Pursuant to the Law on Organization of the Government dated June 19, 2015; the Law Amending and Supplementing Certain Provisions of the Law on Organization of the Government and the Law on Organization of Local Administration dated November 22, 2019;

Pursuant to the Competition Law dated June 12, 2018;

Pursuant to Decree No. 03/2023/NĐ-CP dated February 10, 2023 of the Government stipulating the functions, tasks, powers, and organizational structure of the National Competition Commission;

At the proposal of the Minister of Industry and Trade;

The Prime Minister issues this Decision on the allowance system for members of the National Competition Commission, persons conducting competition litigation, experts, interpreters, witnesses.

Article 1. Scope of Regulation and Applicability

Article 1. This Decision stipulates the allowance system for members of the National Competition Commission, persons conducting competition litigation, experts, interpreters, witnesses.

Article 2. This Decision applies to members of the National Competition Commission, persons conducting competition litigation, experts, interpreters, witnesses and related organizations and individuals.

Article 2. Special Allowance System

Members of the National Competition Commission shall be entitled to an allowance of 2,340,000 VND/person/month.

Article 3. Allowance System for Persons Conducting Competition Litigation, Experts, Interpreters, Witnesses at Hearings

Clause 1. The Chairman of the Council for Handling Anti-Competitive Practices shall be entitled to an allowance of 150,000 VND/day.

Clause 2. Members of the Council for Handling Anti-Competitive Practices, competition case investigators participating in hearings, hearing secretaries shall be entitled to an allowance of 100,000 VND/person/day.

Clause 3. Experts invited by the Council for Handling Anti-Competitive Practices shall be entitled to an allowance of 100,000 VND/person/day.

Clause 4. Interpreters invited by the Council for Handling Anti-Competitive Practices to interpret at hearings shall be entitled to allowances according to regulations on translation costs under the reception expenses for foreign guests and conference and seminar expenses in Vietnam.

Clause 5. Witnesses summoned by the Council for Handling Anti-Competitive Practices to attend hearings shall be entitled to an allowance of 100,000 VND/person/day.

Article 4. Allowance System for Persons Conducting Competition Litigation, Experts, Interpreters, Witnesses During the Investigation of Competition Cases

Clause 1. Competition case investigators shall be entitled to an allowance of 80,000 VND/person/day during the time they are assigned to investigate competition cases.

Clause 2. Interpreters summoned or invited by the Competition Case Investigation Agency to participate in meetings during the investigation of competition cases shall be entitled to allowances according to regulations on translation costs under the reception expenses for foreign guests and conference and seminar expenses in Vietnam.

Clause 3. Experts and witnesses summoned or invited by the Competition Case Investigation Agency to participate in meetings during the investigation of competition cases shall be entitled to an allowance of 100,000 VND/person/day.

Article 5. Allowance System for Participants in Roundtable Discussions, Meetings to Handle Competition Cases, and Appeals against Competition Case Handling Decisions

Clause 1. The Chairman of the Council for Handling Anti-Competitive Practices shall be entitled to an allowance of 150,000 VND/day.

Clause 2. Members of the Council for Handling Anti-Competitive Practices, members of the Council for Resolving Appeals against Competition Case Handling Decisions shall be entitled to an allowance of 100,000 VND/person/day.

Article 6. Sources of funding for implementation

The funds for paying the allowances to members of the National Competition Committee, persons conducting competition litigation, experts, interpreters, and witnesses shall be guaranteed by the state budget and allocated in the annual state budget estimate of the Ministry of Industry and Trade in accordance with the laws on the state budget.

Article 7. Effective Date

1. This Decision takes effect from April 1, 2025.

2. This Decision replaces Decision No. 35/2016/QĐ-TTg dated August 23, 2016 of the Government Chairman regarding allowances for members of the Competition Council and persons conducting and participating in competition litigation.

Article 8. Responsibility for Implementation

Ministers, heads of ministerial-level agencies, heads of relevant agencies, Chair of the National Competition Committee, members of the National Competition Committee, and related organizations and individuals are responsible for implementing this Decision.
