At the proposal of the Minister of Justice;
The Government promulgates this Decree to detail certain provisions and measures to implement the Law on Management and Use of Weapons, Explosives, and Support Tools.No. provisions and measures ect to implement the Law on Legislative Documents.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
This Decree stipulates detailed regulations and measures for implementing the Law on Legislative Documents (hereinafter referred to as the Law) regarding the proposal for drafting legislative documents, policy impact assessment; drafting, reviewing draft projects and draft legislative documents; format and technical presentation of legislative documents, except for legislative documents of the National Assembly, Standing Committee of the National Assembly, President; Official Gazette and publicizing legislative documents; translating legislative documents into ethnic minority languages and foreign languages; inspecting and handling legislative documents; reviewing and systematizing legislative documents; ensuring resources for drafting and promulgating legislative documents.
Article 2. Interpretation of Terms
In this Decree, the following terms are understood as follows:
1. Policy is the orientation and solution of the State to address practical issues in order to achieve specific goals.
2. Policy impact assessment is the analysis and forecasting of the impact of a policy under development on different groups to select the optimal solution for implementing the policy.
3. Official Gazette is an official information publication of the State, uniformly managed by the Government, publishing legislative documents, international treaties that have taken effect for the Socialist Republic of Vietnam, and other legal documents as prescribed in this Decree.
4. Inspecting legislative documents involves examining, evaluating, and concluding on the constitutionality, legality, and consistency of the inspected legislative document and handling illegal documents.
5. Reviewing legislative documents involves examining, comparing, and assessing the provisions of the reviewed document with the basis for review, economic and social development situations to identify, handle, or recommend handling provisions that violate laws, contradictions, overlaps, have expired, or are no longer appropriate.
6. Systematizing legislative documents involves collecting, arranging legislative documents that have been reviewed and determined to still be effective according to the criteria specified in this Decree.
7. Comprehensive review of the legislative document system involves examining and evaluating the entire legislative document system issued by all competent authorities within a specific period.
Article 3. Determination of Legislative Documents
1. Legislative documents must fully meet the requirements regarding content, authority, form, procedure, and process prescribed in the Law.
2. Decisions of the Prime Minister are not legislative documents in the following cases:
a) Approving strategies, programs, proposals, projects, plans;
b) Assigning socio-economic targets to agencies and units;
c) Establishing universities; establishing committees, councils, commissions to perform tasks for a specific period;
d) Awarding commendations, disciplinary actions, job transfers;
đ) Appointing, dismissing, removing from office, accepting resignation, temporarily suspending the work of cadres and civil servants;
e) Other decisions not containing the content stipulated in Article 20 of the Law.
3. Resolutions of People's Councils and decisions of People's Committees are not legislative documents in the following cases:
a) Resolutions on the removal of People's Council representatives and other positions;
b) Resolutions approving election results of People's Council representatives and other positions;
c) Resolutions dissolving People's Councils;
d) Resolutions approving the structure of specialized agencies under provincial People's Committees, centrally-administered city People's Committees, district, urban district, provincial-level city People's Committees, centrally-administered city People's Committees;
đ) Resolutions establishing, merging, dissolving specialized agencies under People's Committees; decisions establishing committees, steering committees, councils, Commissions to perform tasks for a specific period;
e) Resolutions on total staffing at local levels;
g) Resolutions on local budget estimates and final accounts;
h) Decisions approving plans;
i) Decisions assigning targets to each agency and unit;
k) Decisions on staffing quotas for agencies and units; decisions on staff quota and administrative management expenses for each specialized agency under People's Committees;
l) Other resolutions and decisions not containing the content stipulated in Articles 27, 28, 29, and 30 of the Law.
Chapter II
PROPOSAL FOR DRAFTING LEGISLATIVE DOCUMENTS
Section 1
POLICY CONTENT DEVELOPMENT AND POLICY IMPACT ASSESSMENT
Article 4. Cases for proposing to establish regulatory legal documents
1. Law, ordinance.
2. Resolution of the National Assembly prescribed at point b and c, Clause 2, Article 15 of the Law; resolution of the Standing Committee of the National Assembly prescribed at point b, Clause 2, Article 16 of the Law.
3. Decree of the Government prescribed at Clause 2 and 3, Article 19 of the Law.
4. Resolution of the People's Council of the province prescribed at Clause 2, 3, and 4, Article 27 of the Law.
Article 5. Building the content of policy
1. Identify issues that need to be resolved, the cause of each issue.
2. Determine overall objectives, specific goals to be achieved when resolving issues.
3. Determine directions, solutions to resolve each issue.
4. Determine the subjects directly affected by the policy, groups of subjects responsible for implementing the policy.
5. Determine the authority to issue the policy to resolve the issue.
Article 6. Impact Assessment of Policy
The impact of the policy is assessed as follows:
1. Economic impact is assessed based on analyzing costs and benefits related to production, business, consumption, investment and business environment, competitiveness of enterprises, organizations and individuals, economic development structure of the country or locality, public expenditure, public investment, and other issues related to the economy.
2. Social impact of the policy is assessed based on analyzing and forecasting impacts related to population, employment, property, health, environment, healthcare, education, transportation, poverty reduction, traditional cultural values, community cohesion, society, and other social issues.
3. Gender impact of the policy (if applicable) is assessed based on analyzing and forecasting economic and social impacts related to opportunities, conditions, capacity to implement and enjoy rights and interests of each gender.
4. Administrative procedure impact (if applicable) is assessed based on analyzing and forecasting the necessity, legality, rationality, and compliance costs of administrative procedures to implement the policy.
5. Impact on the legal system is assessed based on analyzing and forecasting the implementation and compliance capacity of agencies, organizations, and individuals, impact on the state organizational structure, and Vietnam's implementation and compliance capacity with international treaties.
Article 7. Method of Assessing the Impact of Policy
The impact of the policy is assessed using quantitative methods and qualitative methods. In cases where quantitative methods cannot be applied, the reasons must be clearly stated in the impact assessment report.
Article 8. Responsibility for Building the Impact Assessment Report of the Policy
1. Agencies, organizations, and National Assembly deputies proposing to establish regulatory legal documents have the responsibility to:
a) Build the impact assessment report of the policy according to Model No. 01 Appendix V attached to this Decree;
b) Solicit opinions and feedback on the draft impact assessment report of the policy; incorporate and revise the draft report.
2. The National Assembly Office, the Office of the Delegation of National Assembly Members, and the Institute for Legislative Research, upon request from National Assembly deputies to support the proposal to establish laws and ordinances, have the responsibility to assist National Assembly deputies in building the impact assessment report of the policy in accordance with the provisions of this Decree.
Article 9. Use of information when preparing impact assessment reports on policies
Information used when preparing impact assessment reports on policies must be accurate, truthful, and clearly indicate the source of the information.
Section 2
SEEKING OPINIONS ON PROPOSALS
LEGISLATIVE DRAFTING
Article 10. Responsibilities for seeking opinions during the drafting process of legislative documents
During the drafting process of legislative documents, the proposing agency has the responsibility to:
1. Organize the collection of opinions from entities directly affected by the policies proposed and collect opinions from relevant agencies, organizations, and individuals as prescribed by Law, and compile, study, explain, and incorporate the feedback provided;
2. Clearly identify each policy in the proposal that requires soliciting opinions suitable for each target group and specify the address for receiving opinions;
3. Send the proposal dossier for legislative documents from central agencies to ministries, ministerial-level agencies, government agencies, and related organizations to seek opinions. For proposals to draft resolutions of provincial People's Councils, send the dossier to specialized agencies under the provincial People's Committee, ministries, ministerial-level agencies managing relevant sectors, and other related organizations to seek opinions;
4. Send the proposal dossier for legislative documents from central agencies to the Central Committee of the Vietnam Fatherland Front; the dossier for proposals to draft resolutions of provincial People's Councils to the Provincial Vietnam Fatherland Front Committee; and the dossier for legislative documents related to the rights and obligations of enterprises to the Vietnam Chamber of Commerce and Industry to seek opinions;
5. In cases where necessary, organize meetings to seek opinions on fundamental policies in the proposal for legislative documents;
6. Study feedback to improve the proposal for legislative documents. Reports explaining and incorporating opinions must be published together with other documents in the proposal dossier for legislative documents on the Government’s electronic portal, the electronic portal of the province or centrally-administered city, and the electronic portal or website of the proposing agency.
Article 11. Participation of organizations and individuals in the drafting process of legislative documents
During the drafting process of legislative documents, the proposing agency may mobilize the participation of research institutes, universities, associations, related organizations, experts, and scientists in the following activities:
1. Summarizing and evaluating the implementation of laws; reviewing and assessing current legislative documents;
2. Conducting surveys and sociological studies; evaluating the current social relations related to the policies proposed in the legislative documents;
3. Collecting, studying, and comparing relevant international treaties and materials concerning the policies proposed in the legislative documents;
4. Evaluating the impact of the policies proposed in the legislative documents.
Article 12. The Government provides opinions on draft regulatory legal documents not submitted by the Government and proposals for laws and ordinances.
1. The Ministry of Justice shall take the lead and coordinate with the Ministry of Finance, the Ministry of Home Affairs, the Ministry of Foreign Affairs, the Ministry of Labor, Invalids and Social Affairs, the Government Office, and relevant agencies and organizations to prepare the Government's opinion on draft laws, resolutions of the National Assembly, ordinances, and resolutions of the Standing Committee of the National Assembly that are not submitted by the Government, and proposals for laws and ordinances from National Assembly deputies for the Government to discuss.
In cases where necessary, the Ministry of Justice may send the draft proposal for laws, resolutions of the National Assembly, ordinances, and resolutions of the Standing Committee of the National Assembly that are not submitted by the Government, and proposals for laws and ordinances from National Assembly deputies to relevant ministries and equivalent agencies for their opinions; organize meetings involving representatives from the agencies proposing the draft laws, resolutions of the National Assembly, ordinances, and resolutions of the Standing Committee of the National Assembly, relevant ministries and equivalent agencies, organizations, experts, and scientists to gather opinions on the proposals.
2. The Ministry of Justice shall take the lead and coordinate with the Government Office to incorporate the Government's opinions to revise the draft opinion of the Government on draft laws, resolutions of the National Assembly, ordinances, and resolutions of the Standing Committee of the National Assembly that are not submitted by the Government, and proposals for laws and ordinances from National Assembly deputies for submission to the Prime Minister for consideration and decision.
Section 3
REVIEW OF PROPOSALS FOR LEGISLATIVE DOCUMENTS
LEGAL NORMATIVE DOCUMENTS
Article 13. Responsibilities for reviewing proposals for legislative documents
1. The Ministry of Justice is responsible for:
a) Organize the review of proposals for laws, resolutions of the National Assembly, ordinances, and resolutions of the Standing Committee of the National Assembly submitted by the Government, and decrees of the Government within the prescribed time frame and ensuring quality;
b) Conduct research on contents related to proposals for laws, resolutions of the National Assembly, ordinances, and resolutions of the Standing Committee of the National Assembly, and decrees of the Government;
c) In cases where necessary, organize advisory review meetings or establish advisory review councils with the participation of representatives from the Ministry of Finance, the Ministry of Home Affairs, the Ministry of Foreign Affairs, the Ministry of Labor, Invalids and Social Affairs, the Government Office, and relevant agencies and organizations, experts, and scientists;
d) Request the agency proposing the draft laws, resolutions of the National Assembly, ordinances, and resolutions of the Standing Committee of the National Assembly, and decrees of the Government to present the proposal and provide information and materials related to policies in the proposal;
e) In cases where necessary, organize seminars and roundtable discussions on proposals for laws, resolutions of the National Assembly, ordinances, and resolutions of the Standing Committee of the National Assembly, and decrees of the Government.
2. Provincial Departments of Justice shall be responsible for:
a) Organizing the review of proposals for provincial People's Council resolutions submitted by the same-level People's Committees within the prescribed time frame and ensuring quality;
b) Conducting research on contents related to proposals for resolutions;
c) In cases where necessary, organizing advisory review meetings or establishing advisory review councils with the participation of representatives from the Provincial Department of Finance, the Provincial Department of Home Affairs, the Provincial Department of Labor, Invalids and Social Affairs, the Provincial People's Committee Office, and relevant agencies and organizations, experts, and scientists;
d) In cases where necessary, organizing seminars and roundtable discussions on proposals for resolutions.
Article 14. Responsibilities of agencies proposing to establish regulatory legal documents and related agencies in reviewing proposals for establishing regulatory legal documents
1. Ministries and ministerial-level agencies proposing laws, resolutions of the National Assembly, ordinances, resolutions of the Standing Committee of the National Assembly, decrees of the Government shall be responsible for:
a) Submitting proposal files in accordance with Clause 1 of Article 37 or Article 87 of the Law to the Ministry of Justice for review;
b) Providing relevant information and materials; presenting the proposal at the request of the Ministry of Justice;
c) Ensuring the participation of the Ministry of Justice and the Office of the Government in the process of drafting the proposal; studying, adopting, and revising the proposal based on the review opinions to submit to the Government;
d) Sending the revised proposal and explanatory reports, adopting review opinions to the Ministry of Justice when submitting to the Government.
2. The Ministry of Finance, the Ministry of Home Affairs, the Ministry of Foreign Affairs, the Ministry of Labor, Invalids and Social Affairs, and the Office of the Government shall be responsible for appointing representatives to participate in reviewing proposals for laws, resolutions of the National Assembly, ordinances, resolutions of the Standing Committee of the National Assembly, and decrees of the Government reviewed by the Ministry of Justice.
3. Agencies and organizations proposing resolutions of provincial People's Councils directly under the central government shall be responsible for:
a) Submitting proposal files in accordance with Article 114 of the Law to the Department of Justice for review;
b) Providing relevant information and materials; appointing representatives to attend the Advisory Review Council and meetings related to the review upon the request of the Department of Justice;
c) Ensuring the participation of the Department of Justice and the Office of the Provincial People's Committee in the process of drafting the proposal; studying, adopting, and revising the proposal based on the review opinions to submit to the Provincial People's Committee.
4. Departments of Finance, Home Affairs, Labor, Invalids and Social Affairs, and the Office of the Provincial People's Committee shall be responsible for appointing representatives to participate in reviewing proposals for resolutions of provincial People's Councils reviewed by the Department of Justice.
Article 15. Receiving and inspecting proposal files for establishing regulatory legal documents
1. The Ministry of Justice shall be responsible for receiving and inspecting proposal files for laws, resolutions of the National Assembly, ordinances, resolutions of the Standing Committee of the National Assembly, and decrees of the Government immediately upon receipt of the files.
In case the files do not meet the requirements stipulated in Clause 1 of Article 37 and Article 87 of the Law, the Ministry of Justice shall propose the agency making the proposal to supplement the files within the latest two working days from the date of receiving the files. The agency making the proposal shall be responsible for supplementing the files according to the request of the Ministry of Justice.
2. The Department of Justice shall be responsible for receiving and inspecting proposal files for provincial People's Council resolutions submitted by the provincial People's Committee.
In case the files do not meet the requirements stipulated in Article 114 of the Law, the Department of Justice shall propose the agency making the proposal to supplement the files within the latest two working days from the date of receiving the files. The agency making the proposal shall be responsible for supplementing the files according to the request of the Department of Justice.
Article 16. Review Report
1. The Review Report shall be established based on research and the results of the review meeting regarding the proposal for establishing regulatory legal documents.
2. In case the Ministry of Justice or the Department of Justice concludes that the proposal for establishing regulatory legal documents does not meet the conditions to be submitted to the Government or the provincial People's Committee, the Ministry of Justice or the Department of Justice must clearly state the reasons in the Review Report.
Section 4
APPROVAL OF PROPOSALS FOR ESTABLISHING REGULATORY LEGAL DOCUMENTS
Article 17. Proposing to Draft Regulatory Legal Documents
1. The agency proposing to draft regulatory legal documents shall be responsible for revising and perfecting the proposal dossier to submit to the Government and the People's Committee at the provincial level.
2. Responsibilities for receiving and examining the proposal dossier:
a) The Office of the Government shall be responsible for receiving and examining the proposal dossier for laws, resolutions of the National Assembly, ordinances, and resolutions of the Standing Committee of the National Assembly, and decrees of the Government.
b) The Office of the People's Committee at the provincial level shall be responsible for receiving and examining the proposal dossier for resolutions of the People's Council at the provincial level.
In case the dossier is incomplete according to the provisions of this Law and Decree, within three working days, the Office of the People's Committee at the provincial level shall request the proposing agency to complete the dossier. Within five working days from the date of receiving the complete dossier, it must propose to include it in the agenda of the nearest session of the People's Committee at the provincial level.
Article 18. Approving Proposals to Draft Regulatory Legal Documents
1. The Government shall consider proposals for laws, resolutions of the National Assembly, ordinances, and resolutions of the Standing Committee of the National Assembly, and decrees of the Government during regular sessions of the Government. In cases where there are multiple proposals or based on the work program of the Government and the Prime Minister, the Office of the Government shall take the lead and coordinate with the Ministry of Justice to propose a specialized session of the Government on legislative work.
Based on the resolution approving the proposal, the proposing agency shall proactively proceed with drafting the project or draft document.
2. The People's Committee at the provincial level shall examine and approve proposals for resolutions of the People's Council at the provincial level during regular sessions of the People's Committee to submit to the Standing Body of the People's Council at the provincial level. If approved, the Standing Body of the People's Council at the provincial level shall issue a directive assigning the relevant agencies or organizations to prepare the draft resolution, the deadline for submission to the People's Council at the provincial level, and allocate funds for the drafting process.
Chapter III
THE PROPOSAL OF THE GOVERNMENT
ON THE PROGRAM FOR LEGISLATIVE WORK
Article 19. Sending and Receiving Proposal Dossiers for Laws and Ordinances
1. By the latest on December 31 each year, ministries and equivalent agencies shall send the proposal dossier for laws, resolutions of the National Assembly, ordinances, and resolutions of the Standing Committee of the National Assembly, which have been revised according to the Government's resolution, to the Ministry of Justice.
2. The Ministry of Justice shall be responsible for receiving and examining the proposal dossier for laws, resolutions of the National Assembly, ordinances, and resolutions of the Standing Committee of the National Assembly, which have been approved by the Government, to prepare the Government's proposal on the legislative program.
Article 20. Responsibilities for Preparing the Government's Proposal on the Legislative Program
1. Based on the proposals for laws and ordinances from ministries and equivalent agencies that have been approved by the Government, the Ministry of Justice shall be responsible for drafting the proposal of the Government on the legislative program.
2. The preparation of the Government's proposal on the legislative program must ensure:
a) Conditions for drafting and implementing legal documents;
b) The feasibility of the legislative program;
c) The consistency and unity of the legal system;
d) The priority order set by the Government and the Prime Minister for proposals in the legislative program.
3. The draft proposal of the Government on the legislative program shall be subject to comments from ministries, equivalent agencies, and related agencies and organizations.
4. Based on the feedback received, the Ministry of Justice shall revise and perfect the draft proposal of the Government on the legislative program to submit to the Government.
Article 21. Submitting to the Government the draft proposal on the legislative program for laws and ordinances
1. The dossier for the draft proposal on the legislative program for laws and ordinances includes:
a) A memorandum from the Ministry of Justice, which clearly states the implementation situation of the legislative program for laws and ordinances in the previous year, the principles of establishing the proposal, the main contents of the proposal, issues with differing opinions, and the views of the Ministry of Justice;
b) The draft proposal of the Government on the legislative program for laws and ordinances, which clearly states the name of the document, the expected time to submit to the National Assembly and the Standing Committee of the National Assembly for comments and consideration, and approval of the document;
c) An electronic version of the documents specified in Clause 1 of Article 37 of the Law that have been revised according to the Government's opinions.
2. The annual draft proposal of the Government on the legislative program for laws and ordinances is discussed and approved at the Government meeting in January of the year preceding the year it is expected to be submitted to the National Assembly and the Standing Committee of the National Assembly.
Article 22. Completing the Government's Proposal on the Legislative Program for Laws and Ordinances after the Government's Approval
1. The Ministry of Justice takes the lead and coordinates with the Government Office to incorporate the opinions of Government members, completing the Government's proposal on the legislative program for laws and ordinances.
2. Based on the Prime Minister's opinion, the Minister of Justice, acting on behalf of the Prime Minister, represents the Government to sign the memorandum and report to the Standing Committee of the National Assembly the Government's proposal on the legislative program for laws and ordinances.
Article 23. Responsibilities for Implementing the Legislative Program for Laws and Ordinances
1. Based on the legislative program for laws and ordinances of the National Assembly, the Ministry of Justice is responsible for:
a) Taking the lead and coordinating with the Government Office to draft and submit to the Prime Minister for issuance of a decision assigning the leading agency to draft, the coordinating agencies to draft, and the expected time to submit draft laws and ordinances to the Government;
b) Monitoring, urging, and inspecting the drafting process to ensure the progress and quality of the draft laws and ordinances;
c) Reporting quarterly to the Prime Minister on the situation, progress, and emerging issues during the implementation of the legislative program for laws and ordinances.
2. The agency assigned to lead the drafting is responsible for ensuring the progress and quality of the draft laws and ordinances; regularly updating electronic information monthly and submitting written reports quarterly to the Ministry of Justice on the implementation of the legislative program for laws and ordinances and the progress of drafting law and ordinance projects.
Article 24. Proposing Adjustments to the Legislative Program for Laws and Ordinances
1. Ministries and ministerial-level agencies propose adjustments to the legislative program for laws and ordinances in cases stipulated in Article 51 of the Law.
In cases where the proposal is to remove from the program and not continue to submit, the proposing agency must provide a memorandum clearly stating the reasons; in cases where the proposal is to adjust the submission time for law and ordinance projects, the proposing agency must provide a memorandum clearly stating the reasons, solutions, and submission time.
2. The Government decides on adjustments to the legislative program for laws and ordinances, submitting to the National Assembly and the Standing Committee of the National Assembly.
The Minister of Justice, acting on behalf of the Prime Minister, represents the Government to sign the memorandum and report to the Standing Committee of the National Assembly the Government's proposal on adjusting the legislative program for laws and ordinances.

Section 1
DRAFTING LEGAL REGULATIONS TEXT
Article 25. Responsibilities of the agency or organization in charge of drafting regulatory legal documents
1. Implement tasks as prescribed by the Law.
2. Ensure the participation of the Ministry of Justice and the Government Office during the drafting process of draft regulatory legal documents.
3. Send project and draft files of central agencies to the Central Committee for Fatherland Front Vietnam; draft files of local agencies to the Committee for Fatherland Front Vietnam at the same level; project and draft files related to the rights and obligations of enterprises to the Vietnam Chamber of Commerce and Industry for comments.
4. Prepare draft documents detailing regulations after the Government decides to submit a draft law or ordinance.
Article 26. Establishment and operation of the Drafting Board
1. The Minister or Head of a ministerial-level agency shall establish a Drafting Board in cases where the ministry or ministerial-level agency is assigned to lead the drafting of:
a) Laws, resolutions of the National Assembly, ordinances, and resolutions of the Standing Committee of the National Assembly submitted by the Government, except in cases provided for in Clause 1, Article 52 of the Law;
b) Decrees of the Government if deemed necessary.
2. The composition of the Drafting Board is as stipulated in Article 53 and point b, Clause 2, Article 90 of the Law.
The Drafting Board ceases operations and dissolves itself after the issuance of the document.
3. The Drafting Board operates according to the following principles:
a) Collective discussion;
b) Ensuring transparency, objectivity, and scientific rigor;
c) Emphasizing the personal responsibility of the Chairperson and members of the Drafting Board.
4. Meetings of the Drafting Board are conducted as follows:
a) The Chairperson of the Drafting Board convenes meetings of the Drafting Board based on the nature, content of the draft projects and the requirements for drafting progress;
b) Meetings of the Drafting Board involve representatives from relevant agencies and organizations, experts, scientists, and members of the Editorial Team;
c) At the meeting, members of the Drafting Board discuss issues specified in Clause 2, Article 54 of the Law;
d) Meeting materials of the Drafting Board must be prepared and sent to members of the Drafting Board by the leading agency at least five working days before the meeting date.
Article 27. Establishment of the Editorial Team
1. In cases where a Drafting Board is established, the Chairperson of the Drafting Board may establish an Editorial Team to assist the Drafting Board. Members of the Editorial Team are appointed by agencies and organizations represented as members of the Drafting Board, experts, and scientists, with no more than half being experts from the leading agency.
The head of the Editorial Team is a member of the Drafting Board, designated by the Chairperson of the Drafting Board, responsible for reporting to the Chairperson of the Drafting Board on assigned tasks. Members of the Editorial Team are responsible for fully participating in activities of the Editorial Team and are subject to the assignment of the head of the Editorial Team.
2. In cases where a Drafting Board is not established, the leading agency may establish an Editorial Team with the participation of experts, scientists, and experts from the leading agency.
Article 28. Responsibility for Proposing and Compiling Lists of Detailed Regulatory Documents
1. Ministries and ministerial-level agencies in charge of drafting regulatory legal documents with detailed provisions assigned have the responsibility to:
a) Propose detailed regulations for laws, resolutions of the National Assembly, ordinances, resolutions of the Standing Committee of the National Assembly, decrees, and decisions of the President, specifying the name of the detailed regulation, the articles, clauses, and points assigned for detailed provisions; propose the name of the detailed regulation, the leading agency, the coordinating agency, and the deadline for submission for promulgation;
b) Collect contents of laws, resolutions of the National Assembly, ordinances, resolutions of the Standing Committee of the National Assembly, decrees, and decisions of the President assigned to localities for detailed provisions;
c) Within twenty days from the date of passage of the law, resolution of the National Assembly, ordinance, or resolution of the Standing Committee of the National Assembly, and within ten days from the date of signing and promulgation of the decree or decision of the President, ministries and ministerial-level agencies send lists of detailed regulatory documents as specified in point a and b, Clause 1 of this Article to the Ministry of Justice.
2. The Ministry of Justice shall be responsible for:
a) Receive and compile proposals to compile lists of detailed regulatory documents as specified in point a and b, Clause 1 of this Article; seek opinions from ministries and ministerial-level agencies proposed to draft;
b) Lead and coordinate with the Government Office to compile and submit to the Prime Minister for consideration and decision on lists of detailed regulatory documents implementing laws, resolutions of the National Assembly, ordinances, resolutions of the Standing Committee of the National Assembly, decrees, and decisions of the President as stipulated in Clause 2, Article 82 of the Law;
c) Notify in writing the People's Councils and People's Committees of provinces and centrally-administered cities about the list of contents assigned to localities for detailed provisions as specified in point b, Clause 1 of this Article.
3. Provincial Departments of Justice are responsible for:
a) Leading and coordinating with the People's Council Office at the provincial level and relevant agencies and organizations to compile and submit to the People's Committee at the provincial level for consideration and decision to submit to the Standing Committee of the People's Council for decision on lists of detailed resolutions of the People's Council at the provincial level implementing laws, resolutions of the National Assembly, ordinances, resolutions of the Standing Committee of the National Assembly, decrees, and decisions of the President;
b) Leading and coordinating with the People's Committee Office at the provincial level and relevant agencies and organizations to compile and submit to the Chairman of the People's Committee at the provincial level lists of decisions of the People's Committee implementing laws, resolutions of the National Assembly, ordinances, resolutions of the Standing Committee of the National Assembly, decrees, and decisions of the President.
Article 29. Responsibilities for drafting, monitoring, and urging the drafting of detailed regulatory documents
1. Responsibilities of the leading agency drafting detailed regulatory documents:
a) Ensuring the quality, progress, and deadline for submitting detailed regulatory documents according to the decision on the list of detailed regulatory documents issued by the Prime Minister, the Chairman of the People's Committee at provincial level, and the Standing Committee of the Provincial People's Council;
b) By the 23rd day of each month at the latest, updating electronic information or sending information about the situation regarding the drafting and issuance of detailed regulatory documents implementing laws, resolutions of the National Assembly, ordinances, resolutions of the Standing Committee of the National Assembly, decrees, and decisions of the President of the State to the Legal Department of the Ministry of Justice for monitoring and summarizing. By the 25th day of each month at the latest, the Legal Department of the Ministry of Justice updates electronic information or sends information to the Ministry of Justice;
c) In cases where it is proposed to adjust the time for submitting detailed regulatory documents implementing laws, resolutions of the National Assembly, ordinances, resolutions of the Standing Committee of the National Assembly, decrees, and decisions of the President of the State, the leading agency must submit a proposal letter clearly stating the reasons, solutions, implementation deadlines, and send it to the Ministry of Justice or the Department of Justice for consolidation and reporting to the Prime Minister or the Chairman of the People's Committee at provincial level for consideration and decision.
2. Responsibilities of the Ministry of Justice:
a) Monitoring, urging, and inspecting the drafting of detailed regulatory documents implementing laws, resolutions of the National Assembly, ordinances, resolutions of the Standing Committee of the National Assembly, decrees, and decisions of the President of the State to ensure the progress and quality of the draft detailed regulatory documents;
b) Annually, reporting to the Prime Minister on the situation, progress, and issues arising during the drafting of detailed regulatory documents.
3. Responsibilities of the Department of Justice:
a) Monitoring, urging, and inspecting the drafting of detailed regulatory documents implementing laws, resolutions of the National Assembly, ordinances, resolutions of the Standing Committee of the National Assembly, decrees, and decisions of the President of the State at the local level to ensure the progress and quality of the draft detailed regulatory documents;
b) Annually, reporting to the Chairman of the People's Committee at provincial level and the Ministry of Justice on the situation, progress, and issues arising during the drafting of detailed regulatory documents.
Article 30. Responsibilities for drafting, monitoring, and urging the issuance of Government Decrees that are amended, supplemented, newly issued, replaced, or abolished
1. Ministries and equivalent agencies, based on the results of reviews and management requirements, propose amendments, supplements, new issuances, replacements, or abolitions of Government Decrees and are responsible for submitting the proposal files to the Ministry of Justice for review in accordance with Chapter II of this Decree.
2. After the Government approves the proposal to draft a decree, the Government Office is responsible for consolidating it into the Government's work program; monitoring and urging the drafting and submission of the decree as stipulated in Clause 1 of Article 30 of this Decree.
Article 31. Impact Assessment of Policies in Draft Regulatory Legal Documents
1. During the drafting, reviewing, examining, and providing opinions on draft laws, resolutions of the National Assembly, ordinances, resolutions of the Standing Committee of the National Assembly, and Government Decrees stipulated in Clauses 2 and 3 of Article 19 of the Law, if new policies are proposed, the agency, organization, or individual proposing the policy must prepare an impact assessment report on the new policy. Within ten days from the date of proposing the new policy, the agency or organization proposing the new policy is responsible for preparing an impact assessment report on the new policy.
The impact assessment report on the new policy is prepared in accordance with Articles 5, 6, 7, point a of Clause 1 of Article 8, and Article 9 of this Decree and included in the project file for laws, ordinances, draft resolutions, and decrees.
For documents submitted by the Government, the leading agency drafting the document is responsible for reporting to the Government on the main content of the new policy (if any); for documents not submitted by the Government, the Ministry of Justice is responsible for coordinating with the examination agency to promptly report to the Government on the main content of the new policy (if any).
2. When drafting decisions of the Prime Minister, circulars of ministers, heads of equivalent agencies stipulated in Clause 2 of Article 24 of the Law, the leading agency drafting the document must prepare an impact assessment report on the new policy (if any) before drafting the document.
The impact assessment report on the new policy is prepared in accordance with Articles 5, 6, 7, point a of Clause 1 of Article 8, and Article 9 of this Decree.
3. In cases where new policies arise during the drafting of detailed regulatory documents implementing laws, resolutions of the National Assembly, ordinances, resolutions of the Standing Committee of the National Assembly, decrees, and decisions of the President of the State stipulated in Clause 1 of Article 19 of the Law; decisions of the People's Committee at provincial level detailing the documents of higher-level state agencies stipulated in point c of Clause 2 of Article 128 of the Law, the leading agency drafting the document is responsible for assessing the impact of the new policy in accordance with the Law and this Decree before drafting the document.
Article 32. Participation of organizations and individuals in the process of drafting regulatory legal documents
During the drafting process of draft projects and draft documents, the leading agency may mobilize the participation of research institutes, universities, associations, unions, other related organizations, or experts and scientists in the following activities:
1. Evaluating the impact of policies in draft projects and draft documents;
2. Drafting documents and other activities at the request of the leading agency.
Article 33. Handling of draft project and draft document files at the Government Office and People's Committee Office of provincial level
1. Handling of draft project and draft document files at the Government Office:
a) The Government Office receives and checks the draft project and draft document files. In case the draft project and draft document files are incomplete, within the latest three working days from the date of receiving the files, the Government Office shall issue a document requesting the leading agency to supplement and complete the files;
b) Within the latest five working days from the date of receiving all draft project and draft document files, the Government Office shall submit them to the Prime Minister for consideration and decision to be put on the agenda of the Government meeting.
In cases stipulated in Articles 60, 94, and Clause 1 of Article 100 of the Law, within the latest seven days from the date the Government Office receives all files, the Minister, Head of the Government Office shall organize a meeting between relevant agencies. Within the latest seven days from the date of the meeting, the leading agency shall coordinate with relevant agencies to continue revising and completing the draft project and draft document to be submitted to the Government.
2. Handling of draft regulatory legal document files at the People's Committee Office of provincial level:
a) The People's Committee Office of provincial level receives and checks the draft document files. In case the draft document files are incomplete, within the latest three working days from the date of receiving the files, the People's Committee Office of provincial level shall issue a document requesting the leading agency to supplement and complete the files;
b) Within the latest five working days from the date of receiving all draft document files, the People's Committee Office of provincial level shall submit them to the Chairman of the People's Committee of provincial level for consideration and decision to be put on the agenda of the People's Committee meeting.
Article 34. Revision of draft projects and draft documents after the Government's comments
1. The leading agency shall take the lead and cooperate with the Ministry of Justice, the Government Office, and relevant agencies to incorporate the Government's comments, revise, and finalize the draft projects and draft documents.
2. The Minister, Head of a ministerial-level agency acting on behalf of the Prime Minister, shall sign the report to the National Assembly for draft laws and resolutions; the report to the Standing Committee of the National Assembly for draft ordinances and resolutions; submit to the Prime Minister for issuance of decrees after the Government's approval.
Article 35. Preparation of the Government's opinion on draft laws, ordinances, and draft resolutions not submitted by the Government
1. Within the latest three working days from the date of receipt of draft projects and draft documents not submitted by the Government, the Government Office shall be responsible for reporting and proposing the Prime Minister to assign a ministry or ministerial-level agency to take the lead and cooperate with the Ministry of Justice in preparing the Government's opinion. The leading agency shall send the draft project and draft document files to related ministries and ministerial-level agencies for their opinions.
2. Within the latest five working days from the date of receipt of the files, the ministries and ministerial-level agencies shall be responsible for sending documents participating in the opinions on the contents of the draft projects and draft documents to the ministries and ministerial-level agencies assigned by the Prime Minister to prepare the opinions.
3. In necessary cases or upon the proposal of the leading agency preparing the opinions, the Prime Minister shall decide to discuss the draft projects and draft documents at a Government meeting.
4. Based on the documents participating in the opinions of the ministries and ministerial-level agencies, the opinions of Government members, the Minister, Head of a ministerial-level agency assigned by the Prime Minister to prepare the opinions shall take the lead and cooperate with the Government Office and the Ministry of Justice to compile and finalize the document participating in the Government's opinion; acting on behalf of the Prime Minister, representing the Government, sign the document and send it to the agency or organization in charge of drafting.
Article 36. Drafting and Issuing a Legal Document to Amend, Supplement, Replace, or Repeal Multiple Legal Documents
1. Ministries and ministerial-level agencies shall issue or propose competent authorities to issue a legal document to amend, supplement, replace, or repeal contents within multiple legal documents issued by the same agency in the following cases:
a) When it is necessary to perfect laws to promptly implement international treaties to which the Socialist Republic of Vietnam is a party;
b) When it is necessary to amend, supplement, replace, or repeal simultaneously multiple documents where the amended, supplemented, replaced, or repealed contents belong to the same field or are closely related to ensure consistency and uniformity with newly issued documents;
c) In the proposal for issuance, there are contents related to one or more other documents issued by the same agency, and the proposed document contains provisions different from those documents;
d) To implement a simplified administrative procedure plan approved by competent authorities.
2. Agencies, organizations, or individuals with authority proposing People's Councils or People's Committees to issue legal documents shall propose People's Councils or People's Committees at the same level to issue a legal document to amend, supplement, replace, or repeal contents within multiple legal documents issued by the same agency in the cases stipulated in Clause 1 of this Article.
Article 37. Proposing and Issuing Legal Documents According to Simplified Procedures
1. The Prime Minister shall decide on his own or upon the proposal of a Minister or head of a ministerial-level agency to apply simplified procedures according to the provisions of Article 146 and Clause 3 of Article 147 of the Law.
2. The Standing Committee of the Provincial People's Council shall decide on its own or upon the proposal of the Provincial People's Committee to apply simplified procedures in drafting and issuing resolutions of the Provincial People's Council according to the provisions of Article 146 and Clause 4 of Article 147 of the Law.
3. The Chairman of the Provincial People's Committee shall decide on his own or upon the proposal of a specialized agency under the Provincial People's Committee or the Chairman of the District People's Committee to apply simplified procedures in drafting and issuing decisions of the Provincial People's Committee according to the provisions of Article 146 and Clause 4 of Article 147 of the Law.
4. The content of the proposal according to Clauses 1, 2, and 3 of this Article must clearly state the basis for applying simplified procedures, the name of the document, the necessity of issuing the document; the subject and scope regulated by the document; the main content of the document; the anticipated lead agency responsible for drafting the document and the time for submitting the document.
Article 38. Determining the Effectiveness of Legal Documents
1. Determining the effectiveness of legal documents when issuing:
The effective date of a legal document must be specifically stated in the legal document according to the provisions of Articles 151 and 152 of the Law. The lead agency responsible for drafting must propose a specific effective date for the legal document in the draft legal document based on ensuring sufficient time for agencies, organizations, and individuals to access the document, and for enforcement subjects to prepare for implementation of the document.
2. Determining the expiration of a detailed implementing regulation:
a) When a legal document expires, the detailed implementing regulations for the articles, clauses, and points delegated to provide detailed implementation of that document also expire simultaneously;
b) If only part of a detailed implementing regulation expires, the contents of the expired portion will expire simultaneously with the part of the document it implements. If it is not possible to determine the expired contents of the detailed implementing regulation, the entire regulation will expire;
c) If a detailed implementing regulation covers multiple legal documents, and only some of these documents expire, the contents of the detailed implementing regulation corresponding to the expired documents will expire simultaneously. If it is not possible to determine the expired contents of the detailed implementing regulation, the entire regulation will expire.
3. Ministries and ministerial-level agencies responsible for drafting legal documents that expire according to Clause 4 of Article 154 of the Law shall:
a) Establish and publish, or submit to competent authorities for publication, a list of detailed implementing regulations that expire simultaneously with the document they implement according to Clause 2 of this Article before the expiration date of the document;
b) Issue, or propose competent authorities to issue a document to replace the detailed implementing regulation that expires entirely according to Points b and c of Clause 2 of this Article.
4. Agencies that have issued detailed implementing regulations that expire shall:
a) Publish a list of detailed implementing regulations that expire according to Clause 4 of Article 154 of the Law before the expiration date of these regulations;
b) Provide for the abolition of detailed implementing regulations that expire in the enforcement clause of the legal document amending, supplementing, or replacing the detailed implementing regulation.
5. People's Committees at all levels shall:
a) Establish and publish, or submit to the Standing Committee of the People's Council at the same level for publication, a list of detailed implementing regulations that expire entirely or partially according to Clause 2 of this Article, which they have issued and the People's Council at the same level has issued, before the expiration date of the document they implement;
b) Issue, or propose the People's Council at the same level to issue a document to replace the detailed implementing regulation that expires entirely according to Points b and c of Clause 2 of this Article.
Article 39. Numbering the draft regulatory legal documents;
1. The leading agency responsible for drafting shall be responsible for numbering the draft regulatory legal documents to facilitate monitoring and participation in providing opinions on the draft.
2. The process of numbering the draft regulatory legal documents shall be carried out as follows:
a) Draft 1 is the draft submitted by the drafting unit to the head of the leading agency for drafting;
b) Draft 2 is the draft decided by the head of the leading agency for drafting to send and publish on the Government's electronic portal or the leading agency's electronic portal, or the provincial/municipal electronic portal, for agencies, organizations, and individuals to provide opinions;
c) Draft 3 is the draft sent to the reviewing agency after incorporating opinions from agencies, organizations, and individuals;
d) Draft 4 is the draft that has incorporated review opinions and is submitted to the Government for consideration and decision on submitting to the National Assembly for laws and draft resolutions of the National Assembly; to the Standing Committee of the National Assembly for ordinances and draft resolutions of the Standing Committee of the National Assembly; to the Government for consideration and approval for draft decrees; to the Prime Minister for consideration and issuance for draft decisions; to the Minister or head of an equivalent agency for consideration and issuance for draft circulars and joint circulars; to the People's Council at the provincial level for consideration and decision on submitting to the People's Council for resolutions of the People's Council; to the People's Committee for consideration and issuance of decisions;
đ) Draft 5 is the draft revised technically after incorporating opinions from the Government before the Prime Minister signs on behalf of the Government or delegates signing to submit to the National Assembly for laws and draft resolutions of the National Assembly; to the Standing Committee of the National Assembly for ordinances and draft resolutions of the Standing Committee of the National Assembly; before the Prime Minister signs to issue decrees; after incorporating opinions from the Prime Minister for draft decisions of the Prime Minister; opinions from the Minister or head of an equivalent agency before signing to issue circulars and joint circulars; provincial-level People's Council resolutions, provincial-level People's Committee decisions.
Section 2
REVIEW OF LEGISLATIVE PROJECTS AND DRAFT REGULATORY LEGAL DOCUMENTS
Subsection 1
REVIEW OF LEGISLATIVE PROJECTS AND DRAFTS
REGULATORY LEGAL DOCUMENTS CONDUCTED BY THE MINISTRY OF JUSTICE
Article 40. Responsibilities of the Ministry of Justice
1. Organizing reviews of legislative projects and drafts within the prescribed time frame and ensuring quality.
2. Organizing research on related contents.
3. Organizing advisory review meetings and establishing a Review Board.
4. Proposing relevant ministries, equivalent agencies, and government agencies to send representatives to cooperate in the review.
5. Ensuring the participation of related agencies, organizations, experts, and scientists.
Article 41. Responsibilities of the leading ministry or equivalent agency in drafting
1. Submitting project files and draft documents to the Ministry of Justice as prescribed.
2. Providing information and materials related to the request of the Ministry of Justice.
3. Sending representatives to participate in the Review Board as requested by the Ministry of Justice.
4. Cooperating with the Ministry of Justice and the Government Office to study, incorporate, and revise project and draft documents based on review opinions to submit to the Government and the Prime Minister.
Article 42. Receiving and Examining Drafts for Review
1. The Ministry of Justice shall be responsible for receiving and examining drafts submitted for review.
In cases where the project or draft submitted for review does not meet the requirements stipulated in Clause 2 of Article 58, Clause 2 of Article 92, Clause 2 of Article 98, and Clause 4 of Article 109 of the Law, the Ministry of Justice shall propose to the drafting agency to supplement the dossier within the latest two working days from the date of receipt of the dossier.
2. The drafting agency shall be responsible for supplementing the dossier within the latest seven days from the date of receipt of the proposal. The date of review shall be calculated from the date when the Ministry of Justice receives all necessary documents.
Article 43. Establishing the Review Board
1. The Minister of Justice shall establish the Review Board in cases prescribed in Clause 1 of Article 58, Clause 1 of Article 92, and Clause 1 of Article 98 of the Law.
2. The Review Board shall consist of the Chairperson, Secretary, and other members who are representatives of the Ministry of Justice, the Government Office, relevant agencies and organizations, and experts and scientists.
The total number of members of the Review Board shall be decided by the Minister of Justice. In cases where the project or draft is prepared by the Ministry of Justice or involves complex content related to multiple sectors and fields, the representatives of the Ministry of Justice shall not exceed one-third of the total number of members.
3. The Review Board shall operate on the principle of collective discussion and majority decision-making. The Review Board shall cease its activities and dissolve itself upon completion of its tasks.
4. In cases where the Review Board is not established, the Ministry of Justice may organize a consultation meeting with the participation of representatives of the drafting agency, relevant units under the Ministry of Justice, representatives of relevant agencies and organizations, and experts and scientists.
Article 44. Meetings of the Review Board
1. The Chairperson of the Review Board shall be responsible for organizing meetings of the Review Board. A meeting can only be held if at least two-thirds of the total number of members are present. In cases where a member cannot attend the meeting, they must submit their opinions in writing to the Chairperson.
2. Meeting materials of the Review Board must be sent to the members by the Ministry of Justice at the latest five working days before the meeting is organized.
Article 45. Review Report
1. The review report shall be based on research and the results of the review meeting regarding the project or draft of regulatory legal documents.
2. In cases where the Ministry of Justice concludes that the project or draft does not meet the conditions to be submitted to the Government, the reasons must be clearly stated in the review report.
Subsection 2
REVIEW OF THE CIRCULAR DRAFT
TO BE IMPLEMENTED BY THE LEGAL SYSTEM ORGANIZATION
Article 46. Responsibilities of Legal System Organizations under Ministries and Equivalent Agencies
1. To conduct reviews of draft circulars within the deadline and ensure quality.
2. Organizing research on related contents.
3. To request the main drafting unit to provide relevant information and materials.
4. To request the Minister or Head of an equivalent agency to assign other units to cooperate in the review or to establish a consultation review board.
Article 47. Responsibilities of Units under Ministries and Equivalent Agencies
1. The main drafting unit under ministries and equivalent agencies shall be responsible for:
a) Submitting the draft dossier to the legal system organization of the ministry or equivalent agency; providing relevant information and materials related to the draft upon request of the legal system organization;
b) Studying, adopting, and revising the draft based on the review comments; reporting to the Minister or Head of the equivalent agency, and simultaneously sending the explanation to the legal system organization.
2. Units under ministries and equivalent agencies within their functions, duties, and authorities shall be responsible for:
a) Appointing representatives to participate in the review upon the request of the legal system organization;
b) Providing relevant information and materials related to the review upon the request of the legal system organization.
Article 48. Review of draft circulars
1. The Minister, Head of a ministerial-level agency shall establish an Advisory Council for reviewing draft circulars as stipulated in Clause 1 of Article 102 of the Law. The Advisory Council for reviewing consists of the Chairperson, Secretary, and members who are representatives of relevant agencies and organizations, experts, and scientists.
The total number of members of the Advisory Council for reviewing is decided by the Minister, Head of a ministerial-level agency, wherein the representative of the legal institution does not exceed 1/3 of the total number of members.
2. The Advisory Council for reviewing ceases operations and dissolves itself upon completion of its tasks.
3. Meeting materials of the Advisory Council for reviewing must be sent to the members of the Council by the leading unit for review at least three working days before the meeting date.
4. Based on research and the results of the review meeting on the draft circular, the leading legal institution for review is responsible for completing the review report and sending it to the leading unit for drafting the circular.
Subsection 3
REVIEW OF DRAFTS
LEGAL REGULATORY DOCUMENTS IMPLEMENTED BY THE DEPARTMENT OF JUSTICE
Article 49. Responsibilities of the Department of Justice
1. To conduct reviews of draft circulars within the deadline and ensure quality.
2. Organizing research on related contents.
3. Organize advisory meetings, establish an Advisory Council for reviewing.
4. Participate in activities of the leading agency in the process of drafting legal documents.
5. Propose relevant departments, provincial committees to send representatives to cooperate in the review.
6. Ensure the participation of relevant agencies, organizations, related experts, and scientists.
Article 50. Establishment and operation of the Advisory Council for reviewing
1. The Director of the Department of Justice is responsible for establishing the Advisory Council for reviewing in accordance with Clause 1 of Article 121 of the Law. The Council includes the Chairperson being the leadership of the Department of Justice, the Secretary being a representative of the Department of Justice, and members who are representatives of specialized agencies of the People's Committee, other relevant agencies and organizations, experts, and scientists.
2. The total number of members of the Council is decided by the Director of the Department of Justice. In cases where the review involves complex content, multiple sectors, or fields, or when the Department of Justice leads the drafting, the representative of the Department of Justice does not exceed 1/3 of the total number of members of the Council.
3. The Advisory Council for reviewing ceases operations and dissolves itself upon completion of its tasks.
Article 51. Meetings of the Advisory Council for reviewing
1. A meeting can only be held if at least 2/3 of the total number of members are present. In case a member cannot attend the meeting of the Council, they must send their opinions to the Chairperson of the Council in writing.
2. Meeting materials must be sent by the Department of Justice to the members of the Council at least three working days before the meeting date.
3. The meeting of the Advisory Council for reviewing is conducted in the following sequence:
a) A representative of the leading agency for drafting presents the main contents of the draft document;
b) Members of the Council discuss the content of the review according to Clause 3 of Article 121 of the Law and other issues related to the content of the draft document. Before members of the Council discuss, the Council Secretary reads the comments of absent members;
c) A representative of the leading agency for drafting explains issues related to the content of the draft according to the request of the Council members;
d) The Chairperson of the Council concludes and clearly states whether the draft meets the conditions or not to be submitted to the Provincial People's Committee.
4. The Council Secretary is responsible for recording the minutes of the Council meeting and submitting them to the Chairperson of the Council for signature.
Article 52. Report on Review
1. The report on review shall be prepared based on research and the results of the review meeting regarding the draft regulatory legal document.
2. In case the Department of Justice concludes that the draft does not meet the conditions to be submitted to the Provincial People's Council, the reasons must be clearly stated in the report on review.
Subsection 4
REVIEWING DRAFT REGULATORY LEGAL DOCUMENTS
THE DEPARTMENT OF JUSTICE SHALL IMPLEMENT
Article 53. Responsibilities of the Department of Justice
1. To conduct reviews of draft circulars within the deadline and ensure quality.
2. Organizing research on related contents.
3. Participate in activities of the main drafting agency during the drafting process of the document.
4. Request relevant agencies under the District People's Committee, departments, and sectors of the district to provide opinions on the draft before conducting the review.
Article 54. Organization of Review for Draft Resolutions of the People's Council at the District Level and Decisions of the People's Committee at the District Level
1. The Head of the Department of Justice shall be responsible for organizing the review of draft resolutions of the People's Council at the district level and decisions of the People's Committee at the district level.
2. For draft documents with complex contents related to many fields, prior to conducting the review, the Department of Justice may organize a meeting to gather opinions from relevant agencies, departments, experts, and scientists.
3. Based on research and the results of the review meeting on the draft, the Department of Justice shall complete the report on review and submit it to the main drafting agency. If the Department of Justice concludes that the draft does not meet the conditions for submission as stipulated in Clause 2, Article 134 and Clause 3, Article 139 of the Law, the reasons must be clearly stated in the report on review.
Chapter V
FORM AND TECHNIQUE OF PRESENTATION
REGULATORY LEGAL DOCUMENT
Section 1
FORM OF REGULATORY LEGAL DOCUMENT
Subsection 1
PRESENTATION OF THE INTRODUCTORY PART
Article 55. The Introductory Part of the Document
1. The introductory part of the document includes: National Emblem, Motto, name of the issuing agency, number, code of the document, place name, date of issuance, name of the document, and basis for issuing the document.
2. For documents issued together with another document, the introductory part of the accompanying document includes: National Emblem, Motto, name of the issuing agency, and name of the document. Below the name of the accompanying document, the name, number, code, and date of issuance of the accompanying document must be clearly stated.
Article 56. National Emblem and Motto
1. The National Emblem is: "SOCIALIST REPUBLIC OF VIETNAM". The National Emblem shall be presented in uppercase letters, font size from 12 to 13, upright bold typeface, and positioned at the top right corner of the first page of the document.
2. The Motto is: "INDEPENDENCE - FREEDOM - HAPPINESS". The Motto shall be presented in lowercase letters, font size from 13 to 14, upright bold typeface, immediately below the National Emblem; the first letter of each phrase shall be capitalized, hyphens (-) shall separate phrases, and there shall be a solid underline beneath the Motto, the length of which equals the width of the line.
Article 57. Name of the Issuing Agency of the Document
1. The name of the issuing agency of the document is the name of the agency or the official title of the person authorized to issue the document according to the provisions of the law. The name of the issuing agency must be the official name and must be fully recorded.
2. The name of the issuing agency shall be presented in uppercase letters, upright bold typeface, font size 13, with a solid underline beneath, the length of which is from one-third to one-half the width of the line, centered and balanced relative to the line.
Article 58. Number and Symbol of Legal Documents
1. The number and symbol of legal documents include: serial number, year of issuance, type of document, issuing authority.
2. The number of legal documents shall be recorded using Arabic numerals, consisting of the registration serial number assigned for each type of document issued by the issuing authority within a year and the year of issuance; it starts continuously from number 01 on January 1st and ends on December 31st of each year; the year of issuance must be fully recorded with all digits.
3. The symbol of legal documents includes abbreviations of the type of document and abbreviations of the name of the issuing authority or the state position of the person authorized to issue the document.
Abbreviations of the name of the issuing authority must be clearly defined, concise, easy to understand, and comply with regulations.
4. The presentation of the number and symbol of legal documents is as follows:
a) The number and symbol of legal documents are arranged in the following order: serial number of the document/year of issuance/abbreviation of the type of document-abbreviation of the issuing authority or state position of the person authorized to issue the document, this sequence is written together without spacing between characters;
b) The number and symbol of legal documents are centered below the name of the issuing agency or organization;
c) The word "Number" is presented in lowercase letters, font size 13, upright style; after the word "Number" there is a colon (:); for numbers less than 10, a leading zero must be added;
d) The symbol of legal documents is presented in uppercase letters, font size 13, upright style;
đ) Between the number, year of issuance, and the symbol of the document, there is a forward slash (/); between groups of abbreviations in the document symbol, there is a hyphen (-), without spacing between characters.
Article 59. Place Name and Date of Issuance of Legal Documents
1. The place name recorded on legal documents issued by central government agencies is the official name of the province or centrally-administered city where the issuing agency's headquarters is located. The place name recorded on legal documents issued by local government agencies is the official name of the administrative unit of that issuing agency.
For administrative units named after people, using numbers, or historical events, the full name of the administrative unit must be recorded.
2. The date of issuance of legal documents is the date when the document was passed or signed for issuance. The date of issuance of legal documents must be fully written; the numbers representing day, month, and year use Arabic numerals; for numbers representing days less than 10 and months 1, 2, a leading zero must be added.
3. The place name and date of issuance of legal documents are presented on the same line with the number and symbol of the document, in lowercase letters, font size from 13 to 14, italic style; the first letter of each word in the place name must be capitalized; after the place name, there is a comma (,); the place name and date are centered below, balanced with the National Emblem and Motto.
Article 60. Title of Legal Documents
1. The title of legal documents consists of the type name and the document name. The type name of legal documents is the name of each type of document according to the Law. The document name is a short sentence or phrase reflecting the main content of the document.
2. The presentation of the title of legal documents is as follows:
a) The type name of legal documents in uppercase letters, font size 14, upright style, bold; placed centered horizontally across the document;
b) The document name in lowercase letters, font size 14, upright style, bold placed centered directly under the type name;
c) For documents issued along with other documents, the explanatory note about the accompanying document is placed in parentheses, italic style, font size 14, centered directly under the document name.
Article 61. Basis for issuing a document
1. The basis for issuing a document is a legal normative document with higher legal validity that is currently in effect or has been published or signed but not yet effective but must be effective before or at the same time as the issued document. The basis for issuing a document includes legal normative documents stipulating the authority and functions of the agency issuing the document and legal normative documents with higher legal validity stipulating the content and grounds for issuing the document.
2. If a legal normative document with higher legal validity contains provisions delegating detailed regulations, such detailed regulations must specifically state those articles and clauses in the basis for issuing the document.
In cases where a document provides detailed regulations on multiple articles and clauses or both provides detailed regulations on delegated articles and clauses and other contents, it is not necessarily required to specifically mention the delegated articles and clauses in the basis for issuing the document.
3. The basis for issuing a document is expressed in regular font, italic style, font size 14, presented under the name of the document; each basis must start on a new line, ending with a semicolon (;), the last line ends with a period (.).
Subsection 2
PRESENTATION OF THE CONTENTS OF THE DOCUMENT
Article 62. Structure of the document
1. Depending on the content, the document may be structured as follows:
a) Part, Chapter, Section, Subsection, Article, Clause, Point;
b) Part, Chapter, Section, Article, Clause, Point;
c) Chapter, Section, Subsection, Article, Clause, Point;
d) Chapter, Section, Article, Clause, Point;
đ) Chapter, Article, Clause, Point;
e) Article, Clause, Point.
2. Each point in the structure of the document must express only one idea and must be presented in a complete sentence or paragraph, without using other symbols to express ideas within a point.
3. Parts, Chapters, Sections, Subsections, Articles in the document must have titles. The title is a phrase indicating the main content of the part, chapter, section, subsection, article.
4. The content of the document is presented in regular font, evenly aligned on both margins, upright style; font size from 13 to 14; when starting a new line, the first character indents from 1 cm to 1.27 cm; the space between paragraphs is set to a minimum of 6 pt; the line spacing is set to a minimum of single spacing or 15 pt or more.
5. In cases where the content of the document is structured according to parts, chapters, sections, subsections, articles, clauses, points, it is presented as follows:
a) The terms "Part" and "Chapter" along with their respective numbers are presented on a separate line, centered, in regular font, font size from 13 to 14, upright style, bold. The number of the part and chapter uses Roman numerals. The title of the part and chapter is presented immediately below, centered, in all capital letters, font size from 13 to 14, upright style, bold;
b) The terms "Section" and "Subsection" along with their respective numbers are presented on a separate line, centered, in regular font, font size from 13 to 14, upright style, bold. The number of the section uses Arabic numerals. The title of the section is presented immediately below, centered, in all capital letters, font size from 12 to 13, upright style, bold;
c) The term "Article", its number, and its title are presented in regular font, indented from the left margin from 1 cm to 1.27 cm, the number of the article uses Arabic numerals, followed by a period (.); font size is the same as the body text from 13 to 14, upright style, bold;
d) The numbers of clauses within each section use Arabic numerals, followed by a period (.), font size is the same as the body text from 13 to 14, upright style; if a clause has a title, the number and title of the clause are presented on a separate line, in regular font, font size is the same as the body text from 13 to 14, upright style;
đ) The sequence of points within each clause uses Vietnamese alphabetical letters in alphabetical order, followed by a closing parenthesis, in regular font, font size is the same as the body text from 13 to 14, upright style.
Article 63. Documents issued together with other documents
Documents issued together with other documents consist of two parts:
1. The part containing provisions on the issuance, implementation organization, and effectiveness of the document that is issued together with another document.
2. The part containing specific provisions of the document issued together. Depending on the content, this part may be structured according to Clause 1 of Article 62 of this Decree.
Subsection 3
PRESENTATION OF THE ENDING PART OF THE DOCUMENT
Article 64. Presentation of the ending part of the document
1. The ending part of the document includes: the position, name, and signature of the authorized person signing the document; the stamp of the issuing agency; the recipient of the document.
2. For documents issued together with other documents, the ending part of the document issued together includes: the position, name, and signature of the authorized person signing the document; the stamp of the issuing agency.
Article 65. Presentation of the signature of the document
1. For decrees of the Government, resolutions of the Supreme People's Court Council, decisions of provincial-level People's Committees, decisions of district-level People's Committees, and decisions of commune-level People's Committees, the Prime Minister signs on behalf of the Government, the President of the Supreme People's Court signs on behalf of the Supreme People's Court Council, and the Chairpersons of People's Committees at all levels sign and must write "TM." (on behalf) before "Government", "Supreme People's Court Council", and "People's Committee".
For joint resolutions between the Government and the Central Steering Committee of the Vietnam Fatherland Front, the Prime Minister signs on behalf of the Government, and the Chairman of the Central Steering Committee of the Vietnam Fatherland Front signs on behalf of the Central Steering Committee of the Vietnam Fatherland Front, and must write "TM." before "Government" and "Central Steering Committee of the Vietnam Fatherland Front".
For decisions of the Prime Minister, circulars of Ministers, Heads of equivalent ministries, circulars of the President of the Supreme People's Court, circulars of the Prosecutor General of the Supreme People's Procuracy, and decisions of the State Auditor General, the Prime Minister, Ministers, Heads of equivalent ministries, the President of the Supreme People's Court, the Prosecutor General of the Supreme People's Procuracy, and the State Auditor General sign.
For resolutions of provincial-level People's Councils, resolutions of district-level People's Councils, and resolutions of commune-level People's Councils, the Chairperson of the People's Council signs to certify.
For joint circulars between the President of the Supreme People's Court and the Prosecutor General of the Supreme People's Procuracy; joint circulars between Ministers, Heads of equivalent ministries and the President of the Supreme People's Court and the Prosecutor General of the Supreme People's Procuracy, the President of the Supreme People's Court, the Prosecutor General of the Supreme People's Procuracy, and Ministers, Heads of equivalent ministries sign.
In cases where a deputy signs instead of the authorized person, the abbreviation "KT." (substitute) must be written before the position of the authorized person signing the document.
2. The position and name of the person signing the document, or the person signing on behalf of the document, must be fully reflected in the document. For joint documents, the position and name of the agency of the person signing the document must be clearly stated.
3. The abbreviations "TM.", "KT." or "Q." (authority), authority and position of the signer are presented in uppercase letters, font size from 13 to 14, upright style, bold.
The name of the person signing the document is presented in lowercase letters, font size from 13 to 14, upright style, bold, centered and balanced relative to the authority and position of the signer.
Article 66. Seal of the Issuing Authority
1. The seal of the issuing authority shall only be affixed to the document after the authorized person has signed the document.
2. The process of affixing the seal on the document shall be carried out in accordance with the Government's regulations on archival work.
The model of the seal for classified documents (top secret, highly confidential, or confidential) shall be implemented in accordance with the laws on protecting state secrets.
Article 67. Recipients
1. Recipients of the document include: supervisory agencies, inspection agencies, issuing agencies, the Official Gazette, and other agencies and organizations, depending on the content of the document.
2. The phrase "Recipients" shall be presented on a separate line, aligned horizontally with the line containing the title and position of the signatory, close to the left margin, followed by a colon (:), in regular font, size 12, italic and bold.
The list of agencies, organizations, units, and individuals receiving the document shall be presented in regular font, size 11, upright style; each agency, organization, unit, or individual recipient or each group of recipients shall be presented on a separate line, with a dash at the beginning of the line close to the left margin, and a semicolon (;) at the end of the line; the last line shall include the word "File", followed by a colon (:), then the abbreviation "VT" (archive), a comma, the abbreviation of the drafting unit (or department) name enclosed in parentheses, the number of copies to be filed, followed by a period (.), the abbreviation of the drafter's name and the number of copies to be distributed, ending with a period (.).
Section 2
TECHNICAL PRESENTATION OF DOCUMENTS
Article 68. Layout of the Document Structure
1. The arrangement of provisions on the same issue within parts, chapters, sections, and sub-sections must ensure the following principles:
a) General provisions shall be presented before specific provisions;
b) Provisions on content shall be presented before procedural provisions;
c) Provisions on rights and obligations shall be presented before sanctions provisions;
d) General provisions shall be presented before special provisions;
e) General provisions shall be presented before exceptional provisions.
2. The layout of the document structure must ensure the following principle:
a) Part is the largest structure presented in the document, the contents of the parts in the document must be independent from each other;
b) Chapter is the second largest structure presented in the document, the chapters in the document must have relatively independent contents and systematic and logical interconnections;
c) Section is the third largest structure presented in the document, the division of sections according to relatively independent contents, systematic and logical interconnections. Sections can be used in chapters with multiple contents and articles;
d) Subsection is the fourth largest structure presented in the document, the division of subsections according to relatively independent contents, systematic and logical interconnections. Subsections can be used in chapters with multiple contents, sections, and articles;
e) Articles may be presented by clauses and points. The content of each article must be fully expressed, complete in meaning and sentence, grammatically correct;
f) Clauses are used when the content of an article contains relatively independent ideas, each clause must express a complete idea; each clause must be written as a complete sentence;
g) Points are used when the content of a clause contains different ideas.
Article 69. Language Use in Documents
1. The language used in documents shall be standard Vietnamese, accurate and commonly used.
2. Local dialects, archaic terms, and colloquialisms shall not be used. Foreign terms may only be used when there are no corresponding Vietnamese terms to replace them. Commonly used foreign terms may be directly employed if they need to be transliterated into Vietnamese.
3. Documents must use written language, with expressions being clear, simple, and easily understandable. Specialized terms within the document that require clarification of their content must be explained.
4. Abbreviations may only be used when necessary and must be defined at their first appearance in the document.
For documents containing numerous abbreviations, a separate article should be established to explain all abbreviations in the document.
5. Terms used in documents must accurately convey the intended content without generating multiple interpretations; where terms can be understood in multiple ways, they must be explained according to the meaning used in the document.
Questioning terms and rhetorical devices shall not be used in documents.
6. Terms must be consistently used throughout the document.
Article 70. Presentation of Numbers and Units of Measurement in Documents
1. Numbers in documents must be presented using Arabic numerals and annotated with words immediately following the number, except for cases specified in Clause 2 of this Article.
2. Numbers at the beginning and end of documents; numbers indicating lengths of time periods, numbers indicating time points, and numbers indicating quantities of units of measurement shall be presented using Arabic numerals.
3. The names, symbols, and methods of presenting units of measurement shall be carried out in accordance with legal provisions on measurement.
4. Symbols and formulas in documents must be used with accompanying explanations.
Article 71. Presentation of Time Periods and Time Points
1. When time periods are determined by seconds, minutes, hours, days, weeks, months, quarters, or years, the time period shall be presented using the length of the time period and the unit of time.
2. When time points are determined by seconds, minutes, hours, days, weeks, months, quarters, or years, the time point shall be presented using the time point number and the unit of time.
3. Units of time for time periods and time points shall be expressed in words and placed immediately after the number indicating the length of the time period or the time point.
Article 72. Presentation of Amending and Supplementing Provisions in Chapters or Articles on Implementation Clauses
1. In cases where issued documents contain amending and supplementing provisions for parts, chapters, sections, sub-sections, articles, clauses, points, or phrases of other documents, these contents shall be presented in chapters or articles on implementation clauses. Amending and supplementing provisions may be structured into articles, clauses, or points depending on the scope and degree of amendment and supplementation.
2. In amending and supplementing provisions, the parts, chapters, sections, sub-sections, articles, clauses, or points of the amended and supplemented documents must be clearly identified.
Article 73. Presentation of Transitional Provisions
Transitional provisions shall be established as a separate article at the end of the document, named "Transitional Provisions" or as a separate clause in the relevant articles requiring transitional provisions, or as a separate clause in the article on the effective date.
Article 74. Presentation of provisions on effectiveness
1. The effectiveness of a document must be specifically determined with the specific date, month, and year when the document takes effect.
2. The name of the document, part, chapter, section, sub-section, article, clause, point of the replaced or revoked document must be listed specifically in the article stipulating the effectiveness of the document. In cases where there are multiple documents, articles, clauses, points to be replaced or revoked, a list may be attached.
Article 75. Techniques for Citing Documents
1. When citing related documents, the full name of the type of document, number, and document code; the date, month, and year of approval or issuance of the document; the name of the authority or person authorized to issue the document and the name of the document must be recorded.
2. In cases where parts, chapters, sections, sub-sections of a legal document are cited, the specific parts, chapters, sections, sub-sections of that document must be identified.
3. In cases where articles, clauses, points are cited, it is not necessary to specify the layout unit containing those articles, clauses, points.
4. In cases where parts, chapters, sections, sub-sections, articles, clauses, points of a document are cited, they must be cited in ascending order from smaller to larger units and the name of the document; if citing from one clause, point to another clause, point within the same article or from one section, article to another section, article within the same chapter of the same document, then the name of the document does not need to be specified but must be cited specifically.
Article 76. Paper Size, Margins, Font, and Page Numbering of Documents
The paper size and margins of the document shall be implemented according to Appendix II attached to this Decree.
The font used to present the document is the Vietnamese font of the Unicode character set according to the Vietnamese standard TCVN 6909:2001.
Pages of the document are numbered sequentially using Arabic numerals, font size from 13 to 14, upright style, without numbering the first page, placed centered horizontally in the top margin of the document. Pages of appendices are numbered separately for each appendix.
Section 3
PRESENTATION OF AMENDING AND SUPPLEMENTARY DOCUMENTS
Subsection 1
PRESENTATION OF AMENDING AND SUPPLEMENTARY DOCUMENTS FOR SOME ARTICLES
Article 77. Amending and Supplementing Documents for Some Articles
1. An amending and supplementing document for some articles is a document that amends, supplements, replaces, or revokes one or several provisions of the current document. An amending and supplementing document for some articles must clearly specify the chapters, sections, sub-sections, articles, clauses, points being amended, supplemented, replaced, or revoked.
2. The name of the amending and supplementing document for some articles includes: the name of the type of document accompanied by the phrase "amending and supplementing some articles of" and the full name of the document being amended and supplemented.
Article 78. Layout of Amending and Supplementing Documents for Some Articles
1. The content of an amending and supplementing document for some articles of a document may be arranged into four articles: Article 1 stipulates the content of amendment and supplementation; Article 2 stipulates the abolition or change of wording related to many articles and clauses in the amended and supplemented document; Article 3 stipulates the responsibility for organizing implementation (if any); and Article 4 stipulates the effective date of the document.
2. Clauses stipulating the content of amendment, supplementation, replacement, and abolition are arranged in sequence corresponding to the order of articles, clauses, and points of the amended and supplemented document.
Article 79. The numbering sequence of supplementary Articles and Clauses and the order of Articles and Clauses in amended and supplemented documents
1. The numbering sequence of supplementary Articles and Clauses shall be carried out as follows:
a) Determining the position of supplementary Articles and Clauses within the amended and supplemented document based on the content of the supplementation;
b) Numbering supplementary Articles and Clauses by adding letters from the Vietnamese alphabet after the number of the preceding Article or Clause;
c) The numbering sequence of supplementary Chapters, Sections, Subsections, Articles, and Clauses shall include a numerical part and a letter part. The numerical part reflects the sequence of Chapters, Sections, Subsections, Articles, and Clauses in the amended and supplemented document. The letter part is arranged according to the alphabetical order of the Vietnamese alphabet.
The numbering sequence of supplementary Points shall include a letter part and a numerical part. The letter part reflects the sequence of Points in the amended and supplemented document. The numerical part is arranged starting from number 1.
2. The presentation of the document amending and supplementing several provisions shall not change the order of Articles, Clauses, and Points that are not amended, supplemented, or repealed in the amended and supplemented document.
Subsection 2
PRESENTATION OF DOCUMENTS AMENDING AND SUPPLEMENTING MULTIPLE DOCUMENTS
Article 80. Documents Amending and Supplementing Multiple Documents
1. A document amending and supplementing multiple documents is a document simultaneously amending, replacing, or revoking provisions of several related documents.
2. Depending on the content being amended and supplemented, the name of the document amending and supplementing multiple documents shall be expressed as follows: the type of document followed by the phrase "amending and supplementing certain provisions of" the related documents with the same content being amended and supplemented, which may be summarized or listed specifically.
Article 81. Structure of Documents Amending and Supplementing Multiple Documents
1. Depending on the content, a document amending and supplementing multiple documents can be structured into different Articles, each containing the content being amended and supplemented of one document, except for the Article stipulating the responsibilities, implementation organization, and effective date of the document amending and supplementing multiple documents itself.
2. The content of Articles and Clauses in documents amending and supplementing multiple documents must clearly specify the names of the relevant documents, Articles, Clauses, and Points being amended and supplemented.
The title of an Article in the document is a directive indicating the amendment, supplementation, revocation, or replacement of a specific document.
3. An Article in a document amending and supplementing multiple documents can be structured into Clauses; Clauses can be structured into Points.
4. A Clause includes directives on the amendment, supplementation, revocation, or replacement of Chapters, Sections, Subsections, Articles, Clauses, and Points, accompanied by the content of the amendment, supplementation, revocation, or replacement.
5. The content of the amendment, supplementation, revocation, or replacement is arranged in accordance with the sequence of Articles, Clauses, and Points in the amended and supplemented document.
Chapter VI
ANNOUNCEMENT AND DISPLAY OF LEGAL REGULATORY DOCUMENTS
Section 1
IN THE OFFICIAL GAZETTE
Article 82. Form of the Official Gazette
1. The Official Gazette consists of the Official Gazette of the Socialist Republic of Vietnam published by the Government Office and the Provincial Official Gazette published by the People's Committee Office of provinces and centrally governed cities.
2. The Official Gazette is published in printed and electronic forms.
3. The Government Office provides guidance on the form, format, and technical presentation of the Official Gazette publication.
Article 83. Principles for Publishing Texts in the Official Gazette
1. Legal regulatory texts must be published in the Official Gazette in accordance with the provisions of Article 150 of the Law.
2. The Official Gazette shall publish full, complete, timely, and accurate texts of documents submitted for publication in the Official Gazette by issuing authorities.
3. The Official Gazette shall not publish texts that fall within the list of state secrets as prescribed by law and international treaties where the parties have agreed not to publish in the Official Gazette.
Article 84. Responsibilities of Official Gazette Management Authorities and Issuing Authorities in Submitting for Publication in the Official Gazette
1. The Government Office is responsible for publishing the printed Official Gazette of the Socialist Republic of Vietnam and managing the electronic Official Gazette of the Socialist Republic of Vietnam on the Government Portal.
2. The People's Committee Office of provinces and centrally governed cities is responsible for publishing the printed Official Gazette at the provincial level and managing the provincial electronic Official Gazette on the provincial portal.
3. The Government Office and the People's Committee Office of provinces and centrally governed cities are responsible for failing to publish, publishing late, or publishing incomplete, inaccurate texts in the Official Gazette.
4. Issuing authorities are responsible for failing to submit or submitting late, incomplete, or inaccurate texts for publication in the Official Gazette.
Article 85. Texts Published in the Official Gazette of the Socialist Republic of Vietnam
1. Legal regulatory texts issued by central state agencies.
2. International treaties that have taken effect for the Socialist Republic of Vietnam.
3. Resolutions of the Standing Committee of the National Assembly interpreting the Constitution, laws, and ordinances.
4. Texts abolishing legal regulatory texts.
5. Decisions suspending the enforcement and decisions handling legal regulatory texts contrary to the law.
6. Corrective texts of legal regulatory texts issued by central state agencies.
7. Lists of texts and provisions ceasing to be effective compiled and submitted for publication in the Official Gazette by authorized central state agencies.
8. Other legal texts issued by central state agencies.
The decision to publish texts specified in this clause shall be made by the issuing authority.
Article 86. Texts Published in the Provincial Official Gazette
1. Legal regulatory texts issued by the People's Councils, People's Committees, and local governments in special administrative-economic zones at the provincial level.
2. Texts issued by provincial-level agencies or persons with authority to handle legal regulatory texts contrary to the law.
3. Corrective texts of legal regulatory texts issued by the People's Councils, People's Committees, and local governments in special administrative-economic zones at the provincial level.
4. Lists of texts and provisions ceasing to be effective compiled and submitted for publication in the Official Gazette by provincial-level state agencies with authority.
5. Other legal texts issued by the People's Councils, People's Committees, local governments in special administrative-economic zones, and the Chairpersons of the People's Committees at the provincial level.
The decision to publish texts specified in this clause shall be made by the issuing authority.
Article 87. Legal Effectiveness of Texts Published in the Official Gazette
Texts published in the Official Gazette are official texts and have the same legal value as the original. In case of discrepancies between the printed Official Gazette and the electronic Official Gazette, the printed Official Gazette shall serve as the official basis.
Article 88. Table of Contents of the Official Gazette
The Table of Contents of the Official Gazette is a publication issued at the end of each year, compiling the names of documents published in the Official Gazette according to the issuing authority and arranged in chronological order, serving for the purpose of looking up documents published in the Official Gazette.
Article 89. Deadline for Submitting Documents for Publication in the Official Gazette
1. The deadline for submitting documents for publication in the Official Gazette of the Socialist Republic of Vietnam:
a) Within three working days from the date of promulgation or issuance, the issuing authority shall be responsible for submitting the documents specified in Clauses 1, 3, 4, 5, 6, 7, and 8 of Article 85 of this Decree to the Office of the Government for publication in the Official Gazette;
b) The deadline for submitting international treaties for publication in the Official Gazette of the Socialist Republic of Vietnam shall be carried out in accordance with the Law on International Treaties.
2. The deadline for submitting provincial-level documents for publication in the Official Gazette:
Within three working days from the date of adoption or issuance, the issuing authority shall be responsible for submitting the documents specified in Article 86 of this Decree to the Office of the People's Committee of the province or centrally governed city for publication in the Official Gazette.
Article 90. Documents Submitted for Publication in the Official Gazette
1. Legal documents submitted for publication in the Official Gazette must be the original; copies of international treaties submitted for publication in the Official Gazette must be certified true copies.
2. Documents submitted for publication in the Official Gazette must include one paper copy clearly marked "Document submitted for publication in the Official Gazette" and an electronic copy.
The electronic copy must comply with the standards prescribed by law. The issuing authority of the document is responsible for the accuracy of both the paper and electronic copies.
Article 91. Receipt and Publication of Documents in the Official Gazette
1. The Office of the Government and the Office of the People's Committee of the province or centrally governed city are responsible for receiving documents and publishing them in the Official Gazette; recording, managing, and preserving all documents submitted for publication in the Official Gazette to compare with the documents published in the Official Gazette when necessary.
2. During the process of receiving documents, if any errors are discovered, the Office of the Government and the Office of the People's Committee of the province or centrally governed city must immediately notify the issuing authority of the document to promptly address the issue, and the issuing authority must submit the official copy on the same day to ensure timely publication in the Official Gazette as prescribed.
Article 92. Deadline for Publishing Documents in the Official Gazette
1. Within fifteen days from the date of receipt of the document, the Office of the Government is responsible for publishing that document in the Official Gazette of the Socialist Republic of Vietnam.
2. Within seven days from the date of receipt of the document, the Office of the People's Committee of the province or centrally governed city is responsible for publishing that document in the provincial Official Gazette.
3. The publication of documents on the Electronic Official Gazette is conducted simultaneously with their publication in the printed Official Gazette and from the same database.
Article 93. Submission, Receipt, and Publication of Regulatory Legal Documents Issued Through Simplified Procedures
1. Regulatory legal documents issued in accordance with Clause 1 of Article 146 of the Law must be submitted to the Office of the Government and the Office of the People's Committee of the province or centrally governed city on the same day of promulgation or issuance for publication in the Official Gazette.
2. Upon receipt of the documents specified in Clause 1 of this Article, the Office of the Government and the Office of the People's Committee of the province or centrally governed city shall be responsible for receiving, recording, arranging, and publishing the document in the nearest issue of the Official Gazette, ensuring that the document is published within three working days from the date of promulgation or issuance.
Article 94. Correction of Documents Published in the Official Gazette
1. Documents published in the Official Gazette must be corrected if errors in format or presentation are discovered.
2. Responsibility for correction:
a) The issuing agency shall issue a correction document for errors arising from the process of drafting and promulgating the document;
b) The Government Office shall issue a correction document for errors arising from the publication process of the Official Gazette of the Socialist Republic of Vietnam; the People's Committee Office of provinces and centrally governed cities shall issue a correction document for errors arising from the publication process of the provincial Official Gazette based on comparison with the submitted version.
3. The correction document must be published in the nearest issue of the Official Gazette.
Article 95. Publication and Distribution of the Printed Official Gazette
1. The Official Gazette shall be widely published and distributed to agencies, organizations, and individuals who have a need for it.
2. The Official Gazette of the Socialist Republic of Vietnam shall be provided free of charge to communes, wards, and towns with one copy per issue per commune, ward, or town according to the registration requirements of each locality.
The provincial People's Committee shall be responsible for compiling a list of communes, wards, and towns that require free printed Official Gazettes from their locality and submit it to the Government Office before December 1st each year.
3. The provincial People's Committee shall decide on the distribution of free provincial Official Gazettes in their locality.
Section 2
ANNOUNCEMENT OF LEGAL REGULATORY DOCUMENTS
Article 96. Announcement of Legal Regulatory Documents
1. Legal regulatory documents issued by the People's Councils and People's Committees at district and commune levels must be announced.
2. Principles for announcing legal regulatory documents:
a) Announce the full text, completely, promptly, and accurately all documents required to be announced so that citizens can access the entire content of the document;
b) The announcement of legal regulatory documents must comply with the provisions of the Law;
c) The legal regulatory documents to be announced must be the original version, bearing the seal and signature.
3. The People's Councils and People's Committees at district and commune levels shall be responsible for announcing the legal regulatory documents they issue.
Article 97. Time Limit for Announcing Legal Regulatory Documents
Legal regulatory documents issued by the People's Councils at district and commune levels and the People's Committees at district and commune levels must be announced no later than three working days from the date the Chairman of the People's Council signs to certify or the Chairman of the People's Committee signs to promulgate. The announcement period must last at least thirty consecutive days from the date of announcement.
Article 98. Locations for Announcing Legal Regulatory Documents
1. Legal regulatory documents issued by the People's Councils and People's Committees at district and commune levels shall be announced at the office premises of the issuing agency.
2. Legal regulatory documents issued by the People's Councils and People's Committees at district and commune levels may also be announced at the following locations as decided by the Chairman of the People's Committee at the same level:
a) The location where citizens receive services from the People's Committee at the district level for legal regulatory documents issued by the People's Council and People's Committee at the district level;
b) The location where administrative procedures are received and results are delivered by the People's Committee at the district and commune levels;
c) Cultural houses at the district and commune levels; cultural houses of villages, hamlets, ấp, bản, phum, sóc, clusters of residents, and neighborhood units;
d) Postal and cultural centers at the commune level;
đ) Community education centers;
e) Other concentrated residential areas.
Article 99. Value of posted documents
The normative legal documents of the People's Councils, People's Committees at district and commune levels that are posted are considered official documents. In cases where there are discrepancies between the posted document and documents from other sources, the posted document shall be used.
Article 100. Correction of posted documents
1. After posting, if errors in format or presentation techniques are discovered, they must be corrected immediately upon discovery of the error.
2. The corrected document must be re-posted within one working day from the date the authorized person signs the corrected document. The posting period for the corrected document starts anew.
Chapter VII
TRANSLATION OF LEGAL DOCUMENTS
Article 101. Translation of normative legal documents into ethnic minority languages
1. The Minister, Head of the Committee for Ethnic Minority Affairs, and the Chairman of the Provincial People's Committee decide on the translation and organization of the translation of normative legal documents directly related to the daily lives of ethnic minorities into ethnic minority languages.
2. The translated version of normative legal documents into ethnic minority languages must accurately reflect the spirit of the original document and ensure the accuracy of its content.
Article 102. Translation of normative legal documents into foreign languages
1. The following normative legal documents may be translated into English or another foreign language:
a) Laws, resolutions of the National Assembly, ordinances, and resolutions of the Standing Committee of the National Assembly;
b) Decrees of the Government and decisions of the Prime Minister issued to implement international treaties to which the Socialist Republic of Vietnam is a party or directly related to the lives, work, and business of foreigners and foreign enterprises in Vietnam.
2. The main drafting agency shall take the lead and coordinate with the Vietnam News Agency and relevant agencies and organizations to organize the translation of normative legal documents specified in Clause 1 of this Article into English or another foreign language and bear responsibility for the accuracy of the translation.
3. The Minister, head of a ministerial-level agency, and the Chairman of the Provincial People's Committee decide on the translation of normative legal documents of the Minister, head of a ministerial-level agency, People's Councils, and People's Committees at all levels into a foreign language if deemed necessary.
4. The translated version of normative legal documents into a foreign language must accurately reflect the spirit of the original document and ensure the accuracy of its content.
Chapter VIII
INSPECTION AND HANDLING OF LEGAL NORMATIVE DOCUMENTS
Section 1
OBJECTS, CONTENT, PRINCIPLES, METHODS
INSPECTION AND HANDLING OF LEGAL DOCUMENTS
Article 103. Documents subject to inspection and handling
1. Documents subject to inspection include:
a) Circulars of Ministers and heads of ministerial-level agencies;
b) Joint Circulars between Ministers, Heads of ministerial-level agencies and the Chief Justice of the Supreme People's Court, the Prosecutor General of the Supreme People's Procuracy;
c) Resolutions of the People's Councils, decisions of the People's Committees;
d) Documents containing legal norms but not promulgated in the form of normative legal documents; documents containing legal norms or having the format of normative legal documents issued by agencies or persons without authority to issue them.
2. Documents subject to handling include:
a) Illegal documents including those issued beyond authority; documents containing content contrary to the Constitution or higher-ranking normative legal documents; documents seriously violating procedures and formalities for issuance;
b) Documents with errors in promulgation basis, format, or presentation techniques;
c) Documents as stipulated in point d, Clause 1 of this Article.
Article 104. Content of Text Examination
1. Examination of issuing authority includes examination of formal authority and examination of substantive authority.
2. Examination of the content of the text.
3. Examination of the basis for issuance; format, technical presentation; procedures and formalities for drafting and issuing texts.
Article 105. Principles of Text Examination and Handling
1. Ensuring comprehensiveness, timeliness, objectivity, transparency; compliance with authority, procedures, and formalities; combining examination by competent authorities and individuals with self-examination by issuing authorities and individuals; ensuring coordination among relevant agencies.
2. It is not permissible to abuse text examination and handling for personal gain, causing difficulties for the activities of issuing authorities and individuals, or interfering with the text handling process contrary to the law.
3. Authorities and individuals responsible for examining and handling texts bear responsibility for the examination conclusions and decisions on text handling.
Article 106. Methods of Text Examination
1. Self-examination of texts.
2. Examination of texts according to authority:
a) Examination of texts sent by issuing authorities or individuals;
b) Examination of texts upon receiving requests or recommendations from agencies, organizations, or individuals regarding texts that appear to violate the law;
c) Examination of texts within the jurisdiction of issuing authorities, specialized topics, sectors, or fields.
Article 107. Legal Basis for Determining Illegal Content in Examined Texts
The legal basis for determining illegal content in examined texts is normative legal texts that meet the following conditions:
1. Having higher legal validity than the examined text;
2. Being in effect at the time of issuance of the examined text or not yet in effect at the time of issuance but have been approved or signed for issuance and will take effect before or simultaneously with the examined text.
Normative texts that cease to be effective under Article 153 of the Law shall not be used as legal basis for examining texts from the date they cease to be effective until the date they resume effectiveness pursuant to the decision of the competent state authority.
Article 108. Recommendations for Handling Issuing Authorities That Issue Illegal Texts
Based on the illegal content of the text and the actual damage caused by the illegal text, the authority or individual responsible for examining the text recommends:
1. The authority or individual who issued the illegal text promptly apply measures to mitigate the consequences caused by the issuance and implementation of the illegal text;
2. The authority or individual with the power to consider and decide on the form of handling against the authority or individual who issued the illegal text.
Article 109. Announcing the Results of Text Handling
1. The results of handling illegal normative texts must be published in the Official Gazette, posted on the Portal or Website of the issuing authority, or displayed at designated locations as stipulated in Article 98 of this Decree.
2. The results of handling texts specified in point d, Clause 1, Article 103 of this Decree must be sent to the agencies, organizations, or individuals to whom the text was previously sent. In cases where the text has been published in the Official Gazette, posted on the Portal or Website of the issuing authority, or displayed, the results of handling must also be announced through these media.
Article 110. Documents for inspecting legal texts
1. The agency or person authorized to inspect legal texts shall be responsible for establishing the inspection documents for legal texts.
2. The documents for inspecting legal texts include: legal texts containing illegal content, Inspection Form for Legal Texts according to Model No. 01 attached as Appendix III to this Decree, results of handling the legal texts, and other related documents (if any).
3. The documents for inspecting legal texts shall be stored in accordance with the laws on archiving.
Section 2
SELF-INSPECTION AND HANDLING OF LEGAL TEXTS
Article 111. Responsibility for self-inspection of legal texts
1. Ministers, Heads of ministerial-level agencies, People's Councils at all levels, People's Committees at all levels, and local authorities in special administrative-economic units shall immediately conduct self-inspection of legal texts issued by themselves or jointly issued upon issuance of the legal texts or upon receipt of requests or suggestions from agencies, organizations, or individuals.
2. Agencies or persons responsible for assisting Ministers, Heads of ministerial-level agencies, People's Councils at all levels, People's Committees at all levels, and local authorities in special administrative-economic units in conducting self-inspection of legal texts:
a) The head of the legal system organization under the ministry or ministerial-level agency shall be the focal point to assist the Minister or Head of the ministerial-level agency in self-inspecting circulars and joint circulars issued by the Minister or Head of the ministerial-level agency together with the President of the Supreme People's Court and the Procurator General of the Supreme People's Procuracy;
b) The Director of the Department of Legal Text Inspection under the Ministry of Justice shall be the focal point to assist the Minister of Justice in self-inspecting circulars and joint circulars issued by the Minister of Justice together with the President of the Supreme People's Court and the Procurator General of the Supreme People's Procuracy;
c) The head of the legal system organization under the Government agency shall cooperate with the legal system organization under the ministry that has issued legal texts within the scope of activities of the Government agency to conduct self-inspection of legal texts;
d) The Legal System Committee of the People's Council shall assist the People's Council in self-inspection of legal texts of the People's Council;
đ) The Director of the Department of Justice, the Head of the Justice Division, or the person in charge of the agency assigned by the People's Committee in special administrative-economic units shall be the focal point to assist the People's Committee at the same level in self-inspection of legal texts;
e) Judicial civil servants - civil registration officers shall assist the People's Committee at the commune level in self-inspection of legal texts.
3. The Director of the Department of Legal Text Inspection under the Ministry of Justice and the head of the legal system organization under the ministry or ministerial-level agency shall be responsible for coordinating with relevant agencies or units under the Supreme People's Court and the Supreme People's Procuracy to self-inspect joint circulars between the Minister or Head of the ministerial-level agency and the President of the Supreme People's Court and the Procurator General of the Supreme People's Procuracy.
4. Relevant agencies and units must promptly provide necessary information and documents and coordinate with agencies and persons responsible as stipulated in Clause 2 and Clause 3 of Article 111 of this Decree in the self-inspection of legal texts.
Article 112. Handling of illegal legal texts
1. When discovering signs of illegality in legal texts, the agency or unit implementing self-inspection as prescribed in Clause 2 and Clause 3 of Article 111 of this Decree shall be responsible for establishing the inspection documents for legal texts and immediately reporting the results of the inspection of legal texts to the agency or person who issued the legal texts for consideration and handling in accordance with regulations.
2. The report on the results of self-inspection of legal texts with signs of illegality shall include the following contents:
a) Evaluation of the content showing signs of illegality in the legal text and proposals for handling measures, time limit for handling, and remedial actions for consequences caused by the legal text (if any);
b) Determination of the responsibility of officials and civil servants involved in drafting, reviewing, examining, and issuing the legal text.
3. The agency or person issuing the legal text shall be responsible for promptly handling the illegally issued legal text.
4. The results of handling the legal text must be announced in accordance with Clause 1 of Article 109 of this Decree.
Section 3
INSPECTION AND HANDLING OF LEGAL TEXTS WITHIN AUTHORITY
Subsection 1
AUTHORITY FOR INSPECTING LEGAL TEXTS
Article 113. Authority of the Minister and Head of Equivalent Ministries
1. The Minister and Head of Equivalent Ministries shall inspect documents issued by other Ministers and Heads of Equivalent Ministries, People's Councils and People's Committees at provincial level, and local authorities in special administrative-economic units concerning matters related to their respective sectors and fields.
The head of the legal organization under the Ministry or Equivalent Ministry shall be responsible for assisting the Minister and Head of Equivalent Ministries in inspecting documents within the scope of inspection authority of the Minister and Head of Equivalent Ministries.
The head of the legal organization under the Government agency shall be responsible for coordinating with the legal organization under the Ministry or Equivalent Ministry managing the state administration in the field of operation of the Government agency to inspect documents containing provisions within the field of operation of the Government agency.
2. Authority of the Minister of Justice:
a) The Minister of Justice shall exercise the authority to inspect documents as prescribed in Clause 1 of this Article and assist the Prime Minister in inspecting: circulars of Ministers and Heads of Equivalent Ministries; contents of regulations within the field of state management of ministries and Equivalent Ministries in joint circulars between Ministers and Heads of Equivalent Ministries and the President of the Supreme People's Court, the Procurator General of the Supreme People's Procuracy; resolutions of People's Councils, decisions of People's Committees at provincial level, normative legal documents of local authorities in special administrative-economic units related to many sectors and many fields of state management;
b) The Director of the Department of Normative Legal Document Inspection under the Ministry of Justice shall be responsible for assisting the Minister of Justice in inspecting documents as stipulated in point a of this clause.
3. The Minister of Justice may request ministries, Equivalent Ministries, and local authorities to inspect normative legal documents within their inspection authority when there are reports or suggestions from individuals or organizations.
4. The Minister and Chief of the Government Office shall exercise the authority to inspect as prescribed in Clause 1 of this Article and assist the Prime Minister in inspecting circulars of the Minister of Justice; joint circulars between the Minister of Justice and the President of the Supreme People's Court, the Procurator General of the Supreme People's Procuracy.
5. In case of disputes over the authority to inspect documents, the Minister of Justice shall report to the Prime Minister for decision.
Article 114. Authority of the Chairman of the People's Committee at provincial level and the Chairman of the People's Committee at district level
1. The Chairman of the People's Committee at provincial level shall inspect documents of the People's Council and People's Committee at district level.
2. The Chairman of the People's Committee at district level shall inspect documents of the People's Council and People's Committee at commune level.
3. The Director of the Department of Justice, the Head of the Justice Division shall be responsible for assisting the Chairman of the People's Committee at the same level in implementing the inspection of documents as prescribed in Clauses 1 and 2 of this Article.
Article 115. Procedure for Inspecting Documents According to Authority
1. Receiving Documents Within the Scope of Inspection
The document inspection agency must open a "Document Receipt Book" to monitor the sending and receipt of documents within the scope of inspection.
2. The head of the document inspection agency assigns personnel to inspect documents.
3. The person inspecting the document shall examine and evaluate the constitutionality, legality, and consistency of the inspected document.
4. Reporting the Results of Document Inspection and Proposing Measures for Handling:
a) When discovering signs that the inspected document violates the law, the person inspecting the document shall prepare a Document Inspection Report, report to the head of the document inspection agency on the results of the inspection and propose measures for handling;
b) Depending on the nature, degree of violation of the law of the document and the consequences caused, the person inspecting the document may propose: forms of handling illegal documents; handling responsibility of agencies and persons with authority who have issued illegal documents; handling responsibility of officials and civil servants who have advised in drafting, reviewing, examining, and issuing illegal documents if they are at fault.
5. Concluding Document Inspection:
a) The head of the document inspection agency shall consider and conclude according to their authority or submit to the agency or person with authority for consideration and conclusion on the illegal content of the document;
b) The inspection conclusion shall be sent to the agency or person who issued the document for consideration and handling in accordance with the law.
6. In case the agency or person who issued the document does not handle the illegal document or the document inspection agency disagrees with the handling result, the document inspection agency shall submit to the agency or person with authority for consideration and handling in accordance with the law.
The dossier submitted to the agency or person with authority for considering and handling the document includes: the report of the document inspection agency; the inspected document; legal basis for inspection; Document Inspection Report according to Model No. 01 Appendix III attached to this Decree; opinions of relevant agencies (if any); the inspection conclusion of the document inspection agency; explanations and notifications of handling results of the agency with the inspected document (if any) and other related documents (if any).
The document inspection agency must open a "Record of Illegal Document Handling Follow-up" to monitor and urge the handling of documents according to Model No. 02 Appendix III attached to this Decree.
Article 116. Inspection of documents by territorial area, topic, sector, or field
1. Inspection of documents by territorial area:
a) When discovering documents that have signs of violating the law and significantly affecting the economy and society, if deemed necessary, the agency or person with authority to inspect documents as stipulated in Clause 1, Point b Clause 2 Article 113 and Clause 3 Article 114 of this Decree shall decide to establish an inspection team for documents by territorial area at the agency issuing the document. The document inspection agency has the responsibility to notify the agency whose document is being inspected about the composition, time, location, and content of the work. The agency whose document is being inspected has the responsibility to prepare relevant contents and files according to the requirements of the document inspection agency;
b) The inspection team conducts inspections, concludes, makes recommendations, or reports to the agency or person with authority to consider and recommend handling of unlawful documents; simultaneously recommending consideration of responsibility of agencies or individuals who draft and issue unlawful documents;
c) In cases where a multi-sector inspection team is established to inspect documents by territorial area, the agency whose document is being inspected must cooperate with the leading inspection agency to prepare necessary conditions to serve the inspection team and implement the inspection plan as prescribed in Clause 2 of this Article.
2. Inspection of documents by topic, sector, or field:
a) The Minister, Head of a ministerial-level agency, Chairman of the People's Committee of a province, Chairman of the People's Committee of a district approves plans to inspect documents by topic or by sector or field and urges, directs, and inspects the implementation of these plans;
b) The Minister, Head of a ministerial-level agency, Chairman of the People's Committee of a province, Chairman of the People's Committee of a district decides to establish a multi-sector inspection team to carry out inspections of documents by topic or by sector or field within their inspection authority;
c) The inspection agency must notify the agency whose document is being inspected before conducting inspections by topic or by sector or field. The agency whose document is being inspected has the responsibility to cooperate with the inspection team in carrying out document inspections, preparing relevant contents and files related to the inspected document according to the requirements of the inspection team and the inspection plan of the document inspection agency;
d) The multi-sector inspection team conducting inspections by topic or by sector or field has the responsibility to organize implementation and coordinate with the leading inspection agency, the agency, or locality where the inspected document is located to implement the approved document inspection plan; conclude and make recommendations or report to the agency or person with authority to recommend handling of the inspected contents; report to the leading inspection agency on the results of the inspection team's document inspection.
Article 117. Inspection of documents containing state secrets
The inspection of documents containing state secrets is carried out in accordance with the laws on protecting state secrets and related laws.
Subsection 2
AUTHORITY TO HANDLE UNLAWFUL DOCUMENTS
Article 118. The Minister of Justice submits to the Prime Minister for handling unlawful documents
The Minister of Justice submits to the Prime Minister for decision:
1. Suspend enforcement, revoke partially or entirely:
a) Circulars violating the law issued by the Minister, Head of a ministerial-level agency;
b) Decisions violating the law issued by the People's Committee of a province, People's Committee of a special administrative-economic unit.
2. Suspend enforcement partially or entirely:
a) Unlawful content within the management domain of a ministry or ministerial-level agency in joint circulars issued by the Minister, Head of a ministerial-level agency with the President of the Supreme People's Court, the Procurator General of the Supreme People's Procuracy, while requiring the Ministers, Heads of ministerial-level agencies to negotiate with the President of the Supreme People's Court, the Procurator General of the Supreme People's Procuracy to jointly handle the document;
b) Unlawful resolutions of the Provincial People's Council, People's Council of a special administrative-economic unit, while requesting the Standing Committee of the National Assembly to revoke them.
Article 119. Competence of the Minister, Head of a ministerial-level agency in handling illegal legal documents
1. Competence of the Minister, Head of a ministerial-level agency:
a) Propose the Minister, Head of a ministerial-level agency to suspend implementation, revoke partially or entirely illegal legal documents issued by Ministers, Heads of ministerial-level agencies related to their respective sectors or fields. In case the proposal is not accepted, submit it to the Prime Minister for decision;
b) Submit to the Prime Minister for decision to suspend implementation partially or entirely of illegal resolutions issued by the People's Councils of provinces, People's Councils of special administrative-economic zones concerning their respective sectors or fields, while proposing the Standing Committee of the National Assembly to revoke them;
c) Submit to the Prime Minister for decision to suspend implementation, revoke partially or entirely illegal decisions issued by the People's Committees of provinces, People's Committees of special administrative-economic zones concerning their respective sectors or fields.
2. Authority of the Minister of Justice:
a) Implement the competence to handle illegal legal documents as prescribed in Clause 1 of this Article;
b) Propose the Minister, Head of a ministerial-level agency to suspend implementation, revoke partially or entirely illegal legal documents issued by Ministers, Heads of ministerial-level agencies. In case the proposal is not accepted, submit it to the Prime Minister for decision;
c) Submit to the Prime Minister for decision to suspend implementation of illegal resolutions issued by the People's Councils of provinces, People's Councils of special administrative-economic zones relating to multiple sectors or fields under state management;
d) Submit to the Prime Minister for decision to suspend implementation, revoke partially or entirely illegal decisions issued by the People's Committees of provinces, People's Committees of special administrative-economic zones relating to multiple sectors or fields under state management;
e) Propose handling of joint circulars suspected of being illegal between Ministers, Heads of ministerial-level agencies and the Chief Justice of the Supreme People's Court, the Procurator General of the Supreme People's Procuracy according to the procedure stipulated in Clause 4, Article 122 of this Decree;
3. Competence of the Minister, Director of the Government Office:
a) Implement the competence to handle illegal legal documents as prescribed in Clause 1 of this Article;
b) Propose the Minister of Justice to suspend implementation, revoke partially or entirely illegal legal documents issued by the Minister of Justice. In case the proposal is not accepted, submit it to the Prime Minister for decision;
c) Propose handling of joint circulars suspected of being illegal between the Minister of Justice and the Chief Justice of the Supreme People's Court, the Procurator General of the Supreme People's Procuracy according to the provisions in Clause 4, Article 122 of this Decree.
Article 120. Competence of the Chairman of the People's Committee of a province, Chairman of the People's Committee of a district in handling illegal legal documents
1. Suspend implementation or revoke partially or entirely illegal legal documents of directly subordinate People's Committees.
2. Suspend implementation of illegal resolutions of directly subordinate People's Councils, report to the People's Committee to propose the same level People's Council to revoke them.
Subsection 3
PROCEDURE FOR INSPECTION AND HANDLING OF ILLEGAL LEGAL DOCUMENTS
Article 121. Time for Sending Documents to the Inspection Authority
Within the latest three working days from the date of approval or issuance, the authority or person authorized to issue the document must send the document to the authority or person authorized to inspect the document according to the following provisions:
1. Documents issued by the Minister, Head of a ministry-level agency, Provincial People's Council, Provincial People's Committee, local administration in a special administrative-economic unit shall be sent to the Department of Legal Document Inspection under the Ministry of Justice and the legal department of the ministry-level agency authorized to inspect documents according to their respective sectors and fields.
Joint Circulars between the Minister, Head of a ministry-level agency and the President of the Supreme People's Court, Prosecutor of the Supreme People's Procuracy shall be sent to the Department of Legal Document Inspection under the Ministry of Justice by the ministry or ministry-level agency that jointly issued them.
2. Documents issued by the People's Council, People's Committee at district level shall be sent to the Department of Justice.
3. Documents issued by the People's Council, People's Committee at commune level shall be sent to the Justice Office.
Article 122. Procedures for the Minister, Head of a ministry-level agency to conduct inspection and handle illegal documents
1. Procedures conducted by the Minister, Head of a ministry-level agency:
a) When inspecting and discovering signs of illegal documents, the head of the legal department of the ministry or ministry-level agency shall report to the Minister, Head of a ministry-level agency on the inspection conclusion, and send it to the authority or person who issued the document for examination and handling according to the law;
b) In case the authority or person who issued the illegal document does not handle it within the prescribed time limit or the Minister, Head of a ministry-level agency does not agree with the handling result, then the Minister, Head of a ministry-level agency authorized to inspect the document shall handle the document according to Article 119 of this Decree.
2. Procedures conducted by the Minister of Justice:
a) When inspecting and discovering illegal documents, the Director of the Department of Legal Document Inspection shall conclude the inspection and send it to the authority or person who issued the document for examination and handling. For contents within the scope of management of ministries, ministry-level agencies in joint circulars between the ministry, ministry-level agency and the President of the Supreme People's Court, Prosecutor of the Supreme People's Procuracy, after receiving the inspection conclusion, the authorities that jointly issued the circular must cooperate to examine and handle the document according to the regulations;
b) In case the authority or person who issued the illegal document does not handle it or the Director of the Department of Legal Document Inspection does not agree with the handling result, then the Director of the Department of Legal Document Inspection shall report to the Minister of Justice to handle the document according to Articles 118 and 119 of this Decree.
3. The Chairman of the Government Office shall conduct inspection and handling of illegal documents issued by the Minister of Justice, jointly issued according to the procedures stipulated in Clause 1 of this Article.
4. In case the content regulated in the joint circular involving the Supreme People's Court, Supreme People's Procuracy is found to have signs of illegality, then the Minister of Justice or the Minister, Chairman of the Government Office (for joint circulars with the Ministry of Justice) shall recommend the Supreme People's Court, Supreme People's Procuracy to examine and handle according to the law.
Article 123. Procedures for handling illegal documents when the Minister, Head of a ministerial-level agency, or Chairman of the People's Committee at provincial level requests the Prime Minister
1. When the Minister, Head of a ministerial-level agency, or Chairman of the People's Committee at provincial level requests the Prime Minister to handle illegal documents, the request file shall be sent to the Ministry of Justice and simultaneously to the Office of the Government.
2. For illegal documents where there are no differing opinions on their constitutionality, legality, and handling procedures, within fifteen days from the date of receipt of the request, the Minister of Justice shall examine and report to the Prime Minister for handling according to Article 118 of this Decree.
3. For illegal documents where there are differing opinions on their constitutionality, legality, or where there is a request to reconsider the handling decision as stipulated in Clause 5 of Article 132 of this Decree, within thirty days from the date of receipt of the request, the Minister of Justice shall take the lead and coordinate with the Minister, Director of the Government Office, other Ministers, Heads of ministerial-level agencies, Heads of government agencies, and Chairmen of the People's Committees at provincial level to handle the document according to the following procedure:
a) The authority or person with the competence to inspect the document shall report on the illegal document that needs to be handled;
b) The Minister of Justice shall report on the constitutionality and legality of the requested document and propose a handling direction;
c) The authority or person issuing the requested document shall explain the contents related to the document;
d) The Ministers, Heads of ministerial-level agencies, and Chairmen of the People's Committees at provincial level shall discuss the constitutionality and legality of the document;
đ) The Minister of Justice shall conclude, propose a handling direction for the document, and report to the Prime Minister for consideration and decision.
Article 124. Procedures for the Chairman of the People's Committee at provincial level and Chairman of the People's Committee at district level to conduct inspections and handle illegal documents
1. When inspecting and discovering signs of illegality in a document, the Director of the Department of Justice or the Head of the Justice Division shall conclude the inspection and send it to the authority that issued the document for examination and handling according to the provisions of the law.
2. In cases where the authority that issued the illegal document does not handle it within the prescribed time limit or the Director of the Department of Justice or the Head of the Justice Division disagrees with the handling result, the Director of the Department of Justice or the Head of the Justice Division shall report to the Chairman of the People's Committee at the same level for handling according to Article 120 of this Decree.
Article 125. Time limit for handling illegal documents
1. Within thirty days from the date of receipt of the inspection conclusion on illegal documents, the authority or person who issued the document must organize the examination and handling of the document and notify the inspection results to the inspection authority.
2. Trường hợp cơ quan, người đã ban hành văn bản trái pháp luật không xử lý theo quy định tại khoản 1 Điều này hoặc cơ quan, người có thẩm quyền kiểm tra, xử lý văn bản không nhất trí với kết quả xử lý văn bản thì trong thời hạn 15 ngày kể từ ngày hết thời hạn xử lý, cơ quan, người có thẩm quyền kiểm tra, xử lý báo cáo cơ quan, người có thẩm quyền xem xét, xử lý theo quy định.
3. Việc xử lý nghị quyết trái pháp luật của Hội đồng nhân dân phải được tiến hành tại kỳ họp gần nhất của Hội đồng nhân dân.
Tiểu mục 4
KIỂM TRA, XỬ LÝ VĂN BẢN CÓ CHỨA QUY PHẠM PHÁP LUẬT BAN HÀNH KHÔNG ĐÚNG HÌNH THỨC, THẨM QUYỀN
Điều 126. Văn bản được kiểm tra
1. Việc kiểm tra văn bản quy định tại điểm d khoản 1 Điều 103 của Nghị định này được tiến hành khi nhận được yêu cầu, kiến nghị của cơ quan, tổ chức, cá nhân.
2. Văn bản được kiểm tra quy định tại khoản 1 Điều này gồm:
a) Văn bản có chứa quy phạm pháp luật do Bộ trưởng, Thủ trưởng cơ quan ngang bộ, Hội đồng nhân dân, Ủy ban nhân dân, chính quyền địa phương ở đơn vị hành chính - kinh tế đặc biệt ban hành nhưng không được ban hành bằng hình thức thông tư của Bộ trưởng, Thủ trưởng cơ quan ngang bộ, nghị quyết của Hội đồng nhân dân, quyết định của Ủy ban nhân dân;
b) Văn bản có chứa quy phạm pháp luật hoặc văn bản có thể thức như văn bản quy phạm pháp luật do cơ quan, người không có thẩm quyền ban hành.
Điều 127. Trách nhiệm xử lý văn bản
Bộ trưởng, Thủ trưởng cơ quan ngang bộ, Thủ trưởng cơ quan thuộc Chính phủ, Chủ tịch Hội đồng nhân dân, Chủ tịch Ủy ban nhân dân có trách nhiệm xem xét, xử lý văn bản quy định tại khoản 2 Điều 126 của Nghị định này khi nhận được kết luận của cơ quan, người có thẩm quyền.
Điều 128. Thẩm quyền và thủ tục kiểm tra, xử lý
1. Thẩm quyền kiểm tra, xử lý văn bản:
a) Bộ trưởng Bộ Tư pháp thực hiện kiểm tra, xử lý văn bản quy định tại điểm a khoản 2 Điều 126 của Nghị định này và văn bản có chứa quy phạm pháp luật hoặc có thể thức như văn bản quy phạm pháp luật do Thủ trưởng cơ quan thuộc Chính phủ, Chủ tịch Ủy ban nhân dân cấp tỉnh, Chủ tịch Ủy ban nhân dân ở đơn vị hành chính - kinh tế đặc biệt, Thủ trưởng các đơn vị trực thuộc bộ, cơ quan ngang bộ, cơ quan thuộc Chính phủ, cơ quan chuyên môn thuộc Ủy ban nhân dân cấp tỉnh, cơ quan chuyên môn thuộc Ủy ban nhân dân ở đơn vị hành chính - kinh tế đặc biệt ban hành. Cục trưởng Cục kiểm tra văn bản giúp Bộ trưởng kiểm tra, xử lý văn bản theo quy định tại điểm này;
b) Bộ trưởng, Chủ nhiệm Văn phòng Chính phủ kiểm tra, xử lý đối với các văn bản quy định tại khoản 2 Điều 126 của Nghị định này do Bộ trưởng Bộ Tư pháp hoặc Thủ trưởng các đơn vị trực thuộc Bộ Tư pháp ban hành;
c) Giám đốc Sở Tư pháp thực hiện kiểm tra, xử lý đối với các văn bản có chứa quy phạm pháp luật do Hội đồng nhân dân hoặc Ủy ban nhân dân cấp huyện ban hành nhưng không được ban hành bằng hình thức nghị quyết của Hội đồng nhân dân hoặc quyết định của Ủy ban nhân dân; các văn bản có chứa quy phạm pháp luật hoặc có thể thức như văn bản quy phạm pháp luật do Chủ tịch Ủy ban nhân dân cấp huyện, Thủ trưởng các cơ quan chuyên môn thuộc Ủy ban nhân dân cấp huyện ban hành;
d) Trưởng Phòng Tư pháp thực hiện kiểm tra, xử lý đối với các văn bản có chứa quy phạm pháp luật do Hội đồng nhân dân hoặc Ủy ban nhân dân cấp xã ban hành nhưng không được ban hành bằng hình thức nghị quyết của Hội đồng nhân dân hoặc quyết định của Ủy ban nhân dân; các văn bản do Chủ tịch Ủy ban nhân dân cấp xã hoặc chức danh khác ở cấp xã ban hành, có chứa quy phạm pháp luật.
2. Thủ tục kiểm tra, xử lý đối với các văn bản trái pháp luật quy định tại khoản 1 Điều này được thực hiện theo quy định tại khoản 2 và 3 Điều 122, Điều 124 và khoản 1 Điều 129 của Nghị định này.
3. Việc kiểm tra, xử lý đối với văn bản có chứa quy phạm pháp luật hoặc văn bản có thể thức như văn bản quy phạm pháp luật do người đứng đầu các cơ quan, đơn vị thuộc bộ, cơ quan ngang bộ, cơ quan thuộc Chính phủ được tổ chức ở cấp tỉnh, cấp huyện, đơn vị hành chính - kinh tế đặc biệt ban hành được thực hiện như sau:
a) Đối với các văn bản do người đứng đầu các cơ quan, đơn vị thuộc bộ, cơ quan ngang bộ, cơ quan thuộc Chính phủ được tổ chức ở cấp tỉnh, đơn vị hành chính - kinh tế đặc biệt ban hành được kiểm tra, xử lý theo quy định tại điểm a và b khoản 1 Điều này. Trường hợp người đã ban hành văn bản không tự kiểm tra, xử lý thì người có thẩm quyền kiểm tra báo cáo, kiến nghị Bộ trưởng, Thủ trưởng cơ quan ngang bộ xử lý theo thẩm quyền;
b) Đối với các văn bản do người đứng đầu các cơ quan, đơn vị thuộc bộ, cơ quan ngang bộ, cơ quan thuộc Chính phủ được tổ chức ở cấp huyện ban hành được kiểm tra, xử lý theo quy định tại điểm a khoản 1 Điều này. Trường hợp người đã ban hành văn bản không xem xét, xử lý thì người có thẩm quyền kiểm tra đề nghị cơ quan quản lý cấp trên của cơ quan đó xem xét, xử lý.
4. Việc kiểm tra, xử lý các văn bản có chứa quy phạm pháp luật, văn bản có thể thức như văn bản quy phạm pháp luật do Chủ tịch Hội đồng nhân dân, Thường trực Hội đồng nhân dân và các cơ quan của Hội đồng nhân dân ban hành được thực hiện như đối với văn bản của Hội đồng nhân dân cùng cấp.

XỬ LÝ VĂN BẢN TRÁI PHÁP LUẬT
Điều 129. Kết luận kiểm tra văn bản trái pháp luật
1. Cơ quan có thẩm quyền kiểm tra văn bản gửi kết luận kiểm tra cho Bộ trưởng, Thủ trưởng cơ quan ngang bộ, cơ quan thuộc Chính phủ, Chủ tịch Hội đồng nhân dân hoặc Chủ tịch Ủy ban nhân dân nơi có văn bản được kiểm tra để chỉ đạo, tổ chức việc xử lý văn bản theo quy định. Kết luận kiểm tra đồng thời được gửi cho cơ quan, người đã ban hành văn bản trái pháp luật và tổ chức pháp chế của bộ, cơ quan ngang bộ hoặc Sở Tư pháp, Phòng Tư pháp, cơ quan được Ủy ban nhân dân ở đơn vị hành chính - kinh tế đặc biệt giao là đầu mối, công chức tư pháp - hộ tịch cấp xã nơi có văn bản được kiểm tra.
2. Kết luận kiểm tra phải có các nội dung cơ bản sau đây: tên văn bản được kiểm tra; tên và nội dung văn bản làm căn cứ pháp lý để xác định nội dung trái pháp luật của văn bản được kiểm tra; ý kiến về nội dung trái pháp luật của văn bản được kiểm tra; yêu cầu cơ quan, người đã ban hành văn bản xem xét, xử lý và thông báo kết quả xử lý văn bản, đồng thời kiến nghị việc xem xét, xử lý trách nhiệm đối với cơ quan, người đã tham mưu xây dựng, ban hành văn bản trái pháp luật đó.
3. Trường hợp phát hiện văn bản được kiểm tra có nội dung trái pháp luật, mâu thuẫn, chồng chéo với văn bản có hiệu lực pháp lý cao hơn được ban hành sau văn bản được kiểm tra hoặc không hợp lý, khả thi, không phù hợp với tình hình kinh tế - xã hội; một phần hoặc toàn bộ văn bản làm căn cứ ban hành văn bản được kiểm tra đã được thay thế, sửa đổi, bổ sung, bãi bỏ, đình chỉ thi hành hoặc ngưng hiệu lực bằng văn bản khác của cơ quan nhà nước có thẩm quyền, dẫn đến nội dung của văn bản không còn phù hợp với pháp luật hiện hành thì trong kết luận kiểm tra, cơ quan kiểm tra văn bản kiến nghị cơ quan ban hành văn bản thực hiện việc rà soát, xử lý theo quy định tại Chương IX của Nghị định này.
Điều 130. Hình thức xử lý văn bản trái pháp luật, văn bản có sai sót về căn cứ ban hành, thể thức, kỹ thuật
1. Đình chỉ việc thi hành một phần hoặc toàn bộ văn bản trong trường hợp nội dung trái pháp luật ảnh hưởng đến lợi ích của Nhà nước, quyền và lợi ích hợp pháp của tổ chức, cá nhân nếu không được bãi bỏ kịp thời.
2. Bãi bỏ một phần hoặc toàn bộ văn bản trong các trường hợp sau:
a) Một phần hoặc toàn bộ văn bản được ban hành trái pháp luật về thẩm quyền, nội dung; văn bản vi phạm nghiêm trọng trình tự, thủ tục xây dựng, ban hành;
b) Văn bản quy định tại điểm d khoản 1 Điều 103 của Nghị định này.
3. Đính chính văn bản được thực hiện đối với văn bản có sai sót về căn cứ ban hành, thể thức, kỹ thuật trình bày. Cơ quan, người ban hành văn bản đính chính văn bản bằng văn bản hành chính. Việc đính chính văn bản của Hội đồng nhân dân do Thường trực Hội đồng nhân dân thực hiện.
Mục 4
NHIỆM VỤ, QUYỀN HẠN CỦA CƠ QUAN,
NGƯỜI BAN HÀNH VĂN BẢN ĐƯỢC KIỂM TRA
Điều 131. Nhiệm vụ của cơ quan, người ban hành văn bản được kiểm tra
1. Gửi văn bản đến cơ quan, người có thẩm quyền kiểm tra theo quy định; cung cấp thông tin, tài liệu cần thiết cho cơ quan, người có thẩm quyền kiểm tra văn bản.
2. Gửi đăng Công báo, niêm yết văn bản đã được xử lý theo quy định của pháp luật.
3. Giải trình về nội dung văn bản theo yêu cầu của cơ quan, người có thẩm quyền kiểm tra văn bản.
4. Tự kiểm tra kịp thời để phát hiện và xử lý văn bản có dấu hiệu trái pháp luật theo quy định tại khoản 1 Điều 111 và Điều 112 của Nghị định này.
5. Thông báo kết quả xử lý văn bản trái pháp luật cho cơ quan, người có thẩm quyền kiểm tra văn bản.
6. Tạo điều kiện cho cơ quan, người có thẩm quyền kiểm tra văn bản thực hiện nhiệm vụ kiểm tra văn bản.
7. Thực hiện các quyết định, yêu cầu của Thủ tướng Chính phủ theo quy định tại Điều 118 của Nghị định này.
8. Thực hiện các quyết định, kiến nghị của Bộ trưởng, Thủ trưởng cơ quan ngang bộ theo quy định tại Điều 119 của Nghị định này; nghị quyết của Hội đồng nhân dân cấp tỉnh, cấp huyện, quyết định của Chủ tịch Ủy ban nhân dân cấp tỉnh, cấp huyện theo quy định tại Điều 120 của Nghị định này.
Điều 132. Quyền hạn của cơ quan, người có văn bản được kiểm tra
1. Được thông báo về kế hoạch, nội dung kiểm tra, nội dung được yêu cầu.
2. Trình bày ý kiến liên quan đến nội dung văn bản được kiểm tra.
3. Từ chối trả lời, cung cấp thông tin không thuộc phạm vi chức năng, nhiệm vụ, quyền hạn của mình hoặc những thông tin thuộc bí mật nhà nước không được phép cung cấp theo quy định của pháp luật.
4. Giải trình và đề nghị Bộ trưởng, Thủ trưởng cơ quan ngang bộ, Chủ tịch Ủy ban nhân dân cấp tỉnh, Chủ tịch Ủy ban nhân dân cấp huyện có thẩm quyền kiểm tra, xử lý văn bản xem xét lại kết luận kiểm tra, xử lý văn bản trái pháp luật.
5. Trường hợp cơ quan, người có thẩm quyền kiểm tra, xử lý văn bản vẫn quyết định xử lý theo quy định tại Điều 119 và Điều 120 của Nghị định này thì cơ quan, người có văn bản được kiểm tra có quyền đề nghị cơ quan, người có thẩm quyền xử lý văn bản xem xét lại quyết định xử lý. Trong thời hạn 15 ngày, kể từ ngày nhận được đề nghị xem xét lại quyết định xử lý, nếu cơ quan, người có thẩm quyền xử lý văn bản không trả lời thì cơ quan, người có văn bản được kiểm tra có quyền báo cáo Thủ tướng Chính phủ, nếu cơ quan, người đã xử lý văn bản là Bộ trưởng, Thủ trưởng cơ quan ngang bộ, Hội đồng nhân dân, Chủ tịch Ủy ban nhân dân cấp tỉnh, hoặc báo cáo Chủ tịch Ủy ban nhân dân cấp tỉnh, nếu cơ quan, người đã xử lý văn bản là Hội đồng nhân dân, Chủ tịch Ủy ban nhân dân cấp huyện.
Khi thực hiện các quyền quy định tại khoản 4 và 5 Điều này, cơ quan, người có văn bản được kiểm tra cần chứng minh văn bản do mình ban hành đúng pháp luật và phải chịu trách nhiệm trước cấp trên và trước pháp luật về tính trung thực trong báo cáo, đề nghị của mình.
Điều 133. Những hành vi vi phạm pháp luật trong công tác kiểm tra, xử lý văn bản của cơ quan, người có văn bản được kiểm tra
1. Không gửi văn bản theo quy định; không cung cấp thông tin, tài liệu cần thiết cho cơ quan, người có thẩm quyền kiểm tra văn bản.
2. Không thực hiện việc đăng Công báo, niêm yết các văn bản quy phạm pháp luật đã được xử lý theo quy định của pháp luật.
3. Không tổ chức tự kiểm tra để phát hiện, xử lý văn bản trái pháp luật do mình ban hành.
4. Không xử lý văn bản khi có yêu cầu, kiến nghị của cơ quan, người có thẩm quyền kiểm tra hoặc yêu cầu, kiến nghị của cơ quan, tổ chức, cá nhân và cơ quan thông tin đại chúng.
5. Có hành vi cản trở, gây khó khăn cho cơ quan, người có thẩm quyền kiểm tra trong quá trình kiểm tra văn bản.
6. Báo cáo sai sự thật khi thực hiện các quyền quy định tại các khoản 4 và 5 Điều 132 của Nghị định này.
7. Không thực hiện quyết định của cơ quan có thẩm quyền xử lý văn bản do mình ban hành.
8. Những hành vi vi phạm pháp luật khác trong quá trình thực hiện công tác kiểm tra, xử lý văn bản.
Tùy theo tính chất và mức độ của hành vi vi phạm pháp luật về kiểm tra, xử lý văn bản, cơ quan, người có văn bản được kiểm tra phải bị xử lý theo quy định của pháp luật.
Điều 134. Xem xét, xử lý trách nhiệm đối với cơ quan, người ban hành văn bản trái pháp luật
1. Việc xem xét, xử lý trách nhiệm đối với cơ quan, người đã ban hành văn bản trái pháp luật phải căn cứ vào nội dung, tính chất, mức độ trái pháp luật của văn bản và hậu quả của nội dung trái pháp luật gây ra đối với xã hội và trên cơ sở tính chất, mức độ lỗi của cơ quan, người đã ban hành, tham mưu ban hành văn bản đó.
2. Việc xem xét trách nhiệm tập thể, trách nhiệm cá nhân được thực hiện như sau:
a) Cơ quan ban hành văn bản có nội dung trái pháp luật phải tổ chức việc kiểm điểm, xác định trách nhiệm của tập thể và báo cáo cơ quan cấp trên có thẩm quyền xem xét, quyết định theo quy định của pháp luật, đồng thời xem xét trách nhiệm của người đứng đầu cơ quan trong việc ban hành văn bản có nội dung trái pháp luật;
b) Cán bộ, công chức trong quá trình tham mưu soạn thảo, thẩm định, thẩm tra, ban hành văn bản có nội dung trái pháp luật, tùy theo tính chất, mức độ lỗi và nội dung trái pháp luật của văn bản, phải chịu trách nhiệm theo quy định của pháp luật về cán bộ, công chức.
Thủ tục xử lý kỷ luật cán bộ, công chức thực hiện theo quy định của pháp luật về cán bộ, công chức.
3. Cơ quan, người ban hành văn bản khi nhận được kết luận kiểm tra, kiến nghị của cơ quan có thẩm quyền kiểm tra văn bản mà không thực hiện việc xem xét, xử lý văn bản trái pháp luật hoặc không thực hiện thông báo kết quả xử lý theo quy định thì bị xử lý theo quy định của pháp luật về cán bộ, công chức.
Mục 5
CHẾ ĐỘ BÁO CÁO, ĐÔN ĐỐC, CHỈ ĐẠO, KIỂM TRA
CÔNG TÁC KIỂM TRA, XỬ LÝ VĂN BẢN
Điều 135. Chế độ báo cáo
1. Chế độ báo cáo hằng năm về công tác kiểm tra, xử lý văn bản của các bộ, cơ quan ngang bộ, cơ quan thuộc Chính phủ, Ủy ban nhân dân các cấp, chính quyền địa phương ở đơn vị hành chính - kinh tế đặc biệt được thực hiện cụ thể như sau:
a) Cục Kiểm tra văn bản quy phạm pháp luật thuộc Bộ Tư pháp, tổ chức pháp chế bộ, cơ quan ngang bộ, cơ quan thuộc Chính phủ, Sở Tư pháp, Phòng Tư pháp, cơ quan được Ủy ban nhân dân ở đơn vị hành chính - kinh tế đặc biệt giao nhiệm vụ có trách nhiệm chuẩn bị báo cáo hằng năm về công tác kiểm tra, xử lý văn bản trình Bộ trưởng, Thủ trưởng cơ quan ngang bộ, Thủ trưởng cơ quan thuộc Chính phủ, Chủ tịch Ủy ban nhân dân cấp tỉnh, cấp huyện, đơn vị hành chính - kinh tế đặc biệt;
b) Báo cáo hằng năm về công tác kiểm tra, xử lý văn bản của các bộ, cơ quan ngang bộ, cơ quan thuộc Chính phủ, Ủy ban nhân dân cấp tỉnh, chính quyền địa phương ở đơn vị hành chính - kinh tế đặc biệt được gửi đến Bộ Tư pháp. Báo cáo hằng năm về công tác kiểm tra, xử lý văn bản của Ủy ban nhân dân cấp huyện, cấp xã được gửi đến Ủy ban nhân dân cấp tỉnh, cấp huyện đồng thời gửi đến Sở Tư pháp, Phòng Tư pháp để được tổng hợp, báo cáo Ủy ban nhân dân;
c) Thời hạn gửi báo cáo, thời điểm lấy số liệu báo cáo hằng năm về công tác kiểm tra, xử lý văn bản thực hiện theo quy định về công tác thống kê, báo cáo của ngành Tư pháp.
2. Hằng năm, trên cơ sở báo cáo tình hình công tác kiểm tra, xử lý văn bản của các bộ, cơ quan ngang bộ, cơ quan thuộc Chính phủ, Ủy ban nhân dân cấp tỉnh, chính quyền địa phương ở đơn vị hành chính - kinh tế đặc biệt quy định tại khoản 1 Điều này, Bộ Tư pháp có trách nhiệm tổng hợp báo cáo, trình Bộ trưởng Bộ Tư pháp xem xét, báo cáo Thủ tướng Chính phủ.
3. Báo cáo hằng năm về công tác kiểm tra, xử lý văn bản có các nội dung cơ bản sau:
a) Số liệu do bộ, ngành, địa phương mình ban hành đã được tự kiểm tra và xử lý; kiểm tra theo thẩm quyền đã được gửi đến để kiểm tra và thực tế đã kiểm tra; đã phát hiện có nội dung trái pháp luật và yêu cầu cơ quan, người có thẩm quyền ban hành văn bản xem xét, xử lý; đã được xử lý theo yêu cầu của cơ quan kiểm tra văn bản; đã xử lý theo thẩm quyền.
Cơ quan thuộc Chính phủ báo cáo việc phối hợp với tổ chức pháp chế các bộ, cơ quan ngang bộ trong việc tự kiểm tra và kiểm tra văn bản theo thẩm quyền các văn bản thuộc lĩnh vực hoạt động của cơ quan thuộc Chính phủ;
b) Tình hình rà soát văn bản làm căn cứ pháp lý phục vụ công tác kiểm tra văn bản trong lĩnh vực được giao;
c) Đánh giá về kiểm tra, xử lý văn bản; tổ chức, cán bộ; kinh phí cho công tác kiểm tra văn bản; công tác tập huấn, hướng dẫn, bồi dưỡng nghiệp vụ kiểm tra văn bản và các điều kiện bảo đảm khác cho công tác kiểm tra văn bản;
d) Những khó khăn, vướng mắc và kiến nghị;
đ) Danh mục văn bản trái pháp luật về thẩm quyền, nội dung.
Điều 136. Đôn đốc, chỉ đạo, kiểm tra việc thực hiện công tác kiểm tra, xử lý văn bản
1. Đôn đốc, chỉ đạo, kiểm tra việc thực hiện công tác kiểm tra, xử lý văn bản phải được thực hiện thường xuyên, kịp thời.
2. Cục Kiểm tra văn bản quy phạm pháp luật thuộc Bộ Tư pháp có trách nhiệm giúp Bộ trưởng Bộ Tư pháp đôn đốc, chỉ đạo, kiểm tra việc thực hiện công tác kiểm tra, xử lý văn bản của các bộ, ngành, địa phương.
3. Tổ chức pháp chế bộ, cơ quan ngang bộ, cơ quan thuộc Chính phủ, Sở Tư pháp, Phòng Tư pháp, cơ quan được Ủy ban nhân dân ở đơn vị hành chính - kinh tế đặc biệt giao nhiệm vụ có trách nhiệm giúp Bộ trưởng, Thủ trưởng cơ quan ngang bộ, Thủ trưởng cơ quan thuộc Chính phủ, Chủ tịch Ủy ban nhân dân cấp tỉnh, cấp huyện, đơn vị hành chính - kinh tế đặc biệt trong việc đôn đốc, chỉ đạo công tác kiểm tra, xử lý văn bản ở bộ, ngành, địa phương.
Chương IX
RÀ SOÁT, HỆ THỐNG HÓA VĂN BẢN QUY PHẠM PHÁP LUẬT
Mục 1
ĐỐI TƯỢNG NGUYÊN TẮC, TRÁCH NHIỆM RÀ SOÁT,
HỆ THỐNG HÓA VĂN BẢN QUY PHẠM PHÁP LUẬT
Điều 137. Văn bản được rà soát, hệ thống hóa
Văn bản được rà soát, hệ thống hóa gồm các văn bản quy định tại Điều 4 của Luật, trừ Hiến pháp.
Điều 138. Nguyên tắc rà soát, hệ thống hóa văn bản
1. Việc rà soát văn bản phải được tiến hành thường xuyên, ngay khi có căn cứ rà soát; không bỏ sót văn bản thuộc trách nhiệm rà soát; kịp thời xử lý kết quả rà soát; tuân thủ trình tự rà soát.
2. Việc hệ thống hóa văn bản phải được tiến hành định kỳ, đồng bộ; kịp thời công bố Tập hệ thống hóa văn bản còn hiệu lực và các danh mục văn bản; tuân thủ trình tự hệ thống hóa.
3. Việc rà soát, hệ thống hóa văn bản có nội dung thuộc bí mật nhà nước được thực hiện theo quy định của pháp luật về bảo vệ bí mật nhà nước.
Điều 139. Trách nhiệm rà soát, hệ thống hóa văn bản
1. Trách nhiệm của Bộ trưởng, Thủ trưởng cơ quan ngang bộ:
a) Bộ trưởng, Thủ trưởng cơ quan ngang bộ thực hiện rà soát, hệ thống hóa văn bản do mình ban hành hoặc chủ trì soạn thảo; văn bản do cơ quan, tổ chức, đại biểu Quốc hội trình có nội dung điều chỉnh những vấn đề thuộc lĩnh vực quản lý nhà nước của bộ, cơ quan ngang bộ;
b) Thủ trưởng các đơn vị chuyên môn thuộc bộ, cơ quan ngang bộ có trách nhiệm giúp Bộ trưởng, Thủ trưởng cơ quan ngang bộ thực hiện rà soát, hệ thống hóa văn bản điều chỉnh những vấn đề thuộc chức năng, nhiệm vụ quản lý nhà nước của đơn vị mình. Người đứng đầu tổ chức pháp chế hoặc người đứng đầu đơn vị được giao thực hiện công tác pháp chế ở Tổng cục và tương đương, Cục thuộc bộ, cơ quan ngang bộ có trách nhiệm chủ trì, phối hợp với các đơn vị có liên quan giúp Tổng cục trưởng, Cục trưởng thực hiện rà soát, hệ thống hóa văn bản liên quan đến ngành, lĩnh vực quản lý nhà nước của cơ quan, đơn vị mình;
c) Người đứng đầu tổ chức pháp chế thuộc bộ, cơ quan ngang bộ có trách nhiệm đôn đốc, hướng dẫn, tổng hợp kết quả rà soát, hệ thống hóa văn bản chung của bộ, cơ quan ngang bộ.
Cục trưởng Cục Kiểm tra văn bản quy phạm pháp luật thuộc Bộ Tư pháp có trách nhiệm đôn đốc, hướng dẫn, tổng hợp kết quả rà soát, hệ thống hóa văn bản chung của Bộ Tư pháp.
2. Trách nhiệm của Chánh án Tòa án nhân dân tối cao, Viện trưởng Viện kiểm sát nhân dân tối cao, Tổng Kiểm toán nhà nước:
a) Chánh án Tòa án nhân dân tối cao thực hiện rà soát, hệ thống hóa văn bản do Hội đồng Thẩm phán Tòa án nhân dân tối cao, Chánh án Tòa án nhân dân tối cao ban hành; văn bản do Tòa án nhân dân tối cao chủ trì soạn thảo và văn bản do cơ quan, tổ chức, đại biểu Quốc hội trình có nội dung thuộc nhiệm vụ, quyền hạn của Tòa án nhân dân tối cao.
Viện trưởng Viện kiểm sát nhân dân tối cao thực hiện rà soát, hệ thống hóa văn bản do Viện trưởng Viện kiểm sát nhân dân tối cao ban hành; văn bản do Viện kiểm sát nhân dân tối cao chủ trì soạn thảo và văn bản do cơ quan, tổ chức, đại biểu Quốc hội trình có nội dung thuộc nhiệm vụ, quyền hạn của Viện kiểm sát nhân dân tối cao.
Tổng Kiểm toán nhà nước thực hiện rà soát, hệ thống hóa văn bản do Tổng Kiểm toán nhà nước ban hành; văn bản do Kiểm toán nhà nước chủ trì soạn thảo và văn bản do cơ quan, tổ chức, đại biểu Quốc hội trình có nội dung thuộc nhiệm vụ, quyền hạn của Kiểm toán nhà nước;
b) Thủ trưởng các đơn vị thuộc Tòa án nhân dân tối cao, Viện kiểm sát nhân dân tối cao, Kiểm toán nhà nước thực hiện rà soát, hệ thống hóa văn bản theo quy định của Chánh án Tòa án nhân dân tối cao, Viện trưởng Viện kiểm sát nhân dân tối cao, Tổng Kiểm toán nhà nước.
3. Trách nhiệm của Ủy ban nhân dân:
a) Ủy ban nhân dân thực hiện rà soát, hệ thống hóa văn bản do mình và Hội đồng nhân dân cùng cấp ban hành; phối hợp với Thường trực Hội đồng nhân dân kiến nghị Hội đồng nhân dân xử lý kết quả rà soát, hệ thống hóa văn bản của Hội đồng nhân dân;
b) Chủ tịch Ủy ban nhân dân cấp tỉnh, cấp huyện có trách nhiệm chỉ đạo các cơ quan chuyên môn thuộc Ủy ban nhân dân cùng cấp thực hiện rà soát, hệ thống hóa văn bản do Hội đồng nhân dân, Ủy ban nhân dân cấp mình ban hành.
Chủ tịch Ủy ban nhân dân cấp xã có trách nhiệm tổ chức rà soát, hệ thống hóa văn bản do Hội đồng nhân dân, Ủy ban nhân dân cấp mình ban hành;
c) Thủ trưởng các cơ quan chuyên môn thuộc Ủy ban nhân dân cấp tỉnh cấp huyện chủ trì, phối hợp với Ban pháp chế Hội đồng nhân dân và các cơ quan liên quan thực hiện rà soát, hệ thống hóa văn bản của Ủy ban nhân dân Hội đồng nhân dân cùng cấp có nội dung thuộc chức năng, nhiệm vụ quản lý nhà nước của cơ quan mình.
Người đứng đầu tổ chức pháp chế hoặc đơn vị được giao thực hiện công tác pháp chế ở cơ quan chuyên môn thuộc Ủy ban nhân dân cấp tỉnh chủ trì, phối hợp với các đơn vị có liên quan giúp Thủ trưởng cơ quan chuyên môn thực hiện rà soát, hệ thống hóa văn bản.
Thủ trưởng các cơ quan khác đã chủ trì soạn thảo văn bản của Hội đồng nhân dân, Ủy ban nhân dân có trách nhiệm chủ trì, phối hợp với Ban pháp chế Hội đồng nhân dân, Giám đốc Sở Tư pháp, Trưởng Phòng Tư pháp và các cơ quan liên quan thực hiện rà soát, hệ thống hóa văn bản;
d) Giám đốc Sở Tư pháp, Trưởng Phòng Tư pháp có trách nhiệm đôn đốc, hướng dẫn, tổng hợp kết quả rà soát, hệ thống hóa văn bản chung của Hội đồng nhân dân, Ủy ban nhân dân cấp mình.
4. Trách nhiệm của Ủy ban nhân dân ở đơn vị hành chính - kinh tế đặc biệt:
a) Thực hiện rà soát, hệ thống hóa văn bản do mình và Hội đồng nhân dân cùng cấp ban hành; phối hợp với cơ quan có liên quan kiến nghị Hội đồng nhân dân xử lý kết quả rà soát, hệ thống hóa văn bản của Hội đồng nhân dân;
b) Quy định cụ thể trách nhiệm của các cơ quan thuộc thẩm quyền quản lý trong việc giúp Ủy ban nhân dân thực hiện rà soát, hệ thống hóa văn bản.
5. Trường hợp giải thể, nhập, chia, điều chỉnh địa giới hành chính thì Ủy ban nhân dân của đơn vị hành chính mới có trách nhiệm rà soát, hệ thống hóa văn bản do Hội đồng nhân dân, Ủy ban nhân dân của đơn vị hành chính trước đó ban hành.
Mục 2
KIẾN NGHỊ RÀ SOÁT VĂN BẢN QUY PHẠM PHÁP LUẬT,
NGUỒN VĂN BẢN RÀ SOÁT, HỆ THỐNG HÓA, CĂN CỨ RÀ SOÁT, CÁC HÌNH THỨC XỬ LÝ VĂN BẢN QUY PHẠM PHÁP LUẬT ĐƯỢC RÀ SOÁT, SỬ DỤNG KẾT QUẢ RÀ SOÁT
Điều 140. Kiến nghị rà soát văn bản
1. Cơ quan, tổ chức và công dân khi phát hiện văn bản có nội dung trái pháp luật, mâu thuẫn, chồng chéo hoặc không còn phù hợp thì kiến nghị cơ quan nhà nước có trách nhiệm thực hiện rà soát văn bản được quy định tại Điều 139 của Nghị định này.
2. Cơ quan nhận được kiến nghị có trách nhiệm xem xét để thực hiện rà soát văn bản hoặc chuyển kiến nghị đến cơ quan có trách nhiệm rà soát văn bản, đồng thời thông báo cho cơ quan, tổ chức và công dân đã kiến nghị rà soát văn bản.
Điều 141. Nguồn văn bản rà soát, hệ thống hóa
1. Văn bản được sử dụng để rà soát, hệ thống hóa theo thứ tự ưu tiên như sau:
a) Bản gốc, bản chính;
b) Văn bản đăng trên công báo in, công báo điện tử;
c) Bản sao y bản chính, bản sao lục của cơ quan, người có thẩm quyền;
d) Văn bản trên Cơ sở dữ liệu quốc gia về pháp luật;
đ) Văn bản trong Tập hệ thống hóa văn bản quy phạm pháp luật do cơ quan nhà nước có thẩm quyền công bố.
2. Trường hợp có văn bản hợp nhất thì sử dụng văn bản hợp nhất để rà soát, hệ thống hóa.
Điều 142. Căn cứ rà soát văn bản
1. Văn bản là căn cứ để rà soát là văn bản được ban hành sau, có quy định liên quan đến văn bản được rà soát, gồm:
a) Văn bản quy phạm pháp luật có hiệu lực pháp lý cao hơn văn bản được rà soát; văn bản quy phạm pháp luật của chính cơ quan, người có thẩm quyền ban hành văn bản được rà soát;
b) Điều ước quốc tế mà Cộng hòa xã hội chủ nghĩa Việt Nam là thành viên sau thời điểm ban hành văn bản được rà soát.
2. Tình hình phát triển kinh tế - xã hội là căn cứ để rà soát được xác định căn cứ vào chủ trương, đường lối, chính sách của Đảng, Nhà nước; kết quả điều tra, khảo sát và thông tin thực tiễn liên quan đến đối tượng, phạm vi điều chỉnh của văn bản được rà soát.
Điều 143. Các hình thức xử lý văn bản được rà soát
1. Bãi bỏ toàn bộ hoặc một phần văn bản:
a) Bãi bỏ toàn bộ văn bản được áp dụng trong trường hợp đối tượng điều chỉnh của văn bản không còn hoặc toàn bộ quy định của văn bản trái, chồng chéo, mâu thuẫn với văn bản là căn cứ để rà soát hoặc không còn phù hợp với tình hình phát triển kinh tế - xã hội mà không cần thiết ban hành văn bản để thay thế;
b) Bãi bỏ một phần văn bản được áp dụng trong trường hợp một phần đối tượng điều chỉnh của văn bản không còn hoặc một phần nội dung của văn bản trái, chồng chéo, mâu thuẫn với văn bản là căn cứ để rà soát hoặc không còn phù hợp với tình hình phát triển kinh tế - xã hội mà không cần thiết ban hành văn bản để sửa đổi, bổ sung;
c) Văn bản bị bãi bỏ phải được đưa vào danh mục để công bố theo quy định tại Điều 157 của Nghị định này.
2. Thay thế văn bản được áp dụng trong trường hợp toàn bộ hoặc phần lớn nội dung của văn bản trái, chồng chéo, mâu thuẫn với văn bản là căn cứ để rà soát hoặc không còn phù hợp với tình hình phát triển kinh tế - xã hội.
3. Sửa đổi, bổ sung văn bản được áp dụng trong trường hợp một phần nội dung của văn bản trái, chồng chéo, mâu thuẫn với văn bản là căn cứ để rà soát hoặc không còn phù hợp với tình hình phát triển kinh tế - xã hội.
4. Ban hành văn bản mới được áp dụng trong trường hợp qua rà soát phát hiện có quan hệ xã hội cần được điều chỉnh bởi văn bản có hiệu lực pháp lý cao hơn hoặc có quan hệ xã hội cần điều chỉnh nhưng chưa có quy định pháp luật điều chỉnh.
5. Đình chỉ việc thi hành một phần hoặc toàn bộ nội dung văn bản được áp dụng trong trường hợp văn bản được rà soát có quy định trái pháp luật, mâu thuẫn, chồng chéo nếu chưa được sửa đổi, bổ sung, bãi bỏ, thay thế kịp thời và tiếp tục thực hiện thì có thể gây hậu quả nghiêm trọng, ảnh hưởng đến lợi ích của Nhà nước, quyền và lợi ích hợp pháp của tổ chức, cá nhân.
6. Ngưng hiệu lực một phần hoặc toàn bộ văn bản trong một thời hạn nhất định được áp dụng trong trường hợp rà soát văn bản căn cứ vào tình hình phát triển kinh tế - xã hội để giải quyết các vấn đề kinh tế - xã hội phát sinh.
Điều 144. Sử dụng kết quả rà soát, hệ thống hóa văn bản
1. Kết quả rà soát, hệ thống hóa văn bản được sử dụng trong hoạt động xây dựng văn bản quy phạm pháp luật và hoàn thiện hệ thống pháp luật; tra cứu trong áp dụng và thực hiện pháp luật; cập nhật thông tin của văn bản vào Cơ sở dữ liệu quốc gia về pháp luật.
2. Kết quả rà soát văn bản được sử dụng để phục vụ công tác hợp nhất văn bản, pháp điển hệ thống quy phạm pháp luật và kiểm soát thủ tục hành chính.

Điều 145. Xác định văn bản là căn cứ để rà soát và văn bản cần rà soát
1. Văn bản sửa đổi, bổ sung, thay thế, bãi bỏ, đình chỉ việc thi hành, ngưng hiệu lực một hoặc nhiều văn bản là căn cứ để rà soát; văn bản được sửa đổi, bổ sung, thay thế, bãi bỏ, bị ngưng hiệu lực, bị đình chỉ việc thi hành là văn bản cần rà soát.
2. Văn bản sửa đổi, bổ sung, thay thế, bãi bỏ, ngưng hiệu lực, đình chỉ việc thi hành văn bản được sử dụng làm căn cứ ban hành một hoặc nhiều văn bản là căn cứ để rà soát; văn bản có văn bản là căn cứ ban hành được sửa đổi, bổ sung, thay thế, bãi bỏ, bị ngưng hiệu lực, bị đình chỉ việc thi hành là văn bản cần rà soát.
3. Văn bản sửa đổi, bổ sung, thay thế, bãi bỏ, ngưng hiệu lực, đình chỉ văn bản được dẫn chiếu trong nội dung của một hoặc nhiều văn bản là căn cứ để rà soát; văn bản có chứa nội dung được dẫn chiếu đến văn bản được sửa đổi, bổ sung, thay thế, bãi bỏ, bị ngưng hiệu lực, bị đình chỉ việc thi hành là văn bản cần rà soát.
4. Văn bản có quy định liên quan đến một hoặc nhiều văn bản ban hành trước đó là căn cứ để rà soát; văn bản được ban hành trước đó là văn bản cần rà soát.
Điều 146. Xác định tình hình phát triển kinh tế - xã hội là căn cứ rà soát văn bản
Tình hình phát triển kinh tế - xã hội là căn cứ rà soát văn bản được xác định trên cơ sở các tài liệu, thông tin sau:
1. Điều lệ, cương lĩnh, nghị quyết, thông tri, chỉ thị, tài liệu chính thức khác của Đảng; văn bản, tài liệu chính thức của cơ quan nhà nước có thẩm quyền liên quan đến văn bản được rà soát;
2. Kết quả điều tra, khảo sát; thông tin kinh tế - xã hội; số liệu và báo cáo thống kê; thông tin, số liệu thực tiễn, tài liệu khác liên quan đến văn bản được rà soát do cơ quan nhà nước có thẩm quyền công bố.
Điều 147. Nội dung rà soát theo căn cứ là văn bản
1. Hiệu lực của văn bản.
2. Căn cứ ban hành của văn bản.
3. Thẩm quyền ban hành văn bản.
4. Nội dung của văn bản.
Điều 148. Nội dung rà soát theo căn cứ là tình hình phát triển kinh tế - xã hội
1. Đối tượng điều chỉnh của văn bản.
2. Hình thức văn bản.
3. Nội dung của văn bản.
4. Quan hệ xã hội mới cần được điều chỉnh bằng văn bản quy phạm pháp luật.
Điều 149. Trình tự rà soát theo căn cứ là văn bản
1. Thủ trưởng cơ quan, đơn vị phân công người rà soát văn bản ngay sau khi văn bản là căn cứ rà soát được thông qua hoặc ký ban hành.
2. Người rà soát xác định văn bản cần rà soát, báo cáo Thủ trưởng cơ quan, đơn vị quyết định.
3. Người rà soát xem xét, đánh giá phần căn cứ ban hành văn bản được rà soát để xác định và tập hợp đầy đủ văn bản là căn cứ rà soát.
4. Người rà soát xem xét, xác định hiệu lực của văn bản được rà soát theo các trường hợp sau:
a) Trường hợp văn bản được rà soát hết hiệu lực, ngưng hiệu lực theo quy định tại Điều 153 và khoản 1, 2 và 3 Điều 154 của Luật, người rà soát xác định một phần hoặc toàn bộ nội dung, lý do, thời điểm hết hiệu lực, ngưng hiệu lực của văn bản được rà soát. Việc xác định hiệu lực của văn bản quy định tại khoản 4 Điều 154 của Luật được thực hiện theo quy định tại Điều 38 của Nghị định này.
Trường hợp văn bản được rà soát có văn bản là căn cứ rà soát được ban hành theo trình tự, thủ tục quy định tại Luật ban hành văn bản quy phạm pháp luật năm 1996 và Luật sửa đổi, bổ sung một số điều của Luật ban hành văn bản quy phạm pháp luật năm 2002 thì việc xác định các trường hợp hết hiệu lực của văn bản thực hiện theo Điều 78 của Luật ban hành văn bản quy phạm pháp luật năm 1996.
Trường hợp văn bản được rà soát có văn bản là căn cứ rà soát được ban hành theo trình tự, thủ tục quy định tại Luật ban hành văn bản quy phạm pháp luật năm 2008 thì việc xác định các trường hợp hết hiệu lực của văn bản thực hiện theo Điều 81 của Luật ban hành văn bản quy phạm pháp luật năm 2008.
Trường hợp văn bản được rà soát có văn bản là căn cứ rà soát được ban hành theo trình tự, thủ tục quy định tại Luật ban hành văn bản quy phạm pháp luật của Hội đồng nhân dân, Ủy ban nhân dân năm 2004 thì việc xác định các trường hợp hết hiệu lực của văn bản thực hiện theo Điều 53 của Luật ban hành văn bản quy phạm pháp luật của Hội đồng nhân dân, Ủy ban nhân dân năm 2004;
b) Văn bản được xác định hết hiệu lực, ngưng hiệu lực toàn bộ hoặc một phần phải được đưa vào danh mục để công bố theo quy định tại Điều 157 của Nghị định này;
c) Văn bản được xác định còn hiệu lực thì tiếp tục được rà soát về thẩm quyền và nội dung theo quy định tại khoản 5 và 6 Điều này.
5. Người rà soát xem xét, đánh giá thẩm quyền về hình thức và thẩm quyền về nội dung của văn bản được rà soát.
6. Người rà soát xem xét, đánh giá nội dung văn bản được rà soát để xác định quy định trái, chồng chéo, mâu thuẫn với văn bản là căn cứ rà soát.
Điều 150. Trình tự rà soát theo căn cứ là tình hình phát triển kinh tế - xã hội
1. Thủ trưởng cơ quan, đơn vị phân công người rà soát văn bản ngay khi tình hình kinh tế - xã hội có sự thay đổi có thể làm cho nội dung của văn bản không còn phù hợp.
2. Người rà soát xác định văn bản cần rà soát, báo cáo Thủ trưởng cơ quan, đơn vị quyết định.
3. Người rà soát căn cứ vào đối tượng, phạm vi điều chỉnh của văn bản được rà soát, tập hợp thông tin, tài liệu, văn bản là căn cứ xác định sự thay đổi của tình hình kinh tế - xã hội theo quy định tại Điều 146 của Nghị định này.
4. Người rà soát văn bản xem xét, đánh giá văn bản được rà soát để xác định các nội dung quy định tại Điều 148 của Nghị định này.
Điều 151. Lập Phiếu rà soát văn bản
1. Người rà soát lập Phiếu rà soát văn bản theo Mẫu số 01 Phụ lục IV kèm theo Nghị định này trong trường hợp văn bản được rà soát có quy định trái, mâu thuẫn, chồng chéo với văn bản là căn cứ rà soát hoặc không còn phù hợp với tình hình phát triển kinh tế - xã hội.
Trường hợp kết quả rà soát văn bản có nội dung phức tạp, người rà soát đề xuất Thủ trưởng cơ quan, đơn vị xem xét, tổ chức lấy ý kiến của các cơ quan, đơn vị liên quan để hoàn thiện kết quả rà soát.
2. Người rà soát không lập Phiếu rà soát văn bản mà ký vào góc trên của văn bản được rà soát, ghi rõ họ tên, ngày, tháng, năm rà soát trong trường hợp văn bản được rà soát không có quy định trái, mâu thuẫn, chồng chéo với văn bản là căn cứ rà soát hoặc còn phù hợp với tình hình phát triển kinh tế - xã hội.
Điều 152. Lập hồ sơ rà soát văn bản
Người rà soát lập hồ sơ rà soát gồm các tài liệu sau:
1. Văn bản được rà soát;
2. Văn bản là căn cứ rà soát; tài liệu liên quan về tình hình phát triển kinh tế - xã hội;
3. Phiếu rà soát văn bản;
4. Dự thảo báo cáo kết quả rà soát của cơ quan, đơn vị trình Bộ trưởng, Thủ trưởng cơ quan ngang bộ, Ủy ban nhân dân, trong đó đánh giá về hiệu lực, thẩm quyền ban hành, nội dung trái, chồng chéo, mâu thuẫn của văn bản được rà soát với văn bản là căn cứ rà soát hoặc không còn phù hợp với tình hình phát triển kinh tế - xã hội và kiến nghị xử lý;
5. Dự thảo văn bản lấy ý kiến cơ quan liên tịch ban hành văn bản được rà soát về việc xử lý kết quả rà soát (nếu có);
6. Dự thảo văn bản của bộ, cơ quan ngang bộ, Ủy ban nhân dân kiến nghị cơ quan, người có thẩm quyền xử lý văn bản;
7. Các tài liệu khác có liên quan.
Điều 153. Lấy ý kiến và hoàn thiện hồ sơ rà soát văn bản
1. Cơ quan, đơn vị rà soát thuộc bộ, cơ quan ngang bộ lấy ý kiến tổ chức pháp chế; cơ quan, đơn vị rà soát thuộc Bộ Tư pháp lấy ý kiến Cục Kiểm tra văn bản quy phạm pháp luật thuộc Bộ Tư pháp; cơ quan, đơn vị rà soát cấp tỉnh lấy ý kiến Sở Tư pháp; cơ quan, đơn vị rà soát cấp huyện lấy ý kiến Phòng Tư pháp về kết quả rà soát văn bản.
Cơ quan rà soát lấy ý kiến cơ quan liên tịch ban hành văn bản được rà soát về kết quả rà soát văn bản.
2. Cơ quan, đơn vị được lấy ý kiến có trách nhiệm trả lời bằng văn bản, trong đó nêu rõ nội dung nhất trí, nội dung không nhất trí và lý do hoặc ý kiến khác.
3. Cơ quan, đơn vị rà soát hoàn thiện hồ sơ trên cơ sở ý kiến góp ý để trình Bộ trưởng, Thủ trưởng cơ quan ngang bộ, Ủy ban nhân dân các cấp xem xét, quyết định xử lý.
Điều 154. Xử lý hoặc kiến nghị xử lý kết quả rà soát văn bản
1. Bộ trưởng, Thủ trưởng cơ quan ngang bộ, Ủy ban nhân dân các cấp quyết định xử lý hoặc kiến nghị cơ quan, người có thẩm quyền xử lý kết quả rà soát.
2. Tổ chức pháp chế, Sở Tư pháp, Phòng Tư pháp, Ủy ban nhân dân cấp xã lập “Sổ theo dõi văn bản được rà soát” theo Mẫu số 02 Phụ lục IV kèm theo Nghị định này.
Điều 155. Rà soát và xử lý kết quả rà soát văn bản tại Tòa án nhân dân tối cao, Viện kiểm sát nhân dân tối cao, Kiểm toán nhà nước
Việc rà soát văn bản và xử lý kết quả rà soát tại Tòa án nhân dân tối cao, Viện kiểm sát nhân dân tối cao, Kiểm toán nhà nước được thực hiện theo trình tự do Chánh án Tòa án nhân dân tối cao, Viện trưởng Viện kiểm sát nhân dân tối cao, Tổng Kiểm toán nhà nước quy định.
Điều 156. Rà soát và xử lý kết quả rà soát văn bản của Hội đồng nhân dân, Ủy ban nhân dân ở đơn vị hành chính - kinh tế đặc biệt
Việc rà soát và xử lý kết quả rà soát văn bản của Hội đồng nhân dân, Ủy ban nhân dân ở đơn vị hành chính - kinh tế đặc biệt được thực hiện theo trình tự do Ủy ban nhân dân ở đơn vị hành chính - kinh tế đặc biệt quy định.
Điều 157. Công bố danh mục văn bản hết hiệu lực, ngưng hiệu lực
1. Định kỳ hằng năm, Bộ trưởng, Thủ trưởng cơ quan ngang bộ, Chánh án Tòa án nhân dân tối cao, Viện trưởng Viện kiểm sát nhân dân tối cao, Tổng Kiểm toán nhà nước, Chủ tịch Ủy ban nhân dân các cấp công bố danh mục văn bản hết hiệu lực, ngưng hiệu lực thuộc trách nhiệm rà soát của mình, bao gồm cả văn bản quy định chi tiết thi hành hết hiệu lực theo quy định tại khoản 3, 4 và 5 Điều 38 của Nghị định này.
2. Văn bản công bố danh mục văn bản hết hiệu lực, ngưng hiệu lực là quyết định hành chính, phải được đăng Công báo và đăng trên Cổng thông tin hoặc Trang thông tin điện tử của cơ quan rà soát (nếu có) hoặc niêm yết tại các địa điểm quy định tại Điều 98 của Nghị định này.
3. Văn bản hết hiệu lực, ngưng hiệu lực được đưa vào danh mục để công bố định kỳ hằng năm là văn bản có thời điểm hết hiệu lực, thời điểm bắt đầu ngưng hiệu lực trong một năm (tính từ ngày 01 tháng 01 đến hết ngày 31 tháng 12).
Trường hợp văn bản hết hiệu lực, ngưng hiệu lực thuộc đối tượng của kỳ công bố trước nhưng chưa được công bố thì cơ quan rà soát đưa văn bản đó vào danh mục văn bản để công bố.
4. Quyết định công bố danh mục văn bản hết hiệu lực, ngưng hiệu lực của Bộ trưởng, Thủ trưởng cơ quan ngang bộ, Chủ tịch Ủy ban nhân dân cấp tỉnh được gửi đến Bộ Tư pháp; quyết định của Chủ tịch Ủy ban nhân dân cấp huyện được gửi đến Ủy ban nhân dân cấp tỉnh, Sở Tư pháp; quyết định của Chủ tịch Ủy ban nhân dân cấp xã được gửi đến Ủy ban nhân dân cấp huyện, Phòng Tư pháp để theo dõi, tổng hợp.
5. Danh mục văn bản hết hiệu lực, ngưng hiệu lực được lập theo Mẫu số 03, 04 Phụ lục IV kèm theo Nghị định này.
Điều 158. Xử lý văn bản được phát hiện trái pháp luật tại thời điểm ban hành
1. Khi phát hiện văn bản trái pháp luật tại thời điểm ban hành thuộc đối tượng kiểm tra thì cơ quan rà soát thực hiện việc kiểm tra hoặc đề nghị cơ quan có thẩm quyền kiểm tra theo quy định tại Chương VIII của Nghị định này.
2. Khi phát hiện văn bản của Quốc hội, Ủy ban thường vụ Quốc hội, Chủ tịch nước, Chính phủ, Thủ tướng Chính phủ có nội dung không hợp hiến, hợp pháp tại thời điểm ban hành thì cơ quan rà soát văn bản phối hợp với các cơ quan có liên quan kiến nghị cơ quan, người có thẩm quyền xem xét, xử lý.

Điều 159. Tổng rà soát hệ thống văn bản
1. Chính phủ kiến nghị Ủy ban thường vụ Quốc hội quyết định việc tổng rà soát hệ thống văn bản; trình Ủy ban Thường vụ Quốc hội ban hành và tổ chức thực hiện kế hoạch tổng rà soát hệ thống văn bản.
2. Bộ Tư pháp có trách nhiệm giúp Chính phủ xây dựng và làm đầu mối tổ chức thực hiện kế hoạch tổng rà soát hệ thống văn bản.
Điều 160. Quyết định việc rà soát văn bản theo chuyên đề, lĩnh vực, địa bàn
1. Thủ tướng Chính phủ, Bộ trưởng, Thủ trưởng cơ quan ngang bộ, Chánh án Tòa án nhân dân tối cao, Viện trưởng Viện kiểm sát nhân dân tối cao, Tổng Kiểm toán nhà nước, Chủ tịch Ủy ban nhân dân các cấp quyết định việc rà soát văn bản theo chuyên đề, lĩnh vực nhằm xem xét, đánh giá lại các văn bản cùng điều chỉnh một hoặc nhiều nhóm quan hệ xã hội trong một khoảng thời gian cụ thể.
2. Thủ tướng Chính phủ, Bộ trưởng, Thủ trưởng cơ quan ngang bộ, Chủ tịch Ủy ban nhân dân các cấp quyết định việc rà soát văn bản theo địa bàn nhằm xem xét, đánh giá lại các văn bản đã được ban hành có phạm vi và đối tượng điều chỉnh tại một địa bàn cụ thể theo yêu cầu quản lý nhà nước hoặc khi có sự điều chỉnh địa giới hành chính.
Điều 161. Kế hoạch rà soát văn bản theo chuyên đề, lĩnh vực, địa bàn
1. Bộ trưởng, Thủ trưởng cơ quan ngang bộ giúp Thủ tướng Chính phủ lập kế hoạch, tổ chức thực hiện rà soát văn bản theo chuyên đề, lĩnh vực, địa bàn do Thủ tướng Chính phủ quyết định thuộc thẩm quyền quản lý nhà nước của mình.
Thủ trưởng các đơn vị chuyên môn thuộc bộ, cơ quan ngang bộ giúp Bộ trưởng, Thủ trưởng cơ quan ngang bộ lập, tổ chức thực hiện kế hoạch rà soát văn bản điều chỉnh những vấn đề thuộc chức năng, nhiệm vụ quản lý nhà nước của đơn vị mình.
Thủ trưởng các cơ quan chuyên môn thuộc Ủy ban nhân dân cấp tỉnh, cấp huyện chủ trì, phối hợp với Ban pháp chế Hội đồng nhân dân và các cơ quan liên quan lập, tổ chức thực hiện kế hoạch rà soát văn bản của Ủy ban nhân dân, Hội đồng nhân dân cùng cấp có nội dung điều chỉnh những vấn đề thuộc chức năng, nhiệm vụ quản lý nhà nước của cơ quan mình.
2. Nội dung kế hoạch rà soát văn bản bao gồm mục đích, yêu cầu, đối tượng, phạm vi; thời gian, tiến độ thực hiện; phân công cơ quan, đơn vị chủ trì, phối hợp thực hiện; kinh phí và các điều kiện bảo đảm thực hiện kế hoạch.
Điều 162. Kết quả tổng rà soát hệ thống văn bản, rà soát văn bản theo chuyên đề, lĩnh vực, địa bàn
1. Kết quả tổng rà soát hệ thống văn bản, rà soát văn bản theo chuyên đề, lĩnh vực, địa bàn gồm: đánh giá về thực trạng hệ thống văn bản; kiến nghị, đề xuất xử lý văn bản nhằm hoàn thiện pháp luật.
2. Kết quả tổng rà soát hệ thống văn bản, rà soát văn bản theo chuyên đề, lĩnh vực, địa bàn phải được xây dựng thành báo cáo và các danh mục văn bản như sau:
a) Báo cáo kết quả tổng rà soát hệ thống văn bản, rà soát văn bản theo chuyên đề, lĩnh vực, địa bàn nêu rõ quá trình tổ chức thực hiện; kết quả đạt được thông qua việc tổng rà soát, rà soát theo chuyên đề, lĩnh vực, địa bàn; các đánh giá về thực trạng hệ thống văn bản được rà soát và kiến nghị, đề xuất xử lý văn bản;
b) Danh mục văn bản còn hiệu lực, gồm cả văn bản hết hiệu lực một phần; Danh mục văn bản hết hiệu lực, ngưng hiệu lực toàn bộ; Danh mục văn bản hết hiệu lực, ngưng hiệu lực một phần; Danh mục văn bản cần đình chỉ thi hành, ngưng hiệu lực, sửa đổi, bổ sung, thay thế, bãi bỏ hoặc ban hành mới.
Các danh mục văn bản được lập theo Mẫu số 03, 04, 05, 06 Phụ lục IV kèm theo Nghị định này.
Điều 163. Công bố kết quả tổng rà soát hệ thống văn bản; rà soát văn bản theo chuyên đề, lĩnh vực, địa bàn
1. Chính phủ trình Ủy ban thường vụ Quốc hội quyết định công bố kết quả tổng rà soát hệ thống văn bản.
2. Cơ quan, người quyết định rà soát văn bản theo chuyên đề, lĩnh vực, địa bàn quyết định công bố kết quả rà soát.

Điều 164. Định kỳ hệ thống hóa văn bản
Văn bản quy phạm pháp luật còn hiệu lực phải được định kỳ hệ thống hóa và công bố kết quả hệ thống hóa 05 năm một lần. Thời điểm ấn định văn bản thuộc đối tượng hệ thống hóa để công bố (sau đây gọi là thời điểm hệ thống hóa) là ngày 31 tháng 12 của năm thứ năm tính từ thời điểm hệ thống hóa kỳ trước.
Điều 165. Nội dung hệ thống hóa văn bản
1. Tập hợp các văn bản thuộc đối tượng hệ thống hóa.
2. Kiểm tra lại kết quả rà soát văn bản và rà soát bổ sung.
3. Sắp xếp các văn bản còn hiệu lực theo các tiêu chí quy định tại Điều 168 của Nghị định này.
4. Công bố các danh mục văn bản và tập hệ thống hóa văn bản còn hiệu lực.
Điều 166. Kế hoạch hệ thống hóa văn bản
1. Việc định kỳ hệ thống hóa văn bản phải được lập thành kế hoạch.
2. Nội dung kế hoạch gồm:
a) Mục đích, yêu cầu hệ thống hóa;
b) Đối tượng, phạm vi hệ thống hóa;
c) Thời gian, tiến độ thực hiện;
d) Phân công đơn vị chủ trì, đơn vị phối hợp;
đ) Kinh phí và các điều kiện bảo đảm thực hiện kế hoạch.
Điều 167. Trình tự hệ thống hóa văn bản
1. Tập hợp văn bản và kết quả rà soát văn bản để hệ thống hóa:
a) Văn bản để hệ thống hóa theo định kỳ bao gồm: các văn bản trong Tập hệ thống hóa của kỳ hệ thống hóa trước và các văn bản được ban hành trong kỳ hệ thống hóa hiện tại, gồm cả văn bản được ban hành trong kỳ hệ thống hóa hiện tại nhưng chưa có hiệu lực;
b) Kết quả rà soát văn bản để hệ thống hóa được tập hợp từ cơ sở dữ liệu phục vụ kiểm tra, rà soát, hệ thống hóa văn bản của cơ quan, người có thẩm quyền kiểm tra, rà soát, hệ thống hóa văn bản.
2. Kiểm tra lại kết quả rà soát văn bản và rà soát bổ sung:
a) Kết quả rà soát văn bản để hệ thống hóa phải được kiểm tra lại để bảo đảm tính chính xác về hiệu lực của văn bản tính đến thời điểm hệ thống hóa;
b) Trường hợp kết quả rà soát văn bản phản ánh không cập nhật tình trạng pháp lý của văn bản hoặc phát hiện văn bản chưa được rà soát theo quy định thì cơ quan, người có thẩm quyền rà soát phải tiến hành rà soát ngay theo quy định tại Nghị định này.
3. Xác định văn bản thuộc đối tượng hệ thống hóa:
a) Trên cơ sở kết quả rà soát văn bản đã được kiểm tra lại và được rà soát bổ sung, người thực hiện hệ thống hóa xác định các văn bản thuộc đối tượng hệ thống hóa;
b) Văn bản thuộc đối tượng hệ thống hóa văn bản gồm: văn bản trong Tập hệ thống hóa của kỳ hệ thống hóa trước đã được rà soát xác định còn hiệu lực, văn bản được ban hành trong kỳ hệ thống hóa hiện tại đã được rà soát xác định còn hiệu lực, văn bản được ban hành trong kỳ hệ thống hóa hiện tại nhưng chưa có hiệu lực tính đến thời điểm hệ thống hóa.
4. Lập các danh mục văn bản:
a) Danh mục văn bản quy phạm pháp luật còn hiệu lực, gồm cả văn bản quy phạm pháp luật hết hiệu lực một phần và văn bản chưa có hiệu lực tính đến thời điểm hệ thống hóa; Danh mục văn bản quy phạm pháp luật hết hiệu lực, ngưng hiệu lực toàn bộ; Danh mục văn bản quy phạm pháp luật hết hiệu lực, ngưng hiệu lực một phần; Danh mục văn bản quy phạm pháp luật cần đình chỉ thi hành, ngưng hiệu lực, sửa đổi, bổ sung, thay thế, bãi bỏ hoặc ban hành mới;
b) Các danh mục văn bản được lập theo Mẫu số 03, 04, 05 và 06 Phụ lục IV kèm theo Nghị định này.
5. Sắp xếp các văn bản còn hiệu lực thành Tập hệ thống hóa văn bản:
Căn cứ vào Danh mục văn bản còn hiệu lực, người thực hiện hệ thống hóa văn bản sắp xếp các văn bản thành Tập hệ thống hóa văn bản.
6. Công bố kết quả hệ thống hóa văn bản:
a) Bộ trưởng, Thủ trưởng cơ quan ngang bộ, Chánh án Tòa án nhân dân tối cao, Viện trưởng Viện kiểm sát nhân dân tối cao, Tổng Kiểm toán nhà nước, Chủ tịch Ủy ban nhân dân các cấp công bố kết quả hệ thống hóa văn bản;
b) Kết quả hệ thống hóa văn bản gồm các danh mục văn bản và Tập hệ thống hóa văn bản quy định tại khoản 4 và 5 Điều này;
c) Hình thức văn bản công bố kết quả hệ thống hóa văn bản là quyết định hành chính;
d) Kết quả hệ thống hóa văn bản phải được công bố chậm nhất là 30 ngày đối với văn bản của trung ương, 60 ngày đối với văn bản của Hội đồng nhân dân, Ủy ban nhân dân các cấp kể từ thời điểm hệ thống hóa.
7. Kết quả hệ thống hóa văn bản phải được đăng trên Cổng thông tin hoặc Trang thông tin điện tử của cơ quan hệ thống hóa văn bản (nếu có). Trường hợp cần thiết, cơ quan hệ thống hóa văn bản phát hành Tập hệ thống hóa văn bản bằng hình thức văn bản giấy.
Danh mục văn bản hết hiệu lực, ngưng hiệu lực ở trung ương và cấp tỉnh phải được đăng Công báo. Danh mục văn bản hết hiệu lực, ngưng hiệu lực ở cấp huyện và cấp xã phải được niêm yết tại trụ sở cơ quan rà soát.
Trường hợp sau khi công bố, phát hiện các danh mục văn bản và Tập hệ thống hóa văn bản còn hiệu lực có sai sót thì tiến hành rà soát lại và đính chính.
Điều 168. Tiêu chí sắp xếp văn bản trong Tập hệ thống hóa văn bản và các danh mục văn bản
Văn bản trong Tập hệ thống hóa văn bản và các danh mục văn bản phải được sắp xếp theo các tiêu chí sau:
1. Lĩnh vực quản lý nhà nước của cơ quan hoặc lĩnh vực do cơ quan hệ thống hóa quyết định;
2. Thứ tự văn bản có hiệu lực pháp lý cao hơn đến văn bản có hiệu lực pháp lý thấp hơn;
3. Thứ tự thời gian ban hành văn bản từ văn bản được ban hành trước đến văn bản được ban hành sau;
4. Tiêu chí khác phù hợp với yêu cầu quản lý nhà nước.
Điều 169. Quan hệ phối hợp giữa các cơ quan, đơn vị trong việc hệ thống hóa văn bản
1. Tổ chức pháp chế thuộc bộ, cơ quan ngang bộ, Cục Kiểm tra văn bản quy phạm pháp luật thuộc Bộ Tư pháp, Sở Tư pháp, Phòng Tư pháp chủ trì giúp Bộ trưởng, Thủ trưởng cơ quan ngang bộ, Ủy ban nhân dân xây dựng và làm đầu mối tổ chức thực hiện kế hoạch hệ thống hóa.
2. Các đơn vị chuyên môn thuộc bộ, cơ quan ngang bộ thực hiện hệ thống hóa văn bản theo trình tự hệ thống hóa văn bản và gửi kết quả cho tổ chức pháp chế thuộc bộ, cơ quan ngang bộ để tổng hợp.
Các đơn vị chuyên môn thuộc Bộ Tư pháp thực hiện hệ thống hóa văn bản theo trình tự hệ thống hóa văn bản và gửi kết quả đến Cục Kiểm tra văn bản quy phạm pháp luật thuộc Bộ Tư pháp để tổng hợp.
Các cơ quan, đơn vị thực hiện hệ thống hóa văn bản cấp tỉnh, cấp huyện hệ thống hóa văn bản theo trình tự hệ thống hóa văn bản và gửi kết quả cho Sở Tư pháp, Phòng Tư pháp để tổng hợp.
3. Tổ chức pháp chế, Cục Kiểm tra văn bản quy phạm pháp luật thuộc Bộ Tư pháp, Sở Tư pháp, Phòng Tư pháp kiểm tra lại kết quả hệ thống hóa văn bản, trình Bộ trưởng, Thủ trưởng cơ quan ngang bộ, Chủ tịch Ủy ban nhân dân cùng cấp xem xét, công bố.
4. Quan hệ phối hợp giữa các đơn vị thuộc thẩm quyền quản lý của Tòa án nhân dân tối cao, Viện kiểm sát nhân dân tối cao, Kiểm toán nhà nước trong việc hệ thống hóa văn bản được thực hiện theo quy định của Chánh án Tòa án nhân dân tối cao, Viện trưởng Viện kiểm sát nhân dân tối cao, Tổng Kiểm toán nhà nước.
5. Bộ, cơ quan ngang bộ, Ủy ban nhân dân cấp tỉnh gửi báo cáo kết quả hệ thống hóa văn bản về Bộ Tư pháp trong thời hạn 20 ngày, kể từ ngày công bố kết quả hệ thống hóa theo quy định tại điểm d khoản 6 Điều 167 của Nghị định này để theo dõi, tổng hợp, báo cáo Thủ tướng Chính phủ.
Mục 6

Điều 170. Chế độ báo cáo hằng năm
1. Chế độ báo cáo hằng năm về công tác rà soát, hệ thống hóa văn bản của các bộ, cơ quan ngang bộ, Ủy ban nhân dân các cấp được thực hiện theo quy định sau:
a) Cục Kiểm tra văn bản quy phạm pháp luật thuộc Bộ Tư pháp; tổ chức pháp chế thuộc bộ, cơ quan ngang bộ; Sở Tư pháp, Phòng Tư pháp, công chức tư pháp - hộ tịch có trách nhiệm xây dựng báo cáo hằng năm về công tác rà soát, hệ thống hóa văn bản trình Bộ trưởng, Thủ trưởng cơ quan ngang bộ, Chủ tịch Ủy ban nhân dân.
b) Báo cáo hằng năm về công tác rà soát, hệ thống hóa văn bản của các bộ, cơ quan ngang bộ, Ủy ban nhân dân cấp tỉnh được gửi đến Bộ Tư pháp để tổng hợp, báo cáo Thủ tướng Chính phủ.
Báo cáo hằng năm về công tác rà soát, hệ thống hóa văn bản của Ủy ban nhân dân cấp huyện được gửi đến Ủy ban nhân dân cấp tỉnh, Sở Tư pháp để Sở Tư pháp tổng hợp, báo cáo Ủy ban nhân dân cấp tỉnh.
Báo cáo hằng năm về công tác rà soát, hệ thống hóa văn bản của Ủy ban nhân dân cấp xã được gửi đến Ủy ban nhân dân cấp huyện, Phòng Tư pháp để Phòng Tư pháp tổng hợp, báo cáo Ủy ban nhân dân cấp huyện.
c) Thời hạn gửi báo cáo, thời điểm lấy số liệu báo cáo hằng năm về công tác rà soát, hệ thống hóa văn bản thực hiện theo quy định của pháp luật về thống kê.
2. Hằng năm, trên cơ sở báo cáo công tác rà soát, hệ thống hóa văn bản của các bộ, cơ quan ngang bộ, Ủy ban nhân dân cấp tỉnh quy định tại khoản 1 Điều này, Bộ Tư pháp tổng hợp, báo cáo Thủ tướng Chính phủ.
3. Báo cáo hằng năm về công tác rà soát, hệ thống hóa văn bản cần có các nội dung sau:
a) Kết quả công tác rà soát, hệ thống hóa văn bản, gồm: số liệu về số văn bản phải rà soát, số văn bản đã được rà soát, kết quả rà soát văn bản, tình hình xử lý văn bản được rà soát; kết quả hệ thống hóa văn bản; kết quả rà soát văn bản theo chuyên đề, lĩnh vực, địa bàn;
b) Đánh giá chung về chất lượng công tác xây dựng, ban hành văn bản thuộc trách nhiệm rà soát, hệ thống hóa;
c) Đánh giá về thể chế rà soát, hệ thống hóa văn bản; tổ chức, biên chế, kinh phí cho công tác rà soát, hệ thống hóa văn bản;
d) Hoạt động phối hợp trong rà soát, hệ thống hóa văn bản; tập huấn, hướng dẫn, bồi dưỡng kỹ năng, nghiệp vụ rà soát, hệ thống hóa văn bản và các điều kiện bảo đảm khác;
đ) Khó khăn, vướng mắc và kiến nghị;
e) Những vấn đề khác có liên quan.
4. Chánh án Tòa án nhân dân tối cao, Viện trưởng Viện kiểm sát nhân dân tối cao, Tổng Kiểm toán nhà nước cung cấp thông tin về tình hình, kết quả rà soát, hệ thống hóa văn bản theo quy định tại điểm đ khoản 1 Điều 186 của Nghị định này.
Điều 171. Biểu mẫu rà soát, hệ thống hóa văn bản
1. Phiếu rà soát văn bản quy phạm pháp luật (Mẫu số 01 Phụ lục IV).
2. Sổ theo dõi văn bản quy phạm pháp luật được rà soát (Mẫu số 02 Phụ lục IV).
3. Danh mục văn bản quy phạm pháp luật hết hiệu lực, ngưng hiệu lực toàn bộ (Mẫu số 03 Phụ lục IV).
4. Danh mục văn bản quy phạm pháp luật hết hiệu lực, ngưng hiệu lực một phần (Mẫu số 04 Phụ lục IV).
5. Danh mục văn bản quy phạm pháp luật còn hiệu lực (Mẫu số 05 Phụ lục IV).
6. Danh mục văn bản quy phạm pháp luật cần đình chỉ thi hành, ngưng hiệu lực, sửa đổi, bổ sung, thay thế, bãi bỏ hoặc ban hành mới (Mẫu số 06 Phụ lục IV).

Mục 1
BẢO ĐẢM NGUỒN NHÂN LỰC
Điều 172. Cán bộ, công chức tham gia xây dựng văn bản quy phạm pháp luật và hoàn thiện hệ thống pháp luật
1. Cán bộ, công chức tham gia xây dựng văn bản quy phạm pháp luật và hoàn thiện hệ thống pháp luật là những người có nhiệm vụ chính sau:
a) Xây dựng chính sách, đánh giá tác động của chính sách, lập đề nghị xây dựng văn bản quy phạm pháp luật;
b) Soạn thảo, chỉnh lý văn bản quy phạm pháp luật;
c) Thẩm định, thẩm tra đề nghị xây dựng văn bản quy phạm pháp luật; thẩm định, thẩm tra dự án, dự thảo văn bản quy phạm pháp luật;
d) Kiểm tra, rà soát, hệ thống hóa văn bản quy phạm pháp luật;
đ) Hợp nhất văn bản quy phạm pháp luật, pháp điển hệ thống quy phạm pháp luật;
e) Kiểm soát thủ tục hành chính;
g) Theo dõi tình hình thi hành pháp luật.
2. Cán bộ, công chức tham gia xây dựng văn bản quy phạm pháp luật và hoàn thiện hệ thống pháp luật được bố trí, sử dụng, đào tạo, bồi dưỡng theo quy định của pháp luật về cán bộ, công chức và quy định của Nghị định này.
Điều 173. Bố trí, sử dụng cán bộ, công chức tham gia xây dựng văn bản quy phạm pháp luật và hoàn thiện hệ thống pháp luật
1. Cơ quan, tổ chức, người có thẩm quyền trong xây dựng văn bản quy phạm pháp luật và hoàn thiện pháp luật có trách nhiệm:
a) Bảo đảm đầy đủ cán bộ, công chức có năng lực, trình độ trong tổng biên chế được giao tham gia xây dựng văn bản quy phạm pháp luật và hoàn thiện hệ thống pháp luật;
b) Kiện toàn đội ngũ cán bộ, công chức tham gia xây dựng văn bản quy phạm pháp luật và hoàn thiện hệ thống pháp luật của cơ quan, địa phương mình;
c) Thường xuyên rà soát đội ngũ cán bộ, công chức để điều động, biệt phái cán bộ, công chức có năng lực, trình độ từ các cơ quan khác sang làm công tác xây dựng văn bản quy phạm pháp luật và hoàn thiện hệ thống pháp luật khi có yêu cầu.
2. Cơ quan, tổ chức, người có thẩm quyền trong xây dựng văn bản quy phạm pháp luật và hoàn thiện hệ thống pháp luật có trách nhiệm ưu tiên sử dụng cán bộ, công chức được đào tạo về pháp luật và có năng lực thực hiện công tác xây dựng pháp luật để soạn thảo các văn bản quy phạm pháp luật mà cơ quan mình có trách nhiệm chủ trì soạn thảo hoặc có thẩm quyền ban hành.
Điều 174. Đào tạo, bồi dưỡng cán bộ, công chức tham gia xây dựng văn bản quy phạm pháp luật và hoàn thiện hệ thống pháp luật
1. Cơ quan, tổ chức, người có thẩm quyền trong xây dựng, ban hành văn bản quy phạm pháp luật và hoàn thiện hệ thống pháp luật có trách nhiệm:
a) Ít nhất mỗi năm một lần, tổ chức bồi dưỡng nâng cao kiến thức chuyên môn, kỹ năng nghề nghiệp cho đội ngũ cán bộ, công chức trực tiếp tham gia xây dựng văn bản quy phạm pháp luật và hoàn thiện hệ thống pháp luật;
b) Cử cán bộ, công chức trực tiếp tham gia xây dựng văn bản quy phạm pháp luật và hoàn thiện hệ thống pháp luật của cơ quan mình tham dự các khóa bồi dưỡng chuyên sâu về xây dựng văn bản quy phạm pháp luật và hoàn thiện hệ thống pháp luật do Bộ Tư pháp tổ chức;
c) Ưu tiên cử cán bộ, công chức trực tiếp tham gia xây dựng văn bản quy phạm pháp luật và hoàn thiện hệ thống pháp luật có triển vọng tham dự các chương trình đào tạo luật dài hạn ở nước ngoài.
2. Bộ trưởng Bộ Tư pháp có trách nhiệm:
a) Biên soạn các tài liệu hướng dẫn về nghiệp vụ xây dựng, ban hành văn bản quy phạm pháp luật và hoàn thiện hệ thống pháp luật;
b) Tổ chức đào tạo chuyên môn, nghiệp vụ về xây dựng văn bản quy phạm pháp luật và hoàn thiện hệ thống pháp luật;
c) Hằng năm, tổ chức các khóa bồi dưỡng chuyên sâu cho cán bộ, công chức tham gia xây dựng văn bản quy phạm pháp luật và hoàn thiện hệ thống pháp luật về kiến thức, phương pháp và kỹ năng xây dựng chính sách, đánh giá tác động của chính sách, thẩm định chính sách trong quá trình lập đề nghị xây dựng và soạn thảo văn bản quy phạm pháp luật; soạn thảo văn bản quy phạm pháp luật, thẩm định dự án, dự thảo văn bản quy phạm pháp luật; kiểm tra, rà soát, hệ thống hóa, hợp nhất văn bản quy phạm pháp luật, pháp điển hệ thống quy phạm pháp luật; kiểm soát thủ tục hành chính; lấy ý kiến góp ý đối với dự án, dự thảo văn bản quy phạm pháp luật; đánh giá việc thi hành văn bản quy phạm pháp luật.
Điều 175. Sử dụng chuyên gia
1. Trong quá trình lập đề nghị xây dựng văn bản quy phạm pháp luật, soạn thảo, thẩm định, thẩm tra, Thủ trưởng các cơ quan, tổ chức, đơn vị được sử dụng chuyên gia có năng lực phù hợp với từng công việc.
2. Việc sử dụng chuyên gia phải theo các nguyên tắc sau:
a) Được lựa chọn theo tiêu chí cụ thể cho từng công việc;
b) Được thuê làm việc theo hợp đồng vụ việc;
c) Nếu đã tham gia xây dựng nội dung chính sách, soạn thảo văn bản quy phạm pháp luật thì không tham gia thẩm định, thẩm tra đề nghị xây dựng văn bản quy phạm pháp luật, dự án, dự thảo văn bản quy phạm pháp luật đó.
3. Chuyên gia được hưởng các chế độ sau:
a) Được nhận tiền thù lao theo thỏa thuận trong hợp đồng;
b) Được cung cấp thông tin có liên quan trong quá trình thực hiện công việc của chuyên gia ghi trong hợp đồng;
c) Được hỗ trợ chi phí tham dự hội nghị, hội thảo khoa học trong nước có nội dung phù hợp với công việc của chuyên gia ghi trong hợp đồng với mức hỗ trợ theo quy định hiện hành;
d) Có quyền đề xuất phương thức thực hiện công việc của chuyên gia ghi trong hợp đồng phù hợp với yêu cầu chuyên môn của công việc đó;
đ) Được khen thưởng và vinh danh xứng đáng với kết quả, cống hiến cho sự nghiệp xây dựng pháp luật và hoàn thiện hệ thống pháp luật Việt Nam.
Chế độ ưu đãi đối với chuyên gia là người Việt Nam ở nước ngoài hoặc là người nước ngoài được áp dụng theo quy định về thu hút cá nhân hoạt động khoa học và công nghệ tại Việt Nam.
4. Tiền thù lao và tiền hỗ trợ cho chuyên gia được thực hiện theo các quy định sau:
a) Tiền thù lao và tiền hỗ trợ cho chuyên gia được thanh toán từ ngân sách nhà nước theo phân cấp hoặc từ nguồn kinh phí hợp pháp khác (nếu có);
b) Tiền thù lao cho chuyên gia được thanh toán theo mức ghi trong hợp đồng;
c) Việc thanh, quyết toán tiền thù lao và tiền hỗ trợ cho chuyên gia được thực hiện theo quy định của pháp luật và trên cơ sở đánh giá kết quả hoạt động của chuyên gia.
Điều 176. Sử dụng cộng tác viên kiểm tra, rà soát, hệ thống hóa văn bản
1. Cộng tác viên kiểm tra văn bản:
a) Cộng tác viên kiểm tra văn bản là người có kinh nghiệm trong lĩnh vực xây dựng và kiểm tra văn bản phù hợp với lĩnh vực văn bản được kiểm tra, do người đứng đầu cơ quan kiểm tra văn bản ký hợp đồng cộng tác, hoạt động theo cơ chế khoán việc hoặc hợp đồng có thời hạn, chịu sự quản lý, hướng dẫn nghiệp vụ và thực hiện công việc theo yêu cầu của cơ quan kiểm tra văn bản;
b) Cơ quan kiểm tra văn bản chịu trách nhiệm xây dựng và quản lý đội ngũ cộng tác viên kiểm tra văn bản. Quy mô đội ngũ cộng tác viên kiểm tra văn bản của từng cơ quan kiểm tra văn bản tùy thuộc vào phạm vi, tính chất văn bản thuộc thẩm quyền kiểm tra;
c) Người đứng đầu cơ quan kiểm tra văn bản của các bộ, cơ quan ngang bộ, cơ quan thuộc Chính phủ, Ủy ban nhân dân cấp tỉnh, cấp huyện tham mưu xây dựng, trình Bộ trưởng, Thủ trưởng cơ quan ngang bộ, Thủ trưởng cơ quan thuộc Chính phủ, Chủ tịch Ủy ban nhân dân cấp tỉnh, cấp huyện căn cứ yêu cầu, điều kiện thực tế của cơ quan, địa phương mình ban hành quy chế cộng tác viên kiểm tra văn bản; ký hợp đồng cộng tác với cộng tác viên kiểm tra văn bản theo quy định của pháp luật về hợp đồng.
2. Cộng tác viên rà soát, hệ thống hóa văn bản:
a) Cộng tác viên rà soát, hệ thống hóa văn bản là người có kinh nghiệm trong lĩnh vực xây dựng và rà soát, hệ thống hóa văn bản phù hợp với lĩnh vực văn bản được rà soát, hệ thống hóa, được người đứng đầu cơ quan rà soát ký hợp đồng cộng tác;
b) Cơ quan, đơn vị rà soát chịu trách nhiệm trong việc xây dựng và quản lý đội ngũ cộng tác viên rà soát hệ thống hóa văn bản. Số lượng cộng tác viên rà soát, hệ thống hóa văn bản của từng cơ quan, đơn vị rà soát văn bản tùy thuộc vào phạm vi, tính chất văn bản thuộc trách nhiệm rà soát, hệ thống hóa.
Mục 2
BẢO ĐẢM CƠ SỞ VẬT CHẤT CHO VIỆC XÂY DỰNG VĂN BẢN QUY PHẠM PHÁP LUẬT VÀ HOÀN THIỆN HỆ THỐNG PHÁP LUẬT
Điều 177. Hiện đại hóa phương tiện, hạ tầng kỹ thuật
Cơ quan, tổ chức, người có thẩm quyền trong xây dựng văn bản quy phạm pháp luật và hoàn thiện hệ thống pháp luật có trách nhiệm:
1. Ưu tiên bố trí kinh phí để hiện đại hóa phương tiện, hạ tầng kỹ thuật phục vụ hoạt động xây dựng văn bản quy phạm pháp luật và hoàn thiện hệ thống pháp luật;
2. Ứng dụng thành tựu khoa học, công nghệ, nhất là công nghệ thông tin để đẩy nhanh tiến độ soạn thảo; cung cấp thông tin liên quan nhằm bảo đảm chất lượng xây dựng văn bản quy phạm pháp luật và hoàn thiện hệ thống pháp luật;
3. Hoàn thiện và vận hành hiệu quả Cơ sở dữ liệu quốc gia về pháp luật bảo đảm kết nối thông suốt, thường xuyên, liên tục giữa trung ương và địa phương; bảo đảm cập nhật kịp thời, đầy đủ, chính xác văn bản vào Cơ sở dữ liệu quốc gia về pháp luật đáp ứng nhu cầu khai thác, sử dụng.
Điều 178. Cơ sở dữ liệu phục vụ công tác kiểm tra, rà soát, hệ thống hóa văn bản
1. Cơ sở dữ liệu phục vụ công tác kiểm tra, rà soát, hệ thống hóa văn bản bao gồm các tài liệu bằng văn bản, được phân loại, sắp xếp một cách khoa học và tin học hóa để thống nhất quản lý, tra cứu, sử dụng.
2. Cơ sở dữ liệu phục vụ công tác kiểm tra, rà soát, hệ thống hóa văn bản gồm:
a) Văn bản phục vụ kiểm tra, rà soát, hệ thống hóa;
b) Hồ sơ rà soát văn bản theo quy định tại Điều 152 của Nghị định này;
c) Kết quả hệ thống hóa văn bản;
d) Kết quả kiểm tra và xử lý văn bản; các thông tin về nghiệp vụ kiểm tra;
đ) Các tài liệu khác có liên quan.
3. Cơ sở dữ liệu quy định tại khoản 1 và 2 Điều này được kết nối, tích hợp với Cơ sở dữ liệu quốc gia về pháp luật.
4. Các bộ, cơ quan ngang bộ, Ủy ban nhân dân cấp tỉnh, cấp huyện có trách nhiệm cập nhật các nội dung quy định tại khoản 2 Điều này vào cơ sở dữ liệu phục vụ công tác kiểm tra, rà soát, hệ thống hóa văn bản.

Điều 179. Nguồn kinh phí
1. Kinh phí bảo đảm cho công tác xây dựng văn bản quy phạm pháp luật và hoàn thiện hệ thống pháp luật do ngân sách nhà nước cấp theo phân cấp hiện hành.
2. Trong quá trình xây dựng văn bản quy phạm pháp luật và hoàn thiện hệ thống pháp luật, các cơ quan thực hiện được sử dụng nguồn vốn hỗ trợ từ các dự án, tổ chức, cá nhân trong và ngoài nước theo quy định của pháp luật để bổ sung vào kinh phí xây dựng văn bản quy phạm pháp luật và hoàn thiện hệ thống pháp luật.
Điều 180. Nguyên tắc bảo đảm kinh phí
1. Kinh phí xây dựng văn bản quy phạm pháp luật và hoàn thiện hệ thống pháp luật được bảo đảm từ ngân sách nhà nước, phù hợp với quy định của Luật ngân sách nhà nước và các văn bản quy định chi tiết, hướng dẫn thi hành.
2. Việc bố trí kinh phí cho công tác xây dựng văn bản quy phạm pháp luật và hoàn thiện hệ thống pháp luật tại cơ quan, đơn vị phải căn cứ vào chủ trương, đường lối của Đảng; chính sách của Nhà nước; chức năng, nhiệm vụ được giao, chương trình, kế hoạch xây dựng văn bản quy phạm pháp luật được cấp có thẩm quyền phê duyệt, phù hợp với tiến độ triển khai nhiệm vụ.
3. Việc sử dụng kinh phí bảo đảm cho công tác xây dựng văn bản quy phạm pháp luật và hoàn thiện hệ thống pháp luật phải đúng mục đích, nội dung, chế độ và định mức chi theo quy định của pháp luật về các chế độ chi tiêu tài chính.
4. Thực hiện khoán chi theo kết quả thực hiện các nhiệm vụ xây dựng văn bản quy phạm pháp luật theo hướng dẫn của Bộ Tài chính; bảo đảm không phát sinh tăng kinh phí so với dự toán được cấp có thẩm quyền giao.
5. Cơ quan chủ trì thực hiện nhiệm vụ xây dựng văn bản quy phạm pháp luật và hoàn thiện hệ thống pháp luật được sử dụng nguồn vốn hỗ trợ từ các dự án, tổ chức, cá nhân trong và ngoài nước theo quy định của pháp luật để bổ sung vào nguồn kinh phí thực hiện.
Điều 181. Hoạt động xây dựng văn bản quy phạm pháp luật và hoàn thiện hệ thống pháp luật được ngân sách nhà nước cấp kinh phí
1. Hoạt động lập đề nghị xây dựng văn bản quy phạm pháp luật và chương trình xây dựng luật, pháp lệnh gồm các hoạt động như: tổng kết việc thi hành pháp luật; khảo sát, đánh giá thực trạng quan hệ xã hội có liên quan; nghiên cứu khoa học, thông tin tư liệu, điều ước quốc tế, dịch tài liệu của nước ngoài ra tiếng Việt; xây dựng nội dung của chính sách; đánh giá tác động của chính sách; tổ chức lấy ý kiến các cơ quan, tổ chức có liên quan; chỉnh lý, hoàn thiện đề nghị xây dựng văn bản quy phạm pháp luật; lập các loại danh mục, chương trình, kế hoạch xây dựng văn bản quy phạm pháp luật của Chính phủ, Thủ tướng Chính phủ, bộ, cơ quan ngang bộ và chính quyền địa phương.
2. Hoạt động xây dựng văn bản quy phạm pháp luật gồm các hoạt động như: tổ chức soạn thảo văn bản; tập hợp, rà soát, đánh giá văn bản có liên quan; đánh giá tác động của văn bản; tổ chức lấy ý kiến cơ quan, tổ chức có liên quan, chỉnh lý, hoàn thiện văn bản.
3. Hoạt động góp ý, thẩm định, thẩm tra đề nghị xây dựng văn bản quy phạm pháp luật và dự án, dự thảo văn bản quy phạm pháp luật gồm các hoạt động như: tổ chức Hội đồng tư vấn thẩm định, Hội đồng thẩm định, Hội đồng thẩm tra; lấy ý kiến chuyên gia, nhà khoa học trong trường hợp cần thiết; xây dựng, chỉnh lý báo cáo thẩm định, báo cáo thẩm tra; văn bản góp ý.
4. Các hoạt động liên quan đến tổ chức thi hành pháp luật gồm các hoạt động như: phổ biến, giáo dục pháp luật; kiểm tra, xử lý văn bản quy phạm pháp luật; rà soát, hệ thống hóa văn bản quy phạm pháp luật; kiểm soát thủ tục hành chính; tổ chức thi hành pháp luật và theo dõi tình hình thi hành pháp luật; hợp nhất văn bản quy phạm pháp luật, pháp điển; Công báo; dịch văn bản quy phạm pháp luật ra tiếng nước ngoài, tiếng dân tộc thiểu số.
5. Nội dung chi và mức chi quy định tại Điều này được thực hiện theo quy định của Bộ trưởng Bộ Tài chính.
Điều 182. Lập dự toán, quản lý, sử dụng và quyết toán kinh phí bảo đảm cho xây dựng văn bản quy phạm pháp luật và hoàn thiện hệ thống pháp luật
1. Kinh phí bảo đảm cho công tác xây dựng văn bản quy phạm pháp luật và hoàn thiện hệ thống pháp luật, bao gồm cả kinh phí lập đề nghị xây dựng luật, pháp lệnh, do ngân sách nhà nước cấp, được tổng hợp chung vào dự toán ngân sách chi thường xuyên của bộ, ngành và cơ quan chuyên môn ở địa phương.
Ngoài nguồn kinh phí này, ngân sách nhà nước bố trí một khoản kinh phí để hỗ trợ cho việc xây dựng dự án luật, dự thảo nghị quyết của Quốc hội, dự án pháp lệnh, dự thảo nghị quyết của Ủy ban thường vụ Quốc hội, bao gồm cả chương trình xây dựng luật, pháp lệnh được phê duyệt và cấp cho cơ quan, đơn vị chủ trì soạn thảo dự án luật, pháp lệnh, dự thảo nghị quyết.
2. Việc lập dự toán, quản lý, phân bổ kinh phí bảo đảm cho công tác xây dựng văn bản quy phạm pháp luật và hoàn thiện hệ thống pháp luật được thực hiện theo quy định của Luật ngân sách nhà nước và các văn bản có liên quan. Trên cơ sở dự toán ngân sách nhà nước được giao, tính chất phức tạp của văn bản được dự kiến xây dựng và hoạt động hoàn thiện hệ thống pháp luật được dự kiến thực hiện, Thủ trưởng cơ quan, đơn vị được giao chủ trì quyết định phân bổ định mức kinh phí phù hợp.
3. Đối với trường hợp bố trí kinh phí xây dựng văn bản quy phạm pháp luật theo phương thức khoán theo kết quả thực hiện nhiệm vụ, việc quyết toán thực hiện trên cơ sở: quyết định phê duyệt chương trình, kế hoạch xây dựng văn bản quy phạm pháp luật của cấp có thẩm quyền; văn bản quy phạm pháp luật đã được ban hành đúng chương trình, kế hoạch, dự toán được giao; tờ trình cấp có thẩm quyền ban hành văn bản quy phạm pháp luật đảm bảo đúng tiến độ theo chương trình, kế hoạch đã được phê duyệt. Cơ quan, tổ chức chủ trì soạn thảo văn bản quy phạm pháp luật thực hiện lưu giữ hồ sơ, chứng từ quyết toán theo hướng dẫn của Bộ trưởng Bộ Tài chính.
4. Trường hợp cuối năm nhiệm vụ xây dựng văn bản quy phạm pháp luật và hoàn thiện hệ thống pháp luật chưa hoàn thành được cơ quan có thẩm quyền cho phép chuyển tiếp sang năm sau thực hiện thì được chuyển kinh phí tương ứng sang sử dụng và quyết toán vào năm sau.
Chương XI
ĐIỀU KHOẢN THI HÀNH
Điều 183. Trách nhiệm tổ chức thi hành văn bản quy phạm pháp luật
Văn bản quy phạm pháp luật phải được tổ chức thi hành kịp thời, hiệu quả. Đối với luật, pháp lệnh, nội dung tổ chức thi hành văn bản quy phạm pháp luật tập trung vào các vấn đề sau:
1. Xây dựng kế hoạch tổ chức thi hành văn bản quy phạm pháp luật;
2. Tổ chức thực hiện chính sách, biện pháp trong văn bản quy phạm pháp luật;
3. Phổ biến văn bản quy phạm pháp luật;
4. Ban hành văn bản quy định chi tiết thi hành văn bản quy phạm pháp luật (nếu có);
5. Tập huấn văn bản quy phạm pháp luật;
6. Tổ chức tiếp nhận, xử lý phản ánh, kiến nghị của cá nhân, tổ chức;
7. Bảo đảm cơ sở vật chất, kinh phí, tổ chức bộ máy và nguồn nhân lực để triển khai thi hành văn bản quy phạm pháp luật;
8. Theo dõi, kiểm tra, đôn đốc việc thi hành văn bản quy phạm pháp luật;
9. Sơ kết, tổng kết việc thi hành văn bản quy phạm pháp luật;
10. Báo cáo việc tổ chức triển khai thi hành văn bản quy phạm pháp luật và kiến nghị, xử lý vướng mắc trong việc tổ chức thi hành văn bản quy phạm pháp luật.
Điều 184. Trách nhiệm của Bộ trưởng, Thủ trưởng cơ quan ngang bộ, Ủy ban nhân dân trong việc bảo đảm các điều kiện cho công tác xây dựng văn bản quy phạm pháp luật và hoàn thiện hệ thống pháp luật
1. Tuân thủ trình tự, thủ tục xây dựng, ban hành văn bản quy phạm pháp luật quy định tại Luật và Nghị định này.
2. Bảo đảm các điều kiện cho công tác xây dựng văn bản quy phạm pháp luật trong bộ, cơ quan ngang bộ, địa phương.
3. Bồi dưỡng, nâng cao năng lực lập đề nghị xây dựng văn bản quy phạm pháp luật; kỹ năng soạn thảo, đánh giá tác động của chính sách, lấy ý kiến góp ý đối với dự án, dự thảo; đánh giá việc thi hành văn bản quy phạm pháp luật.
4. Cung cấp thông tin liên quan đến ngành, lĩnh vực do mình phụ trách khi có yêu cầu của cơ quan chủ trì soạn thảo, cơ quan thẩm định, thẩm tra.
5. Hướng dẫn việc xây dựng, ban hành văn bản quy phạm pháp luật, hoàn thiện hệ thống pháp luật trong phạm vi bộ, cơ quan ngang bộ, địa phương.
6. Bộ Tư pháp có trách nhiệm hướng dẫn thống nhất về chuyên môn, nghiệp vụ xây dựng văn bản quy phạm pháp luật và hoàn thiện hệ thống pháp luật.
Điều 185. Trách nhiệm của các cơ quan, cá nhân trong công tác kiểm tra, xử lý văn bản quy phạm pháp luật
1. Trách nhiệm của Bộ trưởng, Thủ trưởng cơ quan ngang bộ:
a) Xây dựng và tổ chức thực hiện kế hoạch kiểm tra văn bản thuộc thẩm quyền kiểm tra của bộ, ngành mình;
b) Chủ trì, phối hợp với Bộ Tư pháp, Văn phòng Chính phủ và các cơ quan có liên quan trong việc kiểm tra, xử lý văn bản có quy định thuộc lĩnh vực quản lý nhà nước của bộ, ngành mình do các bộ, cơ quan ngang bộ, Hội đồng nhân dân và Ủy ban nhân dân cấp tỉnh ban hành;
c) Tổ chức bồi dưỡng nghiệp vụ kiểm tra, xử lý văn bản cho đội ngũ cán bộ, công chức kiểm tra văn bản; tổ chức và quản lý đội ngũ cộng tác viên kiểm tra văn bản thuộc quyền quản lý của bộ, ngành mình;
d) Tổ chức mạng lưới thông tin, cập nhật và quản lý cơ sở dữ liệu phục vụ cho việc kiểm tra, xử lý văn bản trong bộ, cơ quan ngang bộ;
đ) Sơ kết, tổng kết về công tác kiểm tra, xử lý văn bản của bộ, cơ quan ngang bộ.
2. Trách nhiệm của Bộ trưởng Bộ Tư pháp:
a) Giúp Chính phủ thống nhất quản lý nhà nước về công tác kiểm tra, xử lý văn bản trong phạm vi toàn quốc;
b) Chủ trì, phối hợp với Văn phòng Chính phủ, các bộ, ngành, cơ quan có liên quan tổ chức thực hiện kế hoạch kiểm tra văn bản thuộc thẩm quyền kiểm tra của Bộ trưởng Bộ Tư pháp;
c) Đôn đốc, chỉ đạo, kiểm tra việc thực hiện công tác kiểm tra, xử lý văn bản của các bộ, cơ quan ngang bộ, chính quyền địa phương;
d) Hướng dẫn nghiệp vụ, kiểm tra công tác kiểm tra, xử lý văn bản đối với tổ chức pháp chế bộ, cơ quan ngang bộ, cơ quan thuộc Chính phủ, Sở Tư pháp, Phòng Tư pháp;
đ) Tổ chức bồi dưỡng nghiệp vụ kiểm tra, xử lý văn bản cho đội ngũ cán bộ, công chức kiểm tra văn bản; tổ chức và quản lý đội ngũ cộng tác viên kiểm tra văn bản;
e) Tổ chức mạng lưới thông tin, cập nhật và quản lý cơ sở dữ liệu phục vụ cho việc kiểm tra văn bản; tổ chức nghiên cứu khoa học về kiểm tra, xử lý văn bản;
g) Sơ kết, tổng kết về công tác kiểm tra, xử lý văn bản của bộ.
3. Trách nhiệm của Ủy ban nhân dân cấp tỉnh, Ủy ban nhân dân cấp huyện:
a) Xây dựng và tổ chức thực hiện kế hoạch kiểm tra văn bản ở địa phương;
b) Đôn đốc, chỉ đạo kiểm tra việc thực hiện công tác kiểm tra, xử lý văn bản ở địa phương;
c) Phối hợp và tạo điều kiện để các cơ quan kiểm tra văn bản thực hiện việc kiểm tra văn bản theo thẩm quyền;
d) Tổ chức bồi dưỡng nghiệp vụ kiểm tra văn bản; tổ chức và quản lý đội ngũ cộng tác viên kiểm tra văn bản tại địa phương; tổ chức nghiên cứu khoa học về kiểm tra văn bản;
đ) Tổ chức mạng lưới thông tin, cập nhật và quản lý cơ sở dữ liệu phục vụ cho việc kiểm tra văn bản;
e) Sơ kết, tổng kết về công tác kiểm tra, xử lý văn bản của địa phương.
Sở Tư pháp, Phòng Tư pháp giúp Ủy ban nhân dân cùng cấp thực hiện quản lý nhà nước về công tác kiểm tra, xử lý văn bản được quy định tại khoản này.
Điều 186. Trách nhiệm của các cơ quan, cá nhân trong công tác rà soát, hệ thống hóa văn bản quy phạm pháp luật
1. Trách nhiệm của Bộ trưởng, Thủ trưởng cơ quan ngang bộ, Chánh án Tòa án nhân dân tối cao, Viện trưởng Viện kiểm sát nhân dân tối cao, Tổng Kiểm toán nhà nước:
a) Đôn đốc, kiểm tra hoạt động rà soát, hệ thống hóa văn bản quy phạm pháp luật theo thẩm quyền;
b) Hướng dẫn, bồi dưỡng kỹ năng, nghiệp vụ rà soát, hệ thống hóa văn bản quy phạm pháp luật; tổ chức và quản lý đội ngũ cộng tác viên rà soát, hệ thống hóa văn bản quy phạm pháp luật;
c) Tổ chức mạng lưới thông tin, cập nhật và quản lý cơ sở dữ liệu phục vụ cho việc rà soát, hệ thống hóa văn bản quy phạm pháp luật;
d) Sơ kết, tổng kết về công tác rà soát, hệ thống hóa văn bản quy phạm pháp luật;
đ) Chánh án Tòa án nhân dân tối cao, Viện trưởng Viện kiểm sát nhân dân tối cao, Tổng Kiểm toán nhà nước cung cấp thông tin, kết quả về tình hình rà soát, hệ thống hóa văn bản để Bộ Tư pháp giúp Chính phủ tổng hợp, xây dựng báo cáo Quốc hội, Ủy ban thường vụ Quốc hội.
2. Trách nhiệm của Bộ trưởng Bộ Tư pháp:
a) Giúp Chính phủ thống nhất quản lý nhà nước về công tác rà soát, hệ thống hóa văn bản quy phạm pháp luật;
b) Đôn đốc, chỉ đạo và kiểm tra công tác rà soát, hệ thống hóa văn bản quy phạm pháp luật của các bộ, cơ quan ngang bộ, chính quyền địa phương;
c) Hướng dẫn, bồi dưỡng kỹ năng, nghiệp vụ rà soát, hệ thống hóa văn bản trong phạm vi toàn quốc; tổ chức và quản lý đội ngũ cộng tác viên rà soát, hệ thống hóa văn bản quy phạm pháp luật;
d) Tổ chức mạng lưới thông tin, cập nhật và quản lý cơ sở dữ liệu phục vụ cho việc rà soát, hệ thống hóa văn bản quy phạm pháp luật;
đ) Sơ kết, tổng kết về công tác rà soát, hệ thống hóa văn bản quy phạm pháp luật.
3. Trách nhiệm của Ủy ban nhân dân các cấp:
a) Quy định cụ thể về đầu mối chủ trì, cơ chế phân công phối hợp, điều kiện bảo đảm cho công tác rà soát, hệ thống hóa văn bản quy phạm pháp luật;
b) Đôn đốc, chỉ đạo công tác rà soát, hệ thống hóa văn bản quy phạm pháp luật ở địa phương;
c) Hướng dẫn, bồi dưỡng nghiệp vụ rà soát, hệ thống hóa văn bản quy phạm pháp luật; tổ chức và quản lý đội ngũ cộng tác viên rà soát, hệ thống hóa văn bản quy phạm pháp luật;
d) Tổ chức mạng lưới thông tin, cập nhật và quản lý cơ sở dữ liệu phục vụ cho việc rà soát, hệ thống hóa văn bản quy phạm pháp luật;
đ) Sơ kết, tổng kết về công tác rà soát, hệ thống hóa văn bản quy phạm pháp luật của địa phương.
Điều 187. Trách nhiệm của các cơ quan trong công tác Công báo
1. Văn phòng Chính phủ giúp Chính phủ thống nhất quản lý nhà nước về công tác Công báo và có chính sách xã hội hóa Công báo, có trách nhiệm:
a) Quản lý, xuất bản, phát hành Công báo nước Cộng hòa xã hội chủ nghĩa Việt Nam; việc in công báo theo hình thức đấu thầu công khai theo quy định của pháp luật về đấu thầu;
b) Hướng dẫn hình thức, thể thức, kỹ thuật trình bày ấn phẩm Công báo;
c) Hướng dẫn, kiểm tra về nghiệp vụ đăng văn bản trên Công báo đối với Văn phòng Ủy ban nhân dân tỉnh, thành phố trực thuộc trung ương;
d) Sơ kết, tổng kết tình hình tổ chức thực hiện các quy định của pháp luật về Công báo;
đ) Duy trì và quản lý Trang công báo điện tử và thực hiện tích hợp Trang công báo trên Cổng thông tin điện tử Chính phủ.
2. Trách nhiệm của Ủy ban nhân dân cấp tỉnh:
Ủy ban nhân dân cấp tỉnh có trách nhiệm bảo đảm hoạt động đăng văn bản trên Công báo cấp tỉnh đáp ứng yêu cầu thông tin pháp luật, phục vụ hoạt động quản lý nhà nước ở địa phương; quyết định kinh phí cho hoạt động xuất bản Công báo cấp tỉnh trên cơ sở dự toán kinh phí được Hội đồng nhân dân cấp tỉnh phê duyệt; quy định giá bán Công báo cấp tỉnh trên cơ sở định mức giá do Bộ trưởng Bộ Tài chính hướng dẫn; quyết định cấp phát Công báo cấp tỉnh miễn phí; kiểm tra hoạt động xuất bản, phát hành Công báo ở địa phương; tổ chức chỉ đạo việc quản lý, sử dụng, khai thác Công báo cấp phát miễn phí của địa phương.
Điều 188. Điều khoản chuyển tiếp
1. Các văn bản quy phạm pháp luật được ban hành trước ngày 01 tháng 7 năm 2016 đang còn hiệu lực, chưa được kiểm tra, rà soát, hệ thống hóa thì việc kiểm tra, rà soát, hệ thống hóa được thực hiện theo quy định của Luật và Nghị định này.
2. Việc cấp phát miễn phí Công báo nước Cộng hòa xã hội chủ nghĩa Việt Nam cho xã, phường, thị trấn năm 2016 tiếp tục thực hiện theo quy định tại khoản 2 Điều 16 Nghị định số 100/2010/NĐ-CP ngày 28 tháng 9 năm 2010 của Chính phủ về Công báo.
Điều 189. Hiệu lực thi hành
1. Nghị định này có hiệu lực thi hành từ ngày 01 tháng 7 năm 2016.
2. Nghị định số 24/2009/NĐ-CP ngày 05 tháng 3 năm 2009 của Chính phủ quy định chi tiết và biện pháp thi hành Luật ban hành văn bản quy phạm pháp luật; Nghị định số 91/2006/NĐ-CP ngày 06 tháng 9 năm 2006 của Chính phủ quy định chi tiết thi hành một số điều của Luật ban hành văn bản quy phạm pháp luật của Hội đồng nhân dân, Ủy ban nhân dân; Nghị định số 40/2010/NĐ-CP ngày 12 tháng 4 năm 2010 của Chính phủ về kiểm tra, xử lý văn bản quy phạm pháp luật; Nghị định số 100/2010/NĐ-CP ngày 28 tháng 9 năm 2010 của Chính phủ về Công báo; Nghị định số 16/2013/NĐ-CP ngày 06 tháng 02 năm 2013 của Chính phủ về rà soát, hệ thống hóa văn bản quy phạm pháp luật hết hiệu lực kể từ ngày Nghị định này có hiệu lực thi hành./.
