Based on the Nationality Law of Vietnam dated November 13, 2008; the Law Amending and Supplementing Some Articles of the Nationality Law of Vietnam dated June 24, 2014;

Based on the Household Registration Law dated November 20, 2014;

Pursuant to Decree No.98/2022/NĐ-CPThe Government's Decision No. 1295/QD-TTg dated November 29, 2022 on the functions, tasks, powers, and organizational structure of the Ministry of Justice.

Based on Decree No. 123/2015/NĐ-CP dated November 15, 2015 of the Government detailing certain provisions and measures for the implementation of the Household Registration Law;

On the basis of Decree No. 16/2020/NĐ-CP dated February 3, 2020 of the Government detailing certain provisions and measures to implement the Nationality Law of Vietnam;

Pursuant to Decree No. 87/2020/NĐ-CP dated July 28, 2020, issued by the Government, regarding the electronic household registration database and online household registration;

At the proposal of the Director of the Department of Household Registration, Nationality, and Notarization;

The Minister of Justice issues this Circular amending and supplementing certain provisions of Circular No. 02/2020/TT-BTP dated April 8, 2020 issued by the Minister of Justice guiding the use and management of nationality record books and nationality-related documents, and Circular No. 04/2020/TT-BTP dated May 28, 2020 issued by the Minister of Justice detailing the implementation of certain provisions of the Household Registration Law and Decree No. 123/2015/NĐ-CP dated November 15, 2015 of the Government detailing certain provisions and measures to implement the Household Registration Law.

1. Replacing the phrase "Vietnamese diplomatic agencies, consular offices, or other agencies authorized to perform consular functions abroad" with the phrase "Vietnamese representative offices abroad" at Clause 2, Article 2 and Clause 1, Article 6.

2. Replacing the models of Record Books at Article 3, including:

a) Replacing the Nationality Case Processing Record Book (TP/QT-2020-STLHSQT) with the Nationality Case Processing Record Book (TP/QT-2024-STLHSQT).

b) Replacing the Register for Determination of Having Vietnamese Nationality (TP/QT-2020-SĐKXĐCQTVN) with the Register for Determination of Having Vietnamese Nationality (TP/QT-2024-SĐKXĐCQTVN).

c) Replacing the Issuance of Certificate of Having Vietnamese Nationality Record Book (TP/QT-2020-SCGXNCQTVN) with the Issuance of Certificate of Having Vietnamese Nationality Record Book (TP/QT-2024-SCGXNCQTVN).

d) Replacing the Issuance of Certificate of Being of Vietnamese Origin Record Book (TP/QT-2020-SCGXNGVN) with the Issuance of Certificate of Being of Vietnamese Origin Record Book (TP/QT-2024-SCGXNGVN).

3. Replacing the types of nationality-related documents at Article 4, including:

a) Replacing the Application for Acquisition of Vietnamese Nationality Form (TP/QT-2020-ĐXNQT.1) with the Application for Acquisition of Vietnamese Nationality Form (TP/QT-2024-ĐXNQT.1).

b) Replacing the Application for Acquisition of Vietnamese Nationality Form for Legal Representatives to Apply for Acquisition of Vietnamese Nationality for the Represented Person (TP/QT-2020-ĐXNQT.2) with the Application for Acquisition of Vietnamese Nationality Form for Legal Representatives to Apply for Acquisition of Vietnamese Nationality for the Represented Person (TP/QT-2024-ĐXNQT.2).

c) Replacing the Application for Restoration of Vietnamese Nationality Form (TP/QT-2020-ĐXTLQT.1) with the Application for Restoration of Vietnamese Nationality Form (TP/QT-2024-ĐXTLQT.1).

d) Replacing the Application for Restoration of Vietnamese Nationality Form for Legal Representatives to Apply for Restoration of Vietnamese Nationality for the Represented Person (TP/QT-2020-ĐXTLQT.2) with the Application for Restoration of Vietnamese Nationality Form for Legal Representatives to Apply for Restoration of Vietnamese Nationality for the Represented Person (TP/QT-2024-ĐXTLQT.2).

đ) Replacing the Application for Renunciation of Vietnamese Nationality Form (TP/QT-2020-ĐXTQT.1) with the Application for Renunciation of Vietnamese Nationality Form (TP/QT-2024-ĐXTQT.1).

e) Replacing the Application for Renunciation of Vietnamese Nationality Form for Legal Representatives to Apply for Renunciation of Vietnamese Nationality for the Represented Person (TP/QT-2020-ĐXTQT.2) with the Application for Renunciation of Vietnamese Nationality Form for Legal Representatives to Apply for Renunciation of Vietnamese Nationality for the Represented Person (TP/QT-2024-ĐXTQT.2).

g) Replacing the Personal History Statement Form (TP/QT-2020-BKLL) with the Personal History Statement Form (TP/QT-2024-BKLL).

h) Replacing the Application for Registration of Determination of Having Vietnamese Nationality Form (TP/QT-2020-TKXĐCQTVN) with the Application for Registration of Determination of Having Vietnamese Nationality Form (TP/QT-2024-TKXĐCQTVN).

i) Replacing the Application for Issuance of Certificate of Having Vietnamese Nationality Form (TP/QT-2020-TKXNCQTVN) with the Application for Issuance of Certificate of Having Vietnamese Nationality Form (TP/QT-2024-TKXNCQTVN.1).

k) Replacing the Application for Confirmation of Being of Vietnamese Origin Form (TP/QT-2020-TKXNNGVN) with the Application for Confirmation of Being of Vietnamese Origin Form (TP/QT-2024-TKXNNGVN.1).

l) Replacing the Extract from Registration of Determination of Having Vietnamese Nationality (TP/QT-2020-TLXĐCQTVN) with the Extract from Registration of Determination of Having Vietnamese Nationality (TP/QT-2024-TLXĐCQTVN).

m) Replacing the Certificate of Having Vietnamese Nationality (TP/QT-2020-XNCQTVN) with the Certificate of Having Vietnamese Nationality (TP/QT-2024-XNCQTVN).

n) Replacing the Certificate of Being of Vietnamese Origin (TP/QT-2020-XNNGVN) with the Certificate of Being of Vietnamese Origin (TP/QT-2024-XNNGVN).

o) Replacing the List of Persons Requesting Resolution of Nationality Matters (TP/QT-2020-DS) with the List of Persons Requesting Resolution of Nationality Matters (TP/QT-2024-DS).

4. Supplementing two Application Forms for Issuance of Certificate of Having Vietnamese Nationality for Legal Representatives to Apply for Issuance of Certificate of Having Vietnamese Nationality for the Represented Person (TP/QT-2024-TKXNCQTVN.2) and Application Form for Confirmation of Being of Vietnamese Origin for Legal Representatives to Apply for Issuance of Certificate of Being of Vietnamese Origin for the Represented Person (TP/QT-2024-TKXNNGVN.2).

5. Abolishing the Receipt and Result Delivery Form at Article 4.

6. Amending and supplementing Clause 1 and Clause 2 of Article 7 as follows:

"1. Depending on the type of matter, persons requesting resolution of nationality matters must fill out all relevant information accurately according to the columns and items in the Application Form, Personal History Statement, and Declaration Form as detailed in each form issued along with this Circular.

Based on the provisions of this Circular and relevant laws, within 10 (ten) working days from the date the credit institution issues, amends, or supplements its internal regulations on purchasing and selling corporate bonds:certain contents of Circular No. 04/2020/TT-BTP dated May 28, 2020, issued by the Minister of Justice detailing the implementation of some provisions of the Household Registration Law and Decree No.123/2015/NĐ-CPdated November 15, 2015, issued by the Government detailing some provisions and measures for implementing the Household Registration Law

1. Amend and supplement certain contents of Article 3 as follows:

a) Amend and supplement Clause 2 of Article 3 as follows:

b) Supplement Clause 6 of Article 3 as follows:

“6. The submission, acceptance, processing of requests for online household registration and the issuance of online results of household registration shall be carried out in accordance with the provisions of Decree No. 87/2020/NĐ-CP dated July 28, 2020, of the Government on the electronic household registration database, online household registration, and related detailed implementing regulations.”

2. Replace the List of Household Registration Application Forms published on the Ministry of Justice’s website, the registration authority's website, which citizens can print and use (Annex 5) with the List of Household Registration Application Forms published on the Ministry of Justice’s website, the registration authority's website, which citizens can print and use (Annex 5) issued together with this Circular.

3. Amend Clause 2 of Article 18 as follows:

“2. Valid household registration documents with incomplete household registration information may be supplemented if there are valid documents or materials issued by competent authorities.

The requirement to record the addition of Vietnamese nationality shall only be implemented for household registration documents issued from January 1, 2016 onwards, after confirming that the person requesting has Vietnamese nationality in accordance with the Vietnamese Nationality Law.”

Article 3. Transitional Provisions

1. Nationality files and household registration files received before the effective date of this Circular but not yet resolved shall continue to be processed in accordance with Circular No. 02/2020/TT-BTP and Circular No. 04/2020/TT-BTP.

Article 4. Responsibilities for Implementation and Effectiveness

1. This Circular takes effect from June 6, 2024.

2. The Director of the Department of Household Registration, Nationality, and Notarization, Heads of units under the Ministry of Justice, Directors of Provincial Departments of Justice, and relevant agencies, organizations, and individuals are responsible for implementing this Circular./.
