The supervision activities of the National Assembly

To enhance the effectiveness and efficiency of the National Assembly's supervision activities, contributing to ensuring that the Constitution, laws, resolutions of the National Assembly, ordinances, and resolutions of the Standing Committee of the National Assembly are strictly and uniformly implemented;

Pursuant to the Constitution of the Socialist Republic of Vietnam in 1992, amended and supplemented by Resolution No. 51/2001/QH10 dated December 25, 2001 of the National Assembly, tenth session;

This Law stipulates the supervision activities of the National Assembly, the Standing Committee of the National Assembly, the National Ethnic Council, the Committees of the National Assembly, the Delegations of the National Assembly, and the Members of the National Assembly.

Chapter 1:

GENERAL PROVISIONS

Article 1. Supervisory functions of the National Assembly

The National Assembly exercises the highest supervisory power over all activities of the State.

The National Assembly exercises its highest supervisory power at the sessions of the National Assembly based on the supervision activities of the Standing Committee of the National Assembly, the National Ethnic Council, the Committees of the National Assembly, the Delegations of the National Assembly, and the Members of the National Assembly.

Article 2. Interpretation of Terms

In this Law, the following terms shall be understood as follows:

1. Monitoring and Supervision It is the activity of the National Assembly, the Standing Committee of the National Assembly, the National Ethnic Council, the Committees of the National Assembly, the Delegations of the National Assembly, and the Members of the National Assembly following, examining, and evaluating the activities of agencies, organizations, and individuals subject to supervision in the implementation of the Constitution, laws, resolutions of the National Assembly, ordinances, and resolutions of the Standing Committee of the National Assembly.

2. Questioning It is a supervisory activity in which Members of the National Assembly raise issues within the responsibility of the President of the State, the Chairman of the National Assembly, the Prime Minister, Ministers, and other members of the Government, the Chief Justice of the Supreme People's Court, and the Procurator General of the Supreme People's Procuracy, and require these persons to respond.

Article 3. Supervisory powers of the National Assembly, the agencies of the National Assembly, the Delegations of the National Assembly, and Members of the National Assembly

1. The supervisory powers of the National Assembly, the agencies of the National Assembly, the Delegations of the National Assembly, and Members of the National Assembly are prescribed as follows:

a) The National Assembly supervises the activities of the President of the State, the Standing Committee of the National Assembly, the Government, the Prime Minister, Ministers, and other members of the Government, the Supreme People's Court, and the Supreme People's Procuracy in implementing the Constitution, laws, and resolutions of the National Assembly; supervises normative legal documents of the President of the State, the Standing Committee of the National Assembly, the Government, the Prime Minister, the Supreme People's Court, and the Supreme People's Procuracy;

b) The Standing Committee of the National Assembly supervises the activities of the Government, the Prime Minister, Ministers, and other members of the Government, the Supreme People's Court, and the Supreme People's Procuracy, and the People's Councils of provinces and centrally governed cities in implementing the Constitution, laws, resolutions of the National Assembly, ordinances, and resolutions of the Standing Committee of the National Assembly; supervises normative legal documents of the Government, the Prime Minister, the Supreme People's Court, and the Supreme People's Procuracy, and resolutions of the People's Councils of provinces and centrally governed cities; assists the National Assembly in exercising supervisory rights according to the division of labor by the National Assembly;

c) Within their respective tasks and authorities, the National Ethnic Council and the Committees of the National Assembly supervise the activities of the Government, the Prime Minister, ministries, and equivalent agencies, the Supreme People's Court, and the Supreme People's Procuracy in implementing laws, resolutions of the National Assembly, ordinances, and resolutions of the Standing Committee of the National Assembly; supervise normative legal documents within the scope of the National Ethnic Council and the Committee responsible; assist the National Assembly and the Standing Committee of the National Assembly in exercising supervisory rights according to the division of labor by these agencies;

d) The Delegations of the National Assembly organize the supervision activities of the Delegation and arrange for Members of the National Assembly in the Delegation to supervise the implementation of laws at the local level; supervise normative legal documents of the People's Councils and People's Committees of provinces and centrally governed cities; supervise the handling of citizens' complaints and petitions; participate in the Standing Committee of the National Assembly, the National Ethnic Council, and the Committees of the National Assembly's inspection teams at the local level when requested;

đ) Members of the National Assembly question the President of the State, the Chairman of the National Assembly, the Prime Minister, Ministers, and other members of the Government, the Chief Justice of the Supreme People's Court, and the Procurator General of the Supreme People's Procuracy; within their respective tasks and authorities, supervise normative legal documents, supervise the implementation of laws at the local level, and supervise the handling of citizens' complaints and petitions.

2. When deemed necessary, the National Assembly, the Standing Committee of the National Assembly, the National Ethnic Council, and the Committees of the National Assembly may conduct supervision of the activities of other agencies, organizations, and individuals.

Article 4. Responsibilities of the National Assembly, its agencies, Delegations of National Assembly members, and National Assembly members in exercising supervisory powers The exercise of supervisory powers by the National Assembly, the Standing Committee of the National Assembly, the National Ethnic Council, the Committees of the National Assembly, Delegations of National Assembly members, and National Assembly members must ensure transparency, objectivity, compliance with their authority, procedures, and formalities as prescribed by law, without hindering the normal operations of the agencies, organizations, and individuals under supervision. The Standing Committee of the National Assembly, the National Ethnic Council, the Committees of the National Assembly, Delegations of National Assembly members, and National Assembly members are responsible for their decisions, requests, and recommendations on supervision.

The National Assembly examines, evaluates, and reports on its supervisory activities to voters nationwide.

The Standing Committee of the National Assembly is responsible and reports on its supervisory activities to the National Assembly.

The National Ethnic Council and the Committees of the National Assembly are responsible and report on their supervisory activities to the National Assembly and the Standing Committee of the National Assembly.

Delegations of National Assembly members are responsible for their supervisory activities; they report on the supervisory activities of the Delegation and the National Assembly members within the Delegation to the Standing Committee of the National Assembly.

National Assembly members are responsible and report on the implementation of their supervisory tasks to voters in their localities.

Article 5. Rights and responsibilities of agencies, organizations, and individuals subject to supervision

Agencies, organizations, and individuals subject to supervision have rights and responsibilities as stipulated by this Law and other relevant laws.

Article 6. Participation in supervision by agencies, organizations, and individuals

1. When exercising supervisory powers, the National Assembly, the Standing Committee of the National Assembly, the National Ethnic Council, the Committees of the National Assembly, Delegations of National Assembly members, and National Assembly members rely on the participation of the people, the Vietnam Fatherland Front Committee, and its member organizations.

2. When conducting supervisory activities, the Standing Committee of the National Assembly, the National Ethnic Council, the Committees of the National Assembly, Delegations of National Assembly members, and National Assembly members may invite representatives of the Vietnam Fatherland Front Committee, its member organizations, and request representatives of relevant agencies, organizations, and individuals to participate; these agencies, organizations, and individuals are responsible for fulfilling such requests.

ULTIMATE SUPERVISORY ACTIVITIES OF THE NATIONAL ASSEMBLY

Chapter 2:

Article 7. Supervisory activities of the National Assembly

The National Assembly supervises through the following activities:

1. Examining reports on the work of the State President, the Standing Committee of the National Assembly, the Government, the Supreme People's Court, and the Supreme People's Procuracy;

2. Examining reports by the Standing Committee of the National Assembly on the implementation of the Constitution, laws, and resolutions of the National Assembly;

3. Examining normative legal documents issued by the State President, the Standing Committee of the National Assembly, the Government, the Prime Minister, the Supreme People's Court, and the Supreme People's Procuracy that appear to be contrary to the Constitution, laws, and resolutions of the National Assembly;

4. Examining responses to interpellations by the State President, the Chairman of the National Assembly, the Prime Minister, Ministers, and other members of the Government, the Chief Justice of the Supreme People's Court, and the Chief Procurator of the Supreme People's Procuracy;

5. Establishing a temporary committee to investigate a specific issue and examining the investigation results report of the committee.

Article 8. The National Assembly's Supervision Program

The National Assembly decides its annual supervision program based on the proposal of the Standing Committee of the National Assembly, the National Ethnic Council, the National Assembly Committees, the National Assembly Delegations, National Assembly deputies, the Central Committee of the Vietnam Fatherland Front, and the opinions and suggestions of voters nationwide.

The Standing Committee of the National Assembly proposes the National Assembly's supervision program for consideration and decision by the National Assembly at the last session of the previous year and organizes its implementation.

Article 9. Reviewing Work Reports

1. At the end-of-year session, the National Assembly reviews and discusses the annual work reports of the Standing Committee of the National Assembly, the Government, the Supreme People's Court, and the Supreme People's Procuracy. At the mid-year session, these agencies submit their work reports to National Assembly deputies; if necessary, the National Assembly may review and discuss them.

At the end-of-term session, the National Assembly reviews and discusses the term work reports of the National Assembly, the State President, the Standing Committee of the National Assembly, the Prime Minister, the Chief Justice of the Supreme People's Court, and the Procurator General of the Supreme People's Procuracy.

The National Assembly may request the Standing Committee of the National Assembly, the Government, the Supreme People's Court, and the Supreme People's Procuracy to report on other issues when deemed necessary.

2. The work reports specified in Clause 1 of this Article, except those of the National Assembly, the Standing Committee of the National Assembly, and the State President, must be reviewed by the National Ethnic Council and the National Assembly Committees according to the assignment of the Standing Committee of the National Assembly.

3. The National Assembly reviews and discusses the reports in the following sequence:

a) The head of the agency specified in Clause 1 of this Article presents the report;

b) The Chairman of the National Ethnic Council or the Head of the National Assembly Committee presents the review report;

c) The National Assembly discusses;

d) The head of the agency presenting the report may present additional related issues that National Assembly deputies are concerned about;

e) The National Assembly adopts a resolution on the work of the reporting agency when deemed necessary.

Article 10. Reviewing Legal Normative Documents Contrary to the Constitution, Laws, and Resolutions of the National Assembly National Assembly

1. When discovering legal normative documents of the Government, the Prime Minister, the Supreme People's Court, and the Supreme People's Procuracy that have signs of contravening the Constitution, laws, and resolutions of the National Assembly, the Standing Committee of the National Assembly examines, suspends enforcement, and submits the matter to the National Assembly for consideration and decision to revoke part or all of the document at the nearest session.

When discovering legal normative documents of the Standing Committee of the National Assembly and the State President that have signs of contravening the Constitution, laws, and resolutions of the National Assembly, National Assembly deputies propose the Standing Committee of the National Assembly and the State President to amend or revoke part or all of the document; the Standing Committee of the National Assembly and the State President are responsible for examining and responding to National Assembly deputies. In case National Assembly deputies disagree with the response of the Standing Committee of the National Assembly and the State President, they require the Standing Committee of the National Assembly to submit the matter to the National Assembly for consideration and decision at the nearest session.

2. The National Assembly reviews legal normative documents of the Standing Committee of the National Assembly, the State President, the Government, the Prime Minister, the Supreme People's Court, and the Supreme People's Procuracy that have signs of contravening the Constitution, laws, and resolutions of the National Assembly in the following sequence:

a) The Standing Committee of the National Assembly submits the legal normative document with signs of contravening the Constitution, laws, and resolutions of the National Assembly to the National Assembly for consideration;

b) The National Assembly discusses.

During the discussion process, the head of the agency that issued the legal normative document may present supplementary related issues;

c) The National Assembly adopts a resolution on the legality of the legal normative document not contravening the Constitution, laws, and resolutions of the National Assembly; decides to revoke part or all of the legal normative document contravening the Constitution, laws, and resolutions of the National Assembly.

Article 11. Interrogation and Response to Interrogation at the Session

At the National Assembly session, the interrogation and response to interrogation shall be carried out as follows:

1. National Assembly deputies shall clearly record the content of the interrogation, the person being interrogated on the interrogation form and submit it to the Chairman of the National Assembly for delivery to the person being interrogated. The session secretariat assists the Chairman of the National Assembly in compiling the interrogations of National Assembly deputies to report to the Standing Committee of the National Assembly;

2. The Standing Committee of the National Assembly proposes a list of persons responsible for responding to the interrogation at the session and reports to the National Assembly for decision;

3. The process of responding to the interrogation during the plenary session of the National Assembly shall be conducted in the following sequence:

a) The person being interrogated directly answers all the issues raised by the National Assembly deputies and clearly defines responsibility and measures to address them;

b) National Assembly deputies may raise questions related to the content of the interrogation for the person being interrogated to answer.

The time for answering the interrogation, asking questions, and additional responses shall be implemented according to the provisions of Article 43 of the Rules of Procedure of the National Assembly session;

4. After hearing the response to the interrogation, if the National Assembly deputies disagree with the content of the response, they have the right to request the National Assembly to continue discussing at that session, bring it up for discussion at another session of the National Assembly, or propose the National Assembly to consider the responsibility of the person being interrogated. The National Assembly adopts a resolution on the response to the interrogation and the responsibility of the person being interrogated when deemed necessary;

5. Persons who have responded to the interrogation at the National Assembly session, at the Standing Committee session, or have responded to the interrogation of National Assembly deputies in writing shall be responsible for reporting in writing to the National Assembly deputies about the implementation of the issues promised when responding to the interrogation at the next session.

Article 12. Establishment of the Temporary Commission of the National Assembly

1. When deeming it necessary, the Standing Committee of the National Assembly itself or upon the proposal of the State President, the Prime Minister, the National Ethnic Council, the National Assembly's Committees, or the National Assembly deputies shall submit to the National Assembly for decision to establish a Temporary Commission to investigate a specific issue.

The tasks and powers of the Temporary Commission shall be decided by the National Assembly.

2. The National Assembly shall examine the report on the results of the investigation of the Temporary Commission in the following sequence:

a) The Chairperson of the Temporary Commission presents the report on the results of the investigation;

b) The National Assembly discusses;

c) The National Assembly adopts a resolution on the issue that has been investigated.

Article 13. National Assembly Vote of Confidence

1. The National Assembly shall conduct a vote of confidence for individuals holding positions elected or approved by the National Assembly as follows:

a) The Standing Committee of the National Assembly itself or when there is a proposal from at least twenty percent (20%) of the total number of National Assembly deputies or a proposal from the National Ethnic Council, the National Assembly's Committees shall submit to the National Assembly for a vote of confidence for individuals holding positions elected or approved by the National Assembly;

b) Individuals proposed for the vote of confidence have the right to present their views before the National Assembly;

c) The National Assembly discusses and conducts a vote of confidence.

2. In the case where the individual proposed for the vote of confidence does not receive more than half of the total number of National Assembly deputies' confidence, the agency or individual who nominated or proposed the approval of such individual shall be responsible for submitting to the National Assembly for consideration and decision regarding the removal, dismissal, or approval of the removal or demotion of such individual.

Article 14. The National Assembly's authority in reviewing the results of supervision

Based on the results of supervision, the National Assembly has the following powers:

1. Request the Standing Committee of the National Assembly, the Government, the Prime Minister, the Supreme People's Court, and the Supreme People's Procuracy to issue guiding documents for the implementation of the Constitution, laws, and resolutions of the National Assembly;

2. Repeal part or all of normative legal documents issued by the President, the Standing Committee of the National Assembly, the Government, the Prime Minister, the Supreme People's Court, and the Supreme People's Procuracy that are contrary to the Constitution, laws, and resolutions of the National Assembly;

3. Issue a resolution regarding the response to questioning and the responsibility of the person being questioned when deemed necessary;

4. Remove from office or impeach the President, Vice Presidents, Chairperson, Vice Chairpersons, members of the Standing Committee of the National Assembly, the Prime Minister, the Chief Justice of the Supreme People's Court, and the Procurator General of the Supreme People's Procuracy; approve the removal from office or dismissal of Deputy Prime Ministers, Ministers, and other members of the Government.

Chapter 3:

SUPERVISION ACTIVITIES OF THE STANDING COMMITTEE OF THE NATIONAL ASSEMBLY

Article 15. Supervision activities of the Standing Committee of the National Assembly

The Standing Committee of the National Assembly supervises through the following activities:

1. Reviewing reports on the work of the Government, the Supreme People's Court, and the Supreme People's Procuracy during the period between two sessions of the National Assembly;

2. Reviewing normative legal documents of the Government, the Prime Minister, the Supreme People's Court, and the Supreme People's Procuracy that have signs of contravening the Constitution, laws, resolutions of the National Assembly, ordinances, and resolutions of the Standing Committee of the National Assembly;

3. Reviewing the responses to questioning of the person being questioned during the period between two sessions of the National Assembly;

4. Reviewing reports on the activities of the Provincial People's Councils and the People's Councils of centrally governed cities; reviewing resolutions of the Provincial People's Councils and the People's Councils of centrally governed cities that have signs of contravening the Constitution, laws, resolutions of the National Assembly, ordinances, and resolutions of the Standing Committee of the National Assembly;

5. Reviewing the handling of citizens' complaints and petitions;

6. Organizing inspection teams.

Article 16. The supervision program of the Standing Committee of the National Assembly

The Standing Committee of the National Assembly decides on its quarterly and annual supervision programs based on the supervision program of the National Assembly, proposals from the National Ethnic Council, Committees of the National Assembly, Delegations of the National Assembly, National Assembly deputies, the Central Committee of the Vietnam Fatherland Front, and opinions and suggestions of voters nationwide.

Based on the approved supervision program, the Standing Committee of the National Assembly assigns Standing Committee members to implement the contents of the program; it may entrust the National Ethnic Council or Committees of the National Assembly to carry out some of the program's contents and report the results to the Standing Committee of the National Assembly; decide on the progress of implementation and measures to ensure the implementation of the supervision program.

Article 17. Reviewing reports of the Government, the Supreme People's Court, and the Supreme People's Procuracy

1. During the period between two sessions of the National Assembly, the Standing Committee of the National Assembly reviews reports on the work of the Government, the Supreme People's Court, and the Supreme People's Procuracy; requests these agencies to report on other issues when deemed necessary.

2. Reports of the Government, the Supreme People's Court, and the Supreme People's Procuracy are pre-reviewed by the National Ethnic Council or Committees of the National Assembly before being submitted to the Standing Committee of the National Assembly.

3. The Standing Committee of the National Assembly reviews reports according to the following procedure:

a) The head of the agency specified in Clause 1 of this Article presents the report;

b) The Chairman of the National Ethnic Council or the Head of the National Assembly Committee presents the review report;

c) Representatives of invited agencies and organizations present their opinions at the meeting;

d) The Standing Committee of the National Assembly discusses.

d) The head of the agency submitting the report may provide additional information on related matters of interest to Standing Committee members;

e) The Standing Committee of the National Assembly issues a resolution on the work of the reporting agency when deemed necessary.

Article 18. Reviewing regulatory legal documents that appear to violate the Constitution, laws, resolutions of the National Assembly, ordinances, and resolutions of the Standing Committee of the National Assembly 1. The Standing Committee of the National Assembly itself or upon the proposal of the National Assembly's Ethnic Council, Committees of the National Assembly, Delegations of the National Assembly, or National Assembly deputies decides to review regulatory legal documents issued by the Government, Prime Minister, Supreme People's Court, Supreme People's Procuracy that appear to violate the Constitution, laws, resolutions of the National Assembly, ordinances, and resolutions of the Standing Committee of the National Assembly. The Standing Committee of the National Assembly assigns the Ethnic Council or Committees of the National Assembly to prepare opinions on such regulatory legal documents for reporting to the Standing Committee of the National Assembly.

2. The Standing Committee of the National Assembly reviews regulatory legal documents as stipulated in Clause 1 of this Article according to the following procedure:

a) The Chairman of the Ethnic Council or the Head of the National Assembly's Committee presents their opinion;

b) The Standing Committee of the National Assembly discusses;

c) The head of the agency that issued the document presents their opinion;

d) The Standing Committee of the National Assembly issues a resolution regarding whether the regulatory legal document does not violate the Constitution, laws, resolutions of the National Assembly, ordinances, and resolutions of the Standing Committee of the National Assembly; decides to revoke part or all of the regulatory legal document that violates ordinances and resolutions of the Standing Committee of the National Assembly; suspends the implementation of part or all of the regulatory legal document that violates the Constitution, laws, and resolutions of the National Assembly, and submits it to the National Assembly for consideration and decision at the nearest session.

Article 19. Answering questions during the meeting of the Standing Committee of the National Assembly

1. Answering questions during the meeting of the Standing Committee of the National Assembly is carried out as follows:

a) The Chairman of the National Assembly raises the questions of National Assembly deputies decided by the National Assembly to be answered at the Standing Committee meeting and other questions sent to the Standing Committee of the National Assembly between two sessions of the National Assembly;

b) The person being questioned answers directly, fully covering the content of the issues raised by the National Assembly deputies and clearly defining responsibility and corrective measures;

c) National Assembly deputies who have asked questions may be invited to attend the Standing Committee meeting and express their opinions. In cases where National Assembly deputies who have asked questions do not attend the meeting, the content of the answers to the questions and the results of the meeting must be sent to them no later than seven days from the end of the Standing Committee meeting; if the National Assembly deputy who has asked questions disagrees with the content of the answer, they have the right to request the Standing Committee of the National Assembly to discuss it at the next session of the National Assembly.

2. After hearing the answers to the questions, the Standing Committee of the National Assembly issues a resolution regarding the answers to the questions and the responsibilities of the person being questioned when deemed necessary.

Article 20. Reviewing provincial People's Council resolutions directly under the central government that appear to violate the Constitution, laws, resolutions of the National Assembly, ordinances, and resolutions of the Standing Committee of the National Assembly

1. The Standing Committee of the National Assembly itself or upon the proposal of the Prime Minister, the National Assembly's Ethnic Council, Committees of the National Assembly, Delegations of the National Assembly, or National Assembly deputies decides to review provincial People's Council resolutions directly under the central government that appear to violate the Constitution, laws, resolutions of the National Assembly, ordinances, and resolutions of the Standing Committee of the National Assembly. The Standing Committee of the National Assembly assigns the Ethnic Council or Committees of the National Assembly to prepare opinions on such resolutions for reporting to the Standing Committee of the National Assembly.

2. The Standing Committee of the National Assembly reviews resolutions as stipulated in Clause 1 of this Article according to the following procedure:

c) The Chairman of the People's Council that issued the resolution is invited to attend the meeting and present their opinion;

b) The Standing Committee of the National Assembly discusses;

c) The head of the agency that issued the document presents their opinion;

d) The Standing Committee of the National Assembly issues a resolution regarding whether the provincial People's Council resolution directly under the central government does not violate the Constitution, laws, resolutions of the National Assembly, ordinances, and resolutions of the Standing Committee of the National Assembly; decides to revoke part or all of the provincial People's Council resolution directly under the central government that violates the Constitution, laws, resolutions of the National Assembly, ordinances, and resolutions of the Standing Committee of the National Assembly.

d) The Standing Committee of the National Assembly issues a resolution regarding the provincial People's Council's resolutions that do not contravene the Constitution, laws, resolutions of the National Assembly, ordinances, and resolutions of the Standing Committee of the National Assembly; decides to revoke part or all of the provincial People's Council's resolutions that contravene the Constitution, laws, resolutions of the National Assembly, ordinances, and resolutions of the Standing Committee of the National Assembly.

Article 21. Review of the Provincial People's Council's Activity Reports

Annually, the Provincial People's Council sends its activity report to the National Assembly Standing Committee.

When deeming it necessary, the National Assembly Standing Committee reviews and issues a resolution on the activities of the Provincial People's Council.

Article 22. Oversight of the Election of National Assembly Deputies and People's Council Deputies

The National Assembly Standing Committee oversees the election of National Assembly deputies and People's Council deputies at all levels to ensure that the elections are conducted democratically and in accordance with the law.

The procedures and processes for overseeing the election of National Assembly deputies and People's Council deputies at all levels shall be carried out in accordance with the provisions of the law on elections.

Article 23. Organization of the National Assembly Standing Committee Supervision Team

1. Based on its supervision program or upon the request of the National Assembly, the proposal of the National Ethnic Council, the National Assembly Committees, the National Assembly Delegation, or the National Assembly Deputy, the National Assembly Standing Committee decides to establish a supervision team of the National Assembly Standing Committee.

The resolution of the National Assembly Standing Committee on the establishment of the supervision team must clearly define the content, plan, composition of the supervision team, and the agencies, organizations, and individuals subject to supervision.

The content and plan of the supervision team's oversight must be notified to the agencies, organizations, and individuals subject to supervision no later than seven days before the day the supervision team begins its activities.

2. The supervision team has the following tasks and powers:

a) Implementing the content and plan of supervision as stipulated in the resolution on the establishment of the supervision team.

b) Requesting agencies, organizations, and individuals subject to supervision to submit written reports, provide relevant information and documents, and explain issues of concern to the supervision team.

c) Examining and verifying issues that the supervision team deems necessary.

d) When discovering acts of law violation causing damage to the interests of the State, the legitimate rights and interests of organizations and individuals, the supervision team has the right to require relevant agencies, organizations, and individuals to take measures to promptly stop the violations and restore the interests of the State and the legitimate rights and interests of organizations and individuals who have been violated; requesting competent agencies, organizations, and individuals to examine the responsibility of agencies, organizations, and individuals committing violations according to the law.

đ) No later than fifteen days from the end of the supervision activities, the supervision team must submit a report on the results of the supervision to the National Assembly Standing Committee for review and decision.

Article 24. Review of the Supervision Team's Report of the National Assembly Standing Committee

The National Assembly Standing Committee reviews the supervision team's report in the following sequence:

1. The head of the supervision team presents the report.

2. Representatives of invited agencies and organizations speak during the meeting.

3. The National Assembly Standing Committee discusses.

During the discussion, representatives of the supervision team may present additional related issues.

4. The National Assembly Standing Committee issues a resolution on the supervised issue. This resolution is sent to the agencies, organizations, and individuals subject to supervision.

Article 25. Supervision by the Standing Committee of the National Assembly on the handling of complaints and denunciations

The Standing Committee of the National Assembly supervises the enforcement of laws on complaints and denunciations; examines reports from the Government, the Supreme People's Court, and the Supreme People's Procuracy on the handling of complaints and denunciations; organizes inspection teams or assigns the National Assembly's Ethnic Councils and Committees to supervise the handling of complaints and denunciations.

When discovering acts of law violation causing damage to the interests of the State, the legitimate rights and interests of organizations and individuals, the Standing Committee of the National Assembly requests competent agencies, organizations, and individuals to take measures to promptly stop such acts of law violation, examine responsibility, handle violators, restore the interests of the State and the legitimate rights and interests of organizations and individuals that have been violated, and at the same time request those with authority to examine and resolve; if they disagree with the resolution, the Standing Committee of the National Assembly requires the heads of higher-level agencies and organizations to examine and resolve. Competent agencies, organizations, and individuals have the responsibility to implement the requests of the Standing Committee of the National Assembly and must report to the Standing Committee of the National Assembly within seven days from the date of issuing the decision to resolve.

Article 26. Powers of the Standing Committee of the National Assembly in examining supervision results

Based on the results of supervision, the Standing Committee of the National Assembly has the following powers:

1. To suspend the implementation of part or all of normative legal documents of the Government, the Prime Minister, the Supreme People's Court, and the Supreme People's Procuracy that are contrary to the Constitution, laws, and resolutions of the National Assembly, and submit them to the National Assembly for consideration and decision on their abolition at the nearest session;

2. To decide to revoke part or all of normative legal documents of the Government, the Prime Minister, the Supreme People's Court, and the Supreme People's Procuracy that are contrary to ordinances and resolutions of the Standing Committee of the National Assembly;

3. To make recommendations to the National Assembly or request competent agencies or individuals to remove, dismiss, or discipline persons who commit serious violations of the law;

4. To propose the National Assembly to vote on confidence in persons holding positions elected or approved by the National Assembly;

5. To decide to revoke part or all of erroneous resolutions of provincial People's Councils and centrally-run city People's Councils; dissolve provincial People's Councils and centrally-run city People's Councils in cases where they cause serious damage to the interests of the people;

6. To issue a resolution on responding to questions and the responsibility of those questioned when deemed necessary;

7. To request competent agencies, organizations, and individuals to take measures to promptly stop acts of law violation, examine responsibility, handle violators, and promptly restore the interests of the State and the legitimate rights and interests of organizations and individuals that have been violated;

8. To revoke elections of People's Council deputies in constituencies with serious violations of the law and decide to hold new elections in those constituencies.

Chapter 4:

ACTIVITY OF SUPERVISION BY THE NATIONAL ASSEMBLY'S ETHNIC COUNCILS AND COMMITTEES

Article 27. Supervisory Activities of the National Assembly's Ethnic Council and Committees

The National Assembly's Ethnic Council and Committees supervise through the following activities:

1. Reviewing reports on the work of the Government, Supreme People's Court, and Supreme People's Procuracy within their respective fields of responsibility or as assigned by the Standing Committee of the National Assembly.

2. Examining normative legal documents issued by the Government, Prime Minister, Ministers, Heads of equivalent agencies, Supreme People's Court, and Supreme People's Procuracy, inter-ministerial normative legal documents, and normative legal documents between central state agencies with signs of contravention against the Constitution, laws, resolutions of the National Assembly, ordinances, resolutions of the Standing Committee of the National Assembly, and normative legal documents of higher-level state agencies.

3. In necessary cases, requesting the Government, ministries, equivalent agencies, Supreme People's Court, and Supreme People's Procuracy to report on activities within their respective fields of responsibility.

4. Organizing inspection teams.

5. Sending members to relevant agencies and organizations to examine and verify issues of concern to the Ethnic Council and Committees.

6. Organizing research, handling, and reviewing the resolution of citizens' complaints and petitions.

Article 28. Inspection Programs of the National Assembly's Ethnic Council and Committees

The National Assembly's Ethnic Council and Committees decide on their quarterly and annual inspection programs based on the inspection program of the National Assembly, the Standing Committee of the National Assembly, and the opinions of members of the Ethnic Council and Committees.

The permanent bodies of the Ethnic Council and Committees propose the inspection program for consideration and decision-making by the Ethnic Council and Committees and organize its implementation.

Article 29. Procedure for Considering and Reviewing Reports

1. The National Assembly's Ethnic Council and Committees organize meetings to review reports on the work of the Government, Supreme People's Court, and Supreme People's Procuracy.

The review reports of the Ethnic Council and Committees are sent to the National Assembly and the Standing Committee of the National Assembly.

2. The National Assembly's Ethnic Council and Committees organize meetings to consider reports on the activities of the Government, ministries, equivalent agencies, Supreme People's Court, and Supreme People's Procuracy within their respective fields of responsibility.

3. The procedure for considering and reviewing reports as stipulated in Clause 1 and Clause 2 of this Article shall be conducted as follows:

a) The head of the agency submitting the report presents the report.

b) Representatives of invited agencies and organizations make statements.

c) The Ethnic Council and Committees discuss.

d) The chairperson concludes the meeting.

Article 30. Supervision of Normative Legal Documents by the National Assembly's Ethnic Council and Committees

1. Within their duties and powers, the National Assembly's Ethnic Council and Committees have the responsibility to regularly monitor and urge the Government, Prime Minister, Ministers, Heads of equivalent agencies, Supreme People's Court, and Supreme People's Procuracy to issue normative legal documents to guide the implementation of laws, resolutions of the National Assembly, ordinances, and resolutions of the Standing Committee of the National Assembly in accordance with the prescribed deadlines.

2. Upon receiving normative legal documents from relevant agencies, the National Assembly's Ethnic Council and Committees have the responsibility to study and examine the contents of such documents.

3. In case of discovering normative legal documents with signs of contravention against the Constitution, laws, resolutions of the National Assembly, ordinances, and resolutions of the Standing Committee of the National Assembly, within their duties and powers, the National Assembly's Ethnic Council and Committees have the right to request competent authorities, organizations, and individuals to examine, amend, supplement, suspend the enforcement, or revoke part or all of such documents. Within thirty days from the date of receipt of the request, the authority, organization, or individual must inform the Ethnic Council and Committees about the resolution; if there is no response or the resolution does not meet the requirements beyond the said period, the Ethnic Council and Committees have the right:

a) To propose the Standing Committee of the National Assembly to consider and decide on suspending the enforcement of normative legal documents of the Government, Prime Minister, Supreme People's Court, and Supreme People's Procuracy with signs of contravention against the Constitution, laws, and resolutions of the National Assembly, and submit to the National Assembly for consideration and decision;

b) To propose the Standing Committee of the National Assembly to consider and decide on revoking part or all of normative legal documents of the Government, Prime Minister, Supreme People's Court, and Supreme People's Procuracy with signs of contravention against ordinances and resolutions of the Standing Committee of the National Assembly; deciding to revoke part or all of resolutions of provincial People's Councils that contravene the Constitution, laws, resolutions of the National Assembly, ordinances, and resolutions of the Standing Committee of the National Assembly;

c) To recommend the Prime Minister to consider and decide on revoking or suspending the enforcement of part or all of decisions, directives, circulars of Ministers, Heads of equivalent agencies that contravene the Constitution, laws, resolutions of the National Assembly, ordinances, and resolutions of the Standing Committee of the National Assembly, resolutions, decrees of the Government, decisions, and directives of the Prime Minister;

d) To recommend competent authorities, organizations, and individuals to consider and decide on revoking or suspending the enforcement of part or all of inter-ministerial normative legal documents between central state agencies or between state agencies and central organizations of political-social organizations that contravene normative legal documents of higher-level state agencies.

Article 31. Supervisory Delegation of the National Assembly's Ethnic Council and Committees

1. Based on their supervisory program or through supervision of citizens' complaints and denunciations, or upon discovering signs of law violations via mass media, or upon being assigned by the Standing Committee of the National Assembly, the Ethnic Council and Committees of the National Assembly shall organize supervisory delegations of the Councils and Committees.

The establishment of supervisory delegations, the content and plan of supervision, the composition of the supervisory delegation, and the agencies, organizations, and individuals subject to supervision shall be decided by the Permanent Office of the Council or the Permanent Office of the Committee.

The content and plan of the supervision team's oversight must be notified to the agencies, organizations, and individuals subject to supervision no later than seven days before the day the supervision team begins its activities.

2. The supervision team has the following tasks and powers:

a) Implementing the content and plan of supervision as stipulated in the decision establishing the supervisory delegation;

b) Requesting agencies, organizations, and individuals subject to supervision to report in writing, provide information and documents related to the supervision content; explain issues of concern to the delegation;

c) Reviewing and verifying issues deemed necessary by the delegation;

d) When discovering acts of law violation causing damage to state interests or the legitimate rights and interests of organizations and individuals, the supervisory delegation has the right to request relevant agencies, organizations, and individuals to apply measures to promptly stop the law violation, restore state interests, and the legitimate rights and interests of organizations and individuals that have been violated; requesting competent agencies, organizations, and individuals to examine the responsibility of those who violate the law according to the provisions of the law;

đ) At the latest ten days from the end of the supervisory activity, the supervisory delegation must report the results of supervision to the Ethnic Council, Committees of the National Assembly, or to the Permanent Office of the Ethnic Council, Permanent Office of the Committees of the National Assembly.

Article 32. Examination of Reports of the Supervisory Delegation of the Ethnic Council and Committees of the National Assembly

1. Depending on the nature and content of the issue under supervision, the Ethnic Council and Committees of the National Assembly shall organize a Council session or a Standing Office session to examine and discuss the report of the supervisory delegation.

2. The examination of the supervisory delegation's report shall proceed as follows:

a) The head of the supervisory delegation presents the report;

b) Representatives of invited agencies and organizations speak at the meeting;

c) The Ethnic Council and Committees of the National Assembly or their Standing Offices discuss the report of the supervisory delegation;

d) The chairperson concludes the meeting; the Ethnic Council and Committees of the National Assembly or their Standing Offices vote when deemed necessary.

3. The Ethnic Council and Committees of the National Assembly send the report on the results of supervision to the Standing Committee of the National Assembly, while also sending it to the agencies, organizations, and individuals subject to supervision. The report must clearly propose recommendations for necessary measures.

Article 33. Supervision by the Ethnic Council and Committees of the National Assembly over the Handling of Complaints and Accusations

1. Within their duties and powers, the Ethnic Council and Committees of the National Assembly are responsible for receiving citizens; accepting, studying, and handling citizens' complaints and accusations; supervising the handling of citizens' complaints and accusations within the fields they oversee.

2. Upon receiving citizens' complaints and accusations, the Ethnic Council and Committees of the National Assembly are responsible for organizing research and transferring them to competent agencies, organizations, and individuals for consideration and resolution; if they disagree with the resolution result, they request the head of the directly superior agency, organization to reconsider and resolve. Relevant agencies, organizations, and individuals must consider and resolve within the time limit prescribed by law and notify the Ethnic Council and Committees of the National Assembly about the resolution within seven days from the date of the resolution decision.

3. If necessary, the Ethnic Council and Committees of the National Assembly have the right to request relevant agencies, organizations, and individuals or the complainant, accuser to present and provide information, documents of interest to the Council or Committee; organize a supervisory delegation to review and verify issues of concern to the Council or Committee or as requested by the Standing Committee of the National Assembly, the Chairman of the National Assembly.

Article 34. The authority of the National Assembly's Ethnic Council and Committees to propose the Standing Committee of the National Assembly to consider for the National Assembly to vote on confidence in persons elected or approved by the National Assembly 1. During the supervision process, if it is found that persons elected or approved by the National Assembly have violated laws or failed to properly and fully perform their assigned tasks and powers, causing serious damage to the interests of the State, the legitimate rights and interests of organizations and individuals, the National Assembly's Ethnic Council and Committees have the right to propose the Standing Committee of the National Assembly to consider for the National Assembly to vote on confidence in such person.

2. The implementation of the provisions of Clause 1 of this Article shall be carried out in the following procedure:

a) The National Assembly's Ethnic Council and Committees organize a meeting to examine, discuss, and evaluate the violations committed by the person under consideration for the National Assembly's confidence vote.

c) The person under consideration for the confidence vote may be invited to attend the meeting and present their views on issues of concern to the National Assembly's Ethnic Council and Committees.

b) Representatives of invited agencies and organizations speak at the meeting;

d) The National Assembly's Ethnic Council and Committees discuss.

đ) The National Assembly's Ethnic Council and Committees vote. In case at least two-thirds of the total number of members agree to put forward for a confidence vote, then the National Assembly's Ethnic Council and Committees will propose the Standing Committee of the National Assembly to consider for the National Assembly to vote on confidence in such person.

Article 35. The authority of the National Assembly's Ethnic Council and Committees in examining the results of supervision

Based on the results of supervision, the National Assembly's Ethnic Council and Committees have the following rights:

1. Propose and require competent agencies, organizations, and individuals to amend, supplement, suspend the enforcement, revoke part or all of normative legal documents, or issue new normative legal documents.

2. Propose to the Prime Minister, other members of the Government, the President of the Supreme People's Court, the Procurator General of the Supreme People's Procuracy, the Chairman of the People's Committee of provinces and centrally governed cities regarding matters within the scope of the Councils' and Committees' responsibility. The recipient of the proposal has the responsibility to examine and reply within fifteen days from the date of receipt of the proposal. If no reply is received beyond this period or if the content of the reply is not agreed upon, the National Assembly's Ethnic Council and Committees have the right to propose to the Chairman of the National Assembly to request the recipient of the proposal to reply at a meeting of the Standing Committee of the National Assembly or at the nearest session of the National Assembly; in the case of the Chairman of the People's Committee of provinces and centrally governed cities, the proposal is referred to the Prime Minister for consideration.

3. When discovering acts of law violation causing damage to the interests of the State, the legitimate rights and interests of organizations and individuals, they require competent agencies, organizations, and individuals to take measures to promptly stop the acts of law violation, examine liability, handle violators, and restore the interests of the State, the legitimate rights and interests of organizations and individuals that have been violated.

3. When discovering acts of violating the law causing damage to the interests of the State, the rights and legitimate interests of organizations and individuals, request competent authorities, organizations, and individuals to take measures to promptly stop the violation of the law, examine responsibility, handle the violator, and restore the interests of the State, the rights and legitimate interests of organizations and individuals that have been violated.

Article 36. The Standing Committee of the National Assembly directs, coordinates, and cooperates in the supervision activities of the National Ethnic Council and the Committees of the National Assembly. In directing, coordinating, and cooperating in the supervision activities of the National Ethnic Council and the Committees of the National Assembly, the Standing Committee of the National Assembly shall have the following tasks and powers:

1. Assigning the National Ethnic Council and the Committees of the National Assembly to examine draft projects and reports submitted to the National Assembly and the Standing Committee of the National Assembly; entrusting the National Ethnic Council and the Committees of the National Assembly to implement certain contents in the supervision program of the Standing Committee of the National Assembly;

2. Requesting the National Ethnic Council and the Committees of the National Assembly to periodically report on their supervision programs, contents, and plans;

3. Requesting the National Ethnic Council and the Committees of the National Assembly to coordinate in implementing certain supervision activities at the same agency, locality, or unit to ensure the quality and effectiveness of supervision activities;

4. Reviewing and discussing reports on the results of supervision and supervisory recommendations of the National Ethnic Council and the Committees of the National Assembly. In necessary cases, the Standing Committee of the National Assembly shall issue resolutions on issues recommended by the National Ethnic Council and the Committees of the National Assembly, measures to address consequences caused by violations of the law, and requirements for handling violators, and assign relevant agencies and organizations to implement them.

SUPERVISION ACTIVITIES OF NATIONAL ASSEMBLY DELEGATES AND NATIONAL ASSEMBLY DELEGATIONS

Chapter 5:

Article 37. Supervision activities of National Assembly delegates

1. National Assembly delegates supervise through the following activities:

a) Questioning the President of the State, the Chairman of the National Assembly, the Prime Minister, members of the Government, the Chief Justice of the Supreme People's Court, and the Procurator General of the Supreme People's Procuracy;

b) Supervising normative legal documents; supervising the implementation of laws at localities;

c) Supervising the resolution of citizens' complaints and petitions.

2. National Assembly delegates conduct supervision activities themselves or participate in supervision activities of National Assembly Delegations; participate in supervision teams of the Standing Committee of the National Assembly, the National Ethnic Council, and the Committees of the National Assembly at localities when requested.

Article 38. Supervision activities of National Assembly Delegations

National Assembly Delegations supervise through the following activities:

1. Organizing supervision teams of the National Assembly Delegation and organizing for National Assembly delegates in the delegation to supervise the implementation of laws at localities; supervising normative legal documents of the People's Councils and People's Committees of provinces and centrally-administered cities;

2. Supervising the resolution of citizens' complaints and petitions that National Assembly delegates and National Assembly Delegations have transferred to competent authorities, organizations, or individuals for resolution;

3. Requesting local authorities, organizations, or individuals to respond to issues of concern to the National Assembly Delegation;

4. Appointing National Assembly delegates in the delegation to participate in supervision teams of the Standing Committee of the National Assembly, the National Ethnic Council, and the Committees of the National Assembly at localities when requested.

Article 39. Supervision Programs of National Assembly Delegates and National Assembly Delegations

National Assembly delegates establish six-month and annual supervision programs and submit them to the National Assembly Delegation.

The National Assembly Delegation bases its six-month and annual supervision programs on individual delegates' supervision programs, the National Assembly's supervision program, the Standing Committee of the National Assembly's supervision program, the National Ethnic Council's supervision program, the Committees of the National Assembly's supervision program, the actual situation of the locality, proposals from the Provincial or Central City-level United Front Work Committee, and opinions and recommendations of voters in the locality. The National Assembly Delegation reports these programs to the Standing Committee of the National Assembly and organizes the implementation of the delegation's supervision activities and ensures that National Assembly delegates in the delegation implement their own supervision programs.

Every six months and annually, the National Assembly Delegation has the responsibility to report to the Standing Committee of the National Assembly on the implementation of the delegation's supervision program and the individual supervision programs of National Assembly delegates in the delegation.

Every six months and annually, the Delegation of the National Assembly has the responsibility to report to the Standing Committee of the National Assembly on the implementation of the oversight program of the Delegation of the National Assembly and individual National Assembly deputies within the Delegation.

Article 40. Interpellation by National Assembly Deputies

National Assembly deputies have the right to interpellate the President of the State, the Chairman of the National Assembly, the Prime Minister of the Government, Ministers, and other members of the Government, the Chief Justice of the Supreme People's Court, and the Chief Prosecutor of the Supreme People's Procuracy.

The content of the interpellation must be concise, clear, based on evidence, and related to the duties, powers, and individual responsibilities of the person being interpellated.

Interpellation can be expressed in writing or through direct questioning.

The procedures and formalities for interpellation and responding to interpellations shall be carried out in accordance with the provisions of Articles 11 and 19 of this Law.

Article 41. National Assembly Deputies and Delegation of National Assembly Deputies Monitor Legal Normative Documents

Upon receiving legal normative documents, National Assembly deputies and Delegation of National Assembly Deputies have the responsibility to study and review the content of those documents. In cases where they discover that legal normative documents contain signs of contravention to the Constitution, laws, resolutions of the National Assembly, ordinances, or resolutions of the Standing Committee of the National Assembly, within their scope of duties and powers, National Assembly deputies and Delegation of National Assembly Deputies have the right to request competent authorities, organizations, or individuals to amend, supplement, suspend implementation, revoke partially or entirely the legal normative documents, or issue new legal normative documents.

Article 42. Organization of Supervisory Delegations of Delegation of National Assembly Deputies and Organization for National Assembly Deputies to Conduct Supervision of Law Enforcement at Local Levels Pursuant to the supervision program, the Delegation of National Assembly Deputies organizes supervisory delegations of the Delegation of National Assembly Deputies and organizes for National Assembly deputies in the delegation to conduct supervision of law enforcement at local levels.

1. Based on the supervision program, the Delegation of National Assembly Deputies organizes supervisory delegations of the Delegation of National Assembly Deputies and organizes for National Assembly deputies in the delegation to conduct supervision of law enforcement at local levels.

The establishment of supervisory delegations, the content, plan of supervision, composition of supervisory delegations, and the agencies, organizations, or individuals subject to supervision are decided by the Delegation of National Assembly Deputies.

National Assembly deputies decide on the content, plan of supervision, persons invited to participate in supervision, agencies, organizations, or individuals subject to supervision, and report to the Delegation of National Assembly Deputies.

The content, plan of supervision of supervisory delegations of the Delegation of National Assembly Deputies and of National Assembly deputies are announced by the Head of the Delegation of National Assembly Deputies to the agencies, organizations, or individuals subject to supervision not later than seven days before the start of the supervision activities.

2. When conducting supervision, supervisory delegations and National Assembly deputies have the following tasks and powers:

a) Implementing the content and plan of supervision as decided in the decision to establish supervisory delegations or organize supervision activities of National Assembly deputies;

b) Requesting agencies, organizations, or individuals subject to supervision to provide written reports, supply information and materials related to the supervision content; explain issues of concern to supervisory delegations or National Assembly deputies; examine and resolve issues related to the implementation of state policies and laws or related to the economic and social life of the local people;

c) Examining and verifying issues deemed necessary by supervisory delegations or National Assembly deputies;

d) When discovering acts of law violation causing damage to national interests or the legitimate rights and interests of organizations or individuals, proposing relevant agencies, organizations, or individuals to apply measures to promptly stop the violations, restore national interests, and the legitimate rights and interests of organizations or individuals who have been violated; requesting competent authorities to examine the responsibility of agencies, organizations, or individuals committing violations according to the law;

đ) Not later than ten days from the end of the supervision activity, supervisory delegations and National Assembly deputies conducting supervision must submit a report on the results of supervision to the Delegation of National Assembly Deputies.

3. Depending on the nature and content of the issues under supervision, the Delegation of National Assembly Deputies may organize discussions on the recommendations and requests of supervisory delegations or National Assembly deputies who have conducted supervision. Recommendations and requests of the Delegation of National Assembly Deputies through supervision activities are sent to the agencies, organizations, or individuals subject to supervision.

Article 43. Oversight by National Assembly Deputies and National Assembly Delegation on Complaints and Petitions Resolution report

1. National Assembly Deputies and National Assembly Delegations have the responsibility to receive, process, urge, and monitor the resolution of citizens' complaints and petitions.

The National Assembly Delegation has the responsibility to organize for National Assembly Deputies to meet with citizens, oversee agencies, organizations, and individuals with authority in resolving citizens' complaints and petitions.

2. Upon receiving citizens' complaints and petitions, National Assembly Deputies have the responsibility to organize research and directly or through the National Assembly Delegation transfer them to agencies, organizations, and individuals with authority for consideration and resolution. Agencies, organizations, and individuals with authority must consider and resolve within the time limit prescribed by law and notify National Assembly Deputies and the National Assembly Delegation of the resolution within seven days from the date of the decision to resolve.

In cases where they find the resolution unsatisfactory, National Assembly Deputies and the National Assembly Delegation have the right to meet with the heads of relevant agencies and organizations to inquire and request reconsideration. When necessary, National Assembly Deputies and the National Assembly Delegation have the right to request the heads of higher-level agencies and organizations to resolve.

3. In cases of necessity, National Assembly Deputies and the National Assembly Delegation have the right to require agencies, organizations, and individuals related to provide information and materials; examine and verify issues of concern; organize a supervision delegation to supervise the resolution of citizens' complaints and petitions at the local level.

Article 44. Authority of National Assembly Deputies and National Assembly Delegation in Reviewing Oversight Results oversight

1. Based on the oversight results, National Assembly Deputies and the National Assembly Delegation have the following rights:

a) To propose and request agencies, organizations, and individuals with authority to amend, supplement, suspend implementation, revoke part or all of normative legal documents or issue new normative legal documents;

b) To propose agencies, organizations, and individuals with authority to consider and resolve issues related to state policies and laws or local issues;

c) When discovering violations of the law causing damage to national interests, legitimate rights and interests of social organizations, economic organizations, people's armed forces units, or citizens, to request agencies, organizations, and individuals with authority to apply measures to promptly stop the violation of the law, consider responsibility, handle violators, restore national interests, and legitimate rights and interests of the violated organizations and individuals. Within thirty days from the date of receipt of the request, agencies, organizations, units, and individuals must notify National Assembly Deputies and the National Assembly Delegation of the resolution. If there is no response beyond this period, National Assembly Deputies and the National Assembly Delegation have the right to propose to the head of the superior agency, organization, or unit to consider and resolve, while reporting to the Standing Committee of the National Assembly for consideration and decision.

2. In addition to the rights stipulated in Clause 1 of this Article, National Assembly Deputies also have the right to propose to the Standing Committee of the National Assembly to consider submitting to the National Assembly for a vote of confidence in persons elected or approved by the National Assembly.

Chapter 6:

RIGHTS AND RESPONSIBILITIES OF AGENCIES, ORGANIZATIONS, AND INDIVIDUALS SUBJECTED TO OVERSIGHT AND MEASURES TO ENSURE THE EFFECTIVENESS OF OVERSIGHT ACTIVITIES

Article 45. Responsibilities of agencies, organizations, and individuals subject to supervision

1. Agencies, organizations, and individuals subject to supervision must strictly comply with decisions of the National Assembly and the Standing Committee of the National Assembly; create favorable conditions for agencies of the National Assembly, Delegations of National Assembly Members, and National Assembly Members to exercise their supervisory rights; promptly provide necessary information and documents when requested; address and respond to requests and recommendations of the National Ethnic Council, Committees of the National Assembly, Delegations of National Assembly Members, and National Assembly Members.

2. The Government, the Prime Minister, the Supreme People's Court, the Supreme People's Procuracy, Ministers, Heads of ministerial-level agencies, and related agencies and organizations have the responsibility to send normative legal documents they have issued to the Standing Committee of the National Assembly, the National Ethnic Council, and relevant Committees of the National Assembly no later than three days from the date of signing the document.

People's Councils, People's Committees of provinces and centrally-administered cities have the responsibility to send normative legal documents they have issued to Delegations of National Assembly Members no later than three days from the date of signing the document.

3. Individuals and heads of agencies and organizations subject to supervision have the direct responsibility to present issues raised by the National Assembly, the Standing Committee of the National Assembly, the National Ethnic Council, Committees of the National Assembly, Delegations of National Assembly Members, and National Assembly Members; in cases where they delegate others to present, such delegation must be approved by the National Assembly, the Standing Committee of the National Assembly, the National Ethnic Council, Committees of the National Assembly, Delegations of National Assembly Members, and National Assembly Members.

4. Individuals and heads of agencies and organizations subject to supervision who obstruct or fail to implement requests and decisions of the National Assembly, the Standing Committee of the National Assembly, the National Ethnic Council, Committees of the National Assembly, Delegations of National Assembly Members, or National Assembly Members during the exercise of supervisory rights shall be subject to disciplinary action, administrative penalties, or criminal prosecution depending on the nature and severity of the violation.

Article 46. Rights of agencies, organizations, and individuals subject to supervision

When the National Assembly, the Standing Committee of the National Assembly, the National Ethnic Council, Committees of the National Assembly, Delegations of National Assembly Members, and National Assembly Members conduct supervisory activities, agencies, organizations, and individuals subject to supervision have the following rights:

1. To be informed in advance about the plan, content of supervision, or content required to be reported or answered according to the law;

2. To present opinions on matters within their duties and powers;

3. To refuse to answer or provide information that falls outside their duties and powers or information classified as state secrets under the law;

4. To request the National Assembly agencies, Delegations of National Assembly Members, and National Assembly Members to reconsider supervisory requests and recommendations related to their agency, organization, or unit; in cases where they disagree with supervisory requests and recommendations of the National Ethnic Council, Committees of the National Assembly, Delegations of National Assembly Members, or National Assembly Members, they may themselves or report to the head of their superior agency, organization, or unit to request the National Assembly or the Standing Committee of the National Assembly to review and conclude on these requests and recommendations.

Article 47. Responsibilities of the National Assembly Office and the Office Supporting the Delegation of the National Assembly

Within their functions and tasks, the National Assembly Office and the Office Supporting the Delegation of the National Assembly shall be responsible for ensuring material conditions and providing necessary information and materials to organize services for the National Assembly, the Standing Committee of the National Assembly, the National Ethnic Council, the Committees of the National Assembly, the Delegation of the National Assembly, and National Assembly deputies to carry out supervisory activities.

Chapter 7:

IMPLEMENTING PROVISIONS

Article 48. Effective Date

This Law takes effect from August 1, 2003.

All previous provisions that are contrary to this Law are hereby abolished.

Article 49. Guidance on Implementation

The Standing Committee of the National Assembly shall provide guidance on the implementation of this Law.

This Law was passed by the National Assembly of the Socialist Republic of Vietnam, the eleventh session, third meeting, on June 17, 2003.
