PRIME MINISTER

Pursuant to the Government Organization Law dated September 30, 1992;

Pursuant to Resolution No. 85/CP dated July 11, 1997 and Resolution No. 112/1997/NQ-CP dated November 21, 1997 of the Government;

At the proposal of the Minister of Planning and Investment;

DECISION:

Article 1. Approves the list of seven National Target Programs and assigns the agencies responsible for managing and implementing them as follows:

1. The Poverty Reduction Program (including land allocation and settlement work and support for particularly disadvantaged ethnic minorities) shall be managed by the Ministry of Labor, Invalids and Social Affairs, wherein:

The Ministry of Agriculture and Rural Development is a member of the Steering Board of the Program, responsible for land allocation and settlement work;

The Committee for Ethnic Minorities and Mountainous Areas is a member of the Steering Board of the Program, responsible for supporting particularly disadvantaged ethnic minorities.

2. The Population and Family Planning Program shall be managed by the National Committee on Population and Family Planning.

3. The Program to Eradicate Certain Social Diseases and Dangerous Epidemics shall be managed by the Ministry of Health.

4. The HIV/AIDS Prevention and Control Program shall be managed by the National Committee for HIV/AIDS Prevention and Control.

5. The Clean Water and Environmental Sanitation Program in Rural Areas shall be managed by the Ministry of Agriculture and Rural Development.

6. The Program to Build National Talented Athletes and Key Sports Centers shall be managed by the Sports Management Committee.

7. The Employment Program shall be managed by the Ministry of Labor, Invalids and Social Affairs.

Article 2. Mechanism for Managing and Operating National Target Programs.

1. The construction, review, and approval of National Target Programs, as well as the mechanism for planning and allocating funds for these programs, shall be carried out according to Decision No. 531/TTg dated August 8, 1996 of the Prime Minister and Circular No. 06-TT/LB-KH-TC dated April 29, 1997 of the Ministry of Planning and Investment and the Ministry of Finance guiding the implementation of this Decision.

2. The decentralization of management between the central level and localities in the management of National Target Programs.

a. The agency managing the National Target Program and other agencies assisting the Prime Minister in operating the Program shall be responsible for:

The objectives and tasks of the National Target Program; including the annual plan indicators which the Ministry of Planning and Investment will unify with the agency managing the National Target Program.

Forming and consolidating common projects of the National Target Program.

The total budget of the National Target Program, including: construction investment budget, operational budget (which includes management budget)...

Coordinating all activities of the National Target Program.

b. The Chairman of the People's Committees of provinces and centrally-administered cities shall be responsible for managing resources uniformly, directing to organize the implementation of the tasks of the National Target Program at the local level, including the following contents:

Based on the guidance of the agency managing the National Target Program, the Ministry of Planning and Investment, and the Ministry of Finance, through the Provincial Department of Planning and Investment as the main contact point, in coordination with relevant departments, develop plans to implement the objectives and tasks and propose balanced resources for the implementation of the National Target Programs within their jurisdiction, to be sent to the agency managing the program, the Ministry of Planning and Investment, and the Ministry of Finance for consolidation into the overall plan of the National Target Program.

Chairing and coordinating with the agency managing the National Target Program to approve projects of the National Target Program implemented within their jurisdiction.

Assigning targets and budgets for tasks of the National Target Programs under their management to project leaders for implementation (the agencies managing the programs do not assign plans to vertical agencies at the local level but only guide the implementation of the objectives, tasks, and resources of the programs assigned by the Government).

During the implementation of the National Target Program, based on the total budget and budget structure of each program already allocated, they have the right to request the agency managing the program to adjust funding among activities within each program on the principle of maintaining the total budget and the program's objectives. If there is no response from the agency managing the program within 20 days, it is considered approved (except for increasing management costs).

Organizing the integration of related activities and coordinating the resources of the National Target Programs with the objectives and tasks of programs under their management from the planning stage to avoid overlap and reduce the number of contacts for implementing units, while concentrating resources on priority groups and key areas.

In addition to the central budget already allocated, they have the right to mobilize local resources according to the law to supplement the implementation of the Program and must complete financial settlement according to current regulations.

Organizing inspections and supervision of the activities of the National Target Programs within their jurisdiction. They have the right to temporarily suspend activities if violations or inefficiencies are found, and report to the agency managing the program, the Ministry of Planning and Investment, and the Ministry of Finance for handling.

Reporting to the agency managing the National Target Program, the Ministry of Planning and Investment, and the Ministry of Finance on the situation and results of implementing the National Target Programs under their management within their jurisdiction according to the unified content, form, and time specified in Circular No. 06-TT/LB-KH-TC dated April 29, 1997 of the Ministry of Planning and Investment and the Ministry of Finance.

Based on the actual situation regarding the scale and number of projects in each locality, they may issue decisions to establish Steering Committees for National Target Programs at district and county levels to assist the Chairmen of District and County People's Committees in planning, managing, operating, and organizing the implementation of National Target Programs within their districts and counties.

Article 3. This Decision takes effect fifteen days after the date of signature.

Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, Chairpersons of People's Committees of provinces and centrally governed cities are responsible for implementing this Decision./.
