CIRCULAR
Guidelines for constructing new office premises
Pursuant to point (b) Section 5 Part II of Decision No. 984/TTg dated December 30, 1996 of the Prime Minister on certain policies and measures for managing the economic and social development plan and state budget estimate for 1997, the Ministry of Planning and Investment provides specific guidelines regarding investment in the construction of office premises from state budget funds as follows.
1. Given the limited state budget funds, the Prime Minister has decided to restrict expenditures on constructing new offices for administrative and public service agencies, Party organizations, and mass organizations funded by state budget allocations. Agencies should rearrange and utilize existing office premises and equipment efficiently to serve their operations. The Prime Minister delegates the Minister of Planning and Investment to approve the construction of office premises based on a thorough examination of the needs and construction funding sources, and to report back to the Prime Minister.
2. State budget construction investment funds may be considered for constructing office premises for the following entities.
a) At the Central Level:
- Offices of Party organizations, National Assembly, and Government.
- Important political and social mass organizations: United Front, General Confederation of Labor, Communist Youth Union, Women's Union, Farmers' Association, Veterans' Association, Friendship Associations with foreign countries...
- Offices of central vertical agencies directly invested in and managed by the Central Government: Provincial, City, District, and County Courts, Military Prosecution and Military Courts, Provincial and City Statistical Offices, Treasury and Tax Systems... Provincial Development Investment Departments, Customs Offices; Social Insurance System.
b) In provinces and centrally-administered cities, the Provincial Party Committee, People's Council, local Departments, Bureaus, and Sectors, County Party Committees, and County People's Councils.
c) Offices of provincial military commands and public security departments (financed through the national defense and security budget).
3. For the time being, given the limited state budget construction investment funds, priority will be given to constructing new offices only for newly established entities that have not yet secured stable working areas, or those currently using offices with severely deteriorated structures posing safety risks to users, or whose working area is less than 50% of the officially set design standards (average area below 4 square meters per person).
Severely deteriorated structures posing safety risks must be confirmed by authorized state construction appraisal agencies. Specifically, central agencies in Hanoi must obtain confirmation from the Construction Appraisal Department under the Ministry of Construction, while local agencies must obtain confirmation from the Construction Departments.
4. State budget construction investment funds will not be allocated for constructing transaction offices for state-owned enterprises, professional associations, or for township and ward offices.
5. Regarding the design standards for working area, according to Decision No. 150/CP dated June 10, 1997 of the Government Council, until a new decision is issued by the Prime Minister.
6. The procedures for agreeing to construct office premises are as follows:
a) Agreement on the policy to construct: After receiving comprehensive reports on the current total office area, usage status, staffing levels (as stipulated by organizational personnel agencies), requirements for new construction or renovation, and the ability to balance state budget investment funds, the Ministry of Planning and Investment will review and issue an agreement document for ministries, agencies at the level of ministries, and localities to proceed with preparatory steps as prescribed by the Government in Decree No. 42/CP dated July 16, 1996.
b) Agreement on the list of new construction projects to commence within the planning period.
The Ministry of Planning and Investment will examine and submit to the Prime Minister for approval projects in Group A, and agree upon projects in Group B.
Projects in Group C will be closely examined by the Ministry of Planning and Investment for their necessity and budget capacity, and a list of new commencement projects will be agreed upon annually, simultaneously reporting to the Prime Minister on the resolution of these cases.
7. Specifically, for the implementation of construction investment plans for 1997 assigned according to Decision No. 985/TTg dated December 30, 1996 and Decision No. 349/BKH-TH dated December 31, 1996, as follows:
+ Projects in Groups A and B will be implemented according to the plan.
+ Continuing projects in Group C belonging to central agencies and localities will be arranged for implementation according to the allocated capital structure and ensure that more than 60% of the investment capital is allocated to projects and project components completed in 1997.
- New projects in Group C must register with the Ministry of Planning and Investment before May 15, 1997, accompanied by investment decision documents, approved design estimates, and reports on the total current office area, usage status, and agency staffing levels for verification of necessity. The Ministry of Planning and Investment will agree in writing before construction can commence and funds can be released.
Particularly for new projects in Group C in newly divided provinces such as Bac Can, Binh Ninh, Vinh Phuc, Hung Yen, Ha Nam, Quang Nam, Binh Phuoc, Bac Lieu, it is recommended that there be a master plan for constructing provincial agency offices, gradually implementing construction year by year, allowing the implementation of the construction plan but also registering according to the above deadline.
- New projects in Group C starting in 1997 that have completed all necessary construction procedures need only register once (by May 15, 1997 at the latest). If the procedures are not followed correctly or deadlines are missed, the Ministry of Planning and Investment will report to the Prime Minister to adjust the capital allocation for other projects in July 1997. Projects lacking required procedures should complete them and be included in the 1998 plan.
8. Based on the investment targets outlined in point 2, central and local agencies must submit documents proposing new office construction projects expected to start in the 1998 plan, including explanations of the current total office area, usage status, agency staffing levels, and additional area requirements for the Ministry of Planning and Investment to agree on the investment policy in the third quarter of 1997.
Only prepare for investment and draft budget design for projects in Group C that have been agreed upon in writing by the Ministry of Planning and Investment.
- Projects in Group C shall be constructed at most within two years. In cases where it is difficult to balance state budget funds, new construction must be firmly halted. Based on the registration of ministries and localities in the first quarter, the Ministry of Planning and Investment will announce the approved list of projects to commence construction in the year.
9. In May 1997, the Ministry of Planning and Investment will compile and report to the Prime Minister the situation regarding the resolution of investment and construction of office premises in 1997. In October 1997, compile and report the forecast for handling the investment in office premises to be recorded in the plan for 1998.
