REGARDING THE ISSUANCE OF THE LIST OF MAIN MEDICINES USED IN HEALTH CARE AND TREATMENT FACILITIES
THE MINISTER OF HEALTH
Pursuant to Decree No. 188/2007/NĐ-CP dated December 27, 2007 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Health;
Pursuant to the Medicine Law No. 34/2005/QH11 dated June 14, 2005;
Pursuant to the Radiation Safety and Control Ordinance dated June 25, 1996;
Pursuant to Decree No. 50/1998/NĐ-CP dated July 16, 1998 of the Government detailing the implementation of the Radiation Safety and Control Ordinance;
Pursuant to Decree No. 63/2005/NĐ-CP dated May 16, 2005 of the Government promulgating the Social Health Insurance Regulation;
Pursuant to Decree No. 79/2006/NĐ-CP dated August 9, 2006 of the Government detailing the implementation of certain provisions of the Medicine Law;
Pursuant to Decree No. 95/CP dated August 27, 1994 of the Government on the collection of a portion of hospital fees;
Pursuant to Circular Joint No. 14/TTLB dated September 30, 1995 of the Ministry of Health-Finance-Labor, Invalids and Social Affairs-State Price Committee guiding the implementation of the collection of a portion of hospital fees, and Circular Joint No. 03/2006/TTLT-BYT-BTC-BLĐTBXH dated January 26, 2006 of the Ministry of Health-Ministry of Finance-Ministry of Labor, Invalids and Social Affairs supplementing Circular Joint No. 14/TTLB dated September 30, 1995 of the Ministry of Health-Finance-Labor, Invalids and Social Affairs-State Price Committee;
Pursuant to Circular Joint No. 2237/1999/TTLT/BKHCNMT-BYT dated December 28, 1999 of the Ministry of Science, Technology and Environment - Ministry of Health guiding the implementation of radiation safety in healthcare;
At the proposal of the Director of the Department of Medical Examination and Treatment; the Director of the Department of Traditional Medicine; the Director of the Department of Social Health Insurance; and the Director of the Department of Medicine Management,
DECISION:
Article 1. Attached to this Decision is the List of Main Medicines Used in Healthcare and Treatment Facilities including:
1. The List of Modern Drugs (Annex 1)
2. The List of Radioactive Medicines and Marked Compounds (Annex 2)
3. The List of Traditional Medicine Preparations (Annex 3)
4. The List of Traditional Medicine Ingredients (Annex 4)
5. Guidelines for Using the List of Main Medicines Used in Healthcare and Treatment Facilities (Annex 5)
Article 2. The List of Medicines attached to this Decision serves as the basis for healthcare and treatment facilities to select, ensuring treatment needs and payment for patients, including those with health insurance cards.
Article 3. Healthcare and treatment facilities are permitted to use medicines listed in this Decision and are responsible for organizing supply and management in accordance with current regulations on medicine, radiation safety, and control.
Article 4. This Decision takes effect 15 days from the date of publication in the Official Gazette; it abolishes Decision No. 03/2005/QĐ-BYT dated January 24, 2005 on the issuance of the List of Main Medicines Used in Healthcare and Treatment Facilities, and Decision No. 33/2006/QĐ-BYT dated October 24, 2006 on the issuance of the List of Radioactive Medicines and Marked Compounds Used for Diagnosis and Treatment.
Article 5. The following officials are responsible for implementing this Decision: the Director of the Ministry's Office, the Inspector General of the Ministry, the Director of the Department of Medical Examination and Treatment; the Director of the Department of Traditional Medicine; the Director of the Department of Social Health Insurance; the Director of the Department of Medicine Management; relevant Departments and Units; Directors of Provincial Health Services under central cities; Heads of Health Services in sectors; and Directors of hospitals and institutes directly under the Ministry of Health.
