DECREE OF THE GOVERNMENT

DETAILING AND GUIDING IMPLEMENTATION OF CERTAIN PROVISIONS OF THE ORDINANCE ON THE VIETNAM COAST GUARD FORCE

Decree No. 86/2009/ND-CP dated October 19, 2009 of the Government detailing and guiding implementation of certain provisions of the Ordinance on the Vietnam Coast Guard Force, which took effect from December 4, 2009, has been amended and supplemented by:

1. Decree No. 96/2013/ND-CP dated August 27, 2013 of the Government amending and supplementing certain articles of Decree No. 86/2009/ND-CP dated October 19, 2009 of the Government detailing and guiding implementation of certain provisions of the Ordinance on the Vietnam Coast Guard Force, which took effect from October 12, 2013.

2. Decree No. 13/2015/ND-CP dated February 12, 2015 of the Government amending and supplementing Article 9 of Decree No. 86/2009/ND-CP dated October 19, 2009 of the Government detailing and guiding implementation of certain provisions of the Ordinance on the Vietnam Coast Guard Force, which took effect from March 31, 2015.

THE GOVERNMENT

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to the Ordinance on the Vietnam Coast Guard Force 2008;

Upon the proposal of the Minister of National Defense,1

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

This Decree details and guides implementation of certain provisions of the Ordinance on the Vietnam Coast Guard Force regarding organization, operation, certain types of equipment, and preferential policies for the Vietnam Coast Guard Force.

Article 2. Applicability

This Decree applies to the Vietnam Coast Guard Force, organizations and individuals in Vietnam, and foreign organizations and individuals. In cases where international treaties to which the Socialist Republic of Vietnam is a party provide different provisions, such treaties shall be applied.

Article 3. Organization and Operation of the Vietnam Coast Guard Force

1. The Vietnam Coast Guard Force is organized in accordance with the Ordinance on the Vietnam Coast Guard Force, this Decree, and other relevant legal documents.

2.2 The Vietnam Coast Guard is a specialized force of the State, operating in accordance with Vietnamese laws; respecting and complying with international treaties to which the Socialist Republic of Vietnam is a party.

3.3 The Minister of National Defense is responsible before the Prime Minister and the National Assembly for state management over the Vietnam Coast Guard Force, and directly directs the activities of the Vietnam Coast Guard Force. The Government, on the basis of the National Assembly's regulations on state management of the Vietnam Coast Guard force, directly directs the activities of the Vietnam Coast Guard force.

Article 4. International Trade Name

The Vietnam Coast Guard Force has the international trade name in English as Vietnam Coast Guard.

Chapter II

ORGANIZATION OF THE VIETNAM COAST GUARD FORCE

Article 5. System of Organization of the Vietnam Coast Guard Force

1. The General Command of the Coast Guard.5

2. Units subordinate to the General Command of the Coast Guard6, including:

a) Coast Guard Zone. Within the structure of the Coast Guard Zone, there are coast guard flotillas, coast guard squadrons, reconnaissance groups, and coast guard service teams;

b) Coast Guard Flotilla;

c) Reconnaissance Group;

d) Special Task Force for Drug Crime Prevention and Suppression;

đ) Coast Guard Information Center;

e) Coast Guard Training Center.

3. The Minister of National Defense stipulates the staffing, equipment, and specific tasks of coast guard agencies and units.

Article 6. General Command of the Coast Guard

1. The General Command of the Coast Guard has legal personality, has a bank account and a seal bearing the national emblem, and can open an account at the State Treasury; its headquarters is located in Hanoi; operational funds are provided by the state budget and recorded separately in the total operational budget of the Ministry of National Defense.

2. The Commander, Political Commissar, Deputy Political Commissar, and Deputy Commanders of the Coast Guard are appointed by the Prime Minister upon the proposal of the Minister of National Defense.

Article 7. Maritime Police Zones

1. Maritime Police Zone 1 manages the sea areas and continental shelf from the mouth of the Bac Luan River in Quang Ninh Province to Con Co Island in Quang Tri Province, with its headquarters located in Hai Phong City.

2. Maritime Police Zone 2 manages the sea areas and continental shelf from Con Co Island in Quang Tri Province to Cu Lao Xanh Island in Binh Dinh Province, with its headquarters located in Quang Nam Province.

3. Maritime Police Zone 3 manages the sea areas and continental shelf from Cu Lao Xanh Island in Binh Dinh Province to the northern bank of the Ding An Gate in Tra Vinh Province, with its headquarters located in Ba Ria-Vung Tau Province.

4. Maritime Police Zone 4 manages the sea areas and continental shelf from the northern bank of the Ding An Gate in Tra Vinh Province to Ha Tien in Kien Giang Province, with its headquarters located in Ca Mau Province.

Article 8. Maritime Police Officers and Investigators

1. Maritime Police Officers and Investigators are legal titles within the Maritime Police force for performing tasks related to handling administrative violations and combating crime.

2. The Minister of National Defense shall stipulate the criteria and procedures for appointing and relieving officers of these legal titles within the Vietnam Maritime Police force.

Chapter III

FLAGS, BADGES, AND UNIFORMS OF THE VIETNAMESE MARITIME POLICE FORCE

Article 9. Flags and insignia

1. Command Flag

The command flag of the Vietnam Maritime Police Force is an equilateral triangle with a blue ocean background, measuring 1.5 meters in height and 1.0 meter at the base, featuring the national emblem in the center and a horizontal yellow arrow running across the rear.

The command flag is hoisted on a 2.5-meter-high flagpole mounted at the stern of the ship (except for rescue ships which mount it on the upper deck aft).

28. Markings

The markings on various patrol vessels and boats of the Maritime Police are as follows:

Three adjacent stripes on both sides of the hull of the vessel or boat. Stripe number 1, colored orange, is placed at the end of the bow of the vessel or boat, aligned with the front edge of the hull of the vessel or boat, inclined at 30 degrees. The center of stripe number 1 bears the Vietnam Maritime Police badge. Following this, stripe number 2 is white, and stripe number 3 is light blue. The width of stripe number 1 varies according to the size of each type of vessel or boat; the widths of stripes number 2 and number 3 are one quarter that of stripe number 1. 39a) Rescue Ships

The hull of the ship is painted orange, while the deck is painted green. In front of the marking stripe, the ship's serial number is painted white, and behind the marking stripe, the phrase "VIETNAM COAST GUARD" in uppercase letters, color white.

The cabin is painted white, with an upper border painted orange, and on both sides of the cabin, the phrase "VIETNAM COAST GUARD" in uppercase letters, color blue.

On the smokestack, there is a red flag with a golden star painted.

b) Patrol Ships and Other Types of Ships

The hull of the ship is painted white, while the deck is painted green. In front of the marking stripe, the ship's serial number is painted navy blue. Behind the marking stripe, the phrase "VIETNAM COAST GUARD" in uppercase letters, color navy blue.

The cabin is painted white, and on both sides of the cabin, the phrase "VIETNAM COAST GUARD" in uppercase letters, color navy blue.

The gun platform is painted gray.

c) Patrol Boats

The hull of the boat is painted white. In front of the marking stripe, the boat's serial number is painted navy blue. Behind the marking stripe, the top line reads "VIETNAM COAST GUARD" in uppercase letters, color navy blue, and the bottom line reads "VIETNAM COAST GUARD" in uppercase letters, color navy blue.

The cabin is painted white.

. The Commander of the Maritime Police shall specify the exact dimensions of stripe number 1, the Vietnam Maritime Police badge, the phrase "VIETNAM COAST GUARD," and the red flag with a golden star on the smokestack, appropriate to each type of patrol vessel or boat.

3a104. Colors of Maritime Police Aircraft

a) Aircraft Hull

The lower part of the aircraft body is painted blue (from below the protruding window sill down to the belly of the aircraft until just below the cockpit window).

The upper part of the aircraft body is painted white (from below the protruding window sill up to the back of the aircraft until just above the cockpit window and the wings).

b) Aircraft Nose

The nose of the aircraft has two marking stripes painted on the lower part of the aircraft body, on a blue background. Stripe number 1 is painted orange-yellow from the bottom of the cockpit window down to the lower edge of the aircraft body, inclined at 15 to 20 degrees, with a width of 0.5m to 1.0m (depending on the size of the aircraft). In the middle, the industry badge is painted. Following this, stripe number 2 is painted white, parallel and equal to one quarter the width of stripe number 1.

The fuselage has two yellow-orange and white stripes painted on the blue sea-colored background of the aircraft's underside. Stripe number 1 is painted in yellow-orange from the lower edge of the cockpit down to the lower belly of the aircraft, inclined at an angle of 15^° to 20^°degrees, with a width of 0.5m - 1.0m (depending on the size of the aircraft). In the middle, the departmental emblem is painted. Following this, stripe number 2 is painted in white, parallel and one quarter the width of stripe number 1.

The portion before the two marking lines shall be painted with white aircraft serial numbers;

The portion after the two marking lines shall be painted with white uppercase letters on the blue-green body of the aircraft:

The nose of the aircraft shall be painted blue-green.

c) Wings of the aircraft

Main wing: The upper and lower surfaces of the wing shall be painted white.

Horizontal stabilizer: The upper and lower surfaces of the horizontal stabilizer shall be painted white.

Vertical stabilizer: The upper part of both sides of the vertical stabilizer shall be painted with the Vietnamese national flag, the lower part shall be painted with the insignia of the force, and the remaining parts of both sides of the vertical stabilizer shall be painted white.

d) Aircraft engine and propeller

The outer casing of the two engines shall be painted white.

Article 10. Insignia of the Force

The insignia of the Vietnam Coast Guard shall be in the shape of a shield on a dark gray background, with two crossed swords behind it, measuring 105 x 80 mm in height and width, surrounded by a red border 2 mm wide, with a white anchor in the center, yellow rice ears on both sides, the word "CSB" in red below, and a five-pointed yellow star above.

Article 11. Uniforms of the Vietnam Coast Guard

The insignia, rank insignia, badges, duty uniforms, and ceremonial uniforms of the Vietnam Coast Guard shall be prescribed by the Prime Minister.

Article 12. Regulations on the Use of National Flag, Service Flag, Badges, and Uniforms

While performing their duties, vessels, ships, and other means of transport of the Vietnam Coast Guard must fly the National Flag and the Coast Guard Service Flag; officers and soldiers of the Coast Guard must wear uniforms and carry the Vietnam Coast Guard badges according to regulations.

Chapter IV

ACTIVITIES OF THE VIETNAM COAST GUARD

Article 13. Scope of Activities of the Vietnam Coast Guard

The Vietnam Coast Guard operates in the maritime areas and continental shelf of the Socialist Republic of Vietnam.

Article 14. Law Enforcement Activities at Sea

1. The Vietnam Coast Guard conducts inspection, control, detection, prevention, and handling of violations and crimes in the maritime areas and continental shelf of Vietnam in accordance with Vietnamese laws and relevant international treaties to which the Socialist Republic of Vietnam is a member.

2. Individuals, organizations, and means of transport operating in the maritime areas and continental shelf of the Socialist Republic of Vietnam must comply with inspections and controls by the Vietnam Coast Guard to ensure security, order, safety, and compliance with Vietnamese laws and relevant international treaties. to which the Socialist Republic of Vietnam is a member.

3. The Minister of National Defense shall prescribe the procedures for inspections and controls by the Vietnam Coast Guard.

Article 15. International Cooperation Activities

1. Education, training, and enhancement of professional skills to improve the operational capacity of the Vietnam Coast Guard;

2. Prevention and combat against piracy and armed robbery against ships in Asia;

3. Control, prevention, and struggle against illegal entry and exit activities at sea;

4. Cooperation in patrolling, inspecting, and monitoring the conservation and management of marine resources;

5. Search and rescue operations, prevention and response to marine environmental pollution;

6. Control, prevention, and struggle against drug-related crimes at sea;

7. Other related international cooperation activities.

Article 16. Use of weapons, support tools, and technical equipment

When performing tasks, the Vietnam Coast Guard may use weapons and support tools in accordance with the provisions of the law; the use of technical equipment in the activities of the Vietnam Coast Guard shall be regulated by the Minister of National Defense.

Article 17. Operational measures

1. The Vietnam Coast Guard may apply operational measures in accordance with the Law on National Security and other relevant legal documents.

2. When carrying out tasks to combat crime and violations of law at sea, specialized units and dedicated officers of the Vietnam Coast Guard may apply necessary operational measures and must bear responsibility for their activities.

3. The Prime Minister shall issue the Regulation on the operational activities of the Vietnam Coast Guard as stipulated in Clause 2 of this Article.

Chapter V

PRIVILEGE REGIME AND POLICIES

Article 18. Subsidy regime

The long-term service subsidy system in border areas and islands and the special subsidy system for sea operations in search and rescue missions of the Vietnam Coast Guard shall be regulated by the Prime Minister.

Article 19. Policy for wounded and martyred personnel among officers and soldiers when performing duties at sea

Officers and soldiers of the Vietnam Coast Guard who die or become injured due to illness or accidents while performing duties at sea shall be recognized by competent authorities as martyrs, wounded veterans, or persons entitled to benefits similar to those of wounded veterans or disabled veterans in accordance with the law on preferential treatment for persons with meritorious service.

Chapter VI

IMPLEMENTING PROVISIONS

Article 20. Effective Date

This Decree takes effect from December 4, 2009, and replaces Government Decree No. 53/1998/NĐ-CP dated July 21, 1998, which stipulates the organization and operation of the Vietnam Coast Guard.

Article 21. Organization of Implementation

1. Annually, the Ministry of National Defense shall coordinate with the Ministry of Planning and Investment and the Ministry of Finance to prepare the budget to ensure funding for the activities of the Vietnam Coast Guard.

2. The Ministry of National Defense shall take the lead and coordinate with the Ministries of Interior, Finance, and Labor, Invalids and Social Affairs to provide detailed guidance on the contents stipulated regarding the privilege regime and policies for the Vietnam Coast Guard.

3. The Minister of National Defense shall be responsible for guiding and implementing this Decree.

Article 22. Responsibility for enforcement

Ministers, heads of ministerial-level agencies, heads of government-affiliated agencies, and Chairpersons of provincial People's Committees directly under the Central Government and the Commander of the Vietnam Coast Guard14 shall be responsible for enforcing this Decree.
