Decision No. 05/2004/QD-BCN On transferring the Electrical Construction Vocational School from being a member unit of Vietnam Industrial Construction Corporation to directly under the Ministry of Industry

DECISION OF THE MINISTER OF INDUSTRY

Regarding the transfer of the Electricity Installation Secondary School, a public service entity under the Vietnam Industrial Construction Corporation, to be directly under the Ministry of Industry

Considering the proposal of the General Director of the Vietnam Industrial Construction Corporation in Circular No. 809/CV-TCNS dated August 31, 2003;

The Electricity Installation Secondary School, a public service entity under the Vietnam Industrial Construction Corporation, shall be transferred to be directly under the Ministry of Industry.

THE MINISTER OF INDUSTRY

Pursuant to the Education Law dated December 2, 1998;

Pursuant to Decree No. 55/2003/NĐ-CP dated May 28, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Industry;

The Electricity Installation Secondary School, directly under the Ministry of Industry, is an educational institution training and enhancing cadres with secondary technical, economic qualifications and electrical installation workers (including power transmission line and substation installation from 35 kV to 500 kV, power grid operation management up to 500 kV, civil and industrial construction, factory electricity, economics, information technology); it is also a research and development center for specialized science and technology serving economic and social development. The school is subject to state management by the Ministry of Education and Training and the Ministry of Labor, Invalids and Social Affairs, and enjoys state policies and systems applicable to vocational schools and training institutions as stipulated in the Education Law dated December 2, 1998, Government Decree No. 43/2000/NĐ-CP dated August 30, 2000 detailing and guiding the implementation of certain provisions of the Education Law; and Government Decree No. 02/2001/NĐ-CP dated January 9, 2001 detailing the implementation of the Labor Code and the Education Law regarding vocational training.

At the suggestion of the Director of the Department of Organization and Cadres,

DECISION:

Article 1. The Electricity Installation Secondary School is a revenue-generating public service entity with legal personality, entitled to open bank accounts at banks and the State Treasury, and to have seals (including embossed and miniature seals) for its operations and transactions in accordance with the law.

International trade name: POWER CONSTRUCTION AND INSTALLATION INTERMEDIATE SCHOOL;

Article 2. Main office: Trung Thanh Commune, Phu Van District, Thai Nguyen Province.

Train cadres with secondary technical and economic qualifications and electrical installation workers according to the national education system framework and the education and training certification system as prescribed in the Education Law dated December 2, 1998, Government Decree No. 43/2000/NĐ-CP dated August 30, 2000 detailing and guiding the implementation of certain provisions of the Education Law; and Government Decree No. 02/2001/NĐ-CP dated January 9, 2001 detailing the implementation of the Labor Code and the Education Law regarding vocational training.

2. Enhance and retrain the cadre of managers, technicians, and high-level electrical installation workers in accordance with the standards set by the State and the requirements of organizations and individuals both domestically and internationally.

Article 3. The University has the following main tasks:

Conduct scientific research and technological development in electrical installation and industrial electricity; implement the integration of training with employment, scientific research with production labor to improve training quality to meet increasingly higher production and business demands.

4. Carry out activities related to the development, application, and transfer of specialized technology; experimental production, production-business, scientific and technical services in line with the training profession and other tasks as prescribed by law.

5. Implement cooperative relationships, linkages, and interconnections in training enhancement and scientific research and technological development with domestic and foreign agencies, organizations, and individuals.

6. Manage, maintain, develop, and effectively utilize material resources and financial funds allocated by the State.

2. Specialized and operational departments (departments, faculties, subject groups).

Article 4. Organizational structure of the School.

1. Leadership:

a) Principal;

b) Deputy Directors.

a) Drafting and submitting to the Ministry of Industry for approval the Charter on Organization and Operation of the Electricity Installation Secondary School;

b) Based on the approved Charter, the School will define functions, tasks, and arrange staff according to the professional standards of university, college, and secondary vocational school civil servants as issued in Decision No. 538/TCCP-TC dated December 18, 1995 of the Minister, Head of the Organizational and Civil Servant Department of the Government (now the Ministry of Home Affairs);

c) According to the needs for cadre and worker training development in each period, draft organizational and operational plans for service, technology transfer units and submit them to the Ministry for consideration and decision.

The Chairman of the Board of Management and the General Director of the Vietnam Industrial Construction Corporation are responsible for transferring the material assets, finances, and personnel of the Electricity Installation Secondary School to the Ministry of Industry in accordance with current state procedures.

This Decision takes effect 15 days after its publication in the Official Gazette and replaces Decision No. 817/QĐ-TCCB dated June 6, 1997 and Decision No. 339/QĐ-TCCB dated February 15, 2001 of the Minister of the Ministry of Industry.

Article 5. The Chief of the Ministry's Office, the Inspector General of the Ministry, the Heads of Departments and Bureaus under the Ministry, the Chairman of the Board of Management and the General Director of the Vietnam Industrial Construction Corporation, and the Principal of the Electricity Installation Secondary School are responsible for implementing this Decision./.

Article 6. This Decision shall take effect fifteen days after its publication in the Official Gazette and shall replace Decision No. 817/QĐ-TCCB dated June 6, 1997 and Decision No. 339/QĐ-TCCB dated February 15, 2001 of the Minister of Industry.

The Director of the Ministry's Office, the Inspector General of the Ministry, the Heads of Departments under the Ministry, the Chairman of the Board of Management and the General Director of Vietnam Industrial Construction Corporation, and the Principal of the Secondary School for Electrical Installation Construction are responsible for implementing this Decision./.
