CIRCULAR
REGULATIONS ON MEASURES TO IMPLEMENT THE FUNCTION OF STATE MANAGEMENT IN CONSTRUCTION AND IMPLEMENTATION OF VILLAGE AGREEMENTS AND COMMUNITY RULES
Pursuant to Decree No. 79/2017/ND-CP dated July 17, 2017 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Culture, Sports and Tourism:
Pursuant to Decision No. 22/2018/QD-TTg dated May 8, 2018 of the Prime Minister on construction and implementation of village agreements and community rules;
At the proposal of the Director of the Department of Legal Affairs:
The Minister of Culture, Sports and Tourism issues this Circular stipulating measures to implement the function of state management in construction and implementation of village agreements and community rules.
Article 1. Scope of Regulation
This Circular stipulates certain measures to implement the function of state management in construction and implementation of village agreements and community rules; responsibilities of agencies, units, and individuals in implementing state management in construction and implementation of village agreements and community rules.
Article 2. Applicability
This Circular applies to agencies, units, and individuals related to the implementation of state management in construction and implementation of village agreements and community rules.
Article 3. Orientation for the Content of Village Agreements and Community Rules
1. Based on the actual conditions of the locality, the Departments of Culture, Sports and Tourism of provinces and centrally-administered cities shall be responsible for advising the People's Committees of provinces on the orientation for the content of village agreements and community rules as a basis for guiding the construction and recognition of village agreements and community rules within their jurisdiction.
2. The orientation for the content of village agreements and community rules must comply with the requirements regarding the scope of content of village agreements and community rules as stipulated in Clause 1, Article 5 of Decision No. 22/2018/QD-TTg dated May 8, 2018 of the Prime Minister on construction and implementation of village agreements and community rules, and must also be suitable to the actual conditions of the locality.
Article 4. Recognition of Village Agreements and Community Rules
1. After receiving reports from the heads of villages or residential area groups about the results of community discussions and voting to approve village agreements and community rules, the heads of Cultural-Social Services at the commune level shall take the lead, in coordination with the heads of Judicial-Household Registration Services, to advise the People's Committee at the commune level to prepare files to submit to the People's Committee at the district level (through the District Cultural and Information Office) requesting recognition of village agreements and community rules.
The request for recognition of village agreements and community rules shall be carried out according to Model No. 01 attached to this Circular.
2. After receiving complete files requesting recognition of village agreements and community rules from the commune-level People's Committee, the District Cultural and Information Office shall take the lead, in coordination with the District Legal Office, to gather opinions from relevant agencies and units to present to the district-level People's Committee for recognition or non-recognition of village agreements and community rules.
The decision on recognition of village agreements and community rules shall be carried out according to Model No. 02 attached to this Circular.
Article 5. Statistics and Reporting on Construction and Implementation of Village Agreements and Community Rules
1. Statistics and reporting on construction and implementation of village agreements and community rules include:
a) The situation of construction and implementation of village agreements and community rules;
b) The number of village agreements and community regulations that have been recognized or not recognized;
c) The number of village agreements and community regulations that have been amended, supplemented, or replaced;
d) The number of village agreements and community regulations that have been temporarily suspended or abolished;
e) Other related contents (if any).
2. Reports on construction and implementation of village agreements and community rules are part of the Report on the Results of Implementing the All-People Solidarity Movement for Building a Civilized Lifestyle, implemented according to the provisions of Circular No. 14/2019/TT-BVHTTDL dated November 29, 2019 of the Minister of Culture, Sports and Tourism on the periodic reporting system within the scope of state management of the Ministry of Culture, Sports and Tourism.
Article 6. Responsibilities of agencies, units, and individuals in implementing state management over construction, implementation of village regulations and community agreements
1. Department of Culture, Sports and Tourism, Department of Culture and Sports:
a) Implement state management responsibilities for the construction, implementation of village regulations and community agreements as prescribed in Decision No. 22/2018/QD-TTg dated May 8, 2018 of the Government on the construction, implementation of village regulations and community agreements and this Circular;
b) Organize professional training for civil servants of the Cultural and Information Office, cultural and social civil servants, and related individuals in the work of constructing, recognizing, and organizing the implementation of village regulations and community agreements;
c) Coordinate with the Department of Finance to submit to the competent authority for the allocation of funds to recognize village regulations and community agreements within the budget guaranteed for state management activities concerning the construction and implementation of village regulations and community agreements according to the laws on the state budget to be applied at the local level.
2. Cultural and Information Office:
a) Implement state management responsibilities for the construction, implementation of village regulations and community agreements as prescribed in Decision No. 22/2018/QD-TTg dated May 8, 2018 of the Government on the construction, implementation of village regulations and community agreements and this Circular;
b) Guide and urge the People's Committee of communes to prepare files for recognition of village regulations and community agreements ensuring quality and deadlines as prescribed.
3. Cultural and Social Civil Servants:
a) Implement state management responsibilities for the construction, implementation of village regulations and community agreements as prescribed in Decision No. 22/2018/QD-TTg dated May 8, 2018 of the Government on the construction, implementation of village regulations and community agreements and this Circular;
b) Monitor and guide village chiefs and community group leaders in organizing the implementation of village regulations and community agreements.
Article 7. Implementation Organization
1. The Legal Affairs Department shall take the lead and coordinate with relevant agencies and units to guide and organize inspections on the implementation of this Circular.
2. Departments of Culture, Sports and Tourism, Departments of Culture and Sports of provinces and centrally governed cities shall be responsible for organizing the implementation, inspection, and urging relevant agencies, organizations, and individuals to implement this Circular.
Article 8. Effective Date
1. This Circular takes effect from October 1, 2020.
2. During the implementation process, if any difficulties arise, agencies, units, and individuals are requested to promptly reflect them to the Ministry of Culture, Sports and Tourism (through the Legal Affairs Department) for research and appropriate amendments and supplements.
