Regulations on economic and technical norms for declassifying archival documents

Pursuant to the Law on Archives No. 01/2011/QH13 dated November 11, 2011;
Pursuant to the Ordinance on Protection of State Secrets No. 30/2000/PL-UBTVQH10 dated December 28, 2000;
Pursuant to Decree No. 61/2012/NĐ-CP dated August 10, 2012, promulgated by the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Home Affairs;
The Minister of Home Affairs issues this Circular to regulate economic and technical norms for declassifying archival documents,
Article 1. Scope of Regulation
This Circular stipulates economic and technical norms for declassifying archival documents for those archival documents that have reached the declassification deadline as prescribed in Clause 4, Article 30 of the Law on Archives, applicable to paper-based archival documents of completed archives (collections) of archival documents that have been fully organized.
Article 2. Applicability
This Circular shall be applied at historical archives at all levels.
Article 3. Explanation of Terms
In this Circular, the following terms are understood as follows:
1. Completed archive (collection) of documents: refers to all archival documents formed during the operation of an agency or organization which have been classified, appraised, arranged, inventoried, and catalogued.
2. Economic and technical norms for declassifying archival documents are provisions regarding necessary expenditures of labor, materials, and office supplies for the declassification of archival documents.
Article 4. Content of economic and technical norms for declassifying archival documents
1. Labor norm for declassifying archival documents (Tsp) is the amount of labor time consumed to declassify one meter of archival documents, calculated as the sum of technological labor norm (Tcn), service labor norm (Tpv), and management labor norm (Tql): Tsp = Tcn + Tpv + Tql.
a) Labor norm for declassifying archival documents in Vietnamese as specified in Appendix I attached hereto.
b) In cases where the documents are in languages other than Vietnamese, the labor norm for steps 1, 3, 5a, 5b, 7a, and 7b shall be increased by a factor of 1.5 compared to the labor norm specified in Appendix I.
c) For archival documents formed before April 30, 1975, the labor norm for step 3 shall be increased by a factor of 1.3 compared to the labor norm specified in Appendix I.
2. Material and office supply norms for declassifying archival documents as specified in Appendix II attached hereto.
Article 5. Effective Date
This Circular takes effect from August 15, 2014.
Article 6. Responsibility for Implementation
Provincial People's Committees under the central government, National Archive Centers under the State Records and Archives Administration (Ministry of Home Affairs) are responsible for implementing this Circular.
During implementation, if any difficulties arise, they are requested to report to the Ministry of Home Affairs for study, amendment, and supplementation as appropriate.
