CIRCULAR
Regulations on the List of Products and Goods with Potential to Cause Safety Hazards under the Management Responsibility of the Ministry of Information and Communications
pertaining to the responsibility for management of the Ministry of Information and Communications
Pursuant to the Law on Product Quality and Commodities dated November 21, 2007;
Pursuant to the Law on Telecommunications dated November 23, 2009;
Pursuant to the Radio Frequency Law dated November 23, 2009, and the Law Amending and Supplementing Certain Provisions of the Radio Frequency Law dated November 9, 2022;
Pursuant to the Law on Information Technology dated June 29, 2006;
Pursuant to Decree No. 132/2008/ND-CP dated December 31, 2008 of the Government detailing the implementation of certain provisions of the Product Quality Law, and Decree No. 74/2018/ND-CP dated May 15, 2018 of the Government amending and supplementing certain provisions of Decree No. 132/2008/ND-CP dated December 31, 2008 of the Government detailing the implementation of certain provisions of the Product Quality Law;

Pursuant to Decree No. 48/2022/NĐ-CP dated July 26, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Information and Communications;
Pursuant to the proposal of the Director of the Science and Technology Department,
The Minister of Information and Communications issues this Circular regulating the List of Products and Goods with Potential to Cause Safety Hazards under the Management Responsibility of the Ministry of Information and Communications.
Article 1. Scope of Regulation
Article 1. This Circular regulates the List of Products and Goods with Potential to Cause Safety Hazards under the Management Responsibility of the Ministry of Information and Communications (hereinafter referred to as the List of Products and Goods Group 2) and the principles for managing products and goods group 2.
Article 2. This Circular applies only to products and goods with HS codes and product descriptions specified in the List of Products and Goods Group 2.
Article 2. Applicability
This Circular applies to:
1. Organizations and individuals engaged in production and business activities of products and goods listed in the List of Products and Goods Group 2 in Vietnam.
2. Organizations and individuals involved in quality management activities of products and goods listed in the List of Products and Goods Group 2 in Vietnam.
Article 3. List of Products and Goods Group 2
Article 3. The List of Products and Goods Group 2 and the form of management are regulated as follows:
a) "List of Information and Communication Technology Products and Goods that must be certified and declared as compliant" is stipulated in Appendix I of this Circular.
b) "List of Information and Communication Technology Products and Goods that must be declared as compliant" is stipulated in Appendix II of this Circular.
Article 4. The Ministry of Information and Communications shall review, amend, and supplement the List of Products and Goods Group 2 periodically, in accordance with state management policies.
Article 4. Principles for Managing Products and Goods Group 2
1. The management of the quality of products and goods listed in the List of Products and Goods Group 2 shall be carried out in accordance with the regulations of the Ministry of Information and Communications on certification and declaration of compliance, and quality inspection of information and communication technology products and goods, and corresponding technical standards.
2. Products and goods listed in the List of Products and Goods Group 2 that integrate functions of other products and goods listed in the List of Products and Goods Group 2 must fully comply with all applicable technical standards for the integrated products and goods.
3. Products and goods listed in the List of Products and Goods Group 2 that fall within the scope of application of two or more national technical standards must comply with the certification and declaration of compliance requirements set forth in those technical standards.
4. In cases where a technical standard promulgated before the effective date of this Circular provides different requirements for certification and declaration of compliance compared to those stipulated in this Circular, the requirements of this Circular shall apply.
5. In cases where a new technical standard amends, supplements, or replaces a technical standard specified in the List of Products and Goods Group 2, the provisions of the new technical standard shall apply.
Article 5. Implementation Provisions
Article 10. This Circular shall take effect from July 15, 2023.
Article 11. Circular No. 02/2022/TT-BTTTT dated May 16, 2022 of the Minister of Information and Communications regulating the List of Products and Goods with Potential to Cause Safety Hazards under the Management Responsibility of the Ministry of Information and Communications shall cease to be effective from the date this Circular takes effect.
Article 12. Certificates of Compliance and Notifications of Acceptance of Declarations of Compliance issued prior to the effective date of this Circular and still valid shall continue to be applied until the effective date of the new technical standards replacing the existing technical standards and standards mentioned in the Certificates of Compliance and Notifications of Acceptance of Declarations of Compliance.
Article 6. Implementation Organization
Article 13. The Heads of the Office, Department of Science and Technology, Heads of agencies and units under the Ministry of Information and Communications, and related organizations and individuals are responsible for implementing this Circular.
Article 14. During the application of technical standards and testing, organizations and individuals shall promptly reflect any difficulties and implement according to the guidance of the Ministry of Information and Communications (Department of Science and Technology).
Article 15. In cases where there are difficulties in determining the HS code of imported goods as products and goods with potential to cause safety hazards within the scope of regulation of this Circular, the Ministry of Information and Communications (Department of Science and Technology) shall coordinate with the Ministry of Finance (General Customs Department) to provide guidance and handle uniformly.

(d) Mobile terminal devices for terrestrial communications that are not mobile phones must use E-UTRA FDD (4G) technology from July 1, 2024. The conformity certificate for mobile terminal devices for terrestrial communications that are not mobile phones and only integrate/use W-CDMA FDD (3G), GSM (2G and 2.5G) technology according to QCVN 117:2020/BTTTT will continue to be valid until their expiration date, but no later than July 30, 2024.

Short-range radio transmitting and receiving devices mentioned herein do not include radio receiving-only devices; wideband data transmission devices operating in the 2.4 GHz band with equivalent isotropically radiated power (EIRP) less than 60 mW; 5 GHz band radio access devices with equivalent isotropically radiated power (EIRP) less than 60 mW. Conformity declaration shall only be carried out when the device complies with the frequency band and technical conditions as prescribed.
