CIRCULAR
Guidelines for Implementing the System of Position Responsibility Allowancesfor Civil Servants, Government Employees, and Public Officials
Pursuant to Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on the salary system for civil servants, government employees, public officials, and armed forces; after exchanging opinions with the Ministry of Finance and relevant ministries and sectors, the Ministry of Home Affairs provides guidelines for implementing the system of position responsibility allowances for civil servants, government employees, and public officials as follows:
I. SCOPE OF APPLICATION:
The position responsibility allowance applies to civil servants (including probationary civil servants), public officials, and individuals in their probationary or trial period within the payroll establishment of state agencies and state-run public institutions, due to the nature and characteristics of their profession or job requiring high responsibility or managing work but not holding leadership positions elected or appointed (not included in the category entitled to leadership position allowances).
II. LEVELS OF ALLOWANCE AND APPLICABLE OBJECTS:
1. Level of Allowance
The position responsibility allowance includes four levels: 0.5; 0.3; 0.2 and 0.1 compared to the minimum wage level. According to the minimum wage level of 290,000 VND/month, the levels of position responsibility allowance implemented from October 1, 2004 are as follows:

2. Objects eligible for the various levels of position responsibility allowance:
a) Level 1, coefficient 0.5; applicable to:
Civil servants, government employees, and public officials within the payroll establishment of the Central Units 2, 3, and 5 Health Protection Departments under the Friendship Hospital and the Southern Central Health Protection Department under the Unified Hospital;
Drivers serving positions from Deputy Prime Minister and equivalent or higher.
b) Level 2, coefficient 0.3 applied to:
Station chiefs, farm chiefs of research application and experimental science and technology stations of agriculture, forestry, and fisheries sectors;
Station chiefs, farm chiefs of seedling cultivation and rare medicinal plant cultivation stations for research in medical and pharmaceutical laboratories and drug production;
Personnel directly operating, maintaining electron accelerator MT-17 machines, neutron generator NA-3C machines, handling sealed and unsealed radioactive samples and ensuring radiation safety;
Civil servants and public officials within the payroll establishment of the Provincial and Central City Health Protection Boards;
Civil servants and public officials within the payroll establishment of emergency resuscitation departments and directly providing emergency patient care at station 05;
Teachers and educational management personnel within the payroll establishment of specialized schools;
Teachers assigned as full-time or part-time General Leaders of the Ho Chi Minh Communist Youth Union at Class I general secondary schools;
Head coaches of national gymnastics and sports teams;
Drivers serving positions of Ministers and equivalent;
Heads of explosive material warehouses, explosive material supply personnel.
c) Level 3, coefficient 0.2 applied to:
Deputy station chiefs, deputy farm chiefs of research application and experimental science and technology stations of agriculture, forestry, and fisheries sectors;
Deputy station chiefs, deputy farm chiefs of seedling cultivation and rare medicinal plant cultivation stations for research in medical and pharmaceutical laboratories and drug production;
Personnel protecting, transporting, working with sealed and unsealed radioactive samples; checking radiation levels in the electron accelerator MT-17 machine, neutron generator NA-3C machine, and radiation measurement center; serving the operation of the electron accelerator MT-17 machine, neutron generator NA-3C machine, cleaning the machine area, source warehouse, and radiation measurement center;
Team leaders in geological, meteorological, surveying, mapping, forest planting, and forest investigation sectors;
Heads of document archives, libraries, preservation and restoration warehouses of museums classified as Class II or higher, and warehouses in the Presidential Palace relic area;
Heads of document archives under the State Records and Archives Administration;
Heads of National Reserve Warehouses;
Heads of gold, silver, precious stone warehouses of the State Bank and Treasury from central to district level;
Civil servants and public officials within the payroll establishment of heavy war invalids rehabilitation centers, treatment hospitals, mental health care centers, leprosy hospitals;
Teachers assigned as full-time or part-time General Leaders of the Ho Chi Minh Communist Youth Union at Class II general secondary schools;
Civil servants and public officials within the payroll establishment of the Friendship Hospital;
Head coaches of provincial, sectoral, and central city-level gymnastics and sports teams;
Doctors and technicians in sports medicine at national teams engaged in athlete health monitoring, care, and recovery;
Drivers serving positions of Deputy Ministers, Chairmen of Provincial People's Committees, and equivalent;
Deputy heads of explosive material warehouses.
d) Level 4, coefficient 0.1 applied to:
Deputy heads of document archives, libraries, preservation and restoration warehouses of museums classified as Class II or higher, and warehouses in the Presidential Palace relic area;
Heads of document archives, libraries, preservation and restoration and exhibition warehouses of museums;
Deputy heads of gold, silver, precious stone warehouses of the State Bank and Treasury from central to district level;
Teachers assigned as full-time or part-time General Leaders of the Ho Chi Minh Communist Youth Union at Class III general secondary schools;
Medical personnel specializing in childbirth assistance at clinics, hospitals, maternity hospitals, obstetrics departments in general hospitals, and health centers;
Medical personnel directly conducting drug testing;
Doctors and technicians in sports medicine at provincial and sectoral-level teams engaged in athlete health monitoring, care, and recovery;
Security personnel and warehouse managers of explosive materials;
Cashiers of agencies and units;
Team leaders in remaining sectors.
III. FUNDS AND METHODS OF PAYING THE ALLOWANCE
1. Sources of funds for paying the position responsibility allowance:
For objects within agencies and units fully funded by the state budget, the position responsibility allowance is paid from the state budget according to the current budget allocation hierarchy within the annual budget allocated to the agency or unit.
The subjects under the agency implementing quota staffing and administrative management expenses and the subjects under public service units implementing financial autonomy shall receive job responsibility allowances paid from allocated quota funds and self-managed finances by the agency or unit.
2. Method of payment for allowances:
Job responsibility allowances shall be paid concurrently with monthly salaries and shall not be used to calculate social insurance contributions or benefits;
When not performing work specified to receive job responsibility allowances for one month or more, such allowances shall not be received.
IV. EFFECTIVE DATE OF IMPLEMENTATION
1. This Circular shall take effect fifteen days after its publication in the Official Gazette.
Abolish all guiding documents implementing Decree No. 25/CP dated May 23, 1993 of the Government regarding job responsibility allowances for civil servants and officials working in state agencies and public service units.
2. The job responsibility allowance regime stipulated in this Circular shall take effect from October 1, 2004.
Based on the guidance provided in this Circular, the heads of agencies and units directly using and managing civil servants and officials shall determine the recipients and levels of job responsibility allowances applicable to civil servants and officials within their jurisdiction.
Civil servants and officials working in certain special professions or jobs in state agencies and public service units who have been approved by competent authorities to continue receiving job responsibility allowances shall continue to enjoy them until they no longer perform work specified to receive such allowances; ministries, sectors, and localities shall compile reports to the Ministry of Home Affairs for monitoring and management.
Any supplementation of job responsibility allowance recipients or adjustment of job responsibility allowance levels as stipulated in this Circular shall be proposed in writing by relevant ministries and sectors to the Ministry of Home Affairs for unified discussion with the Ministry of Finance to consider and resolve.
3. Personnel working in confidential organizations shall receive job responsibility allowances for protecting secret codes according to separate guidelines.
4. Civil servants and officials working in Party, People's Front, and mass organizations' agencies and public service units shall implement job responsibility allowance regimes guided by the Central Organization Commission.
During implementation, if there are difficulties, ministries, sectors, and localities should report to the Ministry of Home Affairs for research and resolution./.
