Pursuant to the Law on Organization of the Government dated June 19, 2015; the Law Amending and Supplementing Certain Provisions of the Law on Organization of the Government and the Law on Organization of Local Administration dated November 22, 2019;

Pursuant to the Law on Medical Examination and Treatment dated January 9, 2023;

Pursuant to Decree No. 96/2023/NĐ-CP dated December 30, 2023 of the Government detailing certain provisions of the Law on Medical Examination and Treatment;

At the proposal of the Minister of Health;

The Prime Minister issues this Decision to promulgate the Regulations on the organization and operations of the National Medical Council.

Article 1. These Regulations are attached to this Decision.

Article 2. This Decision shall take effect from April 15, 2025.

Article 3. Ministers, Heads of ministerial-level agencies, Heads of governmental agencies, Chairpersons of provincial People's Committees under the central government, Chairperson of the National Medical Council, and related agencies and organizations are responsible for implementing this Decision.

REGULATIONS

ORGANIZATION AND OPERATIONS OF THE NATIONAL MEDICAL COUNCIL
(Attached to Decision No. 05/2025/QĐ-TTg dated February 27, 2025 of the Prime Minister)

PART I

ORGANIZATION AND ACTIVITIES

Article 1. Legal Status

The National Medical Council is an organization established by the Prime Minister with the function of independently assessing the professional competence in medical practice and treatment, having its own seal and separate account.

Article 2. Name and Address

1. Vietnamese name: National Medical Council.

2. English name: Vietnam National Medical Council.

3. Abbreviation in English: VNMC.

4. The National Medical Council has its headquarters in Hanoi city.

Article 3. Organizational Structure of the Council

1. Chairman, Vice Chairmen, and Members of the Council:

a) The Chairman of the Council is concurrently the Leader of the Ministry of Health.

b) The Vice Chairmen of the Council include: one full-time Vice Chairman, one Vice Chairman concurrently the Director of the Department of Medical Examination and Treatment under the Ministry of Health, and one Vice Chairman concurrently the Director of the Department of Science, Technology and Training under the Ministry of Health.

The Prime Minister appoints and dismisses the Chairman and Vice Chairmen of the National Medical Council upon the proposal of the Minister of Health.

The term of office for the full-time Vice Chairman is five years and may be reappointed, but not more than two consecutive terms.

c) Members of the Council include representatives from healthcare facilities, educational institutions in the health sector, professional associations and experts in the healthcare field, and state management agencies, including one Member concurrently the Secretary of the Council. The number of Council Members is determined by the Chairman of the National Medical Council based on the actual needs of the Council.

Members of the National Medical Council are appointed and dismissed by the Chairman of the National Medical Council and work on a concurrent basis. The term of office for Council Members is five years and may be reappointed.

2. Specialized Departments of the Council:

a) The Council has specialized departments to carry out its tasks. Members of these specialized departments include some Council Members and experts from educational institutions in the health sector, hospitals, and professional associations operating in the healthcare field;

b) Members of the specialized departments work on a concurrent basis. The Head and Deputy Head of the specialized departments are Council Members;

c) The specialized departments of the Council include: the Department for Developing Assessment Tools for Professional Competence in Medical Practice and Treatment; the Department for Organizing Inspection and Evaluation of Professional Competence in Medical Practice and Treatment; the Legal Affairs Department.

3. Office of the National Medical Council:

a) The Office of the National Medical Council is a public service unit directly under the Ministry of Health established by the Minister of Health in accordance with the provisions of the law;

b) The Office of the National Medical Council assists the Council and the specialized departments of the Council;

c) The Office of the National Medical Council is responsible for ensuring material conditions, equipment, and funding for the Council and the specialized departments of the Council to operate in accordance with regulations;

d) The Office of the Council has a Director and Deputy Directors; the number of Deputy Directors is implemented according to the provisions of the law. The Minister of Health appoints, reappoints, and dismisses the Director and Deputy Directors of the Council;

đ) The Office operates in accordance with the Regulations on Organization and Operations issued by the Minister of Health.

Article 4. Tasks and Authorities of the Chairman, Vice Chairmen, Members of the Council, and Specialized Committees of the Council

1. Tasks and Authorities of the Chairman of the Council:

a) Assign tasks to the Vice Chairmen and Members of the Council; assign or delegate a Vice Chairman of the Council to direct and resolve the Council's affairs in his absence;

b) Issue the annual and phased activity plans of the Council;

c) Convene, chair, and conclude meetings of the Council; direct the Vice Chairmen, Members of the Council, specialized committees, and the Council's Office to organize the implementation of tasks within the Council's functions and responsibilities;

d) Sign national medical council documents including Decisions on personnel work of the Council after discussion and approval by the Council or its leadership (Chairman, Vice Chairmen): Decision on the number of Council Members, appointment, reappointment, removal of Council Members; Decision on appointment, removal of Committee Heads, Deputy Heads, and members of specialized committees;

đ) Decide on the expenditure of the Council's operational funds and organizations under the Council as stipulated in this Regulation according to the provisions of the law;

e) Perform the tasks of a Council Member.

2. Tasks and Authorities of the Acting Vice Chairman of the Council:

a) Represent the Chairman of the Council in directing, managing, operating, and resolving regular Council affairs according to the Chairman's assignment and be responsible to the Chairman for the assigned work;

b) Be responsible for overseeing, directing, and urging the Council's Office and specialized committees according to the Chairman's assignment;

c) Sign and bear legal responsibility for documents authorized by the Chairman of the Council;

d) Perform the tasks of a Council Member;

đ) Perform other tasks and authorities as assigned by the Chairman of the Council.

3. Tasks and Authorities of the Vice Chairman of the Council who concurrently serves as Director of the Department of Medical Examination and Treatment and Director of the Department of Science, Technology, and Training:

a) Assist the Chairman of the Council in managing and operating Council affairs and directly direct and urge specialized committees according to the Chairman's assignment;

b) Sign and bear legal responsibility for documents authorized by the Chairman of the Council;

c) Perform the tasks of a Council Member;

d) Perform other tasks and authorities as assigned by the Chairman of the Council.

4. Tasks and Authorities of Council Members:

a) Carry out work and tasks according to the Chairman's assignment and be responsible to the Chairman for the assigned duties and authorities;

b) Attend and contribute opinions at Council meetings; propose meeting contents and Council activity plans;

c) Participate in Council and specialized committee work according to the Chairman's assignment;

d) Implement information and document confidentiality according to the law and directives from competent authorities;

đ) Council Members are provided with necessary information and documents; their working conditions are guaranteed according to regulations to perform assigned tasks;

e) Perform other tasks and authorities as assigned by the Chairman of the Council.

5. Tasks and Authorities of the Committee for Building Assessment Tools for Professional Competence in Medical Examination and Treatment:

a) Lead and coordinate with health training institutions, hospitals, and professional associations to build, update, and supplement assessment tools for professional competence in medical examination and treatment for Council approval;

b) Develop test creation procedures and structures for assessing professional competence in medical examination and treatment, to be submitted to the National Medical Council for issuance;

c) Perform other tasks as assigned by the Chairman of the Council.

6. Tasks and Authorities of the Committee for Organizing and Assessing Professional Competence in Medical Examination and Treatment:

a) Develop Regulations on assessing professional competence in medical examination and treatment for the National Medical Council to approve and submit to the Minister of Health for approval;

b) Develop criteria for facilities qualified to host assessments of professional competence in medical examination and treatment for the National Medical Council to approve and submit to the Minister of Health for approval;

c) Conduct evaluations and select facilities to host assessments of professional competence in medical examination and treatment according to approved criteria, to be submitted to the Council for review and approval;

d) Develop plans for organizing assessment periods of professional competence in medical examination and treatment, to be submitted to the National Medical Council for approval;

đ) Serve as the main coordinator and collaborate with relevant units to implement assessment periods of professional competence in medical examination and treatment according to the approved plan;

e) Compile and submit to the Chairman of the National Medical Council for approval the results of assessment periods of professional competence in medical examination and treatment and issue certificates confirming successful completion of the assessment period;

g) Perform other tasks as assigned by the Chairman of the Council.

7. Tasks and Authorities of the Legal Affairs Committee:

a) Lead and coordinate with relevant units to advise the National Medical Council on legal issues related to the Council's functions, responsibilities, and activities; assist the Council in reviewing legal provisions, documents before approval and issuance;

b) Lead and coordinate with relevant units to receive and resolve complaints and reports regarding the results of assessments of professional competence in medical examination and treatment;

c) Assist the Council in performing supervisory functions over Council activities;

d) Perform other tasks as assigned by the Chairman of the Council.

8. Tasks and Authorities of the National Medical Council Office are stipulated in the Regulation on the Organization and Operation of the National Medical Council Office issued by the Minister of Health.

Article 5. Principles of Operation

1. The Council operates under the principles of collectivity, democracy, independence, transparency, and openness when performing its tasks, ensuring compliance with legal regulations. Open and democratic exchanges and discussions are conducted to make decisions on issues related to the Council's activities. Important matters requiring open and democratic discussion and solicitation of opinions from the Council before the Chairman signs the issuance document include:

a) Approving the set of tools for assessing medical practice capabilities; approving the examination question-setting process and structure for the medical practice capability assessment examination;

b) Approving the draft Regulation on the assessment of medical practice capabilities; criteria for examination venues for the assessment of medical practice capabilities before submitting to the Minister of Health for approval;

c) Approving the list of examination venues for the assessment of medical practice capabilities that meet the approved criteria;

d) Approving the draft regulation on the collection, payment, management, and use of costs for the assessment of medical practice capabilities before submitting to the Minister of Health for approval;

đ) Approving personnel-related matters of the Council: number of Council members; appointment, reappointment, and removal of the Vice-Chairman, Council members; selection and appointment of Department Heads and Deputy Department Heads;

e) Approving the duties and powers of specialized departments and internal regulations of the National Medical Council;

g) Approving the results of the medical practice capability assessment examination;

h) Other matters deemed necessary by the National Medical Council for discussion.

2. Meetings of the Council shall only be held if at least two-thirds of the total number of Council members attend. The Council organizes regular meetings once a month or extraordinary meetings upon request of the Chairman or more than half of the total number of Council members to discuss and decide on issues related to the Council's activities. Regular or extraordinary meetings of the Council may be conducted through direct meetings, online meetings, or written consultations.

The Council convenes and collectively discusses resolutions, work plans, and other important matters that must be discussed and agreed upon by Council members at the meeting. In cases where voting is required, the Council's conclusions and resolutions must be approved by more than 50% of the total number of Council members including the Chairman, Vice-Chairmen, and Council members (hereinafter referred to as Council members). If the votes reach 50%, the proposal of the Chairman will be implemented. Council members have the right to retain their opinions but must still comply with the Council's conclusions and resolutions that have been adopted.

3. The Chairman directs and oversees all activities and operations of the Council within the scope of its functions and responsibilities as prescribed by law; directly directs and oversees important tasks and strategic issues in all areas of the Council's activities.

The Chairman assigns tasks to Vice-Chairmen, Council members, specialized departments, and the Council Office, ensuring the full performance of the Council's functions and responsibilities as prescribed by law.

Vice-Chairmen and Council members proactively carry out tasks within their assigned scope and are responsible to the Chairman and the law for their decisions.

Article 6. Work Relationships

The Council is an independent organization that collaborates and supports ministries, sectors, local authorities, and professional associations operating in the healthcare field to fulfill its functions and tasks.

1. Relationship between the Council and the Ministry of Health:

a) The Council is an independent organization that collaborates and supports the Ministry of Health and units under the Ministry of Health;

b) The Council is responsible for providing relevant information and data on the inspection and evaluation of medical practice capabilities to the Ministry of Health after each inspection period or upon request.

2. Relationship between the Council and educational institutions in the health sector, medical examination and treatment facilities, and professional associations operating in the healthcare field: The Council collaborates with educational institutions in the health sector, medical examination and treatment facilities, and professional associations within the healthcare field in developing tools and organizing inspections and evaluations of medical practice capabilities.

3. Relationship between the Council and other organizations and individuals inside and outside the healthcare sector: The Council cooperates and collaborates with agencies, sponsors, units, and individuals both within and outside the healthcare sector to perform assigned functions and tasks.

Chapter II

STANDARDS, CONDITIONS, PROCEDURES FOR APPOINTMENT, REAPPOINTMENT, RESIGNATION, REMOVAL, SUPPLEMENTATION, AND REPLACEMENT OF THE CHAIRMAN, VICE CHAIRMAN, AND COUNCIL MEMBERS

Article 7. Standards and Conditions for Appointment and Reappointment of the Chairman, Vice Chairmen, and Council Members

1. General Standards:

a) Possess good moral character and lifestyle, be loyal to the Party's guidelines and policies, and comply with state laws;

b) Have sufficient health and time to carry out the duties of Council members;

c) Not be subject to disciplinary action or criminal prosecution related to the healthcare field; not be under consideration for disciplinary action, complaint resolution, or accusation handling according to the law on discipline, complaints, and accusations.

2. Specific Standards for the Deputy Chairman:

a) Hold a Doctorate degree in a field within the healthcare domain;

b) Have management experience, having held a managerial position at units under or directly affiliated with a ministry with a position allowance of 1.0 or higher, or currently holding the position of Chairman or Vice Chairman of a professional association operating in the healthcare field;

c) Have outstanding achievements in the healthcare field recognized by the competent authority.

3. Specific Standards for Council Members:

a) Member representing medical examination and treatment facilities: hold a Doctorate degree or a second-level specialty degree in a field or specialty within the healthcare domain; currently working at a medical examination and treatment facility serving as a practical training site in the healthcare field; have at least 15 years of experience practicing medical examinations and treatments;

b) Member representing educational institutions: hold a Doctorate degree in a field within the healthcare domain; currently working at an educational institution training in the healthcare field; have at least 15 years of teaching experience in the healthcare field;

c) Member representing government management agencies: have at least 10 years of work experience in the field of government management of medical examinations and treatments, or in training, development, and human resource management in healthcare, or in healthcare legal affairs;

d) Member representing professional associations operating in the healthcare field: hold a Doctorate degree or a second-level specialty degree in a field or specialty within the healthcare domain specifically for nursing/midwifery/medical technology requiring a master’s degree or higher; be a member of a professional association operating in the healthcare field; have at least 15 years of experience practicing medical examinations and treatments, or have at least 15 years of experience in developing and teaching curricula in the healthcare field.

4. Standards and Conditions for Reappointment:

a) Successfully complete the duties during the term as Deputy Chairman or Council Member;

b) Be in good health to fulfill assigned tasks;

c) Not be subject to criminal prosecution related to the healthcare field; not be under consideration for disciplinary action, complaint resolution, or accusation handling according to the law on discipline, complaints, and accusations.

Article 8. Procedures and formalities for appointing, reappointing, resigning, dismissing, supplementing, and replacing the Chairman, Vice Chairmen, and Members of the Council

1. Appointment of the Chairman, Vice Chairmen, and Members of the Council:

a) The Chairman and two Vice Chairmen concurrently holding positions: The Minister of Health shall submit to the Prime Minister for appointment one Leader of the Ministry of Health as the Chairman of the Council and for concurrent appointment of the Director of the Department of Medical Examination and Treatment, and the Director of the Department of Science, Technology and Training under the Ministry of Health as Vice Chairmen of the Council;

b) The Acting Vice Chairman of the Council: The Chairman of the Council introduces specific candidates for the position of Acting Vice Chairman and submits along with relevant documents and files for the Minister of Health to review and submit to the Prime Minister for approval according to regulations;

c) The Ministry of Home Affairs is responsible for assisting the Prime Minister in reviewing the appointment dossier of the Chairman and Vice Chairmen of the Council.

d) Members of the Council:

Based on the structure, criteria, and conditions for appointing Members of the Council, the Head of the Council's Office proposes personnel plans for the appointment of Members of the Council to the Chairman of the Council. After obtaining agreement on the policy, the implementation process is as follows:

- The Head of the Council's Office meets with the proposed appointee to discuss job requirements and tasks.

- Discuss opinions with the leadership of the agency or unit where the proposed appointee works regarding the appointment policy; seek comments and evaluations from the human resources management agency on the appointment of National Medical Council members for the personnel.

- During the initial phase when the Council has just been established and there are no Members of the Council, the Chairman, Vice Chairmen of the Council discuss, comment, evaluate, and vote by secret ballot on the proposed appointees. The proposed appointees must obtain more than 50% of the total number of Council leaders' agreement; if the proposed appointees reach 50%, the plan proposed by the Chairman of the Council will be implemented.

Once there are Members of the Council, the appointment and reappointment of Members of the Council will be solicited from all members of the Council (including the Chairman, Vice Chairmen, and Members of the Council). The proposed appointees must obtain more than 50% of the total number of Council members' agreement; if the proposed appointees reach 50%, the plan proposed by the Chairman of the Council will be implemented.

- The National Medical Council Office completes the dossier for the Chairman of the Council to issue the decision on appointing Members of the Council, clearly stating the personnel determination process and accompanying evidence, curriculum vitae, and written consent of the proposed appointee.

2. Reappointment of the Acting Vice Chairman and Members of the Council:

a) For the Acting Vice Chairman:

At least 90 days before the end of the term of the Acting Vice Chairman, the Council Office reports and seeks the Chairman of the Council's policy on reappointing the Acting Vice Chairman. After obtaining the Chairman of the Council's agreement, the implementation process is as follows:

- The proposed reappointed personnel prepare a self-assessment report on the performance of their duties during the term of office and provide written comments on the reappointment request.

- The Council discusses, comments, evaluates, and votes by secret ballot on the proposed reappointed personnel. The proposed reappointed personnel must obtain more than 50% of the total number of Council members' agreement; if the proposed reappointed personnel reach 50%, the plan proposed by the Chairman of the Council will be implemented.

- The Council seeks opinions from the competent authority managing human resources on the reappointment of the personnel.

- The Council submits the Petition and dossier for reappointing the Acting Vice Chairman of the Council to the Ministry of Health for submission to the Prime Minister for consideration and decision.

- The Ministry of Home Affairs is responsible for assisting the Prime Minister in reviewing the dossier for reappointing the Acting Vice Chairman of the Council.

b) For Members of the Council:

At least 90 days before the end of the term of the Member of the Council, the National Medical Council Office reports and seeks the Chairman of the Council's opinion on reappointing the Member of the Council. After obtaining agreement on the policy, the National Medical Council Office implements the reappointment process as follows:

- The Member of the Council prepares a self-assessment report on the performance of their duties during the term of office and sends it to the National Medical Council Office for consolidation.

- The Council discusses, comments, evaluates, and votes by secret ballot on the proposed reappointed personnel. The proposed reappointed personnel must obtain more than 50% of the total number of Council members' agreement; if the proposed reappointed personnel reach 50%, the plan proposed by the Chairman of the Council will be implemented.

- The National Medical Council Office seeks opinions from the competent authority managing human resources on the reappointment of the personnel.

- The National Medical Council Office completes the dossier for the Chairman of the Council to consider and decide on the reappointment of the Member of the Council.

3. Dismissal of the Chairman, Vice Chairmen, and Members of the Council:

a) The dismissal of the Chairman, Vice Chairmen, and Members of the Council shall be carried out in the following cases:

- A written request from an individual to withdraw from the Council.

- Being restricted in civil capacity; not having sufficient health to perform the assigned work.

- Violating laws seriously or currently serving a court sentence.

- Violating the Council's Regulations; failing to attend three consecutive meetings of the Council without a valid reason; failing to complete tasks at the Council; having more than 50% of the total number of Council members propose in writing the dismissal; or other cases stipulated in the internal regulations of the Council.

- The Council votes on the dismissal of personnel by secret ballot. The proposed dismissed personnel must obtain more than 50% of the total number of Council members' agreement; if the proposed dismissed personnel reach 50%, the plan proposed by the Chairman of the Council will be implemented.

b) In the case of resignation by the Chairman, Vice Chairmen, and Members of the Council, the following procedures apply:

- During the period of being appointed as the Chairman, Vice Chairmen, and Members of the Council, if an individual feels they lack the qualifications to fulfill the tasks or wishes to resign for other reasons, they should submit a resignation letter detailing the reasons and wishes to the Chairman of the Council for consideration.

- When the resignation letter has not been accepted by the Chairman of the Council, the Council member must continue to perform the assigned tasks and responsibilities.

- Within thirty days from the date of receipt of the resignation letter, the Chairman of the Council must examine the resignation letter and discuss and reach consensus with the Vice Chairmen of the Council on accepting or not accepting the resignation of the Council member; thereafter, instruct the National Medical Council Office to report to the Council for secret ballot voting. The resignation must be approved by more than fifty percent of the total number of Council members; in case the ratio reaches fifty percent, it shall be implemented according to the proposal of the Council Chairman.

4. Supplementing and replacing the Chairman, Vice Chairmen, and Members of the Council:

In cases where the Council is lacking Leadership or Members, the Council Chairman shall direct the selection of replacement personnel based on the composition of the missing Leadership or Members, in accordance with the provisions of the law and this Regulation. The procedures and files for supplementing and replacing Leadership and Members of the Council shall be carried out in accordance with the appointment procedures and files for Leadership and Members of the Council stipulated in this Regulation.

5. Appointment and reappointment files for the Chairman, Vice Chairmen, and Members of the Council:

a) A proposal regarding the appointment or reappointment;

b) Minutes of meetings and ballot counting records during the appointment or reappointment process;

c) Curriculum vitae of the personnel in form 2C/TCTW-98, confirmed by the directly managing unit, with a color photograph measuring 4x6 cm taken within six months;

d) A unified document on the appointment or reappointment of the Council member from the directly managing and using unit;

đ) An agreement on the appointment or reappointment from the personnel;

e) An assessment and evaluation of the performance of the duties and responsibilities of the proposed appointee or reappointee by the Council Chairman;

g) A self-assessment and evaluation of the performance of duties and responsibilities during the term of office of the proposed appointee or reappointee;

h) Health certificate.

Chapter III

STANDARDS AND PROCEDURES FOR APPOINTING AND REMOVING THE HEADS, DEPUTY HEADS, AND MEMBERS OF SPECIALIZED BOARDS

Article 9. Standards for Heads, Deputy Heads, and Members of Specialized Boards

1. General Standards:

a) Possess good moral character and lifestyle, be loyal to the Party's guidelines and policies, and comply with state laws;

b) Possess sufficient health and time to perform the duties of the specialized board;

c) Not be subject to disciplinary action or criminal prosecution related to the healthcare field; not be under consideration for disciplinary action, complaint resolution, or accusation handling according to the law on discipline, complaints, and accusations.

2. Specific Standards:

a) Heads and Deputy Heads of specialized boards:

- The Head and Deputy Head of specialized boards are concurrently held by Members of the National Medical Council.

- Hold a Doctorate degree or a second-level specialty in a field or specialty related to health, except for the Legal Board, where the Head and Deputy Head must have a bachelor's degree or higher in law.

- Have management experience suitable for the work of the specialized board, having previously held a managerial position at units under or directly subordinate to a ministry, with a position allowance of 0.8 or higher, or currently holding the position of President or Vice President of a professional association in the healthcare sector.

b) Members of specialized boards:

- Hold a master's degree or higher in a field related to health, except for the Legal Board, which requires a bachelor's degree or higher in law.

- Have directly participated in teaching or practicing medical diagnosis and treatment for at least ten years; for the Legal Board, there must be at least five years of experience in healthcare legal affairs.

Article 10. Procedures for Appointing and Removing Heads, Deputy Heads, and Members of Specialized Boards

1. Procedure for appointing Heads and Deputy Heads of specialized boards:

Based on the standards for Heads and Deputy Heads of specialized boards, the Chairman and Vice Chairmen of the National Medical Council shall discuss and agree on personnel to recommend for appointment as Heads and Deputy Heads of specialized boards. After reaching consensus, the Chairman of the National Medical Council shall instruct the National Medical Council Office to submit the recommended personnel to the National Medical Council for approval to appoint Heads and Deputy Heads of specialized boards.

The recommended personnel must be approved by more than fifty percent of the Council members; if the ratio reaches fifty percent, it shall be implemented according to the proposal of the Council Chairman.

The Director of the National Medical Council Office shall submit to the Council Chairman for decision on the appointment of Heads and Deputy Heads of specialized boards.

2. Procedure for appointing Members of specialized boards:

Members of the National Medical Council and the Director of the National Medical Council Office shall introduce candidates who meet the prescribed standards to join the specialized board and attach their scientific curriculum vitae.

The National Medical Council Office shall compile and review the list of introduced candidates to ensure they meet the prescribed standards; then issue a document to exchange with the personnel management unit and candidates regarding joining the National Medical Council's specialized board.

After obtaining written consent from the personnel management unit and candidates, the National Medical Council Office shall submit to the Chairman and Vice Chairmen of the Council for approval of the list of personnel for Members of the specialized board. The recommended personnel must be approved by more than fifty percent of the total number of Council Leadership; if the ratio reaches fifty percent, it shall be implemented according to the proposal of the Council Chairman.

The Director of the National Medical Council Office shall submit to the Council Chairman for approval of the Decision on the appointment of Members of the specialized board.

3. Appointment files:

a) A proposal regarding the appointment;

b) Minutes of meetings and ballot counting records during the appointment process;

c) Scientific curriculum vitae of the personnel;

d) A unified document from the directly managing and using unit;

đ) An agreement on the appointment from the personnel;

e) Health certificate.

4. Removal of Heads, Deputy Heads, and Members of specialized boards:

The removal of Heads, Deputy Heads, and Members of specialized boards shall be carried out in the following cases:

a) There is a written request from the individual to cease performing duties at the specialized board;

b) Restricted civil capacity; insufficient health to undertake assigned tasks;

c) Serious violation of the law or currently serving a court sentence;

d) Violation of the Working Regulations of the specialized board; absence from three consecutive meetings without a valid reason; failure to complete assigned tasks; a written recommendation from the Head; or other cases specified in the internal regulations of the Council and the specialized board.

d) The Council votes and decides on the removal of the Head and Deputy Head of the specialized board by secret ballot. The personnel to be removed must obtain more than 50% of the total number of Council members' agreement; in case the personnel reaches 50%, it shall be implemented according to the proposal made by the Chairman of the Council;

e) The Chairman and Vice Chairmen of the Council discuss, vote and decide on the removal of members of the specialized board by secret ballot. The personnel to be removed must obtain more than 50% of the total number of Council Leaders' agreement; in case the personnel reaches 50%, it shall be implemented according to the proposal made by the Chairman of the Council.
