CIRCULAR

REPEALS Circular No. 03/2008/TT-BNV dated June 3, 2008, issued by the Minister of Home Affairs guiding the implementation of examination for salary grade promotion without examination for officials, civil servants, and public employees who have received retirement notice.

BASED ON Decree No. 34/2016/NĐ-CP dated May 14, 2016, promulgated by the Government detailing certain provisions and measures to implement the Law on Enacting Legal Normative Documents; and Decree No. 154/2020/NĐ-CP dated December 31, 2020, promulgated by the Government amending and supplementing certain articles of Decree No. 34/2016/NĐ-CP dated May 14, 2016, promulgated by the Government detailing certain provisions and measures to implement the Law on Enacting Legal Normative Documents;

Pursuant to the Law on Legislative Regulatory Documents promulgation dated June 22, 2015; the Law amending and supplementing certain articles of the Law on Legislative Regulatory Documents promulgation dated June 18, 2020;

Pursuant to the Law on Public Officials and Civil Servants dated November 13, 2008;

Pursuant to the Civil Servant Law dated November 15, 2010;

Pursuant to the Law Amending and Supplementing Certain Provisions of the Civil Servants and Public Officials Law and the Public Service Staff Law dated November 25, 2019;

THE MINISTER OF HOME AFFAIRS ISSUES THIS CIRCULAR TO REPEAL Circular No. 03/2008/TT-BNV dated June 3, 2008, issued by the Minister of Home Affairs guiding the implementation of examination for salary grade promotion without examination for officials, civil servants, and public employees who have received retirement notice.

Pursuant to Decree No. 63/2022/NĐ-CP dated September 12, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Home Affairs;

Circular No. 03/2008/TT-BNV dated June 3, 2008, issued by the Minister of Home Affairs guiding the implementation of examination for salary grade promotion without examination for officials, civil servants, and public employees who have received retirement notice.

1. This Circular takes effect from June 25, 2023.

This Circular takes effect from January 25, 2026.

2. The Minister, Heads of Ministries equivalent to Ministries, Heads of agencies under the Government, Chairpersons of People's Committees of provinces and centrally governed cities, and related organizations and individuals are responsible for implementing this Circular./.

Article 2. Implementation clause

1. This Circular takes effect from June 25, 2023.

2. The Minister, Heads of ministerial-level agencies, Heads of government agencies, Chairpersons of provincial People's Committees under central cities, and relevant organizations and individuals are responsible for implementing this Circular./.
