Circular No. 04/2017/TT-BVHTTDL stipulates the Training Program on Knowledge for the Preservation, Restoration, and Rehabilitation of Historical and Cultural Relics and Scenic Spots.

CIRCULAR

REGULATIONS ON THE PROGRAM FOR TRAINING KNOWLEDGE ON THE PRESERVATION, REPAIR, AND RESTORATION OF HISTORICAL-CULTURAL HERITAGE SITES AND SCENIC SPOTS

Pursuant to the Cultural Heritage Law dated June 29, 2001 and the Law Amending and Supplementing Certain Provisions of the Cultural Heritage Law dated June 18, 2009;

Pursuant to Decree No. 70/2012/NĐ-CP dated September 18, 2012 of the Government on the authority, procedures, and formalities for planning, approving preservation, repair, and restoration projects of historical-cultural heritage sites and scenic spots;

Pursuant to Decree No. 61/2016/NĐ-CP dated July 1, 2016 of the Government on conditions for business activities in antique appraisal and the practice of preservation, repair, and restoration of historical-cultural heritage sites and scenic spots;

Pursuant to Decree No. 79/2017/NĐ-CP dated July 17, 2017, of the Government stipulating functions, tasks, powers, and organizational structure of the Ministry of Culture, Sports and Tourism;

At the proposal of the Director of the Heritage Department and the Director of the Training Department;

The Minister of Culture, Sports and Tourism promulgates this Circular stipulating the Program for Training Knowledge on the Preservation, Repair, and Restoration of Historical-Cultural Heritage Sites and Scenic Spots.

Article 1. Attached herewith is the Program for Training Knowledge on the Preservation, Repair, and Restoration of Historical-Cultural Heritage Sites and Scenic Spots.

Article 2. This Circular takes effect from October 5, 2017.

Article 3. The Heads of the Ministry’s Office, the Director of the Heritage Department, the Director of the Training Department, the Directors of the Departments of Culture, Sports and Tourism, the Directors of the Departments of Culture and Sports of the provinces and centrally-administered cities, the Heads of relevant agencies, organizations, and individuals are responsible for implementing this Circular./.

PROGRAM

TRAINING KNOWLEDGE ON THE PRESERVATION, REPAIR, AND RESTORATION OF HISTORICAL-CULTURAL HERITAGE SITES AND SCENIC SPOTS

I. OBJECTIVES, PARTICIPANTS, AND REQUIREMENTS FOR TRAINING KNOWLEDGE ON THE PRESERVATION, REPAIR, AND RESTORATION OF HISTORICAL-CULTURAL HERITAGE SITES AND SCENIC SPOTS

1.1. Objectives

1.1.1. To meet the requirements for obtaining a Certificate of Practice in the preservation, repair, and restoration of historical-cultural heritage sites and scenic spots as prescribed by laws on cultural heritage.

1.1.2. To enhance the effectiveness of state management and improve the quality of activities related to the preservation, repair, and restoration of heritage sites.

1.2. Participants

1.2.1. Individuals holding a bachelor's degree or higher in construction or architecture as specified in Clauses 1, 2, 3, and 4 of Article 9 of Decree No. 61/2016/NĐ-CP dated July 1, 2016 of the Government on conditions for business activities in antique appraisal and the practice of preservation, repair, and restoration of historical-cultural heritage sites and scenic spots (hereinafter referred to as Decree No. 61/2016/NĐ-CP), who wish to engage in the practice of preserving, repairing, and restoring heritage sites as stipulated in Clause 2 of Article 3 of Decree No. 61/2016/NĐ-CP.

1.2.2. Individuals interested in acquiring knowledge to serve the management, protection, and enhancement of the value of heritage sites.

1.3. Requirements

1.3.1. To raise awareness and responsibility among participants in the practice of preserving, repairing, and restoring heritage sites in accordance with the law.

1.3.2. To ensure that participants have access to and grasp legal documents, scientific principles, basic procedures, skills, and practical lessons for the practice of preserving, repairing, and restoring heritage sites.

II. FRAMEWORK OF THE PROGRAM AND DESCRIPTION OF THE CONTENT OF THE PROGRAM

2.1. Framework of the Program

2.2. Description of the Content of the Program

2.2.1. Theoretical Foundation and Practical Lessons on the Preservation, Repair, and Restoration of Heritage Sites

a) Legal Documents and Basic Concepts on the Preservation, Repair, and Restoration of Heritage Sites:

- The main contents of some international documents: The Athens Charter for the Restoration of Historic Monuments (1931); The Venice Charter for the Conservation and Restoration of Monuments and Sites (1964); The World Heritage Convention (1972); The Washington Charter on the Protection of Historic Towns and Urban Areas (1987); The Principles for the Protection and Management of Archaeological Heritage (1990); The Nara Document on Authenticity (1994); The Principles for the Conservation of Wooden Historical Architecture (1999) and other related documents;

- The main contents of some Vietnamese legal documents: Decree No. 65 dated November 23, 1945 of the Chairman of the Provisional Government of the Democratic Republic of Vietnam on the preservation of ancient relics; Law on Cultural Heritage dated June 29, 2001; Law Amending and Supplementing Certain Provisions of the Law on Cultural Heritage dated June 18, 2009; Construction Law dated June 18, 2014; Decree No. 98/2010/NĐ-CP dated September 21, 2010 of the Government detailing certain provisions of the Law on Cultural Heritage and the Law Amending and Supplementing Certain Provisions of the Law on Cultural Heritage; Decree No. 70/2012/NĐ-CP; Circular No. 18/2012/TT-BVHTTDL dated December 28, 2012 of the Minister of Culture, Sports and Tourism detailing certain provisions on the preservation, repair, and restoration of heritage sites; Circular No. 17/2013/TT-BVHTTDL dated December 30, 2013 of the Minister of Culture, Sports and Tourism guiding the determination of costs for planning, project preparation, economic and technical reports on the preservation, repair, and restoration of heritage sites and other related documents;

- Basic concepts on heritage sites and their preservation, repair, and restoration.

b) Views and Principles in the Preservation, Repair, and Restoration of Heritage Sites:

- Basic views on the preservation, repair, and restoration of heritage sites;

- Basic principles in the preservation, repair, and restoration of heritage sites.

c) Practical Lessons from Activities Related to the Preservation, Repair, and Restoration of Heritage Sites:

- Lessons learned from the restoration of cultural relics in Vietnam: a brief overview of the application process of the science of cultural relic restoration in Vietnam; the current status of cultural relic restoration activities in Vietnam; introduction of achievements, some limitations in cultural relic restoration activities and solutions to address them.

2.2.2. Basic knowledge, procedures, and skills in cultural relic restoration activities

a) Traditional Vietnamese architecture:

- The history of formation and factors influencing traditional Vietnamese architecture;

- The layout of traditional Vietnamese architectural cultural relic sites (fortifications, pagodas, mausoleums, temples, pavilions, communal houses, shrines, and other types of cultural relic sites);

- Architectural form of cultural relic structures, decoration, color, and symbolic meaning, cultural significance of decorative themes;

- Interior arrangement of cultural relic sites: layout diagrams for altars, offerings, statues, and artifacts at specific types of cultural relic sites (pagodas, mausoleums, temples, pavilions, communal houses, shrines, and other types of cultural relic sites); cultural significance of artifacts and offerings;

- Preservation of intangible cultural heritage associated with cultural relic sites.

b) Traditional Vietnamese construction materials and techniques:

- Introduction to traditional Vietnamese construction materials;

- Traditional Vietnamese construction techniques: processing and assembly techniques for wooden architectural components; treatment techniques for brick and stone structures, metal structures; preservation techniques for materials and structures, and other related techniques;

- Introduction to some special materials and techniques at cultural relic sites in Vietnam.

c) Application of scientific and technological achievements in cultural relic restoration:

- Introduction to some results of applying scientific and technological achievements in cultural relic restoration activities worldwide;

- Application of scientific and technological achievements in cultural relic restoration activities in Vietnam.

d) Basic procedures and skills in cultural relic restoration activities:

- Procedures for implementing cultural relic restoration: determining cases for planning, project development, economic-technical report preparation, emergency repairs, regular maintenance, and procedures for each specific case; technical construction procedures for cultural relic restoration, emergency repairs, and regular maintenance of cultural relic sites;

- Basic skills in cultural relic restoration activities: skills in preparing restoration documentation (determining the components and basic content of planning documents, project documents, economic-technical reports, design drawings for construction, emergency repair documents, and regular maintenance documents); skills in organizing construction sites, construction activities, and supervising construction of cultural relic restoration.

2.2.3. Research, field surveys, and practical exercises

a) Research, field surveys: surveying a cultural relic site that has been or is being restored to gain access to scientific restoration documentation, structural and architectural solutions, construction techniques, building materials, and related issues;

b) Practical exercises: surveying a deteriorating cultural relic site requiring restoration, organizing group work to discuss, develop practical exercises based on surveys, assess the current state, value, and propose directions and restoration plans.

2.2.4. Final paper

The final paper is carried out in one of the specific fields: planning cultural relic restoration; developing projects, economic-technical reports, design drawings for cultural relic restoration; construction of cultural relic restoration; supervision of cultural relic restoration construction.

III. IMPLEMENTATION OF THE PROGRAM

3.1. Form and method

3.1.1. Form: concentrated at the training institution.

3.1.2. Method: combining theoretical study, field surveys, discussions at the site, and practical exercises.

3.2. Training institution, lecturers, and training materials

3.2.1. The training institution is a university, college, or research institute with a department or major or specialty in training or a functional department related to cultural relic restoration activities.

3.2.2. Lecturers and speakers teaching the training class must have professional qualifications, teaching experience, or experience working in fields directly related to the content of the Cultural Relic Restoration Knowledge Training Program.

3.2.3. Training materials are compiled by the training institution in an open structure to regularly supplement and update new regulations, lessons learned, and skills relevant to cultural relic restoration activities into the lecture content to meet practical requirements.

3.3. Requirements, evaluation of results, and issuance of certificates

3.3.1. The organization of training classes at training institutions must ensure the content and duration specified in the Framework Program and Content Description of the Program.

3.3.2. Trainees must participate in at least 80% of the classroom time, conduct research, field surveys, practical exercises, and submit a final paper that meets the requirements to be eligible for a certificate.

3.3.3. The head of the training institution authorized to issue certificates for trainees who have completed the Cultural Relic Restoration Knowledge Training Program in accordance with the provisions of Clause 3.3.2 of this Program.

3.4. Responsibilities for implementation

3.4.1. The Department of Training takes the lead and coordinates with the Heritage Department and related units:

a) Guide, inspect, and supervise the implementation of the Cultural Relic Restoration Knowledge Training Program;

b) Handle according to their authority and recommend competent authorities to handle violations in accordance with the law.

3.4.2. Departments of Culture, Sports, and Tourism, Departments of Culture and Sports are responsible for inspecting, supervising, and coordinating with units under the Ministry of Culture, Sports, and Tourism to inspect training institutions and the implementation of this Program at the local level.

3.4.3. Training institutions:

a) Compile training materials on cultural relic restoration knowledge according to the content of this Program;

b) Develop and implement plans for organizing training classes on cultural relic restoration knowledge;

c) Develop and announce recruitment forms;

d) Sign contracts with qualified lecturers and speakers;

e) Organize printing, managing, and issuing certificates for those who have completed the Cultural Relic Restoration Knowledge Training Program in accordance with current regulations;

f) Organize the assessment of the results of each training class on cultural relic restoration knowledge and send reports to the Ministry of Culture, Sports, and Tourism (through the Department of Training and the Heritage Department)./
