CIRCULAR

Regulations on inspection, review, and acceptance of survey work to create topographic maps for planning and construction design

Establishing topographic maps at scales of 1/200; 1/500; 1/1,000; 1/2,000; 1/5,000; and 1/10,000 serving planning and construction design

WHEREAS, Decree No. 17/2008/NĐ-CP dated February 4, 2008 of the Government stipulates the functions, tasks, powers, and organizational structure of the Ministry of Construction;

Pursuant to Decree No. 08/2005/NĐ-CP dated January 24, 2005 of the Government on construction planning;

Pursuant to Decree No. 37/2010/NĐ-CP dated April 7, 2010 of the Government on the preparation, review, approval, and management of urban planning;

Pursuant to Decree No. 12/2002/NĐ-CP dated January 22, 2002 of the Government on mapping activities;

The Ministry of Construction guides the inspection, review, and acceptance of survey work to create topographic maps for urban planning, rural residential area planning, and construction design (hereinafter referred to as planning and construction design), as follows:

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

Article 1. This Circular stipulates the inspection, review, and acceptance of survey work to create topographic maps at scales of 1/200; 1/500; 1/1,000; 1/2,000; 1/5,000; and 1/10,000 used for planning and construction design.

Article 2. This Circular applies to organizations and individuals involved in the inspection, review, and acceptance of survey and mapping work to create topographic maps for planning and construction design (hereinafter referred to as survey and mapping).

This Circular does not apply to survey and mapping work to create topographic maps for use in security and defense areas.

Article 2. Basis and purpose of implementing inspection, review, and acceptance work

Clause 1. Inspection, review, and acceptance work shall be carried out based on technical standards, regulations, technical specifications, economic and technical norms for survey and mapping issued by competent state agencies and approved technical plans and budgets by the Project Owner.

Clause 2. Purpose of inspection, review, and acceptance

Point a. Ensuring compliance with technical standards, regulations, technical specifications, economic and technical norms for survey and mapping work for planning and construction design and other relevant legal documents;

Point b. Identifying errors and violations during implementation to promptly address and ensure the quality of topographic maps;

Point c. Confirming the quality and quantity of completed survey work.

Article 3. Responsibilities of the Project Owner, Contractor, and Consulting Organization

Clause 1. Responsibilities of the Project Owner

Point a. Implementing quality management of survey work including: establishing and approving survey tasks, approving technical plans and budgets; organizing supervision, review, and acceptance of results. In cases where the Project Owner lacks the capacity to perform these tasks, they shall hire consultants with sufficient capacity as prescribed by law to carry them out;

Point b. Selecting Contractors with adequate conditions as prescribed by law; organizing and arranging staff with appropriate expertise to check the capacity of the Contractor and the Survey Manager;

Point c. Signing contracts with Contractors, assigning survey and mapping tasks, and handing over the site to the Contractor, creating conditions for the Contractor to perform their work; organizing inspections and supervision; resolving any arising issues (if any) during the Contractor's survey work; paying full fees to the Contractor based on the accepted volume of work;

Point d. Stopping construction, canceling part or all of the signed contracts when the Contractor fails to implement the approved survey and mapping plan;

Point đ. Being responsible for the quality of information and documents related to survey work provided to the Contractor;

Point e. Organizing the storage of survey and mapping records;

Point g. Upon receiving additional survey requests, if approved, the Project Owner supplements the survey tasks and signs a contract for additional survey volumes with the Contractor;

Clause 2. Responsibilities of the Contractor

Point a. Establishing survey and mapping tasks upon request from the Project Owner; developing technical plans and budgets;

Point b. Conducting survey work according to regulations, business license, based on the approved technical plan by the Project Owner and signed contract;

Point c. Appointing persons with appropriate qualifications as required by law to serve as the Survey Manager. Arranging sufficient experienced and qualified personnel to conduct the survey;

Point d. Internally reviewing the technical plan and survey results before submitting to the Project Owner; being accountable to the Project Owner and the law for the results achieved;

Point đ. Regularly and systematically monitoring and inspecting the application of technical standards and procedures approved in the technical plan regarding quality, quantity, and progress from start to completion; preparing a report on inspection work after completion;

Point e. When conducting survey and mapping, if there are changes in volume or methods and equipment compared to the approved technical plan, supplementary tasks must be proposed to the Project Owner, technical plans adjusted, and only implemented with written approval from the Project Owner;

Point g. Ensuring safety for people, equipment, infrastructure, and other construction works in the survey area; protecting the environment and maintaining the landscape in the survey area; cleaning up the site after completing survey and mapping;

i) Organize the storage of survey file records;

k) Implement confidentiality work in accordance with state regulations for confidential materials related to survey activities (if applicable);

l) Compensate for damages when failing to properly carry out survey tasks and technical solutions that have been approved or using inappropriate information, documents, standards, leading to distorted results, additional survey volumes, and other damaging actions caused by their own fault.

3. Responsibilities of the consulting organization In cases where the Project Owner hires consultants to perform some or all of the following tasks: inspection, supervision, review, acceptance of survey work, the consulting organization shall be responsible for:

a) Performing tasks accurately according to the requirements of the Project Owner as stipulated in the economic contract;

b) Assigning individuals with appropriate capabilities to conduct inspections, supervision, reviews, and acceptance of survey work;

c) Verify the suitability of the bidder's capacity conditions, the survey project leader's capacity conditions, and the equipment that the bidder has committed to the Project Owner in the bidding documents or in the signed contract;

d) Supervise the entire process of conducting field surveys and indoor surveys according to the approved technical plan;

đ) Review, inspect and confirm the quantity and quality of survey items to serve as a basis for the Project Owner to settle accounts;

e) Bear responsibility before the Project Owner and the law regarding the quality and quantity of the construction project survey. Compensate for losses if the bidder's implementation does not comply with the approved technical plan, leading to results that do not meet the requirements of the task and necessitate re-surveying, supplementary surveying, or other actions causing damage due to their own fault.

Chapter II

DETAILED REGULATIONS

Article 4. Provisions on inspection

1. Contents of inspection by the Project Owner

a) Inspect the bidder's capacity, the project leader's capacity, and human resources to perform the tender package in accordance with the bidding documents and relevant laws;

b) Inspect equipment for compliance with the bidding documents, inspect certification documents for machinery and related technical equipment used for survey work;

c) Inspect the quality of processing and installation of standard marks, elevation control marks, and coordinate marks used in mapping work;

d) Inspect the safety assurance for people, equipment, infrastructure technical works, and other construction works in the survey area; the implementation of environmental protection and landscape preservation during the survey period and the restoration of the original site after completion of the survey by the bidder;

đ) Inspect progress according to the approved plan and contract provisions;

2. Contents of inspection by the Bidder

a) Inspect measuring rods, machines, and related technical equipment, measurement books, daily logbooks, and documents required for survey work according to technical requirements for mapping;

b) Inspect the quality and quantity of field (external) and indoor (internal) work performed according to the approved technical plan for compliance with construction geodetic work standards and related industry standards. The contents of external and internal inspection work are detailed in Appendix 1 issued together with this Circular;

c) Inspect safety assurance for people and equipment during the survey process;

d) Inspect progress according to the approved survey plan;

Article 5. Provisions on review

1. Legal basis for review

a) Technical plan - budget approved by the Project Owner;

b) Standards and regulations related to topographic map surveying;

c) Other related legal documents;

2. Documents for submission to review

a) Application for review according to the model at Appendix 2 attached to this Circular;

b) Capacity documents of organizations and individuals participating in survey work; contracts; technical plans approved by the Project Owner;

c) Technical summary report of the survey project (including drawings and explanations);

d) Related legal documents;

3. Contents of review

a) Conditions of the bidder's capacity and the project leader's professional capacity as stipulated;

b) Implementation of standards and regulations related to topographic map surveying;

c) Survey drawing scope and actual quantity completed;

d) Quality of field (external) work including:

- Certification documents for measuring rods, machines, and related technical equipment; types of measurement books, daily logs during the process of connecting coordinates, elevations, survey grids, detailed topographic map measurements; quality of elevation control marks and coordinate marks;

- Documentation, system diagrams of marks, accuracy levels of marks according to applicable standards and regulations, survey grid diagrams, calculation diagrams, error correction materials, external photography control connection materials (if any);

- Accuracy of contour lines and heights of certain characteristic terrain features such as houses and construction works, transportation systems, water conservancy systems, pipelines, high-voltage power lines, telephone lines, ponds, rivers, and observable physical and geological phenomena like faults, landslides, and collapses within the survey area;

đ) Quality of indoor (internal) work including:

- Accuracy, consistency, rationality, logic of documents, reference system parameters, map fragmentation;

- Map symbols, symbols of geographic features according to topographic map drawing standards and regulations; accuracy, completeness of content representation according to symbols, corrections to drawings as prescribed: line thickness, dimensions, symbols, font style; positional accuracy of objects, continuity of line elements, accuracy of height assignment to terrain features, quality of regions and boundaries;

- Representation of terrain and geographic features relative to annotated elevations, mutual positions of important geographic features;

- Fragmentation diagrams; survey grid diagrams; closure errors, extreme closure conditions; independent loop closure errors (if any) for distance and gravity measurements;

- Calculation materials for plane coordinates, heights, assessment of coordinate and height accuracy;

- Calculation results, error correction blocks printed on paper and data files;

- Statistical area records (on paper and on CDs; DVDs...);

- Original map data files (recorded on CDs; DVDs...);

- Digital terrain model data files (recorded on CDs; DVDs...);

Technical report contents must comply with procedural, regulatory, and technical requirements: completeness and rationality in explanations; corresponding appendices to the main text; clear, neat, and compliant presentation;

e) Based on the map scale, the difficulty level of terrain and geographic features, and the contract between the Project Owner and the Survey Bidder, the reviewing organization may consider part or all of the main contents specified in points d and đ of this clause;

4. The review result serves as the basis for the Project Owner to accept the topographic map product.

5. Appraisal authority: The Department of Construction shall organize the appraisal of topographic maps for urban planning purposes; in cases not funded by local sources, the investment decision-making body shall be responsible for organizing the appraisal; design construction project maps shall be self-appraised by the investor.

Where necessary, the appraisal organizing body may engage consultants to review some or all contents according to the provisions of Clause 3 of this Article.

Article 6: Provisions on acceptance

1. Acceptance content

a) The quantity completed meets technical quality standards compared to the approved quantity in the technical survey plan and budget;

b) The level of difficulty of terrain and physical conditions for each work item.

2. Acceptance documents include

a) Survey boundary confirmation record according to Model 3 issued together with this Circular;

b) Contractor's survey work inspection report according to Model 4 issued together with this Circular;

c) Geodetic marker handover record between the Investor and the Survey Contractor according to Model 5 issued together with this Circular;

d) Quality and quantity survey appraisal document from the appraisal agency or organization;

đ) Completion project acceptance record of the Investor according to Model 6 issued together with this Circular;

e) Survey measurement documentation signed and stamped by the Contractor.

3. The acceptance period shall not exceed fifteen (15) working days from when the Investor receives all valid documents; the acceptance results must be recorded in a record. The model for transferring survey measurement documentation records is attached as Model 7 issued together with this Circular.

Article 7: Inspection, Appraisal, and Acceptance Costs

1. Inspection, appraisal, and acceptance costs are included in the total investment estimate of the survey budget and shall be paid by the Investor.

2. These costs are calculated by preparing a budget according to the cost management regulations and Circular Jointly Issued No. 04/2007/TTLT-BTNMT-BTC dated February 27, 2007, guiding the preparation of measurement and land management budgets.

Chapter III

IMPLEMENTATION

Article 8: Implementation Organization

1. The Urban Development Department assists the Minister of Construction in regularly and periodically checking the implementation of the contents stipulated in this Circular nationwide.

2. The Minister, Heads of Ministries equivalent to Ministries, and Government Agencies; Chairpersons of People's Committees of provinces and centrally governed cities are responsible for directing units and organizations to implement survey work for urban planning and construction design; other related units and organizations under their jurisdiction shall implement this Circular.

Article 9. Implementation Provisions

1. This Circular takes effect from July 25, 2011.

2. In the course of implementation, if there are difficulties or obstacles, organizations and individuals are requested to submit their opinions to the Ministry of Construction for research and resolution./.
