Pursuant to the Law on Government Organization dated June 19, 2015;

Pursuant to the Law on Rational and Efficient Use of Energy dated June 28, 2010;

Pursuant to Decree No. 21/2011/NĐ-CP dated March 29, 2011 of the Government detailing and providing implementation measures for the Law on Rational and Efficient Energy Use;

At the proposal of the Minister of Industry and Trade;

The Prime Minister issues this Decision to regulate the list of equipment and devices that must be labeled with energy efficiency labels, apply minimum energy performance standards, and implement schedules.

Article 1. List of equipment and devices that must be labeled with energy efficiency labels and apply minimum energy performance standards

1. Household appliances group includes: Straight fluorescent lamps, compact fluorescent lamps, ballasts for fluorescent lamps (electromagnetic and electronic), air conditioners, refrigerators, household washing machines, rice cookers, electric fans, televisions, LED lamps, hot water storage tanks.

2. Office and commercial equipment group includes: Photocopiers, computer monitors, printers, commercial refrigeration units, laptop computers.

3. Industrial equipment group includes: Distribution transformers, electric motors.

4. Transportation vehicles group includes: Passenger cars up to nine seats, motorcycles, motorbikes.

Article 2. Schedule for implementing energy efficiency labeling

1. For the household appliances group and industrial equipment group

a) Mandatory energy efficiency labeling shall be implemented for the following household appliances and industrial equipment: Straight fluorescent lamps, compact fluorescent lamps, ballasts for fluorescent lamps (electromagnetic and electronic), air conditioners, rice cookers, electric fans, refrigerators, front-loading washing machines, top-loading washing machines, televisions, three-phase distribution transformers, electric motors;

b) Voluntary energy efficiency labeling shall be implemented until December 31, 2019 for: LED products, hot water storage tanks;

c) Mandatory energy efficiency labeling shall be implemented from January 1, 2020 for: LED products, hot water storage tanks.

2. For the office and commercial equipment group

a) Mandatory energy efficiency labeling shall be implemented for commercial refrigeration units;

b) Voluntary energy efficiency labeling shall be implemented for: Photocopiers, computer monitors, printers;

c) Voluntary energy efficiency labeling shall be implemented for laptop computers until December 31, 2019;

d) Mandatory energy efficiency labeling shall be implemented for laptop computers from January 1, 2020.

3. For transportation vehicles group (production, assembly, and new imports):

a) Mandatory energy efficiency labeling shall be implemented for passenger cars up to seven seats;

b) Voluntary energy efficiency labeling shall be implemented for passenger cars over seven seats up to nine seats until December 31, 2017; motorcycles, motorbikes until December 31, 2019;

c) Mandatory energy efficiency labeling shall be implemented for: Passenger cars over seven seats up to nine seats from January 1, 2018; motorcycles, motorbikes from January 1, 2020.

4. Encouragement for voluntary energy efficiency labeling for equipment and devices not included in the list specified in Article 1 of this Decision.

Article 3. Schedule for implementing minimum energy performance standards

1. For household appliances group

Importing and producing equipment and devices with lower energy efficiency than the minimum energy performance standard is prohibited (except for those specified in Clause 4 of this Article).

2. For industrial equipment, office and commercial equipment groups

Importing and producing equipment and devices with lower energy efficiency than the minimum energy performance standard is prohibited (except for those specified in Clause 4 of this Article).

3. For round light bulbs (incandescent lamps)

Importing, producing, and circulating light bulbs with power greater than 60 watts is prohibited.

4. For LED products, hot water storage tanks, laptop computers: The schedule for implementing minimum energy performance standards will be regulated in the Prime Minister's decision on issuing the list and schedule for equipment and devices using energy that must be phased out and low-efficiency power plants that are not allowed to be newly constructed.

Article 4. Measures to support the implementation of energy labeling and the application of minimum energy performance standards

1. Investment in building specialized testing facilities and equipment for inspecting, testing, and certifying the energy efficiency of devices and equipment required to be labeled according to the schedule.

2. Training and enhancing the professional expertise of staff, technical personnel, and skilled workers responsible for inspecting and testing the energy efficiency of devices and equipment required to be labeled.

3. Organizing extensive promotional activities to disseminate information about devices and equipment required to be labeled and the application of minimum energy performance standards.

4. Developing projects to promote energy labeling activities for target groups as specified in this Decision's schedule.

State-owned enterprises that have been assigned by the Ministry of Agriculture and Rural Development to conduct offshore wind power project surveys before the effective date of this Circular shall continue to implement according to the assigned documents; any new matters arising after the effective date of this Circular shall be implemented in accordance with the provisions of this Circular.

1. The Ministry of Industry and Trade shall be responsible for:

a) Guiding, inspecting, and supervising energy labeling for groups of devices and equipment required to be labeled as stipulated in Clauses 1 and 2, Article 2 of this Decision;

b) Taking the lead and coordinating with relevant ministries and sectors to submit to the Prime Minister for supplementation of the list of energy-consuming devices and equipment required to be labeled;

c) Building and implementing measures to support the implementation of the energy labeling schedule as stipulated in Article 4 of this Decision.

2. The Ministry of Transport shall be responsible for guiding, inspecting, and supervising energy labeling for devices and equipment as stipulated in Clause 3, Article 2 of this Decision.

3. The Ministry of Science and Technology shall be responsible for:

a) Taking the lead and coordinating with relevant ministries and sectors to develop and promulgate national standards on energy efficiency and minimum energy performance standards for devices and equipment consistent with the energy labeling schedule;

b) Issuing energy efficiency standards for devices and equipment listed in the energy labeling requirement and applying minimum energy performance standards consistent with the implementation schedule set forth in Articles 2 and 3 of this Decision;

c) Reviewing and announcing national energy efficiency standards and minimum energy performance standards every five years.

4. The Ministry of Finance shall be responsible for:

a) Taking the lead and coordinating with the Ministries of Planning and Investment, Industry and Trade to establish a mechanism for budgetary support to implement the energy labeling schedule and apply minimum energy performance standards;

b) Taking the lead and coordinating with relevant agencies to guide procedures for importing devices and equipment required to be labeled and applying minimum energy performance standards.

5. Provincial People's Committees under the central government shall direct specialized agencies and local energy conservation agencies to coordinate with relevant ministries and sectors to inspect and supervise the implementation of energy labeling and the application of minimum energy performance standards for devices and equipment within their jurisdiction as specified in the schedule of this Decision.

Article 6. Effectiveness

1. This Decision takes effect from April 25, 2017, and replaces Decision No. 51/2011/QĐ-TTg dated September 12, 2011, of the Prime Minister specifying the list of devices and equipment required to be labeled, the application of minimum energy performance standards, and the implementation schedule,Decision No.  03/2013/QĐ-TTg dated January 14, 2013, of the Prime Minister amending and supplementing certain provisions of Decision No. 

51/2011/QĐ-TTg dated September 12, 2011, of the Prime Minister.
