CIRCULAR

Regulations on managing the National Product Development Program until 2030

Based on the Law on Science and Technology dated June 18, 2013;

Based on Decree No. 08/2014/NĐ-CP dated January 27, 2014 of the Government detailing and guiding the implementation of certain provisions of the Law on Science and Technology;

Technology;

Decision No. 157/QĐ-TTg dated February 1, 2021 of the Prime Minister promulgating the National Product Development Program until 2030;

Implementing At the proposal of the Director of the Department of Science and Technology for Economic and Engineering Industries and the Director of the Legal Department;

The Minister of Science and Technology issues this Circular to regulate the management of the National Product Development Program until 2030.

This Circular regulates the management of the National Product Development Program until 2030 (hereinafter referred to as the Program), which was issued by the Prime Minister under Decision No. 157/QĐ-TTg dated February 1, 2021.

Chapter I

GENERAL PROVISIONS

Article 1. Scope of Regulation

This Circular applies to state agencies, enterprises, organizations, individuals managing and implementing the Program, and other related organizations and individuals.

Article 2. Applicability

1. National products are products within priority development fields of the State, approved by the Prime Minister, meeting the requirements stipulated in Clause 1, Section II, Article 1 of Decision No. 157/QĐ-TTg dated February 1, 2021 of the Prime Minister promulgating the National Product Development Program until 2030.

Article 3. Explanation of Terms

In this Circular, the following terms are understood as follows:

Scientific and technological tasks for developing national products are national-level scientific and technological tasks comprising scientific and technological projects and experimental production projects aimed at resolving major scientific and technological issues to serve production and develop national products approved by the Prime Minister.

3. The framework project for developing national products is a document expressing general information about objectives, contents, main tasks, expected products, and the list of scientific and technological tasks for developing national products. The framework project for developing national products is abbreviated as: Framework Project.

4. The Steering Committee of the National Product Development Program is established by the Minister of Science and Technology, with the task of advising on the implementation of activities under the Program. The Steering Committee of the National Product Development Program is abbreviated as: Steering Committee of the Program.

5. The Program management unit includes the specialized management unit and the financial management unit. The specialized management unit is the entity assigned by the Ministry of Science and Technology to manage the Program professionally and organize its implementation. The financial management unit is the entity assigned by the Ministry of Science and Technology to manage the use of state budget funds and perform activities serving state management to implement tasks under the Program.

6. The leading organization for scientific and technological tasks for developing national products is an organization or enterprise assigned to lead the implementation of such scientific and technological tasks. The leading organization for scientific and technological tasks for developing national products is abbreviated as: Leading Organization.

7. The head of the scientific and technological task for developing national products is an individual assigned to organize the implementation of such scientific and technological tasks. The head of the scientific and technological task for developing national products is abbreviated as: Head of Task.

8. The sectoral management ministry is the ministry assigned by the Government to perform state management functions over the sectors and fields of national products.

9. People's Committee of province, centrally governed city is abbreviated as: People's Committee of province.

9. The People's Committee of the province, the centrally governed city shall be abbreviated as: The People's Committee of the province.

Article 4. Code number of scientific and technological tasks for developing national products under the Program

The code number of scientific and technological tasks for developing national products under the Program: SPQG.XX.ĐT (or DA).YY/ZZ. In which:

1. SPQG is the common symbol of the Program;

2. XX is the symbol consisting of two digits indicating the order of the national product approved by the Prime Minister;

3. DT is the symbol for scientific and technological research topic; or DA is the symbol for pilot production project;

4. YY is the symbol consisting of two digits indicating the serial number of the research topic or pilot production project according to each national product;

5. ZZ is the symbol consisting of two digits indicating the year the task begins implementation.

Article 5. Preferential policies and support for developing national products

1. Agencies, organizations, and individuals base on the provisions at Clauses 3, 4, 5, and 6 Section II Article 1 Decision No. 157/QD-TTg and other preferential policies as prescribed by law, propose preferential support contents for developing national products to the competent authority for consideration and decision.

2. The procedures and formalities for assessing and approving preferential policies and support for developing national products shall be carried out in accordance with the relevant laws corresponding to each form of support.

Article 6. Management Organization of the Program

1. The management organization of the Program shall operate in accordance with the provisions at Section IV Article 1 Decision No. 157/QD-TTg.

2. The Program is under the direction and coordination of the Steering Committee of the Program decided by the Prime Minister.

3. The Minister of Science and Technology decides to establish and promulgate the organizational regulations and operations of the Program's Steering Committee.

Article 7. Determining the List of National Products

1. National products selected for development must comply with the provisions at Clause 1 Section II Article 1 Decision No. 157/QD-TTg.

2. Sectoral management ministries, sectoral management agencies, and provincial People's Committees base on the provisions select national products to build the Proposal Form for National Products according to Model A1-ĐX-SPQG issued together with this Circular and send it to the Ministry of Science and Technology.

3. The Ministry of Science and Technology compiles, reviews, and evaluates proposals for national products from sectoral management ministries, sectoral management agencies, and provincial People's Committees, and submits them to the Prime Minister for approval of the List of National Products. The Minister of Science and Technology reviews and submits to the Prime Minister for decision regarding priority national products for development based on government and Prime Minister directives.

4. Based on the proposals of sectoral management ministries, sectoral management agencies, and provincial People's Committees as stipulated in Clause 2 of this Article, the Ministry of Science and Technology compiles, reviews, and evaluates, and submits to the Prime Minister for review and decision on amending and supplementing the List of National Products.

5. For national products already approved by the Prime Minister in the National Product Development Program up to 2020 that require continued support to expand production scale, improve quality, and enhance competitiveness in the National Product Development Program up to 2030, sectoral management ministries, sectoral management agencies, and provincial People's Committees base on actual conditions compile needs and submit to the Ministry of Science and Technology for compilation, review, and submission to the Prime Minister for approval.

Chapter II

BUILDING THE FRAMEWORK PROPOSAL AND DETERMINING THE LIST OF TASKS

SCIENTIFIC AND TECHNOLOGICAL TASKS FOR DEVELOPING NATIONAL PRODUCTS

UNDER THE FRAMEWORK PROPOSAL

Article 8. Construction of the Framework Proposal and Determination of the List of Scientific and Technological Tasks for Developing National Products

1. Based on the Prime Minister's Decision approving the List of National Products, the Ministry of Science and Technology shall announce a call for proposals and the deadline for submitting the Implementation Proposal Form for national products.

2. Ministries managing sectors and fields, People's Committees of provinces shall select and compile proposals from organizations and individuals (if any), build the Implementation Proposal Form for national products according to Model A2-ĐXTK-SPQG issued together with this Circular, and send it to the Ministry of Science and Technology.

3. The Ministry of Science and Technology shall take the lead, coordinate with ministries managing sectors and fields, provincial People's Committees involved, and experts (if necessary) to compile the content of the proposals, draft the Explanation of the Framework Proposal for developing national products according to Model A3-TMĐAK-SPQG, and draft the Framework Proposal for developing national products along with the list of scientific and technological tasks for developing national products within the Framework Proposal according to Model A4-ĐAK-SPQG issued together with this Circular.

4. The Ministry of Science and Technology shall organize the review of the Framework Proposal, determine the scientific and technological tasks for developing national products within the Framework Proposal according to Articles 9 and 10 of this Circular. The Minister of Science and Technology shall approve the Framework Proposal and the list of scientific and technological tasks for developing national products within the Framework Proposal according to Model A8-QĐ-ĐAK-DMNV-SPQG issued together with this Circular after receiving written comments from ministries managing sectors and fields, provincial People's Committees involved.

5. Within no more than 15 days from the date of approval, the Ministry of Science and Technology shall publicly announce the scientific and technological tasks for developing national products ordered in the annual plan on the National Scientific and Technological Task Management System and the Ministry of Science and Technology's electronic portal to select or directly assign to organizations and individuals having the capability to implement.

Based on the implementation time of the scientific and technological tasks for developing national products approved in the list and the actual situation, the Ministry of Science and Technology shall publicly announce the scientific and technological tasks for developing national products ordered in subsequent years' plans on the National Scientific and Technological Task Management System and the Ministry of Science and Technology's electronic portal to select or directly assign to organizations and individuals having the capability to implement.

The procedures and processes for selection and direct assignment shall be carried out according to Chapter III of this Circular.

6. Based on the actual situation, the Ministry of Science and Technology shall consider and decide to adjust and supplement the Framework Proposal and the list of scientific and technological tasks for developing national products within the Framework Proposal.

The procedures and processes for adjustment and supplementation shall be implemented similarly to the procedures and processes for approval stipulated in Clause 2, Clause 3, and Clause 4 of this Article.

Article 9. Organization and Activities of the Advisory Council for Reviewing the Framework Proposal and Determining the Scientific and Technological Tasks for Developing National Products within the Framework Proposal

1. The Minister of Science and Technology shall establish the Scientific and Technological Advisory Council for reviewing the Framework Proposal and determining the scientific and technological tasks for developing national products within the Framework Proposal (hereinafter referred to as the Council).

a) The Council shall have the responsibility to advise the Minister of Science and Technology on reviewing the Framework Proposal and determining the scientific and technological tasks for developing national products within the Framework Proposal;

b) The Council shall consist of 09 to 11 members including: Chairman, Vice-Chairman, and members who are experts from the database of science and technology experts approved by the Ministry of Science and Technology, management officials, economic experts, and enterprise representatives, among which at most 60% of the total number of members are scientific experts. Each scientific and technological task for developing national products within the Framework Proposal shall allocate two members as reviewers;

c) In case of necessity, the Minister of Science and Technology may decide the number of members and composition of the Council different from the provisions of point b, Clause 1 of this Article;

d) The Program Management Unit shall be responsible for organizing Council meetings.

2. At least 2/3 of the total number of Council members must attend each meeting, including two reviewers. The Council operates under the chairmanship of the Council Chairman. If the Chairman is absent, the Deputy Chairman shall be authorized in writing to chair the meeting.

3. Representatives of the Program Steering Committee, representatives of ministries managing sectors and fields, and representatives of related units may be invited to attend Council meetings.

4. Documents serving the Council shall be sent to Council members at least five working days before the meeting. These documents include:

a) Decision establishing the Council;

b) Explanation of the Framework Proposal for developing national products according to Model A3-TMĐAK-SPQG issued together with this Circular;

c) Draft of the Framework Proposal for developing national products along with the list of scientific and technological tasks for developing national products within the Framework Proposal according to Model A4-ĐAK-SPQG issued together with this Circular;

d) Implementation Proposal Form for national products according to Model A2-ĐXTK-SPQG issued together with this Circular;

đ) Model Comment and Evaluation Form for the Framework Proposal according to Model A5-PNXĐG-ĐAK-SPQG, Model Comment Form for scientific and technological tasks for developing national products within the Framework Proposal according to Model A6-PNX-NV-SPQG, Model Evaluation Form for scientific and technological tasks for developing national products within the Framework Proposal according to Model A7-PĐG-NV-SPQG issued together with this Circular;

e) Other relevant documents (if any).

5. The Ministry of Science and Technology shall appoint two administrative secretaries to prepare documents and organize Council meetings.

6. The Council shall operate according to the procedures and processes stipulated in Article 10 of this Circular.

7. Based on the results of the Council's work and the written opinions of the relevant sectoral management agencies, the Minister of Science and Technology shall approve the framework proposal and the list of national product development science and technology tasks under the framework proposal for each national product in accordance with Model A8-QĐ-ĐAK-DMNV-SPQG issued together with this Circular.

8. In cases where necessary, the Minister of Science and Technology may seek advisory opinions from independent domestic or foreign experts or establish another Council to review the framework proposal and determine the national product development science and technology tasks under the framework proposal.

Article 10. Procedures and formalities for the Council's work

1. The administrative secretary announces the decision to establish the Council.

2. A representative of the Ministry of Science and Technology summarizes the requirements for the Council.

3. The Chairman or Vice-Chairman of the Council (in the absence of the Chairman) shall chair the Council's meeting.

4. The Council appoints one member as the scientific secretary to record discussion opinions and minutes of the Council's meetings.

5. Members and Council members present their comments and evaluations on the framework proposal and the national product development science and technology tasks under the framework proposal; the scientific secretary reads out the opinions and evaluations of absent Council members (if any).

6. The Council discusses and analyzes the appropriateness of the name, objectives, main contents, expected products, feasibility, and effectiveness of the framework proposal; the necessity and appropriateness of the name, objectives, main contents, and expected products of each national product development science and technology task under the framework proposal, taking into account the opinions of the attendees at the meeting.

7. Council members comment and evaluate the framework proposal according to Model A5-PNXĐG-ĐAK-SPQG, comment on the national product development science and technology tasks under the framework proposal according to Model A6-PNX-NV-SPQG, and assess the national product development science and technology tasks under the framework proposal according to Model A7-PĐG-NV-SPQG issued together with this Circular.

8. The Council appoints a Voting Committee consisting of three members, including the head and two members. The voting results on the evaluation of the framework proposal are summarized according to Model A9-BBKP-ĐAK-SPQG, and the voting results on the assessment of the national product development science and technology tasks under the framework proposal are summarized according to Model A10-BBKP-NV-SPQG issued together with this Circular.

9. The Council announces the voting results on the assessment.

a) The framework proposal is approved when more than 3/4 of the total number of Council members attending the meeting vote to mark the box indicating compliance with the requirements.

b) The national product development science and technology tasks under the framework proposal are recommended for implementation when more than 3/4 of the total number of Council members attending the meeting vote to mark the box indicating recommendation for implementation.

c) The comments and evaluations of absent members only have reference value.

10. The scientific secretary records the minutes of the Council's work according to Model A11-BBHĐ-SPQG and compiles the Council's recommendations on the framework proposal along with the list of national product development science and technology tasks under the framework proposal according to Model A12-ĐAK-HĐ-SPQG issued together with this Circular.

11. The Council agrees on the method of implementation (selection or direct assignment) for each national product development science and technology task under the framework proposal that is recommended for implementation.

Chapter III

REVIEW OF NATIONAL PRODUCT DEVELOPMENT SCIENCE AND TECHNOLOGY TASKS UNDER THE FRAMEWORK PROPOSAL

NATIONAL PRODUCT UNDER THE FRAMEWORK PROGRAM

Article 11. Organizations responsible for and in charge of national product development scientific and technological tasks

Organizations responsible for and in charge of national product development scientific and technological tasks must meet the conditions for participating in the selection and directly implementing national-level scientific and technological tasks funded by state budget as stipulated in Circular No. 20/2023/TT-BKHCN dated October 12, 2023, issued by the Minister of Science and Technology on the selection and direct assignment of organizations and individuals to implement national-level scientific and technological tasks funded by state budget (hereinafter referred to as Circular No. 20/2023/TT-BKHCN).

Article 12. Selection and Direct Assignment of Organizations and Individuals to Implement National Product Development Scientific and Technological Tasks

1. The Ministry of Science and Technology shall carry out the selection and direct assignment of organizations and individuals to implement national product development scientific and technological tasks according to the principles, procedures, and formalities prescribed for the selection and direct assignment of organizations and individuals to implement national-level scientific and technological tasks funded by state budget as stipulated in Circular No. 20/2023/TT-BKHCN.

2. Representatives of the Program Steering Committee, representatives of sectoral management agencies, and representatives of related units (if necessary) may be invited to attend advisory council meetings on selection and direct assignment and the Financial Review Board.

Chapter IV

 CONTRACT FOR IMPLEMENTATION OF NATIONAL PRODUCT DEVELOPMENT SCIENTIFIC AND TECHNOLOGICAL TASKS

 DEVELOPMENT OF NATIONAL PRODUCTS

Article 13. Contents of the Contract for Implementation of National Product Development Scientific and Technological Tasks

1. Based on the Decision approving the national product development scientific and technological task of the Minister of Science and Technology, the Program Management Unit and the organization responsible for and in charge of the national product development scientific and technological task shall draft the scientific research and technology development contract to implement the national product development scientific and technological task.

2. The contents of the contract for implementation of national product development scientific and technological tasks shall be carried out in accordance with the provisions of Circular No. 05/2014/TT-BKHCN dated April 10, 2014, issued by the Minister of Science and Technology on the Model Scientific Research and Technology Development Contract and Circular No. 04/2023/TT-BKHCN dated May 15, 2023, issued by the Minister of Science and Technology amending and supplementing certain articles of circulars regulating the management of national-level scientific and technological tasks.

Article 14. Signing the Contract for Implementation of National Product Development Scientific and Technological Tasks

1. The Ministry of Science and Technology shall delegate the financial management unit to sign the contract for implementation of national product development scientific and technological tasks with the leading organization.

2. The signing of the contract can only be carried out after the decision approving the task has been made. The progress of implementing the work contents using state budget funds in the contract for implementation of national product development scientific and technological tasks must be consistent with the time when the funds are allocated.

3. On the basis of the leading organization's proposal regarding the need to implement the work contents using non-state budget funds, the financial management unit shall consider and sign the contract for implementation of national product development scientific and technological tasks with the leading organization.

Article 15. Inspection, evaluation, adjustment, and termination of contracts during the implementation of national product development science and technology tasks

1. The Ministry of Science and Technology shall carry out inspection, evaluation, adjustment, and termination of contracts during the implementation of national product development science and technology tasks based on signed scientific research and technological development contracts.

2. The procedures and formalities for inspecting, evaluating, adjusting, and terminating contracts during the implementation of national product development science and technology tasks shall be implemented in accordance with Circular No. 04/2015/TT-BKHCN dated March 11, 2015, issued by the Minister of Science and Technology, which stipulates the inspection, evaluation, adjustment, and termination of contracts during the implementation of national-level science and technology tasks funded by state budget.

3. Representatives of the Program Steering Board, representatives of sectoral management ministries, and related units (if necessary) may be invited to participate in the process of inspecting, evaluating, adjusting, and terminating contracts.

Article 16. Evaluation and acceptance of results of national product development science and technology tasks

1. The Ministry of Science and Technology shall organize the evaluation and acceptance of results of national product development science and technology tasks based on signed scientific research and technological development contracts.

2. The procedures and formalities for evaluating and accepting results of national product development science and technology tasks shall be carried out in accordance with Circular No. 11/2014/TT-BKHCN dated May 30, 2014, issued by the Minister of Science and Technology, which stipulates the evaluation and acceptance of results of national-level science and technology tasks funded by state budget.

3. Representatives of the Program Steering Board, representatives of sectoral management ministries, and related units (if necessary) may be invited to attend the meeting for evaluating and accepting national product development science and technology tasks.

Article 17. Liquidation of Contracts

Units authorized by the Ministry of Science and Technology to sign contracts shall proceed with the liquidation of contracts implementing national product development science and technology tasks with the leading and managing organizations of such tasks in accordance with regulations.

Article 18. Management of Assets Formed and Results of National Product Development Science and Technology Tasks

1. The leading organization shall be responsible for managing formed assets, managing, exploiting, and transferring the results of national product development science and technology tasks in accordance with the law. Ownership rights, copyright, and usage rights of the results of national product development science and technology tasks shall be implemented in accordance with laws on science and technology, intellectual property, and the management and utilization of public assets.

2. The leading organization shall implement registration, submission, and reporting on the application of results of national product development science and technology tasks in accordance with Circular No. 14/2014/TT-BKHCN dated June 11, 2014, issued by the Minister of Science and Technology, concerning the collection, registration, storage, and publication of information on science and technology tasks, amended and supplemented by Circular No. 11/2023/TT-BKHCN dated June 26, 2023, issued by the Minister of Science and Technology.

Chapter V

IMPLEMENTATION OF TASKS UNDER THE PROGRAM

Article 19. Responsibilities of the Program Steering Committee

1. Advise the Minister of Science and Technology on managing and implementing the Program.

2. Coordinate with the Program management unit to perform assigned tasks.

3. Coordinate with the Program management unit to draft reports and prepare the dossier for the National Product Catalogue to be submitted to the Minister of Science and Technology for consideration and to the Prime Minister for approval.

4. Lead and coordinate with the Program management unit to develop the Detailed Plan Proposal for national product development, draft the Detailed Plan Proposal for national product development, and the list of scientific and technological tasks for national product development under the Detailed Plan as assigned by the Ministry of Science and Technology.

5. Attend and provide professional opinions at meetings reviewing the Detailed Plan and determining scientific and technological tasks for national product development under the Detailed Plan; review and assess funding for scientific and technological tasks for national product development; inspect, evaluate; evaluate and accept scientific and technological tasks for national product development and other meetings when invited to attend.

6. Coordinate with the Program management unit to compile and report to the Ministry of Science and Technology on the implementation progress and results of the Program.

7. Perform other tasks as stipulated in Decision No. 939/QĐ-BKHCN dated May 18, 2023 issued by the Minister of Science and Technology on the organizational structure and operation regulations of the Program Steering Committee.

Article 20. Responsibilities of the Program Management Unit

1. Serve as the focal point and assist the Minister of Science and Technology in organizing the implementation of the Program according to the Prime Minister's Directive No. 157/QĐ-TTg.

2. Lead and coordinate with the Program Steering Committee and relevant units to compile and review the National Product Catalogue to be submitted to the Minister of Science and Technology for consideration and to the Prime Minister for approval.

3. Lead and coordinate with the Program Steering Committee and related units to organize the management of scientific and technological tasks for national product development as prescribed.

4. Compile and report on the mobilization and utilization of funds from sources outside the science and technology budget and other sources to implement scientific and technological tasks for national product development.

5. Develop regular, extraordinary, and annual summary reports on the results of implementation, organize mid-term and final reviews of the Program.

6. Perform other tasks assigned by the Minister of Science and Technology.

Article 21. Responsibilities of the Leading and Principal Organizations of Tasks

1. Be responsible for the content and results of scientific and technological tasks for national product development and other tasks assigned to lead.

2. Sign contracts to implement scientific and technological tasks for national product development with the Ministry of Science and Technology as stipulated in this Circular.

3. Be responsible for managing and organizing the implementation of scientific and technological tasks for national product development according to signed contracts.

4. Manage allocated funds, raise sufficient funds and disburse funds according to the schedule committed in the contract for implementing scientific and technological tasks for national product development; organize bidding, procurement, and management of equipment for scientific and technological tasks for national product development in accordance with the law.

5. Implement periodic reporting every six months, annually, or extraordinary (as required by the supervisory authority) on the implementation status of scientific and technological tasks for national product development. Create favorable conditions and provide full information for supervisory authorities in their inspection and audit activities regarding scientific and technological tasks for national product development.

6. Implement publication, submission, application reporting, asset formation management, organization management, exploitation, transfer, and handling of assets of scientific and technological tasks for national product development in accordance with the law.

7. Propose application plans or commercialization of products derived from scientific and technological tasks for national product development.

8. Use funds for intended purposes effectively; manage funds for scientific and technological tasks for national product development in accordance with the law.

9. Inspect and urge organizations and individuals participating in the implementation of scientific and technological tasks for national product development in accordance with the contract.

10. Comply with provisions of this Circular and related laws.

Article 22. Financial management for implementing tasks under the Program

1. The preparation of budgets, management and utilization, and settlement of state budget funds for implementing scientific and technological development tasks for national products shall be carried out in accordance with Circular No. 03/2023/TT-BTC dated January 10, 2023, issued by the Minister of Finance on the preparation of budgets, management and utilization, and settlement of state budget funds for implementing scientific and technological tasks, and Circular No. 02/2023/TT-BKHCN dated May 8, 2023, issued by the Minister of Science and Technology guiding certain specialized contents to serve the construction of budgets for implementing scientific and technological tasks using state budget funds, and other special financial regulations issued by the Ministry of Finance.

2. The expenditure items, contents, and expenditure standards for meetings of the Advisory Council reviewing the framework project proposal shall be applied according to the provisions applicable to meetings of the Advisory Council determining national-level scientific and technological tasks.

3. Non-state budget capital mobilized to implement scientific and technological development tasks for national products under the Program shall be implemented in accordance with the current expenditure standards applicable to such sources of capital.

Article 23. Handling of assets formed through the implementation of scientific and technological development tasks for national products

Management, use, and handling of assets formed through the implementation of scientific and technological development tasks for national products shall be carried out in accordance with the Law on Management and Use of Public Assets; Decree No. 70/2018/NĐ-CP dated May 15, 2018, of the Government on management and use of assets formed through the implementation of scientific and technological tasks using state capital; Circular No. 02/2020/TT-BKHCN dated August 10, 2020, issued by the Minister of Science and Technology guiding the implementation of Clause 1, Article 41 of Decree No. 70/2018/NĐ-CP and related laws and regulations on the management and implementation of scientific and technological tasks.

Article 24. Special scientific and technological development tasks for national products

1. Special scientific and technological development tasks for national products are special national-level scientific and technological tasks for developing national products decided by the Prime Minister.

2. The ministry managing the sector or field shall take the lead in organizing the drafting and approval of the framework project proposal, reviewing, examining, and organizing the implementation of special scientific and technological development tasks for national products according to the Prime Minister's decision.

Chapter VI

IMPLEMENTATION

Article 25. Ministry of Science and Technology

1. Take the lead and coordinate with sectoral ministries, provincial people's committees to organize guidance on the implementation of the Program's contents, annually compile and report to the Prime Minister the results of implementation.

2. Take the lead and coordinate with sectoral ministries, provincial people's committees to propose supplements to the List of National Products, and report to the Prime Minister.

3. Take the lead and coordinate with sectoral ministries to organize the approval of the framework project proposal, and approve the list of scientific and technological development tasks for national products under the framework project proposal.

4. Aggregate the budget estimates for the Program's tasks from the state budget and submit them to the Ministry of Planning and Investment and the Ministry of Finance for annual planning and allocation.

5. Be responsible for auditing the procedures and formalities for the drafting, approval of the framework project proposal, review, examination, and approval of special scientific and technological development tasks for national products under the framework project proposal assigned by the Prime Minister to relevant sectoral ministries.

6. Take the lead and coordinate with sectoral ministries and provincial people's committees to promote communication about the content, results, and products of the Program; attract the attention of Vietnamese business communities to the Program's activities.

7. Organize the management and implementation of the Program in accordance with the legal regulations on the management of tasks and finance for the Program.

8. Take the lead and coordinate with sectoral ministries and provincial people's committees to study and amend the Program's management regulations to suit practical implementation (if necessary).

9. Organize a mid-term review of the Program in 2025 and a final evaluation in 2030.

Article 26. Sectoral and field management agencies

1. Study and propose the National Product Catalogue to be sent to the Ministry of Science and Technology for consolidation and submission to the Prime Minister.

2. Consolidate and propose the implementation of national products approved by the Prime Minister to be sent to the Ministry of Science and Technology.

3. Coordinate with the Ministry of Science and Technology to organize the drafting of the Framework Project, review the Framework Project, select, directly assign, assess, inspect, evaluate, adjust, and accept completion of scientific and technological tasks for developing national products.

4. Provide comments in writing on the Framework Project for national products within their scope of management.

Article 27. People's Committees of provinces and centrally governed cities

1. Study and propose the National Product Catalogue to be sent to the Ministry of Science and Technology for consolidation and submission to the Prime Minister.

2. Consolidate and propose the implementation of national products approved by the Prime Minister to be sent to the Ministry of Science and Technology. Coordinate with the Ministry of Science and Technology to organize the drafting of the Framework Project, review the Framework Project, select, directly assign, assess, inspect, evaluate, adjust, and accept completion of scientific and technological tasks for developing national products.

3. Coordinate with the Ministry of Science and Technology and relevant sectoral and field management agencies to implement activities under the Program within their jurisdiction.

Article 28. Implementation of the Program in Conditions of Natural Disasters and Epidemics

In cases where objective circumstances cause meetings of the Council and the Financial Assessment Team, and conferences and seminars implementing the Program to occur during periods and locations affected by prolonged natural disasters and epidemics, such meetings may be held via online methods or through the application of information technology, but must comply with the provisions set forth in this Circular.

Chapter VII

IMPLEMENTATION PROVISIONS

Article 29. Effective Date

1. This Circular takes effect from August 1, 2024.

2. During the implementation process, if the regulatory legal documents cited in this Circular are replaced, amended, or supplemented, they shall be applied according to the newly issued documents.

Article 30. Transitional Provisions

1. Scientific and technological tasks for developing national products under the National Product Development Program up to 2020 that have been funded prior to the effective date of this Circular shall continue to be implemented in accordance with the guidance documents for managing the National Product Development Program up to 2020.

2. For contents already approved by the main managing ministries in the Framework Project under the National Product Development Program up to 2020 that have not yet been implemented, the main managing ministries shall develop proposals for implementation using Model A2-ĐXTK-SPQG, to be submitted to the Ministry of Science and Technology for consolidation and implementation in accordance with this Circular.

Article 31. Responsibility for Implementation

1. If any difficulties arise during the implementation process, the relevant agencies, organizations, and individuals are requested to report them to the Ministry of Science and Technology for research and appropriate amendments and supplements.

2. The Minister, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of provincial and centrally governed city People's Committees, and related organizations and individuals are responsible for enforcing this Circular./.
