Pursuant to the Law on Foreign Trade Management (2017);

Based on Decree No. 96/2022/NĐ-CP dated November 29, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade;

Pursuant to Decree No. 69/2018/NĐ-CP dated May 15, 2018 of the Government detailing certain provisions of the Law on Foreign Trade Management;

Implementing the Free Trade Agreement between Vietnam and the Eurasian Economic Union which has been ratified by the President of the Socialist Republic of Vietnam;

At the proposal of the Director of the Department of Import-Export;

The Minister of Industry and Trade issues this Circular stipulating the application of tariff quotas for the importation of tobacco leaves and poultry eggs originating from member countries of the Eurasian Economic Union during the period 2023 - 2027.

Article 1. Scope of Regulation

Apply tariff quotas for the importation of tobacco leaves and poultry eggs originating from member countries of the Eurasian Economic Union according to the Free Trade Agreement between Vietnam and the Eurasian Economic Union during the period 2023 - 2027.

Article 2. Applicability

This Circular applies to traders importing under tariff quotas tobacco leaves and poultry eggs from member countries of the Eurasian Economic Union and other relevant agencies, organizations, and individuals.

Article 3. Goods and Quantity of Tariff Quotas for Importation

1. The commodity codes and quantities of tariff quotas for goods subject to tariff quotas as prescribed in Article 1 of this Circular during the period 2023 - 2027 shall be implemented according to the attached Appendix.

2. Goods imported from member countries of the Eurasian Economic Union under the Free Trade Agreement between Vietnam and the Eurasian Economic Union must have a Certificate of Origin (Form EAV) issued in accordance with current regulations.

Article 4. Recipients of Allocation

1. The tariff quota for the importation of tobacco leaves shall be allocated to traders holding a cigarette production license issued by the Ministry of Industry and Trade and having a need to use imported tobacco leaves for cigarette production.

2. QUOTA DUTY IMPORT LIMITS FOR POULTRY EGGS SHALL BE ALLOCATED TO TRADERS WITH IMPORT REQUIREMENTS.

Article 5. Method of Allocation

The method of allocating tariff quotas for the importation of tobacco leaves and poultry eggs shall be carried out in accordance with Circular No. 12/2018/TT-BCT dated June 15, 2018, issued by the Minister of Industry and Trade detailing certain provisions of the Law on Foreign Trade Management and Decree No. 69/2018/NĐ-CP dated May 15, 2018, of the Government detailing certain provisions of the Law on Foreign Trade Management.

Article 6. Effectiveness

This Circular takes effect from April 10, 2023, until December 31, 2027./.

COMMODITY CODES AND QUANTITIES OF TARIFF QUOTAS (TQ)

FOR IMPORTATION OF GOODS SUBJECT TO TARIFF QUOTAS UNDER THE FREE TRADE AGREEMENT BETWEEN VIETNAM AND THE EURASIAN ECONOMIC UNION

IN THE PERIOD 2023 - 2027

Note:

(*) The quantity of TQ for the importation of poultry eggs originating from member countries of the Eurasian Economic Union is separate from the TQ for poultry eggs committed to under the WTO.

(**) The quantity of TQ for the importation of unmanufactured tobacco leaves and waste tobacco leaves originating from member countries of the Eurasian Economic Union shall be applied in accordance with Vietnam's international commitments and corresponding domestic laws and regulations regarding products under these TQs.
