Regulations on the deployment of mobile communication systems IMT on frequency bands 824-835 MHz, 869-915 MHz, 925-960 MHz, 1710-1785 MHz, 1805-1880 MHz, 1920-1980 MHz, and 2110-2170 MHz

WHEREAS, the Law on Radio Frequency Spectrum dated November 23, 2009;

Pursuant to the Law on Telecommunications dated November 23, 2009;

Pursuant to Decree No. 17/2017/NĐ-CP dated February 17, 2017, issued by the Government, on the functions, tasks, powers, and organizational structure of the Ministry of Information and Communications;

Pursuant to Decree No. 25/2011/NĐ-CP dated April 6, 2011 of the Government detailing and guiding the implementation of certain provisions of the Law on Telecommunications and Decree No. 81/2016/NĐ-CP dated July 1, 2016 of the Government amending and supplementing certain provisions of Decree No. 25/2011/NĐ-CP dated April 6, 2011 of the Government detailing and guiding the implementation of certain provisions of the Law on Telecommunications;

Pursuant to Decision No. 71/2013/QĐ-TTg dated November 21, 2013 of the Prime Minister promulgating the national radio frequency spectrum plan and Decision No. 02/2017/QĐ-TTg dated January 17, 2017 of the Prime Minister amending and supplementing the national radio frequency spectrum plan promulgated together with Decision No. 71/2013/QĐ-TTg dated November 21, 2013 of the Prime Minister;

At the proposal of the Director of the Radio Frequency Management Department,

The Minister of Information and Communications issues this Circular regulating the deployment of mobile communication systems IMT on frequency bands 824-835 MHz, 869-915 MHz, 925-960 MHz, 1710-1785 MHz, 1805-1880 MHz, 1920-1980 MHz, and 2110-2170 MHz.

Article 1. Scope of Regulation and Applicability

1. This Circular regulates the deployment of mobile communication systems IMT (including IMT-2000, IMT-Advanced, and subsequent versions, as defined by the International Telecommunication Union - ITU) on frequency bands 824-835 MHz, 869-915 MHz, 925-960 MHz, 1710-1785 MHz, 1805-1880 MHz, 1920-1980 MHz, and 2110-2170 MHz.

2. This Circular applies to telecommunications enterprises that have been granted licenses to use the frequency bands specified in Clause 1 of this Article and relevant agencies and organizations.

Article 2. Deployment regulations for mobile communication systems IMT

1. For frequency bands 824-835 MHz, 869-880 MHz, telecommunications enterprises are permitted to deploy standard IMT mobile communication systems (WCDMA and subsequent versions, LTE, LTE-Advanced, and subsequent versions).

2. For frequency bands 880-915 MHz, 925-960 MHz, 1710-1785 MHz, 1805-1880 MHz, telecommunications enterprises are permitted to deploy standard IMT mobile communication systems (EDGE, WCDMA and subsequent versions, LTE, LTE-Advanced, and subsequent versions).

4. In cases where new technology deployment involves changes in radio emission compared to the provisions in the frequency band usage license already issued, telecommunications enterprises shall follow procedures to amend and supplement the content of the frequency band usage license according to regulations.

5. Telecommunications enterprises deploying experimental or formal standard IMT mobile communication systems at the frequency bands specified in Clause 1 of Article 1 of this Circular shall comply with the provisions in the experimental telecommunications network test license, the public telecommunications network establishment license, the telecommunications service provision license, the frequency band usage license, and other related laws.

Article 3. Implementation Provisions

1. This Circular takes effect from June 9, 2017 and replaces Circular No. 04/2015/TT-BTTTT dated March 10, 2015 of the Minister of Information and Communications regulating the deployment of mobile communication systems IMT on frequency bands 824-835 MHz, 869-915 MHz, 925-960 MHz, 1710-1785 MHz, and 1805-1880 MHz.

2. The Director of the Office, the Directors of the Radio Frequency Management Department, the Telecommunications Department, the Heads of ministries, units under the Ministry of Information and Communications, and related organizations and individuals are responsible for implementing this Circular.

3. During implementation, if there are difficulties or obstacles, agencies, organizations, and individuals are requested to promptly report to the Ministry of Information and Communications (Radio Frequency Management Department) for consideration and resolution.
