This Circular abolishes the list of products and goods with potential to cause safety hazards managed by the Ministry of Health issued in 2017, effective from June 1, 2019. Products registered before this date will still follow the previous regulations.

CIRCULAR

ABOLISHING THE CIRCULAR NO. 31/2017/TT-BYT OF THE MINISTER OF HEALTH ON THE LIST OF PRODUCTS AND GOODS WITH POTENTIAL TO CAUSE SAFETY RISKS UNDER THE SCOPE OF MANAGEMENT ASSIGNED TO THE MINISTRY OF HEALTH

Pursuant to Decree No. 132/2008/NĐ-CP dated December 31, 2008 of the Government detailing implementation of certain provisions of the Product Quality Law;

Pursuant to Decree No. 74/2018/NĐ-CP dated May 15, 2018 of the Government amending and supplementing certain articles of Decree No. 132/2008/NĐ-CP dated December 31, 2008 of the Government detailing the implementation of certain provisions of the Law on Product Quality and Safety;

Pursuant to Decree No. 34/2016/NĐ-CP dated May 14, 2016 of the Government detailing certain provisions and implementing measures of the Law on Legislative Regulatory Documents;

Pursuant to the Government's Decree No. 75/2017/NĐ-CP dated June 20, 2017 stipulating the functions, tasks, powers, and organizational structure of the Ministry of Health;

At the proposal of the Director of the Science, Technology and Training Department, Ministry of Health;

The Minister of Health issues this Circular to abolish Circular No. 31/2017/TT-BYT dated July 25, 2017 of the Minister of Health on the List of Products and Goods with Potential to Cause Safety Risks under the Scope of Management Assigned to the Ministry of Health.

Article 1. Repeal of legal regulatory acts

Abolish Circular No. 31/2017/TT-BYT dated July 25, 2017 of the Minister of Health on the List of Products and Goods with Potential to Cause Safety Risks under the Scope of Management Assigned to the Ministry of Health (hereinafter referred to as Circular No. 31/2017/TT-BYT) from the date this Circular takes effect.

Article 2. Effective Date

This Circular shall take effect from June 1, 2019.

For products and goods registered at customs checkpoints according to Circular No. 31/2017/TT-BYT before the date this Circular takes effect, they shall be implemented in accordance with Circular No. 31/2017/TT-BYT and related legal documents.

Article 3. Responsibility for Implementation

1. Responsibilities of the Department of Science, Technology and Training, Ministry of Health:

a) Guide and organize the implementation of this Circular.

b) Coordinate with relevant Departments, Bureaus, General Departments under the Ministry to review annually and propose the Minister of Health to issue the List of Goods with Potential to Cause Safety Risks under the Scope of Management Assigned to the Ministry of Health to meet management requirements.

2. Relevant Departments, Bureaus, General Departments, Office of the Ministry, and the Inspectorate of the Ministry of Health shall cooperate with the Department of Science, Technology and Training, Ministry of Health in organizing the implementation of this Circular and reviewing annually to supplement the List of Goods with Potential to Cause Safety Risks under the Scope of Management Assigned to the Ministry of Health.

During the implementation process, if there are arising issues, difficulties, or obstacles, agencies, organizations, and individuals shall promptly report to the Ministry of Health for consideration and resolution within their authority./.
