CIRCULAR

Amending and supplementing certain articles of Circular No. 24/2015/TT-BKHCN dated November 16, 2015 of the Minister of Science and Technology on inspectors, specialized inspection civil servants, and inspection collaborators in the field of science and technology

Decree No. 95/2017/NĐ-CP         Pursuant to the proposal of the Director General of the Standardization and Quality Control Agency and the Director of the Legal Department.

Decree No. 97/2011/NĐ-CP dated October 21, 2011 of the Government stipulating inspectors and inspection collaborators and Decree No. 92/2014/NĐ-CP dated October 8, 2014 of the Government amending and supplementing Clause 1, Article 16 of Decree No. 97/2011/NĐ-CP dated October 21, 2011 of the Government stipulating inspectors and inspection collaborators;

Decree No. 07/2012/ND-CP dated February 9, 2012 of the Government stipulating agencies entrusted to perform specialized inspection functions and specialized inspection activities;

Decree No. 213/2013/NĐ-CP dated December 20, 2013 of the Government stipulating the organization and operation of specialized inspection in the field of science and technology and Decree No. 27/2017/NĐ-CP dated March 15, 2017 of the Government amending and supplementing certain articles of Decree No. 213/2013/NĐ-CP dated December 20, 2013 of the Government stipulating the organization and operation of specialized inspection in the field of science and technology;

Pursuant to Decision No. 12/2014/QĐ-TTg dated January 27, 2014 of the Prime Minister stipulating the allowance system for specialized inspection civil servants;

Pursuant to the proposal of the Director General of the Standardization, Metrology and Quality Control General Department and the Inspector General of the Ministry;

The Minister of Science and Technology issues this Circular amending and supplementing some articles of Circular No. 24/2015/TT-BKHCN dated November 16, 2015 of the Minister of Science and Technology stipulating inspectors, specialized inspection civil servants, and inspection collaborators in the field of science and technology.

Article 1. Amending and supplementing certain articles of Circular No. 24/2015/TT-BKHCN dated November 16, 2015 of the Minister of Science and Technology stipulating inspectors, specialized inspection civil servants, and inspection collaborators in the field of science and technology as follows:

1. Amend and supplement Clause 2, Article 3 as follows:

"2. Specialized inspection civil servants in the field of science and technology (hereinafter referred to as specialized inspection civil servants) are civil servants working in the Standardization, Metrology and Quality Control General Department, Radiation and Nuclear Safety Agency, and Quality Control Standardization Sub-department (hereinafter referred to as the General Department, Agency, and Sub-department), assigned by the Director General of the Standardization, Metrology and Quality Control General Department, the Director of the Radiation and Nuclear Safety Agency, and the Director of the Quality Control Standardization Sub-department (hereinafter referred to as the Director General, Director, and Sub-director) to perform specialized inspection tasks in the field of science and technology and recognized according to the provisions of this Circular."

2. Supplement Article 3a following Article 3 as follows:

"Article 3a. Duties and powers of the Director General and Sub-director assigned to perform specialized inspection duties

The Director General and Sub-director assigned to perform specialized inspection functions shall carry out their duties and powers as prescribed in Clause 2, Article 1 of Decree No. 27/2017/NĐ-CP dated March 15, 2017 of the Government amending and supplementing certain articles of Decree No. 213/2013/NĐ-CP dated December 20, 2013 of the Government stipulating the organization and operation of specialized inspection in the field of science and technology, specifically as follows:

1. Submitting competent authorities to establish advisory units or deciding to entrust existing units with advisory responsibilities regarding specialized inspection work at the unit (hereinafter collectively referred to as advisory units). The establishment of advisory units shall be carried out in accordance with the provisions of the law;

2. Issuing regulations on the functions, duties, powers, and organizational structure of advisory units, heads of advisory units; relationships between advisory units and subordinate units under the General Department and Sub-department regarding inspection, supervision, and administrative violation handling within their jurisdiction, within their authority;

3. Deciding on the assignment of civil servants under their management who meet the conditions and standards to perform specialized inspection duties;

4. Proposing new issuance, reissuance, reissue, and revocation of Specialized Inspection Civil Servant Cards in accordance with the provisions of Article 17 of this Circular."

3. Add Article 3b following Article 3a as follows:

"Article 3b. Advisory units on specialized inspection work at the General Department and Sub-department

1. Advisory units on specialized inspection work at the General Department and Sub-department have the function of advising and assisting the Director General and Sub-director in organizing the implementation of specialized inspection work within the scope of their management authority.

2. Duties and powers of advisory units

a) Advising and assisting the Director General and Sub-director in performing the duties and powers stipulated in Article 10 of Decree No. 213/2013/NĐ-CP dated December 20, 2013 of the Government stipulating the organization and operation of specialized inspection in the field of science and technology and Clause 3, Article 1 of Decree No. 27/2017/NĐ-CP dated March 15, 2017 of the Government amending and supplementing certain articles of Decree No. 213/2013/NĐ-CP dated December 20, 2013 of the Government stipulating the organization and operation of specialized inspection in the field of science and technology.

b) Taking the lead in coordinating with relevant units to advise and assist the Director General and Sub-director in building annual inspection plans based on the functions, duties, and powers delegated to the General Department and Sub-department and the inspection orientation of the science and technology sector and the Standardization, Metrology and Quality Control General Department.

c) Advising and assisting the Director General and Sub-director in implementing approved inspection plans by the Minister of Science and Technology and the Director of the Science and Technology Department; organizing regular and spot inspections when assigned by the Director General and Sub-director.

d) Assisting the Director General and Sub-director in monitoring, urging, and inspecting the implementation of inspection conclusions, recommendations, and decisions on handling violations; advising on the resolution of complaints and accusations and other issues arising during the performance of specialized inspection duties.

đ) Advising and assisting the Director General and Sub-director in implementing the information and reporting system on inspection work."

4. AMENDING AND SUPPLEMENTING ARTICLE 6 AS FOLLOWS:

"Article 6. Standards for specialized inspection civil servants

The General Department Director, Department Director, and Branch Director shall decide to recognize specialized inspection officials in accordance with the provisions of this Circular. In addition to the general criteria stipulated in Clause 1, Article 12 of Decree No. 07/2012/ND-CP dated February 9, 2012, of the Government on agencies entrusted with specialized inspection functions and specialized inspection activities, specialized inspection officials must meet the following specific criteria:

1. Have been appointed to the rank of specialist or higher;

2. Be proficient in regulations concerning professional standards and quality measurement (for specialized inspection officials of the General Department and Branches), and be proficient in regulations concerning professional management rules related to radiation safety and nuclear fields (for specialized inspection officials of the Department);

3. Have at least two years of work experience in the assigned professional field (excluding the probation period);

4. Hold a bachelor's degree or higher, with relevant expertise;

5. Possess a certificate for inspector training or higher, or a certificate for training specialized inspection officials, or a certification for training specialized inspection officials.”

5. Amending and supplementing Article 7 as follows:

“Article 7. Authority, Procedures, and Formalities for Recognizing and Terminating Recognition of Specialized Inspection Officials

1. The General Department Director, Department Director, and Branch Director have the authority to recognize and terminate recognition of specialized inspection officials.

2. Procedures and formalities for recognizing and terminating recognition of specialized inspection officials

a) The Legal Affairs and Inspection Division of the General Department, the Department Inspectorate, and the advisory unit for inspection work at the Branch (hereinafter referred to collectively as the advisory unit for specialized inspection work) shall conduct reviews and select officials meeting the criteria set forth in Article 6 of this Circular, prepare files in accordance with Clause 3 of this Article, and submit them to the General Department Director, Department Director, or Branch Director for consideration, selection, and decision within their authority, or submit them to the competent authority for recognition of specialized inspection officials.

b) In cases where specialized inspection officials fall under any of the circumstances specified in point a, Clause 5 of this Article, the advisory unit for specialized inspection work shall prepare files and submit them to the General Department Director, Department Director, or Branch Director for decision to terminate recognition of specialized inspection officials.

3. The application file for recognizing specialized inspection officials includes:

a) Memorandum;

b) A list of proposed specialized inspection officials for recognition;

c) A resume according to Model 2C-BNV/2008 issued together with Decision No. 02/2008/QĐ-BNV dated October 6, 2008, of the Minister of Home Affairs on the issuance of sample forms for personnel and civil servant management files, with confirmation from the head of the directly managing and using agency;

d) A copy of the Bachelor’s Degree Certificate;

đ) A certificate for inspector training or a certificate or certification for training specialized inspection officials;

e) A copy of the Appointment Decision to the civil servant rank.

4. The decision to recognize specialized inspection officials must include the following basic contents:

a) Basis for issuing the Decision;

b) Information about the proposed recognized official, including: full name, civil servant rank, current position held, assigned inspection area, full-time or part-time.

5. Decision to terminate recognition of specialized inspection officials

a) Termination of recognition of specialized inspection officials falls under any of the following circumstances:

- The official has been transferred or rotated to another agency, organization, or unit that does not have the function of specialized scientific and technological inspection;

- Has submitted a voluntary resignation letter to stop working as a specialized inspection official;

- Has failed to complete specialized inspection tasks for two consecutive years;

- Violated service discipline and received disciplinary action of warning or higher;

- Other reasons as prescribed by law.

b) The decision to terminate recognition of specialized inspection officials must include the following basic information:

- Basis for issuing the decision;

- Information about the proposed terminated official, including: full name, civil servant rank, current position held, assigned specialized inspection area, full-time or part-time;

- The time point for termination of recognition of specialized inspection officials.

6. The decision to recognize or terminate recognition of specialized inspection officials shall be implemented in accordance with Form BM 03 and BM 04 attached to this Circular and sent to the Ministry Inspectorate one copy.”

6. Supplement Article 7a following Article 7 as follows:

“Article 7a. Professional Training for Specialized Inspection Officials

1. Civil servants and employees participating in specialized inspection training shall be issued certificates or certifications by authorized agencies.

2. The General Department and Department shall take the lead in coordinating with the Ministry Inspectorate and relevant agencies to develop programs, materials, and plans for training and professional development for officials assigned to perform specialized scientific and technological inspection tasks within their jurisdiction.

3. Specialized inspection officials must undergo training, retraining, or update knowledge according to the training and professional development program for officials assigned to perform specialized inspection tasks.

4. The budget for organizing training and professional development for officials assigned to perform specialized inspection tasks shall be allocated annually in the state budget of the Ministry of Science and Technology for the General Department and Department, and for the Department of Science and Technology for the Branch. The cost for civil servants and employees participating in specialized inspection training shall be borne by the respective agency.”

7. Supplement Article 7b after Article 7a as follows:

“Article 7b. Conditions for Ensuring Specialized Inspection Activities

1. Specialized inspection activities shall be equipped with devices and working tools in accordance with the law. When conducting inspections, organizations and individuals shall be provided with the following working tools and equipment to support inspection activities:

a) Laptop computer;

b) Photography, audio, and video recording equipment;

c) Specialized technical equipment;

d) Other auxiliary equipment serving for inspection activities, as required by the mission of specialized inspection proposed by the head of the specialized inspection advisory department to the person authorized to issue the inspection decision.

2. In addition to the means and technical equipment prescribed in Clause 1 of this Article, when necessary, inspection activities may be equipped with additional technical equipment serving inspection work in accordance with the provisions of the law and the following contents:

a) Means of transportation; means of communication, reporting, and exchanging business matters;

b) Based on the financial resources of the same-level state management agency, the agency performing inspection functions shall be equipped with dedicated vehicles to perform tasks in accordance with the provisions of the law;

3. The funds for implementing the contents prescribed in this Article shall be guaranteed from the annual budget estimate of the Ministry Inspectorate, Department Inspectorate, General Department, Department, Branch Inspectorate, and other sources of funds in accordance with the provisions of the law.”

8. Amend and supplement Article 15 as follows:

Article 15. Specialized Inspection Official Card

1. The specialized inspection official card of science and technology is issued by the Head of the Ministry Inspectorate of Science and Technology to specialized inspection officials under the General Department, Department, and Branch to use when performing specialized inspection tasks, preparing records, and imposing administrative penalties in accordance with the provisions of the law.

Strictly prohibit using the specialized inspection official card for other purposes.

2. The Ministry Inspectorate prints and manages the blank specialized inspection official cards of science and technology. The cost of producing the blank cards is funded by the state budget according to the approved budget for the Ministry Inspectorate.

3. The validity period of the card is five years from the date of issuance.”

9. Amend and supplement Clause 7 of Article 16 as follows:

“7. Specialized Inspection Official Card Code

Each specialized inspection official is assigned one specialized inspection official card code.

The specialized inspection official card of the General Department, Department under the Ministry has a common agency code A08, followed by the abbreviated name of the direct managing unit of the specialized inspection official and the serial number starting from 001. The specialized inspection official card of the Branch has the agency code of local state agencies, followed by the abbreviated name of the province or centrally-administered city and the serial number starting from 001. The agency codes of central and local state agencies are stipulated in Decision No. 93/2005/QĐ-BNV dated August 30, 2005, of the Minister of Home Affairs on issuing the list of agency codes of state agencies and abbreviations of provinces and centrally-administered cities according to Model Form BM 05 attached to this Circular.

The specialized inspection official card code is represented as follows:

a) Specialized inspection official card code of the General Department: A08-TĐC-...;

b) Specialized inspection official card code of the Department: A08-CATBXHN-...;

c) Specialized inspection official card code of the Branch: Local state agency code - abbreviated name of the province or centrally-administered city at Model Form BM 05 - serial number” (Example: According to the provisions at Model Form BM 01 for the General Department, Department is the number: A08-... then for the Branch Quality Standards Metrology and Quality Control of Hanoi is T01-HN-...).

10. Amend and supplement Article 17 as follows:

Article 17. Procedures for Issuing, Replacing, Reissuing, and Revoking Specialized Inspection Official Cards

1. The General Department Director, Department Director proposes the Head of the Ministry Inspectorate of Science and Technology to issue, replace, reissue, and revoke specialized inspection official cards for officials under the General Department, Department, and Branch; the Branch Director submits a written request to the General Department Director to consolidate, review, and propose the Head of the Ministry Inspectorate to issue, replace, reissue, and revoke specialized inspection official cards for standard measurement quality control officials of provinces and centrally-administered cities.

2. Issue a new specialized inspection official card in the case where an official is recognized as a specialized inspection official for the first time.

3. Replace a specialized inspection official card in one of the following cases:

a) The specialized inspection official card has expired;

b) Change the card code;

c) Change the name of the agency entrusted with the function of specialized inspection;

d) When there is a new regulation regarding the card model;

đ) The currently used specialized inspection official card is damaged.

4. Documents for issuing and replacing specialized inspection official cards include:

a) Request for issuing and replacing specialized inspection official cards by the General Department Director, Department Director, and Branch Director;

b) List of persons proposed to be issued specialized inspection official cards according to Model Form BM 02 attached to this Circular;

c) Decision recognizing specialized inspection officials (copy);

d) Two color portrait photographs, ID card size 23 mm x 30 mm, taken within six months, clearly stating the full name, organization, and unit on the back of each photograph and on the envelope containing the photographs;

d) Old specialized inspection official card for replacement cases.

5. Reissue a specialized inspection official card

a) A specialized inspection official may be considered for reissuance of the card in the event of loss due to objective reasons, not falling under the revocation circumstances stipulated in Clause 6 of this Article.

b) Documents for reissuing a specialized inspection official card include:

- Application for reissuance of the card, including a report and explanation of the loss of the specialized inspection official card, confirmed by the head of the agency or directly managing unit;

- Request of the General Department Director, Department Director, and Branch Director;

- List of persons proposed to be issued specialized inspection official cards according to Model Form BM 02 attached to this Circular;

- Two color portrait photographs, ID card size 23 mm x 30 mm, taken within six months, clearly stating the full name, organization, and unit on the back of each photograph and on the envelope containing the photographs.

6. Revoke a specialized inspection official card in one of the following cases:

a) The specialized inspection official has a decision terminating recognition as a specialized inspection official;

b) A specialized inspector civil servant who has been decided to be dismissed from service or has been disciplined with the measure of being compelled to leave the service in accordance with the provisions of the law;

c) A specialized inspector civil servant who retires, dies, or goes missing while on duty;

d) A specialized inspector civil servant who is convicted by a court with a judgment having legal effect;

đ) In the case of changing the Specialized Inspector Civil Servant Card as prescribed in Clause 3, Article 17 of this Circular or when the Specialized Inspector Civil Servant Card is issued contrary to the regulations;

f) Other cases as prescribed by law.

7. Based on the decision of the competent authority regarding the cases stipulated in Clause 6 of this Article, the Director of the General Department, the Director of the Bureau shall propose the Inspector-in-Chief of the Ministry of Science and Technology to revoke the Specialized Inspector Civil Servant Card. The Director of the General Department, the Director of the Bureau, and the Director of the Branch shall carry out the revocation of the Specialized Inspector Civil Servant Card and cut the corner of the card after receiving the decision to revoke the Specialized Inspector Civil Servant Card from the Inspector-in-Chief of the Ministry.

11. Amend and supplement Article 18 as follows;

“Article 18. Uniforms of specialized inspector civil servants

1. The uniforms of specialized inspector civil servants shall be applied in accordance with the provisions of Circular No. 02/2015/TT-TTCP dated March 16, 2015 of the Government Inspector General on the uniforms for cadres, inspectors, civil servants, and officials working at state inspection agencies and shall be provided with kepi hats, badges, shoulder straps, insignia, and specific regulations as follows:

a) The Director of the General Department, the Director of the Bureau shall be provided with uniforms, shoulder straps, and insignia like the Inspector-in-Chief of the Ministry; Deputy Directors of the General Department, Deputy Directors of the Bureau shall be provided with uniforms, shoulder straps, and insignia like Deputy Inspectors-in-Chief of the Ministry; the Director of the Branch shall be provided with uniforms, shoulder straps, and insignia like the Inspector-in-Chief of the Provincial Department; Deputy Directors of the Branch shall be provided with uniforms, shoulder straps, and insignia like Deputy Inspectors-in-Chief of the Provincial Department;

b) Heads and deputies of heads of specialized inspection sector advisory units of the General Department, the Bureau shall be provided with uniforms, shoulder straps, and insignia similar to those of the Heads and Deputy Heads of Departments under the Ministry's Inspectorate;

c) Specialized inspector civil servants not holding leadership management positions or holding department-level positions in the Branch shall be provided with uniforms equivalent to their civil servant ranks as with inspectors, senior inspectors, and chief inspectors;

d) The management and issuance system for uniforms shall be implemented in accordance with Joint Circular No. 73/2015/TTLT-BTC-TTCP dated May 12, 2015 of the Government Inspector General on the management and issuance system for uniforms for inspectors, cadres, civil servants, and officials working at state inspection agencies.

2. The cost of making and equipping uniforms for specialized inspector civil servants shall be funded from the state budget and allocated in the annual budget of the agency managing specialized inspector civil servants.

12. Amend and supplement Article 20 as follows:

“Article 20. Responsibilities of the Director of the General Department, the Director of the Bureau, and the Director of the Branch in managing specialized inspector civil servants

1. To inspect and supervise the performance of tasks by specialized inspector civil servants in accordance with the laws on inspection.

2. To ensure conditions for operation, systems, and policies for specialized inspector civil servants in accordance with the regulations.

3. To assign specialized inspector civil servants to attend training and professional development programs in accordance with the regulations.

4. To evaluate specialized inspector civil servants within their direct management scope in accordance with the regulations.

5. To manage and inspect the use of uniforms, badges, identification plates, and cards within their direct management scope.

6. To implement reward and punishment systems for specialized inspector civil servants within their authority or to propose higher authorities to reward or punish them in accordance with the regulations.

7. To compile and report the number and implementation status of tasks of specialized inspector civil servants within their direct management scope as required by the competent authority.

8. To review and compile lists of civil servants holding inspection ranks in the General Department, Bureau, and Branch and to report to the Board of Examination for Rank Transfer of the Ministry or locality to relieve them of their current positions and transfer them to equivalent civil servant ranks in accordance with the law.

9. To handle complaints and denunciations against specialized inspector civil servants in accordance with the law.

10. To perform other tasks and powers as prescribed by the law.”

13. Amend and supplement Article 22 as follows:

“Article 22. Responsibilities of the Head of the Agency Having Civil Servants and Officials Who Are Summoned or Proposed to Join the Specialized Inspection Team

1. To appoint and arrange civil servants and officials summoned or proposed to join the team in accordance with the summons letter or proposal from the agency summoning the inspectorial collaborator or the agency proposing to join the specialized inspection team.

2. To coordinate with the Head of the Agency Summoning the Inspectorial Collaborator or the Agency Proposing to Join the Inspection Team to monitor the performance of duties by the inspectorial collaborator or the member of the inspection team within their management authority.

3. Article 2. Effective Date

1. This Circular takes effect from July 1, 2018.

2. Replace Model Form BM 02. List of Persons Issued with Specialized Inspector Civil Servant Cards, Model Form BM 03. Decision Recognizing Specialized Inspector Civil Servants, and Model Form BM 04. Decision Terminating Recognition of Specialized Inspector Civil Servants with corresponding Model Forms BM 02. List of Persons Issued with Specialized Inspector Civil Servant Cards, Model Form BM 03. Decision Recognizing Specialized Inspector Civil Servants, and Model Form BM 04. Decision Terminating Recognition of Specialized Inspector Civil Servants as prescribed in the Appendix accompanying this Circular.

Article 3. Implementation Organization

1. The Inspector-in-Chief of the Ministry, the Director of the General Department, and the Director of the Bureau shall be responsible for guiding the implementation of this Circular based on their respective specialized fields of work.

2. During the implementation process, if organizations, individuals encounter difficulties or obstacles, they are requested to reflect these issues to the Ministry of Science and Technology for guidance or research on amendments and supplements to make it more appropriate.

3. The Ministries, ministerial-level agencies, agencies under the Government, People's Committees of provinces and centrally governed cities, and related organizations and individuals are responsible for implementing this Circular./.
