Guidelines on the content and technical requirements for the database of planning dossier and planning scheme, map at the national level, regional planning, provincial planning

On the basis of Law on Planning dated November 24, 2017;

On the basis of Law on Surveying and Mapping dated June 14, 2018;

On the basis of Law on State Secrets Protection dated November 15, 2018;

Decree No. Decree No. 89/2022/NĐ-CP dated October 28, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Planning and Investment;

Decree No. Decree No. 37/2019/NĐ-CP dated May 7, 2019 of the Government detailing certain provisions of the Planning Law;

Decree No. Decree No. 27/2019/NĐ-CP dated March 13, 2019 of the Government detailing certain provisions of the Law on Surveying and Mapping which has been amended and supplemented with some articles pursuant to Decree No. 136/2021/NĐ-CP dated December 31, 2021 and Decree No. 22/2023/NĐ-CP dated May 12, 2023 of the Government;

Pursuant to the proposal of the Director of the Department of Planning Management;

The Minister of Planning and Investment issues this Circular guiding the content and technical requirements for the database of planning dossier and planning scheme, map at the national level, regional planning, provincial planning.

PART I
GENERAL PROVISIONS

Article 1. Scope of Regulation

Article 1. This Circular stipulates the general technical requirements for the database of planning dossier and planning scheme, map at the national level, regional planning, provincial planning; the main content requirements and technical requirements for the geographic database of comprehensive national planning, regional planning, provincial planning.

Article 2. The database of planning dossier and planning scheme, map at the national level, regional planning, provincial planning related to state secrets shall be implemented in accordance with the laws on state secret protection.

Article 2. Applicability

This Circular applies to agencies, organizations, individuals implementing the construction, updating, management, and use of the database of planning dossier and planning scheme, map at the national level, regional planning, provincial planning, and other agencies, organizations, and individuals related thereto.

Article 3. Explanation of Terms

1. The database of planning dossier includes electronic documents of the planning dossier that have been decided or approved and the geographic planning database.

2. Electronic documents of the planning dossier that have been decided or approved are documents and electronic texts in the form of data messages created or digitized from paper documents of the planning dossier that have been decided or approved, including: Petition for decision or approval of the plan; decision or approval document of the plan; planning report (comprehensive report and summary report) and strategic environmental assessment report (if any), planning scheme, planning map that have been reviewed and completed consistently with the decision or approval document of the plan by the organization responsible for planning; other textual documents (if any).

3. Geographic planning database is an organized collection of data on the geographical location and attributes of geographical objects reflecting the basic content of the plan built on the basis of the national geographic database foundation.

Chapter II
GENERAL TECHNICAL REQUIREMENTS FOR THE DATABASE OF PLANNING DOSSIER AND SCHEME, MAP AT THE NATIONAL LEVEL, REGIONAL PLANNING, PROVINCIAL PLANNING

Article 4. Format of electronic documents of national-level, regional, and provincial planning dossier

Clause 1. Text file, report format *.doc; *.docx; *.odt;

Clause 2. Digitized documents from paper documents: format Portable Document Format (*.pdf) version 1.4 or higher; color image (if any); minimum resolution: 200 dpi; scanning ratio: 100%.

Clause 3. Digitized format of paper planning scheme, map: GeoTIFF, GeoPDF with a minimum resolution of 300 dpi or higher, scanning ratio 1:1.

Clause 4. The format of other documents (if any) shall comply with relevant legal regulations.

Article 5. Data format of the geographic database of national-level planning, regional planning, and provincial planning

1. The geographic database for planning shall be packaged in the Geodatabase format (*.gdb) or comply with the geographic data exchange standard *.xml, *.gml.

2. The presentation of spatial geographic data on planning shall be in the format: *.mxd, *.mpk, *.qgz.

Article 6. Mathematical basis and requirements for the content representation of diagrams and maps of national-level planning, regional planning, and provincial planning

1. Diagrams and maps of planning shall be established within the reference system, national coordinate system VN-2000, and based on the national topographic map corresponding to the scale of the diagrams and maps of planning.

2. The content of diagrams and maps of planning must ensure consistency with the decision or approval of the planning and relevant documents in the planning dossier; accurately and fully reflect the national territorial sovereignty, and be consistent with international treaties to which the Socialist Republic of Vietnam is a member.

Article 7. Coordinate reference system, time reference system, metadata of the geographic database of national-level planning, regional planning, and provincial planning

1. The coordinate reference system and time reference system shall be implemented according to the National Technical Regulation on Geographic Information Standards code number QCVN 42:2020/BTNMT issued together with Circular No. 06/2020/TT-BTNMT dated August 31, 2020 of the Minister of Natural Resources and Environment.

2. Metadata of the geographic database on planning shall be constructed in accordance with Clause 4, Article 45 of the Law on Surveying and Mapping, Appendix I of QCVN 42:2020/BTNMT, and TCVN 12687:2019 Geographic Database - Metadata Construction.

Chapter III
REQUIREMENTS FOR THE MAIN CONTENT AND TECHNICAL REPRESENTATION OF THE GEOGRAPHIC DATABASE OF NATIONAL OVERALL PLANNING, REGIONAL PLANNING, AND PROVINCIAL PLANNING AND DIAGRAMS, MAPS OF NATIONAL OVERALL PLANNING, REGIONAL PLANNING, AND PROVINCIAL PLANNING

Article 8. Requirements for the main content and technical representation of diagrams and maps of national overall planning, regional planning, and provincial planning

1. The main content of diagrams and maps of national overall planning, regional planning, and provincial planning is specified in Appendix I attached to this Circular.

2. Diagrams and maps of national overall planning, regional planning, and provincial planning must meet the following technical requirements:

a) The location, boundary range, and direction of geographical objects depicted on diagrams and maps of national overall planning, regional planning, and provincial planning must ensure compliance with relevant legal bases as stipulated by law and adhere to legal regulations on protecting state secrets and related provisions. In cases where there is insufficient legal basis to determine the accurate location, boundary range, and direction of planned geographical objects, then symbols indicating the proposed location, boundary range, and direction of such objects should be shown on the planning diagrams and maps. The accurate location, boundary range, and direction of geographical objects in national overall planning, regional planning, and provincial planning will be detailed in urban planning, rural planning, land use plans at the district level, technical and specialized planning, or during the stages of preparation, review, approval, or investment decision-making of programs and projects. Ministries, agencies equivalent to ministries, and provincial People's Committees assigned tasks for planning shall be responsible for the accuracy, completeness, and adherence to legal regulations regarding the content and technical representation of diagrams and maps of planning under their management, ensuring consistency with the decision or approval of the planning;

b) The layout presentation and symbol system of diagrams and maps of national overall planning, regional planning, and provincial planning shall be carried out in accordance with the provisions of Appendix II attached to this Circular;

c) Ministries, agencies equivalent to ministries, and provincial People's Committees may supplement the contents of diagrams and maps and explanatory annotations of Appendix I and Appendix II of this Circular to represent the approved planning content and ensure compliance with legal regulations on planning and related laws.

4. Determination of the priority level of geographical objects depicted on diagrams and maps of national overall planning, regional planning, and provincial planning shall ensure the following principles:

a) Geographical objects concerning the main content of planning shall be prioritized for depiction on diagrams and maps of planning;

b) Priority order for depicting geographical objects: point-type geographical objects, line-type geographical objects, area-type geographical objects;

c) Symbols of geographical objects with lower priority levels on the map shall be moved to positions adjacent to symbols of geographical objects with higher priority levels.

Article 9. Data organization of the national master plan database, regional plan database, and provincial plan database

1. The national master plan database, regional plan database, and provincial plan database shall be packaged into one Geodatabase package (*.gdb) and organized according to 14 data topics as follows:

a) Economy - society and investment;

b) Construction;

c) Industry and commerce;

d) Agriculture and rural development;

đ) Natural resources and environment;

e) Culture, sports and tourism;

g) Transportation;

h) Information and communication;

i) Science and technology;

k) Health;

l) Education and training;

m) Labor - War Invalids and Social Affairs;

n) National defense and security;

o) Foreign affairs.

2. The naming convention for the data package, data topic, data layer, and information field of the national master plan database, regional plan database, and provincial plan database shall be implemented in accordance with the provisions set out in Section 1 of Appendix III attached hereto.

Article 10. Assignment of identification codes for geographic objects in the national master plan database, regional plan database, and provincial plan database

1. The national master plan database, regional plan database, and provincial plan database must assign unique identification codes for each geographic object.

2. The rules for assigning identification codes for each geographic object in the national master plan database, regional plan database, and provincial plan database shall be implemented in accordance with the provisions set out in Section 2 of Appendix III attached hereto.

Article 11. List of geographic objects in the national master plan database, regional plan database, and provincial plan database

1. The list of geographic objects in the national master plan database, regional plan database, and provincial plan database is specified in Section 3 of Appendix III attached hereto.

2. Ministries, ministerial-level agencies, and provincial People's Committees may supplement new geographic objects, or add data types, attributes, relationships, and value ranges for existing geographic objects in the list set out in Section 3 of Appendix III attached hereto to reflect the content of plans that have been decided or approved and ensure compliance with laws on planning and other related laws.

Chapter IV
IMPLEMENTATION

Article 12. Implementation Organization

1. The Ministry of Planning and Investment shall organize the construction of the planning dossier database and the national master plan schematic and map databases in accordance with the content and technical requirements stipulated in Chapter II and Chapter III of this Circular; update the national master plan dossier database and regional plan dossier database onto the national planning information system and database after the plan has been decided or approved.

2. Ministries and ministerial-level agencies shall organize the construction of the planning dossier database, schematic, and map databases within their jurisdiction in accordance with the technical requirements stipulated in Chapter II of this Circular and relevant regulations; update the planning dossier database within their jurisdiction onto the national planning information system and database after the plan has been decided or approved.

3. Provincial People's Committees shall organize the construction of the provincial planning dossier database, schematic, and map databases within their jurisdiction in accordance with the content and technical requirements stipulated in Chapter II and Chapter III of this Circular; update the provincial planning dossier database onto the national planning information system and database after the plan has been approved.

Article 13. Transitional Provisions

1. For national plans, regional plans, and provincial plans that have been decided or approved before the effective date of this Circular, the planning dossier database, schematic, and map databases shall be implemented in accordance with guidance documents prior to the effective date of this Circular. In cases where the planning dossier database has not yet been updated onto the national planning information system and database, it shall be completed to ensure consistency with the decision or approval document of the plan in accordance with this Circular and then updated onto the national planning information system and database.

2. For national plans, regional plans that have been submitted for review but not yet approved by the Planning Review Board, or have been approved by the Planning Review Board but not yet decided or approved before the effective date of this Circular, the planning dossier database, schematic, and map databases of the dossier for decision or approval of the plan shall be implemented in accordance with guidance documents prior to the effective date of this Circular. After the plan has been decided or approved, ministries, ministerial-level agencies, and provincial People's Committees shall complete the planning dossier database, schematic, and map databases to ensure consistency with the decision or approval document of the plan and comply with the provisions of this Circular.

3. For national plans, regional plans, and provincial plans that have not yet been submitted for review from the effective date of this Circular, the planning dossier database, schematic, and map databases shall be implemented in accordance with the provisions of this Circular.

Article 14. Effective Date

1. This Circular takes effect from August 10, 2023.

2. In cases where the legal normative documents cited in this Circular are amended, supplemented, or replaced, they shall be applied according to the amended, supplemented, or replacing documents;

3. During implementation, if there are difficulties, obstacles, or points that are not suitable, please report to the Ministry of Planning and Investment for consideration and adjustment to make them appropriate.
