ISSUING REGULATIONS ON ECONOMIC AND TECHNICAL STANDARDS FOR DNA FORENSIC SERVICES TO IDENTIFY THE IDENTITY OF REMAINS OF UNKNOWN SOLDIERS
THE MINISTER OF LABOR, WAR INVALIDS AND SOCIAL AFFAIRS
Pursuant to Decree No.Decision No. 62/2022/NĐ-CP September 12, 2022 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Labor - Invalids and Social Affairs;
Pursuant to Decree No.131/2021/NĐ-CP December 30, 2021 Government Decree detailing and providing implementation measures for the Ordinance on Preferential Treatment for Persons Contributing to the Revolution;
Pursuant to Decree No.55/2023/NĐ-CP July 21, 2023 Government Decree amending and supplementing certain articles of the Government Decree number75/2021/NĐ-CP July 24, 2021 Government Decree stipulating the level of allowances, subsidies, and preferential policies for persons contributing to the revolution;
Pursuant to Decree No.60/2021/NĐ-CP June 21, 2021 Government Decree stipulating the financial autonomy mechanism for public service units;
Pursuant to Decree No.73/2024/NĐ-CP June 30, 2024 Government Decree stipulating the base salary and bonus system for civil servants, public officials, and military personnel;
Pursuant to Circular No. 23/2023/TT-BTC April 25, 2023 of the Ministry of Finance guiding the management, depreciation, and amortization of fixed assets at agencies, organizations, units, and fixed assets entrusted by the State to enterprises without being considered part of the State's capital in the enterprise;
Pursuant to Circular No. 119/2023/TT-BQP December 22, 2023 of the Ministry of National Defense promulgating the procedure for identifying the identity of remains of unknown soldiers;
Pursuant to Decision No. 1771/QĐ-LĐTBXH dated December 26, 2016 of the Minister of Labor, Invalids and Social Affairs regarding the issuance of the Regulation on the management of economic and technical standards under the jurisdiction of the Ministry of Labor, Invalids and Social Affairs;
At the proposal of the Director of the Department of Persons Contributing to the Revolution, the Minister of Labor, Invalids and Social Affairs issues this Circular on economic and technical standards for implementing DNA forensic services to identify the identity of remains of unknown soldiers.
Article 1. Scope of Regulation
This Circular stipulates economic and technical standards for implementing DNA forensic services to identify the identity of remains of unknown soldiers.
Article 2. Applicability
This Circular applies to agencies and organizations commissioned by the Ministry of Labor, Invalids and Social Affairs to perform DNA forensic services on samples of remains of unknown soldiers and samples of relatives of soldiers to determine the identity of remains of unknown soldiers.
Article 3. Explanation of Terms
1. DNA forensic service is a public service using state budget funds within the social security sector.
2. Economic and technical standards for DNA forensic services to identify the identity of remains of unknown soldiers are the amount of consumption of labor factors, equipment, and materials required to complete the analysis of one DNA sample (one sample of remains of an unknown soldier or one sample of a relative of a soldier).
Article 4. Content of Standards
The content of economic and technical standards for DNA forensic services to identify the identity of remains of unknown soldiers includes economic and technical standards for mitochondrial DNA analysis of samples of remains of unknown soldiers and economic and technical standards for mitochondrial DNA analysis of samples of relatives of soldiers (two Appendices attached).
Article 5. Implementation Provisions
This Circular takes effect from April 13, 2025.
Article 6. Implementation Organization
During the implementation process, if there are any difficulties, they should be reported promptly to the Ministry of Labor, Invalids and Social Affairs (through the Department of Persons Contributing to the Revolution) for consideration and resolution within their authority or reporting to the competent authority for resolution.
