CIRCULAR

Regulations on the List of Products and Goods with Potential to Cause Safety Hazards under the Management Responsibility of the Ministry of Information and Communications

Pursuant to the Law on Product Quality and Commodities dated November 21, 2007;

Pursuant to the Law on Telecommunications dated November 23, 2009;

Pursuant to Decree No. 132/2008/NĐ-CP dated December 31, 2008 of the Government detailing implementation of certain provisions of the Product Quality Law;

Pursuant to Decree No. 25/2011/NĐ-CP dated April 6, 2011, issued by the Government, detailing and guiding the implementation of certain provisions of the Law on Telecommunications;

Based on Decree No. 132/2013/ND-CP dated October 16, 2013 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Information and Communications;

At the proposal of the Director of the Science and Technology Department and the Director of the Telecommunications Department,

Article 1. This Circular stipulates the List of Products and Goods with Potential to Cause Safety Hazards under the Management Responsibility of the Ministry of Information and Communications (hereinafter referred to as the List of Products and Goods Group 2).

Article 1. Scope of Regulation

This Circular stipulates the List of products and goods that may cause safety hazards under the management responsibility of the Ministry of Information and Communications (hereinafter referred to as the List of products and goods group 2).

Article 2. Applicability

This Circular applies to organizations and individuals within the country and foreign organizations and individuals engaged in the production and business of products and goods listed in the List of products and goods group 2 in Vietnam, and organizations and individuals involved in the quality of products and goods group 2 in Vietnam.

Article 3. List of Products and Goods Group 2

1. The List of products and goods group 2 and the form of management are specified in the following Appendices:

a) "List of information technology and telecommunications products and goods that must be certified and declared compliant" is specified in Appendix I of this Circular.

b) "List of information technology and telecommunications products and goods that must be declared compliant" is specified in Appendix II of this Circular.

2. Periodically, the Ministry of Information and Communications reviews, amends, and supplements the List of products and goods group 2 in accordance with the State's management policies.

Article 4. Management Principles

1. The management of product and good quality listed in the List of products and goods group 2 stipulated in this Circular shall be carried out in accordance with national technical standards and regulations.

2. The management of product and good quality listed in Appendices I and II of this Circular shall be carried out in accordance with Circular No. 30/2011/TT-BTTTT dated October 31, 2011, issued by the Minister of Information and Communications on the certification and declaration of compliance for information technology and telecommunications products and goods.

Article 5. Implementation Provisions

1. This Circular takes effect from May 5, 2014, and replaces Circular No. 20/2011/TT-BTTTT dated July 1, 2011, issued by the Minister of Information and Communications on the List of products and goods that may cause safety hazards under the management responsibility of the Ministry of Information and Communications; Circular No. 31/2011/TT-BTTTT dated October 31, 2011, issued by the Minister of Information and Communications promulgating the List of information technology and telecommunications products and goods that must be declared compliant; and Circular No. 32/2011/TT-BTTTT dated October 31, 2011, issued by the Minister of Information and Communications promulgating the List of information technology and telecommunications products and goods that must be certified and declared compliant.

2. The Head of the Office, the Director of the Science and Technology Department, the Director of the Telecommunications Department, the Heads of agencies and units under the Ministry of Information and Communications, and related organizations and individuals are responsible for implementing this Circular.

3. During the implementation process, if difficulties arise, agencies, organizations, and individuals should promptly report them to the Ministry of Information and Communications for review and resolution./.
