Issued Regulation on organization and operation

of boarding schools for ethnic minorities

Pursuant to the Education Law dated June 14, 2019;

Decree No. 86/2022/Decree-CP dated February 24 the 10 Pursuant to Decree No. 32/2019/NĐ-CP dated April 10, 2019 of the Government on assigning tasks, procurement or tendering for the supply of products and services using state budget from regular operating expenses;22 The Government has defined the functions, tasks, powers, and organizational structure of the Ministry of Education and Training;

Pursuant to Decree No. 127/2018/NĐ-CP dated September 21, 2018 of the Government stipulating responsibilities for state management in education;

At the request of the Director of the Ethnic Education Department;

The Minister of Education and Training issues this Circular on the Regulation on organization and operation of boarding schools for ethnic minorities.

Article 1. This Circular sets forth the Regulation on organization and operation of boarding schools for ethnic minorities.

Article 2. This Circular takes effect from April 10, 2023 and replaces Circular No. 01/2016/TT-BGDĐT dated January 15, 2016 issued by the Minister of Education and Training on the Regulation on organization and operation of boarding schools for ethnic minorities.

Article 3. The Heads of the Office, the Director of the Ethnic Education Department, the Heads of relevant units under the Ministry of Education and Training; Chairpersons of People's Committees of provinces and centrally governed cities; Directors of Departments of Education and Training; Directors of Departments of Education, Science and Technology of Bac Lieu Province; Principals of boarding schools for ethnic minorities, School Friendship 80, School Friendship T78 and High School in Northern Vietnam shall be responsible for implementing this Circular.

REGULATIONS

TOrganization and operation of boarding schools for ethnic minorities

(Issued together with Circular No. 04/2023/TT-BGDĐT dated February 23, 2023 of the Minister of Education and Training)

 

 

 

 

 

PART I

GENERAL PROVISIONS

 

Article 1Scope of regulation and applicable subjects

1. This Regulation stipulates the organization and operation of boarding schools for ethnic minorities (hereinafter referred to as PTDTNT), including: organization and management of the school; enrollment, educational activities, care, nurturing, and student management; duties and rights of teachers, staff, and students.

2. This Regulation applies to PTDTNT and related organizations and individuals.

3. School Friendship 80, School Friendship T78, and High School in Northern Vietnam shall apply this Regulation to fulfill their educational tasks for boarding students.

4. PTDTNT shall comply with the regulations of the Charter of Secondary Schools and High Schools and the Charter of High Schools with Multiple Levels (hereinafter collectively referred to as the Charter of Secondary Schools) and the provisions of this Regulation.

Article 2. Boarding high schools for ethnic minorities and boarding students and ethnic minority boarding students

1. PTDTNT is established by the State for ethnic minority students and students from families permanently settled in areas with special difficulties in economic and social conditions, aiming to train quality human resources for ethnic minority and mountainous regions and areas with special difficulties in economic and social conditions.

2. Ethnic minority boarding students: Students who meet the criteria specified in Article 9 of this Regulation and are admitted to PTDTNT.

Article 3Article 3. Tasks of boarding high schools for ethnic minorities

PTDTNT shall perform the tasks stipulated in the Charter of Secondary Schools and the following tasks:

1. Care, nurture, and manage ethnic minority boarding students; ensure conditions for ethnic minority boarding students to study, eat, live, and engage in safe activities at school.

2. Organize specific educational activities suitable for ethnic minority boarding students.

3. Educate students about the Party and State's policies on ethnic groups; cultural identity and fine traditions of Vietnamese ethnic groups; awareness of participating in socio-economic development in ethnic minority and mountainous regions and areas with special difficulties in economic and social conditions.

4. Vocational guidance and traditional vocational training appropriate to students' abilities and qualities, local development needs, and requirements.

5. Monitor, statistically record the number of students, evaluate annual and phased educational effectiveness, and develop appropriate solutions to improve the quality of education at PTDTNT.

Article 4Article 4. System of boarding high schools for ethnic minorities

1. PTDTNT secondary school.

2. PTDTNT high school.

3. PTDTNT secondary school and high school.

Article 5Article 5. School name and school signboard

1. The naming of PTDTNT is regulated as follows

PTDTNT secondary school (or: PTDTNT high school; PTDTNT secondary school and high school) + specific name (if any) + administrative unit name at district level (or provincial level).

2. The school name shall be recorded on the establishment decision, school signboard, seal, and transaction documents of the school.

3. The school signboard shall include the following information

a) Top left corner

- For PTDTNT secondary school

First line: People's Committee of district, town, city, or provincial city under the province or centrally governed city (hereinafter collectively referred to as People's Committee at district level) and district name;

Second line: Department of Education and Training;

- For PTDTNT with the highest grade being high school

First line: People's Committee of province or centrally governed city (hereinafter collectively referred to as People's Committee at provincial level) and province name;

Second line: Department of Education and Training;

b) In the center, the school name according to the provision of Clause 1 of this Article shall be recorded;

c) At the bottom, the address, phone number, email, and website (if any) of the school shall be recorded.

Article 6Article 6. Management levels

1. PTDTNT secondary school is established by the Chairman of the People's Committee at provincial level and managed by the People's Committee at district level.

2. PTDTNT with the highest grade being high school is established by the Chairman of the People's Committee at provincial level and managed by the Department of Education and Training. The Department of Education and Training shall coordinate with the People's Committee at district level to build content for joint management and organize related educational activities involving PTDTNT secondary school and high school.

3. School Friendship 80, School Friendship T78, and High School in Northern Vietnam are managed by central ministries and agencies; they are subject to coordinated management by the Department of Education and Training where the school is located regarding program implementation, organizing graduation exams, and issuing graduation certificates.

 

Chapter II

ORGANIZATION AND MANAGEMENT OF THE SCHOOL

 

, Clause 1, Clause 2 Article 7a of this Regulation.Article 7. Organizational structure of boarding high schools for ethnic minorities

1. The organizational structure of the PTDTNT school shall be implemented in accordance with the Charter of secondary schools. In addition, the PTDTNT school may establish up to three additional units to assist the principal in carrying out special educational tasks, caring for, nurturing, and managing boarding students from ethnic minorities. The establishment of these units shall be decided by the principal based on the agreement of the supervising authority. Each unit shall have a head, and if there are seven members or more, a deputy head shall also be appointed. The heads and deputies of these units shall be appointed by the principal and shall be subject to the management and direction of the principal.

2. The units serving special educational activities, care, nurturing, and management of boarding students from ethnic minorities shall have the following responsibilities:

a) Proactively develop plans for special educational activities, care, nurturing, and management of boarding students from ethnic minorities on a weekly, monthly, semester, and annual basis; coordinate with other specialized units to develop and implement the school's educational plan;

b) Implement tasks according to the plan;

c) Participate in professional training as prescribed;

d) Carry out other tasks assigned by the principal;

đ) Organize meetings at least once every two weeks and may convene emergency meetings as required by work or upon the principal's request. These units operate under the principle of democracy, with members supporting each other to effectively fulfill their educational, care, nurturing, and management responsibilities for boarding students from ethnic minorities.

3. Each class in the PTDTNT school shall not exceed thirty-five students.

Article 8. Duties and rights of the principal and vice-principal

In addition to the duties and rights stipulated in the Charter of secondary schools, the principal and vice-principal of the PTDTNT school shall also have the following duties and rights:

1. To thoroughly understand the Party and State policies regarding ethnic minority affairs.

2. To organize the implementation of the school's tasks as specified in Article 3 of this Regulation.

3. To study the culture, language, customs, traditions, and psychological characteristics of ethnic minority students in the locality.

4. To develop plans and organize special educational activities suitable for boarding students from ethnic minorities as specified in Articles 13, 14, and 15 of this Regulation.

5. To cooperate with local authorities, mass organizations, and social organizations in caring for, nurturing, and managing boarding students from ethnic minorities.

6. To receive training on methods of education, care, and management of boarding students from ethnic minorities.

Chapter III

ADMISSION, ORGANIZATION OF EDUCATIONAL AND CARE, NURTURING, AND MANAGEMENT ACTIVITIES FOR STUDENTS

 

Article 9. Admission criteria

1. Students who are ethnic minorities whose own person and father or mother or guardian have continuously resided for thirty-six months or more until the date of submitting the admission application at:

a) Communes, wards, towns in Region III and particularly difficult communes in mountainous areas inhabited by ethnic minorities and coastal islands, and extremely poor communes as defined by the competent authority (hereinafter referred to collectively as particularly difficult communes);

b) Communes, wards, towns in Region II and Region I in mountainous areas inhabited by ethnic minorities as defined by the competent authority.

2. Students from ethnic minorities who are very few in number as defined in Decree No. 57/2017/NĐ-CP dated May 9, 2017 of the Government on preferential admission policies and support for preschool children, students, and university students from ethnic minorities who are very few in number.

3. Students who are Han Chinese whose own person and father or mother or guardian have continuously resided for thirty-six months or more until the date of submitting the admission application at particularly difficult communes. The PTDTNT school may admit up to ten percent of students who are Han Chinese in the total number of new admissions annually.

4. In cases where the number of students eligible for admission as stipulated in Clause 1, Clause 2, and Clause 3 of this Article is less than the scale of the PTDTNT school in the area, the Provincial People's Committee may specify additional regions for training human resources for ethnic minorities to admit additional students who are ethnic minorities from poor and near-poor households whose own person and father or mother or guardian have continuously resided for thirty-six months or more in that region until the date of submitting the admission application.

Article 10. Admission conditions and application materials

1. Admission conditions

a) Belonging to the admission criteria stipulated in Article 9 of this Regulation;

b) Meeting the provisions of the Secondary School Admission Regulations and High School Admission Regulations issued by the Ministry of Education and Training.

2. Application materials

a) Secondary School Admission

- A certified copy of a valid birth certificate;

- Legal basis to confirm residence information;

- Elementary school report card or other documents of equivalent value;

- Certificate of preferential treatment issued by the competent authority (if applicable);

b) High School Admission

- A certified copy of a valid birth certificate;

- Legal basis to confirm residence information;

- Certified true copy or photocopy with original for verification of the secondary school graduation certificate or temporary secondary school completion certificate;

- Secondary school report card;

- Certificate of preferential treatment issued by the competent authority (if applicable).

 Article 11. Admission methods, preferential treatment, and direct admission

1. Admission methods and preferential treatment shall be carried out in accordance with the Secondary School Admission Regulations and High School Admission Regulations issued by the Ministry of Education and Training.

2. Direct admission

Direct admission to the PTDTNT school for the following categories:

a) Students from ethnic minorities who are very few in number;

b) Secondary school students belonging to the category stipulated in Article 9 of this Regulation who have won national or international awards in cultural, artistic, sports, scientific, and technical fields shall be directly admitted to the PTDTNT high school;

c) Primary school students belonging to the category stipulated in Article 9 of this Regulation who have won provincial-level or higher awards in cultural, artistic, and sports fields shall be directly admitted to the PTDTNT secondary school.

Article 12. Admission plan and organization of admission

1. Admission plan

a) The Department of Education and Training shall prepare an admission plan for the PTDTNT school in the province, submit it for approval and issuance by the Provincial People's Committee. The admission plan shall include the following main contents: admission criteria, geographical areas, admission methods, admission quotas; admission ratios in particularly difficult communes and other areas; organization of admission activities;

b) Schools Huynh Nghia 80, Huynh Nghia T78, and Viet Bac High School shall develop enrollment plans, report to their supervising authorities, and submit them for approval by the Ministry of Education and Training.

2. Enrollment Organization

a) The Department of Education and Training shall guide the enrollment process for schools with the highest level of education being high school and guide the enrollment process for district education offices that have middle schools for ethnic minority students.

b) Schools Huynh Nghia 80, Huynh Nghia T78, and Viet Bac High School shall organize enrollments according to approved plans.

Article 13. Educational Programs and Education Plans

Ethnic Minority Boarding Schools shall establish an educational plan for the school to implement the general education program as stipulated in the Secondary School Regulations, including a two-session-per-day teaching plan to provide tutoring, enhancement, and consolidation of knowledge based on the needs of boarding ethnic minority students and in accordance with the conditions of the school.

Article 14. Special Education Activities

1. Ethnic Minority Boarding Schools shall organize special education activities as prescribed in the Secondary School Regulations to implement the general education program, while also organizing special education activities to preserve and promote the cultural identity of ethnic minorities and enhance skills for boarding ethnic minority students.

2. Special education activities in Ethnic Minority Boarding Schools include cultural education about ethnic groups, traditional trades, life skill education suitable for boarding ethnic minority students.

3. Annually, Ethnic Minority Boarding Schools shall develop plans to organize special education activities through various forms such as group activities, arts and culture, sports, clubs, exchanges with general schools, and guided vocational experience activities.

4. Ethnic Minority Boarding Schools shall carry out social work within the school, psychological counseling for students in accordance with guidelines from the Ministry of Education and Training, suitable for boarding ethnic minority students living far from home; create a safe, friendly educational environment, and prevent school violence.

Article 15. Cwork care, nurture and management 2025; BASED ON THE EDUCATION LAW dated June 14, 2019; of ethnic minority

1. Ethnic Minority Boarding Schools shall organize collective dining for boarding ethnic minority students to ensure food safety in compliance with current regulations. Nurture work shall be conducted openly and transparently in accordance with the law.

2. Ethnic Minority Boarding Schools shall implement school health programs to care for the health of boarding ethnic minority students.

3. Ethnic Minority Boarding Schools shall comprehensively manage the study, eating, living, and travel of boarding ethnic minority students during their time at school; organize and manage dormitory activities in accordance with regulations; guide, inspect, and urge students to self-study and follow living routines in the dormitory area; educate students to assist each other in learning, build civilized lifestyles, maintain hygiene, and protect the environment.

 

Chapter IV

DUTIES AND RIGHTS OF TEACHERS, STAFF, AND STUDENTS STUDENTS

 

Article 16. Duties and rights of teachers

In addition to duties and rights prescribed in the Secondary School Regulations, teachers at Ethnic Minority Boarding Schools shall have the following duties and rights:

1. Comply with assignments from the principal and vice-principal in organizing and implementing the school's tasks.

2. Educate students on the Party and State's policies regarding ethnic affairs.

3. Understand the culture, language, customs, traditions, and psychological characteristics of ethnic minority students in local areas.

4. Apply teaching methods, organizational forms, and assessment techniques suitable for boarding ethnic minority students, ensuring the required standards of character and ability as stipulated; participate in educating, caring for, and managing students outside class hours and organizing special education activities; tutor and provide supplementary instruction to students; guide students in self-study.

5. Receive training on educational methods, student care, and management for boarding ethnic minority students.

Article 17. Duties and rights of staff

In addition to duties and rights prescribed in the Secondary School Regulations, staff at Ethnic Minority Boarding Schools shall have the following duties and rights:

1. Implement assignments from the principal and vice-principal in organizing and implementing the school's tasks.

2. Understand the culture, language, customs, traditions, and psychological characteristics of ethnic minority students in local areas.

3. Receive training on educational methods, student care, nurturing, and management for boarding ethnic minority students.

Article 18Duties and rights of boarding students from ethnic minorities

In addition to the duties and rights of students stipulated in the School Regulations for Secondary Schools, boarding students from ethnic minorities also have the following duties and rights:

1. Preserving the cultural identity of their own ethnic group and respecting the cultural identities of other ethnic groups.

2. Being provided with meals, accommodation, and living arrangements within the boarding area and enjoying benefits and policies according to state regulations.

3. When they wish to participate in activities outside school, students must obtain permission in accordance with the school's rules./.
