CIRCULAR
Amending and supplementing certain provisions of the Joint Circular number 47/2011/TTLT-BCT-BTNMT dated December 30, 2011, issued by the Minister of Industry and Trade and the Minister of Natural Resources and Environment, stipulating the management of import, export, and temporary import-re-export of substances that deplete the ozone layer in accordance with the Montreal Protocol on Substances that Deplete the Ozone Layer
Pursuant to the Law on Foreign Trade Management No. 05/2017/QH14 dated June 12, 2017;
Pursuant to Decree No. 98/2017/NĐ-CP dated August 18, 2017, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade;
Pursuant to Decree No. 69/2018/NĐ-CP dated May 15, 2018 of the Government detailing certain provisions of the Law on Foreign Trade Management;
Implementing the Vienna Convention of 1985 for the Protection of the Ozone Layer and the Montreal Protocol of 1987 on Substances that Deplete the Ozone Layer and the amending and supplementary documents of the Montreal Protocol which have been approved by the Socialist Republic of Vietnam to participate in;
At the proposal of the Director of the Import-Export Department,
The Minister of Industry and Trade issues this Circular to amend and supplement some articles of the Joint Circular No. 47/2011/TTLT-BCT-BTNMT dated December 30, 2011, issued by the Minister of Industry and Trade and the Minister of Natural Resources and Environment, stipulating the management of import, export, and temporary import-re-export of substances that deplete the ozone layer in accordance with the Montreal Protocol on Substances that Deplete the Ozone Layer (hereinafter referred to as Joint Circular 47).
Article 1. Amending and supplementing some articles of Joint Circular 47
1. The list of HCFC substances at Appendix I specified in point a, Clause 3, Article 1 of Joint Circular 47 shall be replaced by Appendix I attached hereto.
2. Point c shall be added after point b, Clause 3, Article 1 of Joint Circular 47 as follows:
"c) Hydrofluorocarbons (in this Circular referred to as HFCs) listed in Appendix IIa and Appendix IIb of this Circular."
3. Clause 1, Article 3 of Joint Circular 47 shall be amended as follows:
"1. The quota volume of HCFC substances listed in Appendix I of this Circular for each year from January 1, 2020 to December 31, 2028 shall be managed through permits issued by the Ministry of Industry and Trade, specifically as follows:"

2. The quota volume of HFC substances listed in Appendix IIa and Appendix IIb of this Circular from 2023 onwards will be determined and announced by the Ministry of Industry and Trade based on the average annual imports of HFC substances in 2020, 2021, and 2022 plus 65% of the base consumption level of HCFC substances. From 2024 to 2028, the quota volume of HFC substances will remain unchanged at the level of the base quota in 2023. The specific quota volumes of HFC substances for each year will be announced and calculated according to the equivalent CO2 quantity as prescribed in the Kigali Amendment to the Montreal Protocol."
5. Article 4a shall be added after Article 4 of Joint Circular 47 as follows:
"Article 4a. Procedures for importing HFC substances
The procedures for issuing import permits for HFC substances shall be carried out in accordance with Clause 2, Article 4 of Joint Circular 47, which has been amended and supplemented by Article 2 of Circular No. 51/2018/TT-BCT. Specifically, the application for importing HFC substances shall be guided by Appendix III attached hereto."
6. Article 6a shall be added after Article 6 of Joint Circular 47 as follows:
"Article 6a. Export procedures for HFC substances under quotas
The Ministry of Industry and Trade issues Export Permits for HFC substances under quotas in accordance with the decisions of the member countries of the Montreal Protocol. The file and process of issuing permits for import are implemented in accordance with Clause 1 and Clause 2, Article 9 of Decree No. 69/2018/NĐ-CP dated May 15, 2018 of the Government detailing certain provisions of the Law on Management of Foreign Trade. The files are submitted to the Ministry of Industry and Trade (Department of Import-Export), except for the application for exporting HFC substances as prescribed in Appendix IV attached hereto."
7. Clause 3 shall be added after Clause 2, Article 8 of Joint Circular 47 as follows:
Article 2. "3. Merchants must report the situation of exporting and importing HFC substances quarterly and annually in the form and time as prescribed for HCFC substances in Clause 1 and Clause 2, Article 8 of Joint Circular 47 and in accordance with the guidance provided in Appendix V attached hereto."
Article 3. Effectiveness
Clause 2, Article 3 of Joint Circular 47 is abolished.
