REGULATIONS ON THE ANNOUNCEMENT OF COMPLIANCE WITH STANDARDS AND REGULATIONS AND METHODS FOR ASSESSING COMPLIANCE WITH STANDARDS AND TECHNICAL REGULATIONS

Circular No. 28/2012/TT-BKHCN dated December 12, 2012, issued by the Minister of Science and Technology, on the announcement of compliance with standards, regulations, and methods for assessing compliance with standards and technical regulations, which took effect from January 27, 2013, was amended and supplemented by:rime Minister cCircular No. 02/2017/TT-BKHCN dated March 31, 2017, issued by the Minister of Science and Technology, amending and supplementing certain articles of Circular No. 28/2012/TT-BKHCN dated December 12, 2012, issued by the Minister of Science and Technology, on the announcement of compliance with standards, regulations, and methods for assessing compliance with standards and technical regulations, which took effect from May 15, 2017.

Pursuant to the Law on Standards and Technical Regulations dated June 29, 2006;

Pursuant to the Law on Product Quality and Commodities dated November 21, 2007;

Decree No. 1Decision No. 132/2008/NĐ-CP dated December 31, 2008, of the Government detailing the implementation of certain provisions of the Law on Product Quality;

The Minister of Science and Technology hereby stipulates on the announcement of compliance with standards, the announcement of compliance with regulations, and methods for assessing compliance with standards and technical regulations.of the Government stipulating functions, tasks, powers, and organizational structure of the Ministry of Home AffairsThis Circular stipulates on the announcement of compliance with standards, the announcement of compliance with regulations, and methods for assessing compliance with standards and technical regulations.

Pursuant to Decree No. 28/2008/NĐ-CP dated March 14, 2008, promulgated by the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Science and Technology;

Considering the proposal of the General Director of the Standardization, Metrology and Quality Control Department;

This Circular applies to organizations, individuals, and management agencies related to activities of assessing compliance, announcing compliance with standards, and announcing compliance with regulations.No. Article 1. Announcement of Compliance with Standardsurinary catheter is the act of organizations and individuals self-announcing products, goods, services, processes, and environments as being compliant with corresponding standards.1.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

Article 2. Applicability

is the act of organizations and individuals self-announcing products, goods, services, processes, and environments as being compliant with corresponding technical regulations.

Article 3. Explanation of Terms

In this Circular, the following terms are understood as follows:

Accredited Certification Body is an organization that has registered its certification activities according to the provisions of Decree No. 107/2016/NĐ-CP dated July 1, 2016, of the Government on conditions for operating conformity assessment services (hereinafter referred to as the accredited certification body).

4. Accredited Certification Body for Technical Regulation Conformity Assessment is an accredited certification body as stipulated in Clause 3 of this Article and designated by the competent authority to conduct conformity assessment activities (hereinafter referred to as the designated certification body).

3.2 Testing Organizationconducting testing activities for product quality and goodsurinary catheter hnationalis an organization that has registered its testing activities according to the provisions of Decree No. 107/2016/NĐ-CP dated July 1, 2016, of the Government on conditions for operating conformity assessment services. Sectoral Authorityis a specialized agency designated and entrusted by the Ministry managing the sector, field, People's Committee of province, centrally governed city to receive applications for the announcement of compliance with regulations submitted by organizations and individuals.

Article 4. Standard Compliance Mark, Regulation Compliance Markurinary catheter 1. Standard Compliance Mark and Its Use The standard compliance mark shall be defined by the accredited certification body regarding its shape, structure, expression method, and usage, granted to the certified object and must meet the following basic requirements:nationala) Clear and not easily confused with other marks;

5.3 b) Must fully display the symbol of the corresponding standard used as the basis for certification of compliance with standards. In case organizations and individuals announce compliance with standards based on self-assessment results, they do not need to define the shape, structure, expression method, and cannot use the standard compliance mark. technical 2. 6.4 a) The regulation compliance mark shall have a shape and size as prescribed in Appendix I of this Circular; b) The regulation compliance mark may be directly applied to products, goods, or packaging, or in technical documentation, or on labels attached to products, goods at visible and readable positions;无效c) The regulation compliance mark must ensure it is not easily erased or removed and reattached;

d) The regulation compliance mark can be enlarged or reduced but must maintain the correct ratio and basic size of the regulation compliance mark prescribed in Appendix I of this Circular and be recognizable to the naked eye;

đ) The regulation compliance mark must be designed and expressed in the same color, easily recognizable.

The conformity mark shall be defined by the registered certification organization regarding its shape, structure, expression, and usage, and must meet the following basic requirements:rime Minister cIt shall be granted to the certified conformity object and must satisfy the following requirements:

a) Ensuring clarity and not causing confusion with other marks;

b) Fully displaying the corresponding standard symbol used as the basis for conformity certification.

In cases where organizations or individuals announce conformity based on self-assessment results, they need not define the shape, structure, expression, and may not use the conformity mark.

2. Conformity mark and use of the conformity mark

a) The conformity mark has a shape and size as prescribed in Appendix I of this Circular;

b) The conformity mark can be directly applied to products, goods, packaging, technical documents, or labels attached to products or goods in easily visible and readable positions;

c) The conformity mark must ensure that it cannot be easily erased or removed and reattached;

d) The conformity mark can be enlarged or reduced but must maintain the correct ratio and basic size specified in Appendix I of this Circular and be recognizable to the naked eye;

đ) The conformity mark must be designed and expressed in the same color, easily recognizable.

Article 5. Methods for assessing conformity

1. The assessment of conformity shall be carried out according to one of the following methods:

a) Method 1: Testing typical samples;

b) Method 2: Testing typical samples and evaluating the production process; monitoring through testing samples taken from the market;

c) Method 3: Testing typical samples and evaluating the production process; monitoring through testing samples taken at the place of production combined with evaluating the production process;

d) Method 4: Testing typical samples and evaluating the production process; monitoring through testing samples taken at the place of production and on the market combined with evaluating the production process;

đ) Method 5: Testing typical samples and evaluating the production process; monitoring through testing samples taken at the place of production or on the market combined with evaluating the production process;

e) Method 6: Evaluating and monitoring the management system;

g) Method 7: Testing and evaluating batches of products or goods;

h) Method 8: Testing or kiinspecting all products or goods.

2. The contents, procedures, and principles for using the methods for assessing conformity are specified in Appendix II of this Circular.

Article 6. Application of methods for assessing conformity

1. The method for assessing conformity to standards applicable to specific types of products, goods, services, processes, or environments shall be selected by certification organizations or entities and individuals announcing conformity according to the methods for assessing conformity prescribed in Article 5 of this Circular. The chosen method for assessing conformity must be appropriate for the object being assessed to ensure the reliability of the conformity assessment results.

2. The method for assessing conformity to technical regulations applicable to specific products, goods, services, processes, or environments is stipulated in the corresponding technical regulations.

3. The method for assessing conformity must be specifically recorded on the certificate of conformity to technical regulations.

Chapter II

ANNOUNCEMENT OF CONFORMITY

Article 7. Principles of announcing conformity

1. The subject of announcing conformity is the product, good, service, process, or environment specified in the corresponding standard. Announcing conformity is a voluntary activity.national2. The announcement of conformity to the corresponding standard is based on:

a) The result of conformity certification issued by a registered certification organization or;

b) The result of self-assessment of conformity by the entity or individual announcing conformity.nationalTesting for conformity assessment purposes must be conducted at a registered testing organization.Article 8. Procedure for announcing conformity

The announcement of conformity is carried out in the following steps:policies1. Step 1: Assessing the conformity of the subject of the conformity announcement with the corresponding standard (hereinafter referred to as conformity assessment).nationala) The conformity assessment is performed by a registered certification organization (third party) or by the entity or individual announcing conformity (first party).

The conformity assessment is carried out according to the method for assessing conformity prescribed in Clause 1 of Article 6 of this Circular;nationalb) The result of the conformity assessment specified in Point a Clause 1 of this Article serves as the basis for the entity or individual announcing conformity.

2. Step 2: Registering the announcement conformity dossier with the Provincial or Municipal Standardization, Metrology, and Quality Control Agency where the entity or individual producing the goods has registered their business or trade registration (hereinafter referred to as the Agency).

The announcement of conformity is carried out in the following steps:

1. Step 1: Assessing the conformity of the announced object with the corresponding standard (hereinafter referred to as conformity assessment).

a) The conformity assessment is conducted by a registered certification organization (third party) or by the organization or individual announcing conformity (first party).

The conformity assessment is carried out according to the conformity assessment method prescribed in Clause 1 of Article 6 of this Circular;

b) The result of the conformity assessment as stipulated in Point a of Clause 1 of this Article serves as the basis for the organization or individual announcing conformity.

2. Step 2: Registering the conformity announcement file at the Provincial or Municipal Standard Measurement Quality Control Agency where the production organization or individual registers their business or trading operation (hereinafter referred to as the Agency).

Article 9. Documents for Registration of Standard Compliance Announcement

Organizations and individuals announcing standard compliance shall prepare two (2) sets of standard compliance announcement documents, one set to be submitted directly or sent via postal service to the Inspection Unit, and the other set to be retained by the organization or individual. The contents of the documents are specified as follows:

1. In cases where the standard compliance announcement is based on the results of third-party certification organizations (third party), the standard compliance announcement documents include:

a) A copy of the standard compliance announcement (in accordance with Model 2. CBHC/HQ stipulated in Appendix III of this Circular);

b) A certified true copy of the documents proving the production and business activities of the organization or individual making the standard compliance announcement (Business Registration Certificate, Business License, Business Household Registration, Investment Certificate, Decision on Establishment, or other documents as prescribed by law);

c) A certified true copy of the standards used as the basis for the announcement;rime Minister cn using as the basis for announcement;

d) A certified true copy of the Standard Compliance Certificate issued by the registered certification organization along with the conformity mark sample.

During the review process, if necessary, the original documents will be examined or additional certified copies may be requested.

2. In cases where the standard compliance announcement is based on self-assessment results of the producing and trading organizations or individuals (first party), the standard compliance announcement documents include:

a) A copy of the standard compliance announcement (in accordance with Model 2. CBHC/HQ stipulated in Appendix III of this Circular);

b) A certified true copy of the documents proving the production and business activities of the organization or individual making the standard compliance announcement (Business Registration Certificate, Business License, Business Household Registration, Investment Certificate, Decision on Establishment, or other documents as prescribed by law);

c) A certified true copy of the standards used as the basis for the announcement;

d) If the organization or individual making the standard compliance announcement has not been issued a certificate of conformity to management system standards (ISO 9001, ISO 22000, HACCP...) by a registered certification organization, then the organization's or individual's standard compliance announcement documents must include a production process accompanied by a quality control plan that has been established and implemented (in accordance with Model 1. KHKSCL stipulated in Appendix III of this Circular) and a management system monitoring plan;nationalđ) If the organization or individual making the standard compliance announcement has been issued a certificate of conformity to management system standards (ISO 9001, ISO 22000, HACCP...) by a registered certification organization, then the organization's or individual's standard compliance announcement documents must include a certified true copy of the Management System Conformity Certificate still in effect;

e) A self-assessment report (in accordance with Model 5. BCĐG stipulated in Appendix III of this Circular) accompanied by a certified true copy of the test result form within twelve (12) months from the date of submission of the standard compliance announcement documents of the registered testing organization.

Article 10. Processing of Standard Compliance Announcement DocumentsnationalStandard compliance announcement documents sent to the Inspection Unit are processed as follows:

During the review process, if necessary, the original documents will be examined or additional certified copies may be requested.

1. For incomplete standard compliance announcement documents as stipulated in Article 9 of this Circular, within three (3) working days from the date of receipt of the standard compliance announcement documents, the Inspection Unit shall notify in writing the organization or individual making the standard compliance announcement to supplement the required documents as stipulated in Article 9 of this Circular. If the standard compliance announcement documents are not supplemented fully within fifteen (15) working days from the date the Inspection Unit sends the notification, the Inspection Unit has the right to cancel the processing of these documents.

2. For complete standard compliance announcement documents as stipulated in Article 9 of this Circular, within five (5) working days from the date of receipt of the standard compliance announcement documents, the Inspection Unit must organize the verification of the completeness and validity of the standard compliance announcement documents as follows:nationala) In cases where the standard compliance announcement documents are complete and valid, the Inspection Unit shall issue a Notification of Receipt of Standard Compliance Announcement Documents to the organization or individual making the standard compliance announcement (in accordance with Model 3. TBTNHS stipulated in Appendix III of this Circular). The Notification of Receipt of Standard Compliance Announcement Documents shall have the same validity as the Standard Compliance Certificate issued by the registered certification organization or shall be valid for three (3) years from the date the leadership of the organization or individual signs to confirm the self-assessment report (for cases of self-assessment).

b) In cases where the standard compliance announcement documents are complete but invalid, the Inspection Unit shall notify in writing the organization or individual making the standard compliance announcement about the reasons for non-receipt of the documents.

2. For complete conformity announcement files as prescribed in Article 9 of this Circular, within five working days from the date of receipt of the conformity announcement file, the Agency must organize the verification of the validity of the conformity announcement file.nationaln announcement file to process as follows:nationala) In case the conformity announcement file is complete and valid, the Agency issues a Notification of Receipt of the Conformity Announcement File for the organization or individual announcing conformity (in accordance with Model 3. TBTNHS prescribed in Appendix III of this Circular). The Notification of Receipt of the Conformity Announcement File has the value of the conformity certificate issued by the registered certification organization or has a validity of three years from the date the leadership of the organization or individual signs to confirm the conformity assessment report (for cases where the organization or individual conducts self-assessment).

b) In case the conformity announcement file is complete but invalid, the Agency notifies the organization or individual announcing conformity in writing about the reasons for not accepting the file.nationaln announcement;nationaln announcement based on the results of third-party conformity certification, retain the conformity announcement file including original and copies of documents as prescribed in Clause 1 of Article 9 and the supervision evaluation file of the registered certification organization;

n announcement based on the results of self-assessment by the production and business organization or individual (first party), retain the conformity announcement file;

Article 11. Responsibilities of organizations and individuals publishing conformity declarations

1. Select conformity assessment methods appropriate to the subject of the conformity declaration to ensure the reliability of the assessment results.nationaln announcement to ensure the reliability of the assessment results.rime Minister cn announcement; maintaining quality control, testing, and periodic monitoring at the production and business premises of the organization or individual.

2. Continuously maintain and be responsible for the conformity of products, goods, services, processes, and environments that have been registered for publication of conformity declarations; maintain quality control, testing, and periodic monitoring at production and business establishments.nationaln announcement during circulation and use, the organization or individual must:

3. When discovering non-conformity with products, goods, services, processes, and environments that have been published for conformity declarations during circulation or use, organizations and individuals must:nationalb) Implement measures to address non-conformities;

a) Temporarily halt production and recall non-conforming products and goods circulating in the market if they pose a high risk to user safety; stop operation and exploitation of related processes, services, and environments when necessary;

4. Establish and retain the conformity announcement file as follows:

b) Implement measures to correct non-conformities;

n announcement based on the results of third-party conformity certification (third party), retain the conformity announcement file including original and copies of documents as prescribed in Clause 1 of Article 9 and the supervision evaluation file of the registered certification organization;

c) Provide written notification to the Inspection Unit about the results of correcting non-conformities before resuming the use, circulation, exploitation, and sale of products, goods, services, processes, and environments.nationaln announcement based on the results of self-assessment by the production and business organization or individual (first party), retain the conformity announcement file;

4. Establish and retain records of conformity declarations as follows:national5. Provide documentation proving the compliance of products, goods, services, processes, environments with the corresponding standards when requested by competent state authorities.nationala) In cases where conformity declarations are based on certification results from registered certification bodies (third parties), retain records of conformity declarations including original and copies of documents as stipulated in Clause 1, Article 9 and the surveillance assessment files of the registered certification body;

7. Reannounce when there is any change in the content of the previously registered conformity announcement file or any change in the characteristics of the announced products, goods, or services.

b) In cases where conformity declarations are based on self-assessment results from organizations and individuals engaged in production and business (first parties), retain records of conformity declarations including original and copies of documents as stipulated in Clause 2, Article 9 and self-surveillance assessment files of organizations and individuals according to surveillance plans.

Article 12. Principles of conformity announcementnationala) The conformity assessment is performed by a registered certification organization (third party) or by the entity or individual announcing conformity (first party).

Chapter III

5. Provide documentation proving the conformity of products, goods, services, processes, and environments with corresponding standards when requested by competent state agencies.

2. Sector management agencies determine product groups 2, develop national technical regulations accordingly, and establish management measures for conformity announcement in these national technical regulations after obtaining the consensus of the Ministry of Science and Technology.

6. Provide certified true copies of the receipt of conformity declaration registration forms to organizations and individuals trading in products, goods, services, processes, and environments.

4. When using the assessment results of foreign conformity assessment organizations, such organizations must be recognized under the law or designated by competent state management authorities.

7. Re-publish when there are any changes to the content of previously registered conformity declaration records or any changes in the features, functions, characteristics of declared products, goods, services.

n technical regulations, standards, organizations, and individuals must promptly report to specialized agencies and organize the handling and recall of such goods in accordance with the law.nationalCONFORMITY DECLARATION

Article 12. Principles of conformity declaration publication

1. The subjects of conformity declaration publication are products, goods, services, processes, and environments specified in national technical regulations issued by sectoral ministries or local technical regulations issued by provincial People's Committees. Conformity declaration publication is a mandatory activity.

n announcement is complete and valid, the specialized agency issues a Notification of Receipt of the Conformity Announcement File for the organization or individual announcing conformity (in accordance with Model 3. TBTNHS prescribed in Appendix III of this Circular).

2. Sectoral ministries determine Group 2 products, establish corresponding national technical regulations, and management measures for conformity declaration publication after obtaining consensus from the Ministry of Science and Technology.

n announcement file has the value of the conformity certificate issued by the designated certification organization or has a validity of three years from the date the leadership of the organization or individual signs to confirm the conformity assessment report (for cases where the organization or individual conducts self-assessment).

3. The conformity declaration publication activity for imported goods as stipulated in this Circular is the implementation of state inspection regulations on the quality of imported goods by organizations and individuals.rime Minister cn assessment);

Article 13. Procedures for Announcement of Compliance

1. In cases where the announcement of compliance is based on self-assessment results:

a) For domestically produced products and goods:

- Organizations and individuals submit the announcement of compliance dossier in accordance with Article 14 of this Circular to the specialized agency for announcement of compliance based on their self-assessment results;

- After submitting the announcement of compliance dossier to the specialized agency, organizations and individuals are permitted to circulate goods.

b) For imported goods:

- Organizations and individuals register for quality inspection of imported goods with the following information: name of importing organization or individual, address, telephone, fax; name of goods, brand, type; technical characteristics; origin, manufacturer; quantity, volume; import port; time of import; contractdevelopment(Contract) (; list of goods; (Packing list) (; invoice; from ((Invoice); ; bill of lading ((Bill of Lading); ; declaration of imported goods; technical regulation number; commitment that the product and goods comply with technical regulations and published standards and fully bear legal responsibility for the quality of the product and goods.

Within one working day, the specialized agency confirms the registration of quality inspection of imported goods by organizations and individuals on their registration form;

- Organizations and individuals submit the registered form with confirmation from the specialized agency to the customs authority to be allowed to clear goods;

- Within fifteen working days from the date of clearance of goods, organizations and individuals must submit the self-assessment results in accordance with point b, Clause 1, Article 14 of this Circular to the specialized agency.

Organizations and individuals must fully bear responsibility for the self-assessment results and ensure that goods comply with technical regulations and published standards. In case goods do not comply with technical regulations and published standards, organizations and individuals must promptly report to the specialized agency and simultaneously organize the handling and recall of these goods in accordance with the law.

2. In cases where the announcement of compliance is based on the assessment results of a certification body that has been registered or recognized (hereinafter referred to as the certification body):

a) For domestically produced products and goods:

- Organizations and individuals submit the announcement of compliance dossier in accordance with Article 14 of this Circular to the specialized agency for announcement of compliance based on the assessment results of the certification body;

- After receiving the Notice of Acceptance of the Announcement of Compliance Dossier from the specialized agency, organizations and individuals are permitted to circulate goods.

b) For imported goods:

- Organizations and individuals register for quality inspection of imported goods with the following information: name of importing organization or individual, address, telephone, fax; name of goods, brand, type; technical characteristics; origin, manufacturer; quantity, volume; import port; time of import; contract (Contract); list of goods (Packing list); invoice (Invoice); bill of lading (Bill of Lading); declaration of imported goods; technical regulation number; commitment that the product and goods comply with technical regulations and published standards and fully bear legal responsibility for the quality of the product and goods;

Within one working day, the specialized agency confirms the registration of quality inspection of imported goods by organizations and individuals on their registration form;

- Organizations and individuals submit the registered form with confirmation from the specialized agency to the customs authority to be allowed to clear goods;

- Within fifteen working days from the date of clearance of goods, organizations and individuals must submit a certified true copy of the Certificate of Compliance with Technical Regulations to the specialized agency.

In cases where goods have been assessed by the certification body in the exporting country, within three working days from the date of clearance, organizations and individuals must submit a certified true copy of the Certificate of Compliance with Technical Regulations to the specialized agency.

Organizations and individuals must fully bear responsibility and ensure that goods comply with technical regulations and published standards. In case goods do not comply with technical regulations and published standards, organizations and individuals must promptly report to the specialized agency and simultaneously organize the handling and recall of these goods in accordance with the law.rime Minister cb) In case the conformity announcement file is complete but invalid, the specialized agency notifies the organization or individual announcing conformity in writing about the reasons for not accepting the file.

3. In cases where the announcement of compliance is based on the assessment results of a designated certification body:

a) For domestically produced products and goods:

- Organizations and individuals submit the announcement of compliance dossier in accordance with Article 14 of this Circular along with a certified true copy of the Certificate of Compliance with Technical Regulations issued by the designated certification body to the specialized agency to obtain the Notice of Acceptance of the Announcement of Compliance Dossier;

- After obtaining the Notice of Acceptance of the Announcement of Compliance Dossier, organizations and individuals are permitted to circulate goods.

b) For imported goods:

- Organizations and individuals register for quality inspection of imported goods with the following information: name of importing organization or individual, address, telephone, fax; name of goods, brand, type; technical characteristics; origin, manufacturer; quantity, volume; import port; time of import; contract (Contract); list of goods (Packing list); invoice (Invoice); bill of lading (Bill of Lading); declaration of imported goods; technical regulation number; commitment that the product and goods comply with technical regulations and published standards and fully bear legal responsibility for the quality of the product and goods, along with a certified true copy of the Certificate of Compliance with Technical Regulations issued by the designated certification body;

- The specialized agency issues the Notice of Inspection Results of Imported Goods Quality;

- After receiving the Notice of Inspection Results of Imported Goods Quality, organizations and individuals submit a certified true copy of this Notice to the customs authority to clear goods.

4. The specialized agencies specified in Clauses 1, 2, and 3 of this Article process the announcement of compliance dossiers in accordance with Article 15 of this Circular.

Article 14. Documents for Announcement of Compliance

Organizations and individuals making the announcement of compliance shall prepare the documents for announcement of compliance and submit them directly or send them through postal service to the specialized agency designated by the Ministry managing the industry or field, or by the People's Committee of the province or centrally governed city. The components of the documents are specified as follows:

1. In cases where the announcement of compliance is based on self-assessment results of organizations and individuals (Party A), the documents for announcement of compliance shall include:

a) The announcement of compliance (in accordance with Model 2. CBHC/HQ stipulated in Appendix III of this Circular);

b) Self-assessment report including the following information:

- Name of organization, individual; address; telephone, fax;

- Product name, goods;

- Technical regulation number;

- Conclusion that the product, goods comply with technical regulations;

- Commitment to ensure product quality, goods comply with technical regulations, standards applied, and full responsibility under the law for product quality, goods, and self-assessment results.

The self-assessment report is based on the results of self-execution by organizations and individuals or based on the assessment results of conformity assessment bodies registered.

2. In cases where the announcement of compliance is based on certification results from registered certification bodies or designated certification bodies (third party), the documents for announcement of compliance shall include:national2. In cases where the announcement of compliance is based on certification results from registered certification bodies or designated certification bodies (third party), the documents for announcement of compliance shall include:

a) The announcement of compliance (in accordance with Model 2. CBHC/HQ stipulated in Appendix III of this Circular);nationalb) Certified true copy of the Certificate of Conformity to Technical Regulations along with the conformity mark issued by the registered certification body or designated certification body to the organization, individual.

Article 15. Handling of Documents for Announcement of Compliance

Documents for announcement of compliance sent to specialized agencies shall be handled as follows:

For complete standard compliance announcement documents as stipulated in Article 9 of this Circular, within five (5) working days from the date of receipt of the standard compliance announcement documents, the Inspection Unit must organize the verification of the completeness and validity of the standard compliance announcement documents as follows:national1. For documents for announcement of compliance not meeting the requirements stipulated in Article 14 of this Circular, within three (3) working days from the date of receipt of the documents for announcement of compliance, the specialized agency shall notify in writing requesting supplementation of documents according to the regulations to the organization, individual making the announcement of compliance. If the documents for announcement of compliance are not supplemented fully within fifteen (15) working days from the date the specialized agency sends the request, the specialized agency has the right to cancel the handling of these documents.

2. For documents for announcement of compliance meeting the requirements stipulated in Article 14 of this Circular, within five (5) working days from the date of receipt of the documents for announcement of compliance, the specialized agency shall organize the verification of the validity of the documents for announcement of compliance:a) In cases where the documents for announcement of compliance are complete and valid, the specialized agency shall issue a Notification of Receipt of Documents for Announcement of Compliance to the organization, individual making the announcement of compliance (in accordance with Model 3. TBTNHS stipulated in Appendix III of this Circular).

The Notification of Receipt of Documents for Announcement of Compliance shall have the value equivalent to the value of the conformity certificate issued by the designated certification body or shall have a validity period of three (3) years from the date the leadership of the organization, individual signs to confirm the conformity assessment report (for cases where the organization, individual conducts self-assessment);

b) In cases where the documents for announcement of compliance are complete but invalid, the specialized agency shall notify in writing to the organization, individual making the announcement of compliance about the reasons for not accepting the documents.national5. Responsibilities of the Provincial or Municipal Standard Measurement Quality Control Agencies under the Department of Science and Technology:nationalp provides for organizations and individuals to announce compliance (in accordance with Model 3. TBTNHS prescribed in Appendix III of this Circular).

The notification of receipt of the compliance announcement dossier has the value of the compliance certification issued by the certifying organization designated to issue it or has a validity of three (03) years from the date the leadership of the organization or individual signs to confirm the conformity assessment report (for cases involving organizations or individuals conducting conformity assessments).nationalp assessment;itself đánh giá hợp quy);

Article 16. Responsibilities of organizations and individuals publishing conformity declarations

1. Announce on appropriate information channels about their conformity declaration to ensure that users of the products, goods can easily access it.

2. Continuously maintain and be responsible for the conformity of the products, goods, services, processes, environments declared conforming; maintain quality control, testing, and regular monitoring.

3. Use the conformity mark on products, goods that have been declared conforming according to Clause 2, Article 4 of this Circular before putting them into circulation on the market. Maintain a record and annually report the use of the conformity mark to the designated certification organization.

4. When discovering non-conformity of products, goods, services, processes, environments that have been declared conforming during circulation or use, the organization or individual must:, amended and supplemented by Decree No. 109/2025/NĐ-CP and Decree No. 193/2025/NĐ-CP The organization or individual must:

a) Promptly notify in writing about the non-conformity to the specialized agency;

b) Temporarily halt production and recall non-conforming products, goods circulating on the market if they pose a high risk to user safety; stop operation and exploitation of related processes, services, environments when necessary;

c) Implement measures to correct the non-conformity;

d) Notify in writing to the specialized agency about the results of correcting the non-conformity before continuing to put products, goods, services, processes, environments into use, circulation, exploitation, business.

5. Establish and retain records of conformity declarations as a basis for inspection and supervision by state management agencies as follows:

a) In cases where the conformity declaration is based on the results of third-party conformity assessment by a designated certification organization, retain the conformity declaration records including original and copies of documents as stipulated in Clause 1, Article 14 and the surveillance assessment file of the designated certification organization;ənb) In cases where the conformity declaration is based on self-assessment results by the producing or trading organization or individual (first party), retain the conformity declaration records including original and copies of documents as stipulated in Clause 2, Article 14 and the self-surveillance assessment file of the organization or individual according to the surveillance plan.

6. Provide documentation proving the conformity of products, goods, services, processes, environments with corresponding technical regulations when requested by competent state authorities.

Provide certified true copies of documents as stipulated in Clause 2 and Clause 3, Article 13 of this Circular (Notification of receipt of conformity declaration application files or Certificate of compliance with technical regulations or Notification of national quality inspection results for imported goods) to organizations or individuals trading in products, goods, services, processes, environments; or use appropriate measures to ensure that organizations or individuals trading in products, goods, services can trace the origin and information about the conformity of products, goods, services with published standards and technical regulations.

7.8 8. Re-publish when there is any change in the content of the registered conformity declaration file or any change in the characteristics, functions, features of the products, goods, services that have been declared conforming.

8. Reannounce when there is any change in the content of the previously registered compliance announcement dossier or any change in the characteristics, features, or functions of the products, goods, or services that have been announced for compliance.

Chapter IV

IMPLEMENTATION

Article 17. Responsibilities of management agencies

1. Responsibilities of Ministries managing sectors and fields and Provincial People's Committees under central cities:

a) Direct the activities of conformity declaration in accordance with this Circular when issuing technical regulations for management purposes; b) Designate the lead agency responsible for managing conformity declaration activities in their assigned fields; notify the list of lead agencies to relevant organizations and individuals to implement and send it to the Ministry of Science and Technology for coordination and management;

c) Assign responsibility for receiving conformity declaration dossier to specialized agencies;ngAnnually in December, at any time upon request, compile and report on the situation of receiving conformity declaration dossiers (in Form 4. BCTNHS prescribed in Appendix III of Circular No. 28/2012/TT-BKHCN) to the Ministry of Science and Technology for compilation and reporting to the Prime Minister.development Take the lead and coordinate with the Ministry of Science and Technology to determine products and goods in Group 2, national technical standards, and select corresponding management measures according to the principle of conformity declaration stipulated in Clause 2, Article 1 of this Circular.

2. Responsibilities of the Standards Measurement Quality Agency as the lead agency designated in point b, Clause 1 of this Article:

d) 9 Assist the Ministry of Science and Technology in unified management and guidance of conformity assessment activities, standard conformity declaration, and regulation conformity declaration. Coordinate with sectoral ministries and agencies to determine products and goods in Group 2, national technical standards, and select corresponding management measures managed by sectoral ministries and agencies according to the principle of conformity declaration stipulated in Clause 2, Article 1 of this Circular;

đ)10 b) Coordinate with central agencies under sectoral ministries and agencies, provincial science and technology departments under central cities in urging and guiding the implementation of standard conformity declaration and regulation conformity declaration in accordance with this Circular;No. c) Monitor the situation of standard conformity declaration and regulation conformity declaration for products, goods, services, processes, and environments under the management of the Ministry of Science and Technology based on reports from local Standard Measurement Quality Agencies; monitor the designation of sectoral ministries and agencies regarding conformity assessment activities.

3. Responsibilities of lead agencies designated in point b, Clause 1 of this Article under sectoral ministries and agencies and Provincial People's Committees under central cities:

a) 11 a) Implement monitoring and management of registration activities for regulation conformity declaration by specialized agencies; coordinate with the Standards Measurement Quality Agency in managing regulation conformity declaration activities; annually compile and report to sectoral ministries and agencies and related Provincial People's Committees under central cities on the situation of designating conformity assessment organizations, while sending to the Standards Measurement Quality Agency for coordinated management;

Compile the situation of receiving regulation conformity declaration dossiers from specialized agencies and annually in December, at any time upon request, report to sectoral ministries and agencies, and related Provincial People's Committees under central cities.No. 4. Responsibilities of specialized agencies designated by sectoral ministries and agencies, Provincial People's Committees under central cities:

a) Receive and manage conformity declaration dossiers; revoke or suspend the results of receiving conformity declaration dossiers for products, goods, services, processes, and environments managed by national technical standards issued by sectoral ministries and agencies and related local technical standards within their assigned management areas;

Regularly update the status of receiving conformity declaration dossiers and publicly announce on their electronic information websites with the following contents:

- Name of organization or individual declaring conformity;

b) 12 - Products and goods declared conformity;

- Type of assessment: First party (name of organization or individual) or third party (name of certification body or designated certification body).

c) Coordinate with local Standard Measurement Quality Agencies in providing information on conformity declaration to facilitate product quality inspection;

b) 13 Annually in December, at any time upon request, compile and report to the lead agency the list of products, goods, services, processes, and environments on the situation of receiving conformity declaration dossiers (in Form 4. BCTNHS prescribed in Appendix III of Circular No. 28/2012/TT-BKHCN).

5. Responsibilities of Local Standard Measurement Quality Agencies under provincial science and technology departments:

a) Receive and manage standard conformity declaration dossiers; revoke or suspend the results of receiving standard conformity declaration dossiers for organizations and individuals producing and trading locally and publicly announce on the electronic information website of the provincial science and technology department or local Standard Measurement Quality Agency the situation of standard conformity declaration;

- Technical regulation number;

Receive and manage regulation conformity declaration dossiers; revoke or suspend the results of receiving regulation conformity declaration dossiers for products, goods, services, processes, and environments managed by national technical standards issued by the Ministry of Science and Technology and related local technical standards within their assigned management areas; regularly update the status of receiving regulation conformity declaration dossiers and publicly announce on the electronic information website of the provincial science and technology department or local Standard Measurement Quality Agency with the following contents:

c) Coordinate with local specialized agencies in providing information on standard conformity declaration to facilitate product quality inspection;

d) 14 Annually in December, at any time upon request, compile and report to the Standards Measurement Quality Agency the situation of receiving standard conformity declaration and regulation conformity declaration dossiers (in Form 4. BCTNHS prescribed in Appendix III of Circular No. 28/2012/TT-BKHCN) as stipulated in points a and b of this clause.

5. Responsibilities of the Provincial/City Market Surveillance and Consumer Rights Protection Departments under the Science and Technology Departments of provinces and centrally governed cities:

a) Accept registration and manage declaration standard conformity dossier; revoke, suspend the results of accepting declaration standard conformity dossiers from organizations and individuals producing, trading in the locality and publicly announce on the Science and Technology Department's or Local Standard Metrology Quality Control Agency’s website the situation of standard conformity declarations;

b) 15 Accept registration and manage declaration conformity dossier; revoke, suspend the results of accepting declaration conformity dossiers for products, goods, services, processes, environments managed by national technical regulations issued by the Ministry of Science and Technology and related local technical regulations within the assigned management field; update regularly the current status of accepting conformity declaration dossiers;No. conformity and declare conformity;No. publicly announce on the Science and Technology Department's or Local Standard Metrology Quality Control Agency’s website with the following contents:

5. Responsibilities of Local Standard Measurement Quality Agencies under provincial science and technology departments:

a) Receive and manage standard conformity declaration dossiers; revoke or suspend the results of receiving standard conformity declaration dossiers for organizations and individuals producing and trading locally and publicly announce on the electronic information website of the provincial science and technology department or local Standard Measurement Quality Agency the situation of standard conformity declaration;

- Technical regulation number;

Receive and manage regulation conformity declaration dossiers; revoke or suspend the results of receiving regulation conformity declaration dossiers for products, goods, services, processes, and environments managed by national technical standards issued by the Ministry of Science and Technology and related local technical standards within their assigned management areas; regularly update the status of receiving regulation conformity declaration dossiers and publicly announce on the electronic information website of the provincial science and technology department or local Standard Measurement Quality Agency with the following contents:

c) Coordinate with specialized agencies at the locality in providing information about standard conformity declarations to facilitate product quality inspection;

d) 16 Annually in December, or when required, compile and report to the National Standard Metrology Quality Control Administration the situation of accepting standard conformity declaration dossiers, conformity declaration dossiers (in accordance with Model 4. BCTNHS stipulated in Appendix III of Circular No. 28/2012/TT-BKHCN) as prescribed in points a, b of this clause;

Article 18. Inspection, Audit, and Handling of Violations

1. The competent state management agency shall carry out inspection, audit, and handle violations of laws in the activities of standard declaration and conformity declaration according to this Circular and other relevant current regulations.rime Minister cn, conformity declaration in accordance with this Circular and other relevant current provisions;

2. Organizations and individuals violating the provisions on standard declaration and conformity declaration shall be subject to handling according to the current relevant laws depending on the nature and degree of violation.

Article 19. Implementation Provisions

This Circular takes effect from January 27, 2013, and replaces Decision No. 24/2007/QĐ-BKHCN dated September 28, 2007, issued by the Minister of Science and Technology regarding the issuance of regulations on standard certification, conformity certification, and standard declaration, conformity declaration.rime Minister cn, conformity declaration;

Article 20. Implementation

1. The Minister, the Heads of Ministries equivalent to Ministries, and the Chairmen of Provincial People's Committees directly under the Central Government are responsible for organizing the implementation of this Circular.

2. The Director of the General Department of Standardization, Metrology, and Quality Control is responsible for guiding and organizing the implementation of this Circular.

3. In the course of implementation, if there are arising issues or difficulties, organizations and individuals shall promptly reflect them in writing to the Ministry of Science and Technology for research and amendment.development study amendment and supplementation./.

CONTENT, PROCEDURE, AND PRINCIPLES FOR USING EVALUATION METHODS TO DETERMINE COMPLIANCE

I. Method 1: Testing Typical Samples

Method 1 involves testing typical samples of products or goods to conclude on compliance. The conclusion on compliance applies to the type or model of product or good that was sampled.

1. Content and procedure of the main activities in Method 1 include:

1.1. Sampling:

Conduct sampling of typical samples for products or goods. A typical sample of a product or good represents a specific type or model produced under the same design, in the same conditions, and using the same raw materials.

The number of samples must be sufficient for testing and retention.

1.2. Evaluation of compliance of tested samples:

The product or good samples are tested at laboratories registered for testing activities according to the law, which may include the manufacturer’s laboratory. Priority should be given to designated and recognized laboratories.

The characteristics of the product or good to be tested and the testing methods are specified in the corresponding standards or technical regulations.

1.3. Processing the evaluation results:

Review the characteristics of the product or good based on the test results compared to the requirements of the corresponding standards or technical regulations.

1.4. Conclusion on compliance

Conclude on the compliance of the product or good with the requirements of the corresponding standards or technical regulations. The product or good is considered compliant if all the criteria of the tested sample meet the prescribed levels of the corresponding standards or technical regulations.

2. Principles for using Method 1

Method 1 is used to evaluate the compliance of products or goods under the following conditions:

a) The design of the product or good allows clear identification of each type or model;

b) It is not possible to assess the requirements for maintaining stable quality.

II. Method 2: Testing Typical Samples and Evaluating Production Processes; Monitoring Through Market Sample Testing

Method 2 bases its conclusions on the compliance of products or goods on the results of testing typical samples and evaluating production processes, followed by monitoring through testing market samples.

1. Content and procedure of the main activities in Method 2 include:

1.1. Sampling:

Proceed as stipulated in Section 1.1 of Method 1.

1.2. Evaluation of compliance of tested samples:

Proceed as stipulated in Section 1.2 of Method 1.

1.3. Evaluation of compliance of production processes:

The evaluation of production processes must fully consider the manufacturer's control conditions related to the formation of the product to ensure stable quality. These control conditions include:

a) Technical file control (design documents, product technical standards);

b) Full production process control from input, through intermediate stages, until the product is formed, including packaging, storage, and transportation;

c) Raw material, semi-finished product, and finished product quality control;

d) Control of technological equipment and measuring, inspecting, and testing equipment;

đ) Skill level control of workers and technical staff;

e) Other necessary technical contents.

If the manufacturer already has a quality management system certificate from a recognized certification organization for the field of certification or recognized for the production of the evaluated product or good, there is no need to evaluate the production process. However, if there is evidence of non-maintenance of the effectiveness of the quality management system, the certification body must conduct a production process evaluation and report to the General Department of Standardization, Metrology, and Quality Control.

1.4. Processing the evaluation results:

Review the characteristics of the product or good based on the test results compared to the requirements of the corresponding standards or technical regulations.

Review the compliance of the production process with the requirements specified in Section 1.3 of this method.

1.5. Conclusion on compliance

Conclude on the compliance of the product or good with the requirements of the corresponding standards or technical regulations. The product or good is considered compliant if it meets both of the following conditions:

a) All criteria of the tested sample comply with the prescribed levels of the corresponding standards or technical regulations;

b) The production process evaluation results comply with the requirements.

The conclusion on conformity of products and goods shall have maximum validity of three years provided that such products and goods are subject to monitoring and evaluation.

1.6. Monitoring:

During the validity period of the conformity conclusion, products and goods must be evaluated and monitored through sampling tests conducted on the market. The frequency of evaluation and monitoring must not exceed once every twelve months.

Sampling testing of products and goods shall be carried out as prescribed in Sections 1.1, 1.2, and 1.3 of Method 1.

The results of the monitoring and evaluation will serve as the basis for deciding whether to maintain, suspend, or revoke the conformity conclusion.

2. Principles for using Method 2:

Method 2 is used to evaluate the conformity of products and goods under the following conditions:

a) Products and goods belong to a category with low risk to safety, health, and environment;

b) The design of products and goods allows clear identification of each type and characteristic model;

c) It is necessary to pay attention to maintaining the stability of quality characteristics of products and goods during production;

d) The quality of products and goods may change during distribution and circulation on the market;

đ) Organizations and individuals producing and trading products and goods have effective measures to recall products and goods from the market when they are found to be non-conforming during monitoring.

III. Method 3: Typical sample testing and production process assessment; monitoring through sampling at the place of production combined with production process assessment.

Method 3 bases its conclusions on conformity on the results of typical sample testing and production process assessment. Monitoring is carried out through sampling of products and goods taken from the place of production combined with production process assessment.

1. Contents and sequence of basic activities in Method 3 include:

1.1. Sampling:

Proceed as stipulated in Section 1.1 of Method 1.

1.2. Assessment of conformity of test samples

Proceed as stipulated in Section 1.2 of Method 1.

1.3. Evaluation of compliance of production processes:

Conducted as prescribed in Section 1.3 of Method 2.

1.4. Processing the evaluation results:

Conducted as prescribed in Section 1.4 of Method 2.

1.5. Conformity Conclusion:

Conducted as prescribed in Section 1.5 of Method 2.

1.6. Monitoring:

During the validity period of the conformity conclusion, products and goods must be evaluated and monitored through sampling at the place of production combined with production process assessment. The frequency of evaluation and monitoring must not exceed once every twelve months.

Sampling testing of products and goods shall be carried out as prescribed in Sections 1.1, 1.2, and 1.3 of Method 1.

Production process assessment is conducted as prescribed in Section 1.3 of Method 2.

The results of the monitoring and evaluation will serve as the basis for deciding whether to maintain, suspend, or revoke the conformity conclusion.

2. Principles for using Method 3:

Method 3 is used to evaluate the conformity of products and goods under the following conditions:

a) Products and goods belong to a category with higher risk to safety, health, and environment than those evaluated according to Method 2;

b) The design of products and goods allows clear identification of each type and characteristic model;

c) It is necessary to pay attention to maintaining the stability of quality characteristics of products and goods during production;

d) The quality of products and goods essentially does not change or changes little during distribution and circulation on the market;

đ) It is difficult to implement effective measures to recall products and goods from the market when they are found to be non-conforming during monitoring.

IV. Method 4: Typical sample testing and production process assessment; monitoring through sampling at the place of production and on the market combined with production process assessment.

Method 4 bases its conclusions on conformity on the results of typical sample testing and production process assessment. Subsequent monitoring is carried out through sampling of products and goods taken from the place of production and on the market combined with production process assessment.

1. Contents and sequence of basic activities in Method 4 include:

1.1. Sampling:

Proceed as stipulated in Section 1.1 of Method 1.

1.6. Monitoring:

During the validity period of the conformity notification, products and goods must be evaluated and monitored through sampling at the place of production and on the market combined with production process assessment. The frequency of evaluation and monitoring must not exceed once every twelve months.

Sampling testing of products and goods shall be carried out as prescribed in Sections 1.1, 1.2, and 1.3 of Method 1.

Production process assessment is conducted as prescribed in Section 1.3 of Method 2.

The results of the monitoring and evaluation will serve as the basis for deciding whether to maintain, suspend, or revoke the conformity conclusion.

2. Principles for using Method 4:

Method 4 is used to evaluate the conformity of products and goods under the following conditions:

a) Products and goods belong to a category with higher risk to safety, health, and environment than those evaluated for conformity according to Method 3;

b) The design of products and goods allows clear identification of each type and characteristic model;

c) It is necessary to pay attention to maintaining the stability of quality characteristics of products and goods during production;

d) The quality of products and goods may become unstable during production and change during distribution and circulation on the market;

đ) There are measures allowing the recall of products and goods from the market when they are found to be non-conforming during monitoring.

V. Method 5: Typical sample testing and production process assessment; monitoring through sampling at the place of production or on the market combined with production process assessment.

Method 5 bases its conclusions on conformity on the results of typical sample testing and production process assessment. Monitoring is carried out through sampling at the place of production or on the market combined with production process assessment.

1. Contents and sequence of basic activities in Method 5 include:

1.1. Sampling:

Proceed as stipulated in Section 1.1 of Method 1.

1.2. Evaluation of compliance of tested samples:

Proceed as stipulated in Section 1.2 of Method 1.

1.3. Evaluation of compliance of production processes:

Conducted as prescribed in Section 1.3 of Method 2.

1.4. Processing the evaluation results:

Conducted as prescribed in Section 1.4 of Method 2.

1.5. Conformity Conclusion:

Conducted as prescribed in Section 1.5 of Method 2.

1.6. Monitoring:

b) A widely applied method should be used aiming towards mutual recognition of conformity assessment results.

VI. Method 6: Evaluation and monitoring of management systems

Method 6 is based on evaluating the management system to conclude whether the management system complies with the relevant standards and technical regulations.

1. The contents and procedures for implementing the main activities in Method 6 include:

1.1. Evaluating the compliance of the management system:

- The management system is evaluated according to the provisions of the relevant standards and technical regulations.

- Reporting the evaluation results in comparison with the provisions of the relevant standards and technical regulations.

1.2. Concluding on compliance:

Based on the evaluation report, conclusions are made regarding the compliance of the management system with the provisions of the relevant standards and technical regulations.

The conclusion on compliance of the management system has a maximum validity period of three years provided that the management system is subject to surveillance.

1.3. Surveillance of the management system.

- Surveillance is conducted through the evaluation of the management system at a frequency not exceeding once every twelve months.

- The surveillance results serve as the basis for deciding to continue maintaining, suspending, or revoking the compliance of the management system.

2. Principles for using Method 6:

Method 6 is used to evaluate the compliance of processes, services, and environments with management systems according to the relevant standards and technical regulations.

VII. Method 7: Testing and evaluating batches of products and goods

Method 7 bases its conclusions on the test results of samples taken from batches of products and goods using statistical sampling methods to determine their compliance. The conclusion on compliance is valid only for the specific batch of products and goods and does not require subsequent monitoring measures.

1. The contents and procedures for implementing the main activities in Method 7 include:

1.1. Sampling:

Test samples are taken using statistical sampling methods to ensure they are representative of the entire batch.

The number of samples must be sufficient for testing and retention.

1.2. Evaluation of compliance of tested samples:

Proceed as stipulated in Section 1.2 of Method 1.

1.3. Processing the evaluation results:

Assessing the characteristics of the products and goods based on the test results compared to the provisions of the relevant standards and technical regulations.

1.4. Concluding on compliance:

A batch of products and goods is considered compliant if the number of non-conforming test samples falls within the permissible limit.

A batch of products and goods is considered non-compliant if the number of non-conforming test samples exceeds the permissible limit.

2. Principles for using Method 7:

Method 7 is used to evaluate the compliance of products and goods under the following conditions:

a) Products and goods are classified into uniform batches.concerning the classification and determination of state management authority in the field of crop productionVIII. Method 8: Testing or inspecting all products and goods

b) It is not possible to assess the requirements for maintaining stable quality.

Method 8 bases its conclusions on the testing or inspection results of all products and goods to determine their compliance before circulation and use. The conclusion on compliance is valid only for individual products and goods and does not require subsequent monitoring measures.

1. The contents and procedures for implementing the main activities in Method 8 include:

1.1. Identifying the products and goods to be tested or inspected;

1.2. Evaluating the compliance of the products and goods:

a) Testing or inspecting the products and goods shall be carried out by laboratories or inspection bodies registered in the relevant field and having the necessary capacity, at the place of production, installation, use, or at the laboratory or inspection body.

Priority should be given to recognized laboratories or inspection bodies.

b) The characteristics of the products and goods to be tested or inspected and the testing or inspection methods are specified in the relevant standards and technical regulations.

Assessing the characteristics of the products and goods based on the test or inspection results compared to the requirements.

1.3. Processing the evaluation results:

The products and goods are considered compliant if all tested or inspected characteristics comply with the levels specified in the relevant standards and technical regulations.
