distribution

1. Maximum Postage Rate for Public Service Activities in Newspaper Distribution for the period 2016-2017:

Where:

- Intra-provincial newspaper distribution is newspaper distribution within the scope of a province or a centrally governed municipality.

- Newspaper distribution at provinces with printing points is newspaper distribution at provinces/municipalities directly under the Central Government where editorial offices have set up printing points.

- Inter-provincial newspaper distribution is newspaper distribution from a province with a printing point to other provinces and municipalities directly under the Central Government.

2. Maximum Postage Rate for Public Service Activities in Newspaper Distribution for the period 2018-2019

a) The maximum postage rate for the distribution of People's Army Newspaper, People's Army Newspaper, and newspapers of provincial party committees and municipal party committees directly under the Central Government shall increase by 60% compared to the postage rates specified in Clause 1 of this Article;

b) The maximum postage rate for the distribution of Communist Review shall increase by 20% compared to the postage rates specified in Clause 1 of this Article.

3. The maximum postage rate for public service activities in newspaper distribution from 2020 shall increase by 25% compared to the maximum postage rates specified in Clause 2 of this Article.

Article 2. Responsibilities of News Agencies

People's Army Newspaper, People's Army Newspaper, Communist Review, and newspapers of provincial party committees and municipal party committees directly under the Central Government must comply with legal regulations on postage rates for public service activities in newspaper distribution.

Article 3. Implementation Organization

1. Responsibilities of the Ministry of Information and Communications:

a) To take the lead and coordinate with relevant ministries and agencies to implement the provisions of this Circular;

b) To coordinate with the Ministry of Finance to inspect and supervise the implementation of regulations on postage rates for public service activities in newspaper distribution;

c) To take the lead and coordinate with the Ministry of Finance to review and adjust the maximum postage rates for public service activities in newspaper distribution when there are significant changes in price formation factors.

2. Responsibilities of Provincial Departments of Information and Communications:

To manage state affairs regarding postage rates for public service activities in newspaper distribution within their jurisdiction.

3. Responsibilities of Vietnam Post Corporation:

a) To determine the postage rate for public service activities in newspaper distribution within its authority, ensuring it does not exceed the maximum postage rates stipulated in Article 1 of this Circular;

b) To report to the Ministry of Information and Communications and the Ministry of Finance on the postage rates for public service activities in newspaper distribution stipulated in Article 1 of this Circular thirty days before implementing them across the network.

Article 4. Implementation clause

1. This Circular takes effect from April 1, 2016 and replaces Decision No. 619/QĐ dated September 5, 1966 of the General Post and Broadcasting Department on the unified system of distribution fees for domestic newspapers published and distributed by the Postal Service.

2. The Director of the Office, Heads of the Postal Services Department, Heads of agencies and units under the Ministry of Information and Communications, Vietnam Post Corporation, and related entities are responsible for implementing this Circular./.
