Pursuant to the Law on Science and Technology dated June 18, 2013;

Pursuant to the Law on Statistics dated November 23, 2015;

Pursuant to the Law on Technology Transfer dated June 19, 2017;

Pursuant to Decree No. 94/2016/NĐ-CP dated July 1, 2016 of the Government detailing and guiding the implementation of certain provisions of the Law on Science and Technology;No.statistics;

Pursuant to Decision No. 43/2016/QĐ-TTg dated October 17, 2016 of the Prime Minister promulgating the National Statistical Survey Program;

Pursuant to Decree No. 95/2017/NĐ-CP dated August 16, 2017, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Science and Technology;

At the proposal of the Director of the National Science and Technology Information Center and the Head of the Legal Department;

The Minister of Science and Technology issues this Circular regulating scientific and technological statistical surveys outside the National Statistical Survey Program.No.Statistical surveys of science and technology outside the National Statistical Survey Program.No.This Circular regulates scientific and technological statistical surveys outside the National Statistical Survey Program, including:

Article 1. Scope of Regulation

1. Regular scientific and technological statistical surveys.

2. Ad hoc scientific and technological statistical surveys.

Article 2. Regular scientific and technological statistical surveys

1. Regular scientific and technological statistical surveys aim to collect information on statistical indicators for state management purposes in science and technology but not included in the national statistical indicator system, according to a survey plan prepared periodically and approved by the Minister of Science and Technology.

2. The list of regular scientific and technological statistical surveys is specified in the Appendix attached hereto.

Article 3. Implementation of regular scientific and technological statistical surveys

1. Responsibilities of units under the Ministry of Science and Technology:

a) The National Science and Technology Information Center shall take the lead and coordinate with relevant units under the Ministry of Science and Technology to develop plans and survey schemes for regular scientific and technological statistical surveys in accordance with the law. They shall organize the surveys, inspect the provision of information by surveyed organizations and individuals, process and compile the results of regular scientific and technological statistical surveys, and report to the Minister of Science and Technology.

b) The Department of Planning and Finance shall be responsible for reviewing budget estimates and allocating funds for the surveys, submitting them to the leadership of the Ministry for approval based on the survey plans, scale, and nature of the surveys.

c) Units under the Ministry of Science and Technology shall be responsible for collecting information related to regular scientific and technological statistical surveys within their areas of management and sending the collected statistical information to the National Science and Technology Information Center for compilation.

2. Organizations performing central information functions in science and technology at the ministerial level shall be responsible for coordinating with the National Science and Technology Information Center to collect information related to regular scientific and technological statistical surveys and send the collected statistical information to the National Science and Technology Information Center under the Ministry of Science and Technology for compilation.

3. Provincial Departments of Science and Technology under centrally governed cities shall be responsible for directing the performance of central information functions in science and technology at the provincial level to coordinate with the National Science and Technology Information Center to collect information related to regular scientific and technological statistical surveys in their respective regions and send the collected statistical information to the National Science and Technology Information Center under the Ministry of Science and Technology for compilation.

3. The Provincial Science and Technology Departments shall be responsible for directing the implementation of the provincial-level science and technology information focal point function, coordinating with the National Science and Technology Information Center to collect information related to periodic science and technology surveys within their jurisdiction, and sending the collected statistical information results to the National Science and Technology Information Center under the Ministry of Science and Technology for consolidation.

Article 4. Emergency scientific and technological surveys and statistics

Emergency scientific and technological surveys and statistics aim to collect special statistical information that is urgent for the management needs of the Ministry of Science and Technology, but which do not fall under the regular scientific and technological surveys and statistics conducted by the Ministry of Science and Technology as stipulated in the Appendix attached to this Circular.

Article 5. Implementation of emergency scientific and technological surveys and statistics

1. The Minister of Science and Technology decides to organize emergency scientific and technological surveys and statistics and assigns units under the Ministry to implement them when directed by competent authorities or when there is a need for management, guidance, and operation by the Ministry of Science and Technology.

2. Responsibilities of units assigned to implement emergency scientific and technological surveys and statistics

a) Develop plans and schemes for emergency scientific and technological surveys and statistics in accordance with the provisions of the law.

b) Implement emergency scientific and technological surveys and statistics after the plans and schemes have been approved by the Minister of Science and Technology;

c) Process, compile results of emergency scientific and technological surveys and statistics and report to the Minister of Science and Technology.

Article 6. Implementation Provisions

1. This Circular takes effect from July 1, 2018.

2. During the implementation process, if difficulties arise, they should be reported to the Ministry of Science and Technology for review and appropriate amendments and supplements./.
