CIRCULAR

Amending and supplementing certain provisions of Circular No. 12/2017/TT-BLDTBXH dated April 20, 2017 issued by the Minister of Labor, Invalids and Social Affairs on the minimum volume of knowledge and requirements for capabilities that students achieve upon graduation from intermediate and higher vocational education levels

The Minister of Labor, Invalids and Social Affairs issues this Circular to amend and supplement certain provisions of Circular No. 12/2017/TT-BLDTBXH dated April 20, 2017 stipulating the minimum volume of knowledge and requirements for capabilities that students achieve upon graduation from intermediate and higher vocational education levels

Pursuant to the Law on Vocational Education dated November 27, 2014;

Based on Decree No. 62/2022/NĐ-CP dated September 12, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Labor, Invalids, and Social Affairs;

Pursuant to Decree No. 15/2019/NĐ-CP dated February 1, 2019, of the Government detailing certain provisions and measures to implement the Law on Vocational Education;

At the proposal of the Director General of the General Department of Vocational Education,

Article 1. Amending and supplementing certain provisions of Circular No. 12/2017/TT-BLDTBXH dated April 20, 2017 issued by the Minister of Labor, Invalids and Social Affairs stipulating the minimum volume of knowledge and requirements for capabilities that students achieve upon graduation from intermediate and higher vocational education levels

Article 7. Content stipulating the minimum volume of knowledge and requirements for capabilities that students achieve upon graduation from intermediate and higher vocational education levels according to each training profession

1. Amending and supplementing Article 7 as follows:

"The minimum volume of knowledge and requirements for capabilities that students achieve upon graduation from intermediate and higher vocational education levels according to each training profession include the following contents:

3. Minimum volume of knowledge

1. Name of the training field and profession.

2. Level of training.

4. Requirements for capabilities

a) Knowledge requirements;

b) Skill requirements;

c) Level of autonomy and responsibility."

"Article 8. Procedures for developing the Regulations on the minimum volume of knowledge and requirements for capabilities that students achieve upon graduation from intermediate and higher vocational education levels

2. Amend and supplement Article 8 as follows:

1. Preparation for development

a) The Director of the General Department of Vocational Education decides to establish the Steering Committee for developing the Regulations on the minimum volume of knowledge and requirements for capabilities that students achieve upon graduation from intermediate and higher vocational education levels according to each training profession (hereinafter referred to as the Steering Committee);

b) The Steering Committee is trained and guided by the General Department of Vocational Education on methods and procedures for developing the Regulations on the minimum volume of knowledge and requirements for capabilities that students achieve upon graduation from intermediate and higher vocational education levels.

2. The Steering Committee organizes the development of the Regulations on the minimum volume of knowledge and requirements for capabilities that students achieve upon graduation from intermediate and higher vocational education levels through the following steps:

a) Studying and surveying occupational standards, skill level standards, job positions in enterprises, and national occupational skills standards;

b) Analyzing professions, analyzing jobs, identifying job positions and required capabilities for each job position within the profession;

c) Organizing the compilation of the content of the Regulations on the minimum volume of knowledge and requirements for capabilities that students achieve upon graduation from intermediate and higher vocational education levels according to the model prescribed in the Appendix attached to this Circular;

d) Organizing seminars to collect opinions from managers, scientists, experts, lecturers, teachers, and employers to improve the draft content;

đ) Soliciting opinions from businesses, specialized managers, and training managers regarding the draft Regulations on the minimum volume of knowledge and requirements for capabilities that students achieve upon graduation from intermediate and higher vocational education levels;

e) Based on the results of comments as stipulated in points d and đ of Clause 2 of this Article, the Steering Committee will incorporate, explain, and perfect the draft content of the Regulations on the minimum volume of knowledge and requirements for capabilities that students achieve upon graduation from intermediate and higher vocational education levels and submit it to the General Department of Vocational Education for organization of review.

3. The General Department of Vocational Education guides, monitors, and supervises the process of organizing the development of the Regulations on the minimum volume of knowledge and requirements for capabilities that students achieve upon graduation from intermediate and higher vocational education levels in accordance with the procedure and ensuring quality"

"Article 9. Procedures for reviewing, accepting, and promulgating the Regulations on the minimum volume of knowledge and requirements for capabilities that students achieve upon graduation from intermediate and higher vocational education levels

3. Amend and supplement Article 9 as follows:

1. Preparation for review

a) The Minister of Labor, Invalids and Social Affairs decides to establish the Review Board for the Regulations on the minimum volume of knowledge and requirements for capabilities that students achieve upon graduation from intermediate and higher vocational education levels according to each training profession (hereinafter referred to as the Review Board);

b) The Review Board is trained and guided by the General Department of Vocational Education on content, methods, and review procedures;

c) The General Department of Vocational Education sends the draft content of the Regulations on the minimum volume of knowledge and requirements for capabilities that students achieve upon graduation from intermediate and higher vocational education levels to the members of the Review Board to prepare comments and evaluations;

d) Members of the Review Board study and send their written comments on the draft Regulations on the minimum volume of knowledge and requirements for capabilities that students achieve upon graduation from intermediate and higher vocational education levels to the Chairman of the Review Board;

đ) After receiving all comments from the members, the Chairman of the Review Board informs the Steering Committee about the plan, time, and location for the review meeting and the matters to be reported to the Review Board.

2. Organizing the review meeting

a) The Steering Committee reports the results of developing the Regulations on the minimum volume of knowledge and requirements for capabilities that students achieve upon graduation from intermediate and higher vocational education levels for the assigned profession;

b) Members of the Review Board comment and evaluate the draft;

c) The Steering Committee explains and incorporates the comments of each member of the Review Board;

d) The Chairman of the Review Board summarizes the comments, suggestions, explanations, and concludes on the issues that the Steering Committee needs to incorporate and revise in the draft;

d) The Chairman of the Review Board shall consolidate comments, opinions, explanations, and conclusions on the issues that the Steering Committee needs to adopt and revise in the draft;

d) The Appraisal Board shall vote to assess the draft Regulation on the minimum volume of knowledge and requirements for skills that students achieve upon graduation at the intermediate level and college level according to specific criteria as stipulated in the evaluation form prescribed by the Chairman of the Appraisal Board, with three levels: meeting the requirements, meeting the requirements but needing revision, and not meeting the requirements.

3. Acceptance

a) The draft Regulation on the minimum volume of knowledge and requirements for skills that students achieve upon graduation at the intermediate level and college level shall be accepted immediately when all members of the Appraisal Board have voted to assess and meet the requirements;

b) In cases where more than 50% of the members of the Appraisal Board assess that the draft Regulation on the minimum volume of knowledge and requirements for skills that students achieve upon graduation at the intermediate level and college level does not meet the requirements, the Department Head must perfect it to organize re-appraisal. The re-appraisal shall be carried out in accordance with the provisions of Clause 2 of this Article;

c) Apart from the cases specified in points a and b of this clause, the Department Head must implement revisions based on the conclusions of the Chairman of the Appraisal Board. After revisions and obtaining written agreement from all members of the Appraisal Board without having to convene another appraisal meeting, the draft Regulation on the minimum volume of knowledge and requirements for skills that students achieve upon graduation at the intermediate level and college level shall be accepted.

4. After the draft Regulation on the minimum volume of knowledge and requirements for skills that students achieve upon graduation at the intermediate level and college level has been accepted, the Chairman of the Appraisal Board shall report and propose to the Director General of the Vocational Education Administration to issue the Regulation on the minimum volume of knowledge and requirements for skills that students achieve upon graduation at the intermediate level and college level for each vocational training program to the Minister of Labor, Invalids and Social Affairs.

5. Replace the phrase "requirements for skills that students must achieve" with the phrase "requirements for skills that students achieve" in the name of the Article, Clause 3 of Article 6; Point a of Clause 4 of Article 10; Point b of Clause 4 of Article 11; Clause 1 and Clause 2 of Article 12; Clause 1 and Clause 2 of Article 13; Article 14 and Clause 1 of Article 15.

Article 2. Implementation

Ministries, ministerial-level agencies, agencies under the Government, People's Committees of provinces and centrally governed cities, political and social organizations, the Vocational Education Administration, Departments of Labor, Invalids and Social Affairs, colleges, intermediate schools, and other institutions registered to operate vocational education at the intermediate level and college level shall be responsible for implementing this Circular.

Article 3. Effectiveness

1. This Circular takes effect from July 30, 2023.

2. For industries and trades currently being developed, appraised but not yet issued, the minimum volume of knowledge and requirements for skills that students achieve upon graduation at the intermediate level and college level shall continue to be applied according to the provisions of Circular No. 12/2017/TT-LDTBXH until they are issued by the competent authority.

3. During the implementation process, if any issues arise, please reflect them to the Ministry of Labor, Invalids and Social Affairs for consolidation, supplementation, and amendment.
