Guidelines for Competition and Reward Work in the Justice Sector

Pursuant to Decree No. 16/2001/NĐ-CP dated May 2, 2001 of the Government on the organization and operation of financial leasing companies;
Pursuant to Decree No. 56/1998/NĐ-CP dated July 30, 1998 of the Government stipulating forms, subjects, and criteria for rewards granted by the Government, Ministries, agencies at the level of ministries, government agencies, People's Committees at all levels; detailing the criteria for rewarding the Labor Medal;
After consultation with the National Competition and Reward Institute, the Ministry of Justice provides guidelines for competition and reward work in the justice sector as follows:
I - GENERAL PROVISIONS
A.Principles of Competition and Reward
1- The principles of competition include:
a. Voluntary, self-aware, transparent;
b. Unity, cooperation, and mutual development.
2- The principles of reward include:
a. Accuracy, transparency, fairness, and timeliness;
b. Each form of reward may be awarded multiple times to the same recipient;
c. Ensuring consistency between the nature, form, and recipient of the reward;
d. Combining spiritual encouragement closely with material incentives.
B.Organization of Competition
1- Heads of units have the responsibility to take the lead, closely coordinate with political and social organizations at the same level, regularly direct the organization, maintain, and expand competition movements within their units, within the scope of their management areas, aiming to develop these movements strongly, widely, correctly, effectively, and promptly identify individuals and groups worthy of rewards or recommend higher authorities to grant rewards.
2- Initiating competition movements must have programs and plans, clearly defining objectives, contents, targets, scope, and specific competition subjects, closely aligning with tasks and operations of the sector, locality, and unit.
3- Competition movements need to be widely launched, continuously, and regularly across various fields of work, reaching every unit and each cadre and civil servant.
4- Organizing competition movements must ensure practicality and effectiveness, avoiding superficial formalism; implementing inspections, mid-term reviews, and final summaries of the movements; building and expanding exemplary models; regularly promoting, disseminating, and encouraging participation in competition movements.
5- Effectively implement the registration of competition agreements between units and individuals for titles of excellence and Competition Flags of the sector and the Government.
C.Recipients of Rewards
1- Individuals currently working in units under the Ministry of Justice, local enforcement agencies.
2- Groups within the justice sector including basic units and small groups within basic units:

Units under the International Adoption Bureau, National Registry of Security Interests Bureau, Legal Documents Inspection Bureau, Civil Enforcement Bureau, Legal Aid Bureau, Institute of Legal Science, Information Technology Center;
Departments, Rooms, and units under Hanoi Law University, Judicial Training College;
Units under Law Newspaper, Democracy and Law Journal, Legal Publishing House;
Provincial Civil Enforcement Offices, and Civil Enforcement Teams at districts, counties, towns, and cities under provinces and centrally governed municipalities.
3- Other individuals and groups (belonging to local judicial agencies, auxiliary judicial agencies, administrative judicial agencies, industry legal departments, foreign agencies and organizations...) who have outstanding achievements contributing to judicial work fields.
II. FORMS AND CRITERIA FOR REWARDS
a. Forms of reward
1. Forms of reward in the justice sector
1.1- Titles of excellence:
For individuals:
Excellent Worker;
Outstanding Competitor at the grassroots level;
Outstanding Competitor in the Justice Sector.
For groups:
Excellent Working Group;
Outstanding Working Group.
1.2- Forms of reward:
Certificate of Merit from the Head of the Basic Unit;
Award from the Minister of Justice;
Flag of Excellence of the Justice Sector.
2. Forms of reward by the State
2.1- Titles of excellence:
National Outstanding Competitor.
2.2- Forms of reward:
Flag of Excellence of the Government;
Award from the Prime Minister;
Labor Medal (various classes)...
3. Relationship between titles of excellence, flags of excellence, and other forms of reward
3.1- Titles of excellence and flags of excellence are forms of recognition of competition results for the year and serve as grounds for selecting outstanding individuals and groups to be awarded certificates of merit, awards, or medals by leaders at various levels.
The granting of titles of excellence and flags of excellence is conducted at the end of the competition year based on competition agreements registered at the beginning of the year and publicly evaluated among participating members.
3.2- Certificates of merit, awards, and medals are forms of reward given to individuals and groups with outstanding achievements in competition movements, while also being awarded to those who achieve exceptional and outstanding results not included in competition targets or who did not participate in signing competition agreements within any organization. Outstanding achievements recognized during the competition year are considered additional factors when evaluating overall performance in the annual summary.
b.Criteria for Rewards
1. Excellent Worker
Civil servants awarded the title of Excellent Worker must meet the following criteria:
Excelling in professional expertise; completing assigned tasks well; achieving high-quality and effective work outcomes;
Adhering to internal regulations of the agency and unit, Party policies, and state laws; having self-reliance spirit; fostering unity and mutual assistance among colleagues; maintaining good moral character and lifestyle; registering for competition and actively participating in competition movements;
Actively studying to meet the professional standards of the civil service position they hold (political theory, public administration, professional expertise, foreign languages).
The title of Excellent Worker is awarded once a year by the Head of the Basic Unit for civil servants within the basic unit; the Director of the Department of Justice is authorized by the Minister of Justice to decide on this title for civil servants in the Enforcement Division and Enforcement Teams; the Minister of Justice decides on this title for civil servants in units under the Ministry of Justice.
Civil servants who are awarded the title of Excellent Worker shall be granted a certificate accompanied by a reward not exceeding half a month's minimum wage.
2. Outstanding Soldier at the Basic Level
Civil servants who are awarded the title of Outstanding Soldier at the Basic Level must meet the following criteria:
Successfully completing assigned tasks with high quality and efficiency; actively promoting initiatives, improving techniques, methods of work, and applying new scientific and technological advancements;
Serving as a model in complying with internal regulations and rules of the agency, unit, and policies and laws of the Party and State; demonstrating self-reliance; fostering a spirit of unity, mutual assistance among colleagues; maintaining good moral character and healthy lifestyle; registering for competition and actively participating in various competitive movements;
Actively studying to meet the professional standards of the civil service position they hold (political theory, public administration, professional expertise, foreign languages).
The title of Outstanding Soldier at the Basic Level is awarded once a year by the Minister of Justice for civil servants in units under the jurisdiction of the Ministry of Justice.
Civil servants who are awarded the title of Outstanding Soldier at the Basic Level shall be granted a certificate accompanied by a reward not exceeding one month's minimum wage.
3. Outstanding Soldier in the Justice Sector
Civil servants who are awarded the title of Outstanding Soldier in the Justice Sector must meet the following criteria:
Being the most outstanding among Outstanding Soldiers at the Basic Level and having been consecutively awarded the title of Outstanding Soldier at the Basic Level for three years, or if less than three consecutive years, their achievements must serve as exemplary models for the sector;
Or being the most outstanding among those who have been consecutively awarded Commendation Certificates from the Minister of Justice or the Chairman of the Provincial People's Committee for three years;
Proposing projects or initiatives that are applied in the management field of the sector or unit.
Registering for competition and actively participating in various competitive movements.
The title of Outstanding Soldier in the Justice Sector is reviewed and awarded twice every five years, in the third and fifth years of the five-year plan, by the Minister of Justice for civil servants working in units under the Ministry of Justice, enforcement agencies, and Directors of Justice Departments.
Civil servants who are awarded the title of Outstanding Soldier in the Justice Sector shall be granted a certificate and the Emblem of Outstanding Soldier in the Justice Sector accompanied by a reward not exceeding two months' minimum wage.
4. National Outstanding Soldier
Civil servants who are awarded the title of National Outstanding Soldier must meet the following criteria:
Being the most outstanding among Outstanding Soldiers in the Justice Sector, having been consecutively awarded the title of Outstanding Soldier in the Justice Sector for two times, and meeting all of the following conditions:
Having achieved the title of Outstanding Soldier in the Justice Sector during the review period;
Achievements in the last three years recognized by the Prime Minister with a Commendation Certificate or by the President with a Labor Medal;
Registering for competition and actively participating in various competitive movements.
The title of National Outstanding Soldier is reviewed and awarded once every five years, at the end of the five-year plan, by the Prime Minister for civil servants working in units under the Ministry of Justice, enforcement agencies, and Directors of Justice Departments.
Civil servants who are awarded the title of National Outstanding Soldier shall be granted a certificate and the Emblem of National Outstanding Soldier accompanied by a reward not exceeding three months' minimum wage.
5. Excellent Work Team
A small team within a basic unit that is awarded the title of Excellent Work Team must meet the following criteria:
Completing assigned tasks and plans, having registered for competition and organized regular and effective competitive movements;
Adhering well to the policies and laws of the Party and State, the team is united and strong;
At least 30% of individuals in the unit must achieve the title of Excellent Worker, and there should be no individual disciplined with a warning or higher;
The title of Excellent Work Team is awarded once a year by the Head of the Basic Unit for small teams within the basic unit; the Director of the Justice Department is authorized by the Minister of Justice to decide on this title for the Enforcement Division and Enforcement Teams; the Minister of Justice decides on this title for small teams under the Ministry of Justice.
An Excellent Work Team is granted a certificate accompanied by a reward not exceeding one month's minimum wage.
6. Excellent Work Team with Distinction
A small team within a basic unit that is awarded the title of Excellent Work Team with Distinction must meet the following criteria:
Innovative, overcoming difficulties, successfully completing tasks, fulfilling obligations to the State; having registered for competition and organizing regular and practical competitive movements that are recognized and emulated by other units;
Serving as a model in adhering to the policies and laws of the Party and State; the team is united, clean, and strong;
At least 50% of individuals in the unit must achieve the title of Excellent Worker, and there must be individuals who have been awarded the title of Outstanding Soldier at the Basic Level, with no individual disciplined with a warning or higher;
The title of Excellent Work Team with Distinction is awarded once a year by the Minister of Justice for small teams in basic units under the jurisdiction of the Ministry of Justice.
An Excellent Work Team with Distinction is granted a certificate accompanied by a reward not exceeding three months' minimum wage.
7. Commendation from the Head of the Basic Unit
This is a form of commendation for individuals and teams on the occasion of annual work summaries, at the end of a campaign, a short-term competition period, or outstanding achievements and exemplary deeds that serve as role models within the scope of the basic unit's activities.
Civil servants and teams in the sector who are commended with a Commendation from the Head of the Basic Unit on the occasion of the annual work summary must meet the following criteria:
For individuals: being outstanding among those who have achieved the title of Excellent Worker;
For small teams: being outstanding among those who have achieved the title of Excellent Work Team.
The Minister of Justice delegates to the Director of the Department of Justice the authority to decide on civil servants and collectives under local enforcement agencies.
Individuals and collectives receiving a Certificate of Merit shall be awarded a bonus not exceeding half a month's minimum wage.
8. Certificate of Merit from the Minister of Justice
It is a form of reward for individuals and collectives under the management authority of the Ministry of Justice during annual work summaries, at the end of a campaign or short-term competition period, when outstanding achievements are made in a particular field of work, or for outstanding spontaneous achievements, exemplary good deeds, which have educational and exemplary effects within the sector; other individuals and collectives (from local judicial agencies, judicial auxiliary agencies, administrative judicial agencies, industry legal organizations, foreign agencies and organizations...) who have made outstanding contributions in judicial work fields.
Civil servants and collectives within the sector eligible for the Certificate of Merit from the Minister of Justice during annual work summaries must meet the following criteria:
For individuals: they must be outstanding among those who have been honored with the title of Model Worker at the grassroots level;
For small collectives: they must be outstanding among those who have been honored with the title of Excellent Labor Collective;
For grassroots units: at least 80% of individuals must be honored with the title of Good Worker and at least 10% of individuals must be honored with the title of Model Worker at the grassroots level.
Individuals and collectives receiving the Certificate of Merit from the Minister of Justice shall be awarded a bonus not exceeding one month's minimum wage for individuals and two months' minimum wage for collectives.
9. Flag of Competition of the Judicial Sector
Collectives eligible for the Flag of Competition of the Judicial Sector must meet the following criteria:
They must excel comprehensively in all assigned tasks throughout the year with high quality and efficiency; they must have registered for competition and have a regular, practical, and effective competition movement;
They must be recognized and esteemed as leading units in the competition region of the sector;
They must have new factors and models for other units in the sector to emulate; they must practice thrift effectively; they must combat corruption, smuggling, and social evils effectively; they must implement policies on gender equality and women's advancement well.
The Flag of Competition of the Judicial Sector is reviewed annually for awards during the year-end summary, decided upon by the Minister of Justice to be presented to outstanding collectives of the Department of Justice, Enforcement Agencies, and units under the Ministry of Justice in the competition movement of the sector.
Collectives receiving the Flag of Competition of the Judicial Sector shall be awarded a bonus not exceeding fifteen months' minimum wage.
10. Flag of Competition of the Government
Collectives eligible for the Flag of Competition of the Government must meet the following criteria:
They must excel comprehensively in all assigned tasks and plans throughout the year with high quality and efficiency; they must have registered for competition and have a regular, practical, and effective competition movement;
They must be recognized and esteemed as leading units in the sector's work group;
They must have exemplary new factors and models for the whole country to emulate; they must lead in practicing thrift, combating waste, corruption, smuggling, and social evils effectively; they must implement policies on gender equality and women's advancement well.
The Flag of Competition of the Government is reviewed annually for awards during the year-end summary, decided upon by the Prime Minister to be presented to outstanding collectives of the Department of Justice, Enforcement Agencies, and units under the Ministry of Justice that lead in comprehensive performance and in the sector's work groups.
Collectives receiving the Flag of Competition of the Government shall be awarded a bonus not exceeding thirty months' minimum wage.
11. Certificate of Merit from the Prime Minister
Individuals and collectives eligible for the Certificate of Merit from the Prime Minister must meet the following criteria:
For individuals:
They must have outstanding spontaneous achievements in the sector;
Or individuals who have been awarded the Certificate of Merit by the Minister of Justice or the Chairman of the Provincial People's Committee for three consecutive years, and in the year proposed for commendation, they must achieve new outstanding results;
Or individuals who have been awarded the title of Model Worker at the grassroots level for five consecutive years or more;
For groups:
They must have outstanding spontaneous achievements in the sector;
Or collectives who have been awarded the Certificate of Merit by the Minister of Justice or the Chairman of the Provincial People's Committee for three consecutive years, and in the year proposed for commendation, they must achieve new outstanding results.
Individuals and collectives receiving the Certificate of Merit from the Prime Minister shall be awarded a bonus not exceeding two months' minimum wage for individuals and four months' minimum wage for collectives.
12. Labor Medal (various classes)
Individuals and collectives eligible for the Labor Medal (various classes) must meet the following criteria:
12.1 - Labor Medal Class III
For individuals:
They must be a Model Worker at the grassroots level for ten consecutive times or more, or a Model Worker in the Judicial Sector, a Model Worker in a province or centrally-administered city for three consecutive times or more, or be outstanding among those who are National Model Workers;
Or they must have been awarded the Certificate of Merit by the Prime Minister, and then for three consecutive years achieved outstanding results to be awarded the Certificate of Merit by the Minister of Justice or the Chairman of the Provincial People's Committee;
For groups:
They must be outstanding collectives, having been awarded the Certificate of Merit by the Minister of Justice or the Chairman of the Provincial People's Committee for five consecutive years or more, including the last year being awarded the Flag of Competition of the Sector or the Flag of Competition of the Government;
Or they must have been awarded the Certificate of Merit by the Prime Minister, and then for three consecutive years achieved outstanding results to be awarded the Certificate of Merit by the Minister of Justice or the Chairman of the Provincial People's Committee;
Individuals and collectives receiving the Labor Medal Class III shall be awarded a bonus not exceeding four months' minimum wage for individuals and eight months' minimum wage for collectives.
12.2 - Labor Medal Class II
For individuals:
They must be outstanding among those who have been twice National Model Workers;
Or they must have been awarded the Labor Medal Class III, and then for five consecutive years or more achieved outstanding results to be awarded the Certificate of Merit by the Minister of Justice or the Chairman of the Provincial People's Committee;
For groups:
They must have been awarded the Labor Medal Class III, and then for three consecutive years or more received the Flag of Competition of the Sector;
Or they must have been awarded the Labor Medal Class III, and then for five consecutive years or more achieved outstanding results to be awarded the Certificate of Merit by the Minister of Justice or the Chairman of the Provincial People's Committee.
Individuals and groups awarded the Second-Class Labour Medal shall be accompanied by a cash award not exceeding eight months of the minimum wage for individuals and not exceeding sixteen months of the minimum wage for groups.
12.3- The First-Class Labour Medal
For individuals:
Is an outstanding representative among those who have been three-time National Model Workers;
Or has been awarded the Second-Class Labour Medal, and thereafter continuously for five years or more achieved outstanding results recognized with a Certificate of Merit by the Minister of Justice or the Chairman of the People's Committee at provincial level.
For groups:
Is an outstanding representative group of the Sector, awarded the Flag of Excellence by the Government four times or more;
Or has been awarded the Second-Class Labour Medal, and thereafter continuously for five years or more achieved outstanding results recognized with a Certificate of Merit by the Minister of Justice or the Chairman of the People's Committee at provincial level, including being awarded the Flag of Excellence of the Sector in the last two years or having been awarded the Flag of Excellence of the Government in one year.
Individuals and groups awarded the First-Class Labour Medal shall be accompanied by a cash award not exceeding ten months of the minimum wage for individuals and not exceeding twenty months of the minimum wage for groups.
III. PROCEDURES AND CONTENT OF THE APPLICATION FILE FOR RECOGNITION OF MERIT
a. Procedures for proposing recognition of merit
1. For commendation forms within the authority of the Head of the Basic Unit
Based on the proposal of the Competition and Commendation Council of the basic unit, the Head of the basic unit decides to commend:
The title of Excellent Worker for civil servants and small groups within the basic unit under the jurisdiction and delegation of management by the Ministry of Justice.
A certificate of merit for individuals and groups as stipulated in Point 7, Section B, Part II of this Circular.
The Head of the basic unit is responsible for keeping the file, recording in the commendation book, and sending the Decision on Commendation to the Standing Body of the Competition and Commendation Council of the Legal Sector for monitoring and management.
2. For commendation forms within the authority of the Minister of Justice
2.1- Based on the proposal of the Competition and Commendation Council of the Ministry of Justice, the Minister of Justice decides to commend:
The title of Excellent Worker for civil servants and small groups within the Ministry of Justice.
2.2- Based on the proposal of the Competition and Commendation Council of the Legal Sector, the Minister of Justice decides to commend:
The title of Outstanding Model Worker at the Basic Level for civil servants under the management authority of the Ministry of Justice.
The title of Outstanding Model Worker in the Legal Sector for civil servants working in units under the Ministry of Justice, enforcement agencies, and Directors of Provincial Legal Departments.
The title of Excellent Working Group for small groups within basic units under the management authority of the Ministry of Justice.
The Flag of Excellence of the Legal Sector for Provincial Legal Departments, enforcement agencies, and units under the Ministry of Justice.
A certificate of merit for individuals and groups as stipulated in Point 8, Section B, Part II of this Circular.
3. For commendation forms by the State
Based on the proposal of the Competition and Commendation Council of the Legal Sector, the Minister of Justice examines and submits to the competent authority for consideration and presentation of State commendation forms for individuals and groups under the management authority of the Ministry of Justice, Provincial Legal Departments, and Directors of Provincial Legal Departments.
4. Consultation on Proposals for Commendation
4.1- For commendation forms: Outstanding Model Worker in the Legal Sector, Flag of Excellence of the Legal Sector, and State commendation forms, before the Ministry of Justice proposes for commendation or presents to the State for commendation, there must be a consultation document from the People's Committee of the province or centrally-administered city.
4.2- In cases where the Ministry of Justice is requested to provide consultation on proposals for commendation, there must be a request document from the ministry, sector, or People's Committee of the province or centrally-administered city, along with a report on achievements of the individual or group proposed for commendation.
b.Content of the Application File for Recognition of Merit
1. For annual regular commendation proposals
1. A registration form for issuing a journalist card filled out by the applicant according to the model; approved and stamped by the head of the applying agency (Model No. 1);
A work achievement record of the individual or group proposed for commendation, confirmed, signed, and stamped (if applicable) by the Head of the unit; The work achievement record of the Enforcement Team must have a consensus opinion, signed, and stamped by the Chairman of the same-level People's Committee and the Director of the Provincial Enforcement Department.
A meeting record evaluating individuals and groups meeting the specified criteria, proposed for commendation by the unit, signed and stamped by the Head of the unit.
A meeting record of the Competition and Commendation Council of the basic unit.
A commendation proposal document from the Head of the basic unit. For individuals and groups under the Ministry of Justice, the Chairman of the Competition and Commendation Council of the Ministry of Justice issues a commendation proposal document.
A consultation document from the People's Committee of the province or centrally-administered city.gFor individuals and groups proposed for commendation of the title of Outstanding Model Worker in the Legal Sector, Flag of Excellence of the Legal Sector, and State commendation forms.
A proposal document and a record of selection and endorsement from the competition area for groups proposed for the Flag of Excellence of the Sector, Flag of Excellence of the Government, and individuals proposed for commendation of Outstanding Model Worker in the Sector, National Outstanding Model Worker.
2. For cases proposing extraordinary commendation
1. A registration form for issuing a journalist card filled out by the applicant according to the model; approved and stamped by the head of the applying agency (Model No. 1);
A summary of achievements confirmed, signed, and stamped (if applicable) by the Head of the unit; The summary of achievements of the Enforcement Team must have a consensus opinion, signed, and stamped by the Chairman of the same-level People's Committee and the Director of the Provincial Enforcement Department.
A letter proposing commendation from the Head of the basic unit (specifying the extent and scope of influence of the achievements made).
The consultation process must ensure compliance with the above regulations.
3. Quantity of Application Files for Commendation
In addition to the files kept by the basic unit, the quantity of files sent to the Competition and Commendation Council of the Sector is regulated as follows:
3.1- Application files for commendation forms within the authority of the Minister of Justice consist of one set.
3.2- Application files for commendation of the Flag of Excellence of the Government and Certificates of Merit from the Prime Minister consist of three sets.
3.3- Application files for the Prime Minister to recognize the title of National Outstanding Model Worker consist of eight sets.
3.4- Application files for State commendation of the Labour Medal in all classes consist of four sets.
All sets of files must be original (original copies).
Reports on achievements of individuals and collectives must comprehensively state all aspects of work during the period for which commendation is being sought according to the prescribed standards, and fully record all forms of commendations achieved. Example:
If recommending the Prime Minister to confer a Commendation Certificate, then a report on three consecutive years of work performance must be submitted.
If recommending the conferral of Labor Medals of various classes, then a report on five consecutive years of work performance must be submitted, etc.
Documents in the commendation application file must be typed, without erasures or corrections; they must correctly and fully include full name, date of birth, nationality, place of origin, position, administrative unit.
c.Time for considering commendations
1. Forms of commendation within the authority of the Ministry of Justice and the Government's Flag of Excellence are considered in December each year. Application files for commendation consideration by the Ministry of Justice must be sent to the Standing Committee of the Competition and Commendation Council of the Justice Sector before November 30 each year..
2. National forms of commendation such as the Commendation Certificate of the Prime Minister and Labor Medals of various classes are submitted to the Prime Minister for consideration at the following times:
On May 1;
On September 2;
On November 20: for schools under the Ministry of Justice.
Application files for the Prime Minister's commendation consideration must be sent to the Standing Committee of the Competition and Commendation Council of the Justice Sector at least 45 days before May 1, September 2, and November 20.
3. In cases of outstanding and exceptionally excellent achievements, the units responsible shall immediately establish files upon achieving the results and submit them to the competent authorities for commendation.
IV. TASKS AND LIMITATIONS OF THE COMPETITION AND COMMENDATION COUNCILS AT ALL LEVELS AND REGIONAL COMPETITION MEETINGS

1. Basic Level Competition and Commendation Council
1.1- Implement advisory functions, assist the head of the basic level unit in competition and commendation work within the unit's field of activity; organize, guide, and direct the competition movement of the unit to develop it strongly, in the right direction, and effectively.
1.2- Consider and recommend to the head of the basic level unit to commend certificates and titles of Excellent Workers for collectives and individuals within the unit's authority, or to have the head of the basic level unit recommend to higher-level agencies for commendation.
1.3- Examine and recommend to the head of the basic level unit to resolve complaints, denunciations, and suggestions regarding competition and commendation; Examine and recommend to the competent authorities to revoke commendation decisions for cases where violations of competition and commendation regulations are discovered.
2. Competition and Commendation Council of the Ministry of Justice Agency
2.1- Implement advisory functions, assist the Minister of Justice in competition and commendation work of the Ministry of Justice Agency; organize, guide, and direct the competition movement of the agency to develop it strongly, in the right direction, and effectively.
2.2- Consider and recommend to the Minister of Justice to commend titles of Excellent Workers for collectives and individuals within the Ministry of Justice Agency. For the consideration of commendation of other competition titles and forms of commendation for collectives and individuals within the Ministry of Justice units, the Competition and Commendation Council of the Ministry of Justice Agency considers and recommends to the Competition and Commendation Council of the Justice Sector to consider recommending to the Minister of Justice for commendation or to have the Minister of Justice recommend to higher-level agencies for commendation.
2.3- Examine and recommend to the Minister of Justice to resolve complaints, denunciations, and suggestions regarding competition and commendation for collectives and individuals within the Ministry of Justice units; Examine and recommend to the competent authorities to revoke commendation decisions for cases where violations of competition and commendation regulations are discovered.
3. Competition and Commendation Council of the Justice Sector
3.1- Implement advisory functions, assist the Minister of Justice in competition and commendation work within the Justice Sector; organize, guide, and direct the competition movement of the entire sector to develop it strongly, widely, in the right direction, and effectively.
3.2- Select collectives and individuals with outstanding achievements in the sector's competition movement to recommend to the Minister of Justice for commendation of competition titles and other forms of commendation within the Minister of Justice's authority or to have the Minister of Justice recommend to higher-level agencies for commendation.
3.3- Examine and recommend to the Minister of Justice to resolve complaints, denunciations, and suggestions regarding competition and commendation within the Justice Sector; Examine and recommend to the competent authorities to revoke commendation decisions for cases where violations of competition and commendation regulations are discovered.
4. Regional Competition Meetings
4.1- Summarize and conclude the annual competition movement and propose directions for organizing the regional competition movement; exchange experiences, build new models, and exemplary advanced cases in the region; organize the signing of competition agreements between members and develop the regional competition movement strongly, widely, in the right direction, and effectively.
4.2- Select and honor units and individuals with outstanding and exemplary achievements in the region to recommend for consideration of awarding the Government's Flag of Excellence, the Justice Sector's Flag of Excellence, Hero of Labor, National Model Worker, and Justice Sector Model Worker.
V. EXPENSES FOR COMPETITION AND COMMENDATION,
HANDLING VIOLATIONS AND RESOLVING COMPLAINTS AND DENUNCIATIONS REGARDING COMPETITION AND COMMENDATION
1- Expenses for competition and commendation in the Justice Sector are allocated from the State budget. Annually, within the scope of the Ministry of Justice's budget assigned by the Government, the Ministry of Justice allocates up to 15% of the total salary fund of the sector to serve as the source of expenses for competition and commendation in the Justice Sector.
2- Any individual or collective that reports achievements untruthfully, concealing shortcomings to obtain commendation, if discovered, the head of the unit and the individuals and collectives involved must bear full responsibility. Depending on the severity of the violation by the individual or collective, the person authorized to decide on commendation will issue a decision or request the competent state authority to revoke the commendation decision, certificate of commendation title, and other forms of commendation, and demand the return of any accompanying monetary awards. Additionally, the individuals and collectives violating the rules will be subject to other legal provisions.
The procedures, formalities, deadlines, and files for handling complaints and denunciations regarding commendation and reward shall be carried out in accordance with the provisions of the law on complaints and denunciations.
This Circular takes effect fifteen days from the date of publication in the Official Gazette and replaces Circular No. 06/2001/TT-BTP dated November 8, 2001 of the Ministry of Justice guiding the work of commendation and reward in the judicial sector. All previous guiding documents of the Ministry of Justice that conflict with this Circular are hereby abolished. In the course of implementation, if there are difficulties, they should be promptly reflected to the Ministry of Justice for study and resolution./.
ANNEX
Provisions on the allocation of criteria for the Flag of Excellence and the ratio of rewards for other forms of commendation
under the authority of the Minister of Justice
in the annual summary of excellence campaigns (Annexed to Circular No. /2003/TT-BTP dated month day year 2003)
I. FORMS OF REWARD BY THE STATE
The Flag of Excellence of the Government
1. Based on the selection and endorsement of excellence regions, the Ministry of Justice will examine and propose to the Prime Minister to present:
the Flag of Excellence of the Government to five units with outstanding comprehensive achievements leading the sectors of work in the judicial system nationwide (two Provincial Justice Departments, two Enforcement Offices, and one unit under the Ministry of Justice).05National Model Worker
2. On the occasion of the final year's summary of excellence campaigns within the five-year plan, based on the selection and endorsement of excellence regions, the Ministry of Justice will examine and propose to the Prime Minister to confer the title of National Model Worker on individuals with outstanding achievements leading the sectors of work in the judicial system nationwide.:
II. FORMS OF REWARD BY THE JUDICIAL SYSTEM
The Flag of Excellence of the Judicial System
1. Based on the selection and endorsement of excellence regions, the Ministry of Justice will award:
the Flag of Excellence of the Judicial System to thirty-two units with outstanding achievements leading the sectors of work in the judicial system in their region (ten Provincial Justice Departments, ten Enforcement Offices, ten Enforcement Teams, and two units under the Ministry of Justice).32Certificate of Merit of the Minister of Justice
2. For individuals and collectives under the management authority of the Ministry of Justice::
Each unit may propose to the Excellence and Reward Council of the Sector to consider and propose the Minister to award Certificates of Merit not exceeding
the total number of Model Workers at the grassroots level (for Schools, the ratio is calculated based on the total number of Model Workers at the grassroots level and Excellent Teachers at the grassroots level), and not more than fifty percent of the total number of Outstanding Labor Collectives in their unit.40%For individuals and collectives not under the management authority of the Ministry of Justice: only those outstanding cases with significant positive contributions in various fields of judicial work may be proposed for reward.

4. Each unit may propose to the Excellence and Reward Council of the Sector to consider and propose the Minister to recognize the title of Model Worker at the Grassroots Level not exceeding:
the total number of staff and civil servants in their unit (Excellent Teacher at the Grassroots Level is counted as Model Worker at the Grassroots Level). For Provincial Justice Departments, the ratio is calculated based on the total number of staff and civil servants in Enforcement Offices and Enforcement Teams.20%Title of Model Worker of the Judicial System
5. On the occasion of the third and final years' summary of excellence campaigns within the five-year plan, based on the selection and endorsement of excellence regions, the Excellence and Reward Council of the Sector will consider and propose the Minister to confer the title of Model Worker of the Judicial System with a maximum of two people per unit (grassroots units and units under the Ministry's agency).:
On the occasion of summarizing the annual competition for the third year and the final year of the five-year plan, based on the selection and recommendation from the competition zones, the Ministry's Competition and Commendation Council will consider submitting to the Minister for conferring the title of Outstanding Competitor in the Industry to a maximum of no more than two individuals per unit (basic units and units under the Ministry's agency).
