AMENDMENTS AND SUPPLEMENTS TO CERTAIN ARTICLES OF CIRCULAR NO. 52/2017/TT-BYT DATED DECEMBER 29, 2017, CIRCULAR NO. 18/2018/TT-BYT DATED AUGUST 22, 2018 ISSUED BY THE MINISTER OF HEALTH AMENDING AND SUPPLEMENTING CERTAIN ARTICLES OF CIRCULAR NO. 52/2017/TT-BYT ON PRESCRIPTIONS AND MEDICINE PRESCRIPTIONS FOR OUTPATIENT TREATMENT AND CIRCULAR NO. 27/2021/TT-BYT DATED DECEMBER 20, 2021 ISSUED BY THE MINISTER OF HEALTH ON ELECTRONIC MEDICATION PRESCRIPTIONS

Pursuant to the Drug Law No. 105/2016/QH13 dated April 6, 2016;

Pursuant to the Government's Decree No. 75/2017/NĐ-CP dated June 20, 2017 stipulating the functions, tasks, powers, and organizational structure of the Ministry of Health;

Pursuant to the proposal of the Director of the Department of Medical Examination and Treatment and the Director of the Department of Information Technology;

The Minister of Health issues this Circular amending and supplementing certain articles of Circular No. 52/2017/TT-BYT dated December 29, 2017, and Circular No. 18/2018/TT-BYT dated August 22, 2018 issued by the Minister of Health amending and supplementing certain articles of Circular No. 52/2017/TT-BYT on prescriptionsand medicine prescriptions for outpatient treatment, and Circular No. 27/2021/TT-BYT dated December 20, 2021 issued by the Minister of Health on electronic medication prescriptions.

Article 1. Amending and supplementing certain articles of Circular No. 52/2017/TT-BYT dated December 29, 2017, and Circular No. 18/2018/TT-BYT dated August 22, 2018 issued by the Minister of Health amending and supplementing certain articles of Circular No. 52/2017/TT-BYT on prescriptions and medicine prescriptions for outpatient treatment (hereinafter referred to as Circular No. 52/2017/TT-BYT and Circular No. 18/2018/TT-BYT), and Circular No. 27/2021/TT-BYT dated December 20, 2021 issued by the Minister of Health on electronic medication prescriptions (hereinafter referred to as Circular No. 27/2021/TT-BYT) as follows:

1. Amend Article 10 of Circular No. 52/2017/TT-BYT as follows:

"Article 10. Electronic Prescription FormHealth examination and treatment facilities shall implement electronic prescription forms in accordance with Circular No. 27/2021/TT-BYT dated December 20, 2021 issued by the Minister of Health on electronic medication prescriptions."

2. Replace the Prescription Forms specified in Appendix II and Appendix III issued together with Circular No. 52/2017/TT-BYT and the Prescription Form issued together with Circular No. 18/2018/TT-BYT with the Prescription Forms specified in the Appendices issued together with this Circular.

3. Amend Article 6 of Circular No. 27/2021/TT-BYT as follows:

"Article 6. Implementation ScheduleHealth examination and treatment facilities must implement electronic medication prescriptions as prescribed in this Circular according to the following specific schedule:
1. For hospitals at level 3 and above: Complete by December 31, 2022.2. For other health examination and treatment facilities: Complete by June 30, 2023."

Article 2. Effective Date

This Circular takes effect from September 15, 2022.

Article 3. Transitional Provisions

Health examination and treatment facilities specified in Clause 2, Article 6 of Circular No. 27/2021/TT-BYT currently using paper prescriptions based on the prescription forms stipulated in Circular No. 52/2017/TT-BYT and Circular No. 18/2018/TT-BYT may continue to use printed paper prescriptions according to the schedule specified in Clause 3, Article 1 of this Circular.

Article 4. Responsibilities for Implementation

The Director of the Department of Medical Examination and Treatment, the Director of the Department of Information Technology, the Head of the Ministry's Office, the Inspector General, the Heads of Departments, Directors of Bureaus, and General Directors of Bureaus and General Departments under the Ministry of Health, the Heads of units directly under the Ministry of Health, and relevant organizations and individuals are responsible for implementing this Circular./
