of provinces, centrally governed cities (hereinafter referred to collectively as the provincial People's Committee) and the Finance and Planning Office under the People's Committee of districts, towns, centrally governed cities within provincesFUNCTIONS, DUTIES, POWERS, ORGANIZATIONAL STRUCTURE, OPERATIONAL REGULATIONS, AND RELATIONSHIPS OF MANAGEMENT BOARDS; DUTIES, POWERS OF THE CHAIRPERSON, VICE CHAIRPERSON (IF ANY), SECRETARY, AND MEMBERS OF MANAGEMENT BOARDSand centrally governed cities within centrally governed citieson(hereinafter referred to collectively as thePeople's Committee at the district level) as follows:DEPARTMENT OF PLANNING AND INVESTMENT1. The Department of Planning and Investment is a specialized agency under the provincial People's Committee responsible for performing the function of advising and assisting the provincial People's Committee in state management of planning, investment, including: planning; socio-economic development plans; public investment plans; mechanisms and policies in economic sectors, attracting investment resources, restructuring the economy, implementing new economic models, new business methods, coordinating regional development; domestic and foreign investment in the locality; managing official development assistance (ODA) funds, preferential loans from sponsors and non-reimbursable aid not included in ODA provided by foreign organizations, individuals; bidding; business registration within the local area; consolidating and uniformly managing issues related to enterprises, collective economies, cooperatives, private economies, household economies, and other economic organizations; organizing the provision of public services within the scope of state management of the Department according to the provisions of the law.

PART I

2. The Department of Planning and Investment has legal personality, its own seal and separate account; it is subject to the direction and management of the provincial People's Committee regarding organization, staffing, and personnel work; at the same time, it is subject to the direction, guidance, inspection, and supervision of the Ministry of Planning and Investment in terms of professional and technical matters.

Article 1. Position and Functions

The Department of Planning and Investment performs tasks and powers as prescribed by laws on planning, investment, and the following specific tasks and powers:

a) Drafting plans to implement provincial master plans; five-year and annual socio-economic development plans of the province, proposing plans to allocate capital for public investment over five years and annually from central and local budgets; plans for investment promotion, annual investment promotion programs, lists of investment projects attracting investment in the locality; major economic and social balances of the province, including public investment capital balances; programs and plans to implement sustainable development goals and green growth targets of the province; plans and implementation status of national target programs; programs and measures to organize the implementation of administrative reform tasks and improve the business investment environment in the fields under the Department’s state management;

b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;

b) Drafting action programs to implement socio-economic development plans according to the resolutions of the Provincial People's Council and being responsible for monitoring and summarizing the implementation status of monthly, quarterly, semi-annual, and annual plans for reporting to the provincial People's Committee to manage and coordinate the implementation of major economic and social balances of the province;

1. Submit to the provincial People's Committee:

c) Drafting programs and plans for the reorganization and development of state-owned enterprises and enterprises with state capital managed by the locality; management mechanisms for state-owned enterprises and enterprises with state capital; drafting programs and plans to support the development of small and medium-sized enterprises, private enterprises (including innovation and start-up programs), cooperative development, and individual business development annually and over five years in the province; drafting plans to improve the business investment environment index and enhance the competitiveness of the province;

d) Drafting decisions on programs and measures to organize the implementation of administrative reform tasks in the field of planning and investment under the Department's jurisdiction as prescribed by law and the delegation of the Ministry of Planning and Investment;

đ) Drafting decisions specifying the functions, tasks, powers, and organizational structure of the Department; drafting decisions on establishing, reorganizing, and dissolving public service units of the Department according to the provisions of the law;

e) Drafting approval documents for investment proposals, adjustments to investment proposals, investor approvals, simultaneous approvals for investment proposals and investors according to the division of labor of the provincial People's Committee for projects within the Committee's authority to approve investment proposals and investors as stipulated by investment laws; drafting lists of investment projects using land; preliminary requirements for capacity and experience; implementation plans for selecting investors based on preliminary assessments of capacity and experience for projects using land;

g) Drafting decisions on delegating tasks and powers in the field of planning and investment management to relevant departments and agencies of the district-level People's Committee.

e) Draft approval documents for investment orientation, adjustment of investment orientation, investor approval, simultaneous approval of investment orientation and investor according to the division of labor by the provincial People's Committee for projects within its authority to approve investment orientation and investors under the laws on investment; draft list of investment projects using land; draft preliminary requirements regarding capacity and experience; implementation plan for selecting investors based on the preliminary assessment of capacity and experience for investment projects using land;

g) Draft decision on the delegation of state management tasks in the planning and investment sector to departments and agencies of the People's Committee at the district level.

2. Submit to the Chairman of the People's Committee at the provincial level

a) Draft decision stipulating the functions, tasks, powers, and organizational structure of public service units under the Department, as provided for by law (if applicable);

b) Draft decisions, directives, and other documents within the authority to promulish of the Chairman of the Provincial People's Committee regarding the fields under the Department’s administrative management.

3. Assist the Chairman of the Provincial People's Committee in directing, guiding, inspecting, providing information, disseminating, and educating the law in the field of planning and investment; organizing the implementation of legal regulatory documents, policies, plans, programs, projects, and proposals within the scope of the Department’s administrative management after they have been issued or approved by competent authorities.

4. On planning and planning

a) Advise and assist the Provincial People's Committee in issuing and implementing legal regulatory documents on provincial planning; plans, policies, solutions, resource allocation for implementation, and evaluation of provincial planning implementation; organizing solicitation of opinions, announcing provincial planning; providing relevant data within the local management scope to update into the national system of planning information and database; reviewing and proposing adjustment policies for provincial planning; reporting annually on planning activities in the province; managing and overseeing certain aspects of plan implementation assigned by the Provincial People's Committee;

b) Building, evaluating, managing, storing, publishing, providing, exploiting, and using information and databases on planning;

c) Taking the lead and coordinating with departments, agencies, and district people's committees within the province to propose contents to be integrated into provincial planning; supervising the implementation process of planning and plans that have been approved by competent authorities;

5. On development investment and public-private partnership investment

a) Taking the lead and coordinating with relevant agencies to build plans and propose budget allocations for each task, program, and project funded by the state budget managed by the province;

b) Taking the lead and coordinating with relevant agencies to build, implement, monitor, and supervise the implementation of state investment policies and laws on public-private partnership investment, compliance with state investment plans;

c) Taking the lead and coordinating with the Department of Finance and related agencies to monitor and evaluate the effectiveness of state budget investment in programs and projects within the province;

d) Taking the lead and coordinating with agencies to aggregate, evaluate, and report on the implementation of public-private partnership investment projects within the local management scope;

e) Serving as the focal point for applying and implementing the National Information System and Database on State Investment in local state management activities;

f) Serving as the permanent member of the basic-level project appraisal council for public-private partnership investment projects; serving as the focal point for receiving and appraising public-private partnership investment projects within the local management scope when assigned by the Provincial People's Committee and performing tasks according to the law on public-private partnership investment;

g) Serving as the focal point for publishing information on public-private partnership investment projects; appraising tender invitation preliminary screening documents, preliminary screening results, tender invitation documents, request documents, negotiation invitation documents, lists of investors meeting technical requirements, investor selection results in cases where these contents are approved by the Provincial People's Committee;

h) Taking the lead in advising on handling situations in selecting investors for public-private partnership investment projects; taking the lead in organizing inspections, supervision, and monitoring the implementation of laws on public-private partnership investment for projects within the province; participating in the advisory council to resolve local-level complaints according to the law on public-private partnership investment;

6. On domestic and foreign investment management

a) Issuing, adjusting, and revoking Investment Registration Certificates for projects outside industrial zones, export processing zones, high-tech industrial zones, economic zones, and other cases as prescribed by investment law;

b) Serving as the focal point for receiving applications for approval, adjustment of investment policies, and approval of investors as prescribed by investment law; serving as the focal point for implementing tasks related to investment supervision and evaluation at the provincial level; guiding the implementation of investment supervision and evaluation for subordinate levels, projects approved by the provincial people's committee for lower-level decisions to invest;

c) Managing domestic and foreign investment activities in the province as prescribed by law; resolving difficulties and obstacles for investors at the local level within its authority or referring them to competent authorities for resolution; serving as the focal point to assist the provincial people's committee in state management of investment promotion activities; organizing investment promotion activities according to the plan approved by the provincial people's committee; guiding investment procedures within its authority;

d) Collecting, storing, and managing investment registration information; standardizing and updating investment registration data into the national investment database; guiding economic organizations implementing investment projects to use the national investment information system; reporting to the Ministry of Planning and Investment and the provincial people's committee on the situation of receiving, issuing, adjusting, and revoking Investment Registration Certificates, the operation status of investment projects within the management scope; organizing, supervising, and evaluating the implementation of investment reporting systems at the local level.

7. On management of ODA funds, preferential loans from foreign donors, and non-reimbursable aid not included in official development assistance from foreign agencies, organizations, and individuals

a) Serve as the focal point to assist the People's Committee at the provincial level in coordinating with the Ministry of Planning and Investment, relevant ministries, sectors, and related agencies in developing strategies, orientations, plans for mobilizing, attracting, and managing ODA funds, preferential loans from sponsors, and non-repayable aid not included in official development assistance from foreign organizations, institutions, and individuals; guide departments and sectors in compiling lists and contents of programs using ODA funds, preferential loans from sponsors, and non-repayable aid not included in official development assistance from foreign organizations, institutions, and individuals; compile lists of programs and projects using ODA funds, preferential loans from sponsors, and non-repayable aid not included in official development assistance from foreign organizations, institutions, and individuals, submit them to the People's Committee at the provincial level for approval, and report to the Ministry of Planning and Investment.

b) Supervise and evaluate the implementation of programs and projects using ODA funds, preferential loans from sponsors, and non-repayable aid not included in official development assistance from foreign organizations, institutions, and individuals; handle or recommend the Chairman of the People's Committee at the provincial level to address issues arising in the allocation of counterpart funds and disbursement for implementing ODA projects, preferential loans from sponsors, and non-repayable aid not included in official development assistance from foreign organizations, institutions, and individuals that involve multiple departments, sectors, districts, and communes; periodically compile and report on the situation and effectiveness of attracting and utilizing ODA funds, preferential loans from sponsors, and non-repayable aid not included in official development assistance from foreign organizations, institutions, and individuals.

c) Chair the review of non-repayable aid not included in official development assistance from foreign organizations, institutions, and individuals within the approval authority of the Chairman of the Provincial People's Committee.

8. On tender management

a) For the activity of selecting contractors: Review the plan for selecting contractors for projects decided to be invested in by the Chairman of the People's Committee at the provincial level; review the notice of interest, prequalification documents, tender documents, request for proposals, list of contractors meeting technical requirements for two-envelope tenders, results of evaluating notices of interest, results of evaluating prequalification submissions, and contractor selection results for tenders under projects where the provincial-level People's Committee is the investor.

b) For the activity of selecting investors to implement investment projects involving land use: Publish the list of investment projects involving land use; conduct preliminary assessments of the capabilities and experience of investors submitting applications to implement projects; review the plan for selecting investors, tender documents, request for proposals, list of investors meeting technical requirements, and investor selection results when these items are approved by the People's Committee at the provincial level.

c) Chair the advisory process for handling situations in tendering for packages and projects within the authority of the People's Committee at the provincial level; chair the organization of inspections, supervision, and monitoring of the implementation of laws on tendering for projects and budgets within the province; chair the summary, evaluation, and compilation of reports on the implementation of tendering activities within the province; establish a local advisory board to resolve complaints, with the Director of the Department of Planning and Investment serving as the Chairman of the advisory board, and perform other tasks related to tendering assigned by the People's Committee at the provincial level.

9. On enterprises and business registration

a) Organize the receipt of enterprise registration applications; issue or refuse to issue enterprise registration certificates; guide enterprises and their founders regarding application documents, procedures, and processes for enterprise registration; provide free advice and guidance to individual businesses wishing to convert to enterprises.

b) Guide, train, and instruct county-level business registration agencies on cooperative society and individual business registration documents, procedures, and processes; inspect and supervise county-level business registration agencies in performing their duties and powers concerning cooperative society and individual business registration.

c) Coordinate in building, managing, and operating the national information system for enterprise registration within the jurisdiction; collect, store, review, and manage enterprise registration information; standardize and update local enterprise registration data into the national database for enterprise registration.

d) Serve as the focal point for tracking and summarizing enterprise situations; directly or propose competent state agencies to inspect and supervise enterprises according to the content in the enterprise registration documents; handle violations related to enterprise registration; coordinate with relevant departments to inspect, monitor, summarize situations, and handle violations by enterprises after establishment according to their authority.

e) Provide enterprise registration information stored in the national database for enterprise registration within the managed jurisdiction to organizations and individuals in accordance with the law and regulations on anti-money laundering and terrorist financing.

g) Serve as the focal point for tracking and summarizing the restructuring, modernization, and development of state-owned enterprises, enterprises with state capital contributions, and the development of enterprises in other economic sectors; chair and coordinate with relevant departments to advise the People's Committee at the provincial level on the establishment, restructuring, and ownership transfer of state-owned enterprises; serve as the focal point for drafting content, proposals, programs, and plans to support small and medium-sized enterprises in the locality; organize the implementation, monitoring, and summarizing of the implementation of activities supporting small and medium-sized enterprises in the locality.

10. On collective economy and private sector economy

a) Take the lead in compiling, proposing, and organizing the implementation of strategies, programs, plans, and projects for the development of collective economic organizations, cooperatives, individual businesses, and private enterprises; establish and organize the implementation of mechanisms and policies to support and provide preferential treatment for collective economic organizations and cooperatives; guide, monitor, compile, and evaluate the implementation of programs, plans, mechanisms, and policies for the development of collective economic organizations, cooperatives, individual businesses, and private enterprises, as well as the activities of collective economic organizations, cooperatives, individual businesses, and private enterprises within the province; build, conclude, and expand models of effective collective economic organizations and cooperatives, production linkage, and product consumption; organize the registration of cooperative unions and people's credit funds according to their authority;

b) Take the lead and coordinate with relevant agencies to resolve issues related to mechanisms and policies for the development of collective economic organizations, cooperatives, individual businesses, and private enterprises that involve multiple sectors;

Serve as the focal point for coordinating with domestic and international organizations and individuals to research, conclude experiences, and develop assistance programs, attract capital, and other resources to serve the development of collective economic organizations, cooperatives, individual businesses, and private enterprises within the province;

Regularly prepare reports in accordance with the guidelines of the Ministry of Planning and Investment to be submitted to the provincial People's Committee, the Ministry of Planning and Investment, and relevant ministries and ministerial-level agencies regarding the situation of the development of collective economic organizations, cooperatives, individual businesses, and private enterprises within the province;

11. Implement international cooperation in the fields of planning, programs, and investment in accordance with the provisions of the law and the division of responsibilities or delegation by the provincial People's Committee;

12. Provide professional guidance on planning, programs, and investment within the scope of management of the planning and investment sector to the Finance and Planning Department under the provincial People's Committee;

Organize research and application of scientific and technological progress; establish information systems and archives, implement digital transformation to serve state administration and professional work in the assigned field;

Conduct inspections, audits, handle complaints and denunciations in accordance with the law; process or recommend higher authorities to process violations of the law in areas under the management of the Department; prevent corruption, promote thrift, and combat waste; assist and advise the provincial People's Committee on rewarding units, organizations, and individuals who have made achievements in the activities of the sector in accordance with the law;

Specify the specific functions, tasks, powers, and working relationships of the Department's office and specialized departments in accordance with the functions, tasks, and powers of the Department as guided by the Ministry of Planning and Investment and as stipulated by the provincial People's Committee;

Manage organizational structures, civil service quotas, job classification structures, positions, and staffing levels in public service units based on occupational titles; implement salary systems and incentive policies, training, rewards, and disciplinary measures for cadres, civil servants, public officials, and employees under the Department's jurisdiction in accordance with the law and as delegated by the provincial People's Committee;

Manage and be responsible for financial resources and assets allocated in accordance with the law and as assigned by the provincial People's Committee;

Carry out regular and ad hoc reporting on the implementation of assigned tasks in various fields to the provincial People's Committee and the Ministry of Planning and Investment;

Perform other tasks as prescribed by law or as assigned or delegated by the Ministry of Planning and Investment, the provincial People's Committee, or the Chairman of the provincial People's Committee in accordance with the law;

Chapter II

FINANCE AND PLANNING DEPARTMENT

Article 3. Position and functions in the field of planning, plans, and investment

1. The Finance and Planning Office is a specialized agency under the People's Committee at the district level, implementing advisory and assistance functions to manage state affairs on planning within the district; plans and investment; registration of business households, cooperative registration; consolidation and unified management of issues related to collective economic organizations, cooperatives, business households, and private economy according to the provisions of the law.

2. The Finance and Planning Office has its own seal and separate account; it is subject to direction and management regarding organization, job positions, civil servant quotas, and career structure by the People's Committee at the district level; simultaneously, it is subject to direction, inspection, and guidance on professional matters within the field of planning and investment by the Department of Planning and Investment.

Article 4. Tasks and Powers

The Finance and Planning Office performs tasks and powers as prescribed by law in the fields of planning, plans, and investment, and the following specific tasks and powers:

1. Submit to the People's Committee at the district level:

a) Drafting proposals and programs for socio-economic development, administrative reform in the field of planning and investment within the district, in accordance with approved planning;

b) Drafting decisions and guiding documents to implement mechanisms, policies, laws, and regulations of the People's Committee at the district level and the Department of Planning and Investment concerning planning and investment work within the district.

2. Establishing, reviewing, and consolidating public investment plans within the assigned scope and sources of funds managed by the People's Committee at the district level; reviewing bidding plans for projects decided to be invested in by the Chairman of the People's Committee at the district level; reviewing tender invitation documents, prequalification documents, tender documents, request documents, evaluation results of tender invitations, prequalification results, and selection results of contractors for packages of works under projects led by the People's Committee at the district level.

3. Implementing legal normative documents, mechanisms, policies, plans, programs, projects, and proposals that have been approved by competent authorities; providing information, propaganda, dissemination, and legal education on planning and investment matters within the district.

4. Providing information, promoting investment, coordinating with relevant specialized departments to organize the attraction of domestic and foreign investors to invest in the district; providing professional guidance to cadres and civil servants engaged in planning and investment work at the commune level.

5. Regarding enterprises, collective economy, cooperatives, business households, and private economy.

a) Directly receiving registration files for cooperatives and business households; issuing or refusing to issue cooperative and business household registrations; guiding cooperatives and business households and their founders about registration files, procedures, and processes.

b) Coordinating in building, managing, and operating information systems for cooperatives and business households within the district; regularly reporting to the People's Committee at the district level, provincial business registration agencies, and local tax agencies about the situation of cooperative and business household registrations; providing registration information for cooperatives and business households within the district to organizations and individuals as required by law.

c) Consolidating, monitoring, and evaluating the implementation of programs, plans, proposals, mechanisms, and policies for developing collective economy, private economy, cooperatives, and economic organizations within the district.

d) Directly inspecting or requesting competent state agencies to inspect cooperatives and business households based on registration files within the district; revoking business registration certificates according to the provisions of the law.

6. Consolidating and reporting on the implementation of assigned tasks to the People's Committee at the district level and the Department of Planning and Investment.

7. Organizing research and application of scientific and technological progress; establishing information and storage systems to serve assigned professional management tasks.

8. Managing and being responsible for cadres, civil servants, finances, and assets assigned according to the law and as delegated or authorized by the People's Committee at the district level.

9. Implementing regular and urgent information and reporting on the implementation of assigned tasks as prescribed.

10. Performing other state management tasks in the field of planning and investment as delegated, classified, or authorized by the People's Committee at the district level and according to the law.

Chapter III

IMPLEMENTATION

Article 5. Effective Date

This Circular takes effect from June 20, 2022, and replaces Circular Joint No. 21/2015/TTLT-BKHĐT-BNV dated December 11, 2015, issued by the Ministry of Planning and Investment and the Ministry of Home Affairs guiding the functions, tasks, powers, and organizational structures of the Department of Planning and Investment under the People's Committees of provinces and centrally-run cities, and the Finance and Planning Offices under the People's Committees of districts, towns, and cities under provinces and centrally-run cities.

Article 6. Responsibility for Implementation

1. Provincial People's Committees shall be responsible for:

a) Based on the guidelines of this Circular, the Provincial People's Committee shall specify the functions, tasks, and powers of the Department of Planning and Investment; directing and guiding the District People's Committees to specify the functions, tasks, and powers of the Finance and Planning Offices.

b) Directing, guiding, inspecting, and auditing the implementation of regulations on the functions, tasks, and powers of the Department of Planning and Investment under the Provincial People's Committee and the Finance and Planning Offices under the District People's Committees.

2. The Chairman of the Provincial People's Committee is responsible for annually reporting to the Ministry of Planning and Investment on the organization and operation of the Department of Planning and Investment.

During implementation, if any issues arise or difficulties occur, the People's Committees of provinces and centrally-run cities and relevant agencies, organizations, and individuals are requested to promptly report to the Ministry of Planning and Investment for consideration and resolution according to their authority./.
