CIRCULAR
Guidelines for Implementing Certain Provisions of Decree No. 91/2001/NĐ-CP dated December 11, 2001 of the Government on Conditions for Operating Certain Transportation Services in Inland Waterways.
Pursuant to Clause 1, Article 5 of Decree No. 91/2001/NĐ-CP dated December 11, 2001 of the Government for business conditions and Law No. 47/2024/QH15 for certain transportation services in inland waterways (hereinafter referred to as the Decree), AND The Department of Transport shall provide detailed guidelines for certain provisions of the Decree as follows:
A. Guidelines for Clause 4, Article 4 regarding registration with the competent transport management authority concerning the route of operation and business plan for fixed-route transportation or the area of operation for non-fixed-route transportation.
I. Registration Procedures for Routes or Areas of Operation.
1. After obtaining a Business Registration Certificate for inland waterway passenger transportation, organizations and individuals engaged in fixed-route passenger transportation or non-fixed-route passenger transportation (hereinafter collectively referred to as organizations and individuals engaged in passenger transportation) must register their routes or areas of operation at the competent transport management authority as specified in Section II Part A of this Circular.
2. Content of Route or Area Registration:
a) For fixed-route passenger transportation:
Number of routes consistent with the inland waterways that have been officially announced for exploitation;
Number of vessels and vessel registration numbers operating on each route;
Ports and wharfs for picking up and dropping off passengers on each route;
Operational schedule for each route: number of trips per day (week), departure and arrival times for each trip;
Transport tariffs for each route;
Duration of operation.
b) For non-fixed-route passenger transportation:
Area of operation;
Number of vessels and vessel registration numbers operating in each area;
Ports and wharfs for picking up and dropping off passengers in each area;
Duration of operation.
3. Documents to be Presented and Submitted:
a) Present the original copies of the following documents:
Business Registration Certificate; Certificate of Registration of Inland Waterway Vessels or substitute documents as prescribed when the vessel is mortgaged or pledged;
Certificate of Technical Safety of Inland Waterway Vessels;
Crew List, accompanied by professional certificates of crew members.
b) Submit the following documents:
Copies of the documents stipulated in Subpoint a of Point 3;
Application for Registration of Passenger Transportation Business in Inland Waterways according to the prescribed forms in Appendices 1 and 2.
4. Upon receipt of the complete application as stipulated in Point 3, Section I Part A of this Circular, within no more than one working day, the competent transport management authority shall endorse the Application for Registration of Passenger Transportation Business in Inland Waterways, retain a copy for monitoring and management, and return the original to the organization or individual engaged in passenger transportation for operation in accordance with the registered content.
II. Competent Transport Management Authority.
1. The Vietnam Inland Waterway Administration shall confirm the registration of routes or areas of operation for passenger transportation by organizations and individuals with foreign investment operating on central inland waterway routes and cross-border transportation from Bình Thuận northward.
The Southern Vietnam Inland Waterway Administration shall confirm the registration of routes or areas of operation for passenger transportation by organizations and individuals with foreign investment operating on central inland waterway routes. cross-border transportation from Bình Phước, Đồng Nai, Bà Rịa - Vũng Tàu southward.
2. Departments of Transport and Departments of Transport and Public Works shall confirm the registration of routes or areas of operation for passenger transportation by organizations and individuals registering business operations locally outside the scope defined in Point 1, Section II Part A of this Circular.
3. In cases where the route or area of operation for passenger transportation by an organization or individual spans both central and local inland waterway routes, the confirmation of the registration of the route or area of operation shall be made by the Vietnam Inland Waterway Administration or the Southern Vietnam Inland Waterway Administration.
4. Organizations and individuals engaged in high-speed passenger ferry transportation, in addition to implementing this Circular, must also comply with Decision No. 2764/2000/QĐ-BGTVT dated April 21, 2000 of the Minister of Transport on the Management and Supervision of High-Speed Passenger Ferry Operations and other current relevant regulations.
III. Changes to Registered Content.
Organizations and individuals who have registered routes or areas of operation for passenger transportation in inland waterways, if they wish to change any of the registered contents, must submit a change registration document to the registration authority and must notify passengers and the general public through mass media at least 72 hours before the intended change.
B. Guidelines for Clause 4, Article 5 regarding the conditions for operating passenger transportation across rivers.
Passenger pick-up and drop-off points must meet safety requirements and be permitted to operate in accordance with current regulations (Decision No. 1211/1999/QĐ-BGTVT dated May 20, 1999 of the Minister of Transport on the Management of River Crossings Passenger Wharves and Circular No. 947/CĐS-PC dated July 15, 1999 of the Vietnam Inland Waterway Administration guiding the implementation of Decision No. 1211/1999/QĐ-BGTVT and other current relevant regulations).
C. Guidelines for Clause 2, Article 7 regarding the conditions for cargo handling at ports and wharves in inland waterways.
Ports or wharves for cargo handling must meet safety requirements and be permitted to operate in accordance with current regulations (Decision No. 2046/QĐ-PC dated August 6, 1996 of the Minister of Transport promulgating the Rules for Managing Ports and Wharves in Inland Waterways; Decision No. 3809/1999/QĐ-BGTVT dated December 30, 1999 of the Minister of Transport amending and supplementing certain articles of the Rules for Managing Ports and Wharves in Inland Waterways; and Circular No. 98/CĐS-PC dated January 25, 2000 of the Vietnam Inland Waterway Administration guiding the implementation of Decision No. 3809/1999/QĐ-BGTVT and other current relevant regulations).
D. Implementation Organization.
I. This Circular shall take effect fifteen days after its date of issuance.
II. Organizations and individuals who have been issued a Business Registration Certificate for inland waterway passenger transport before Decree No. 91/2001/NĐ-CP dated December 11, 2001 took effect and are currently operating must complete procedures to register their routes or areas of operation in accordance with the regulations.
III. The Vietnam Inland Waterways Administration shall submit to the Ministry for publication the central inland waterway passenger transport routes; the Department of Transport, the Department of Transport and Public Works shall submit to the People's Committee of the province for publication the local inland waterway passenger transport routes as a basis for enterprises to register their passenger transport routes.
IV. Heads of advisory agencies under the Ministry, Directors of the Vietnam Inland Waterways Administration, Directors of the Vietnam Ship Registry, and Directors of the Departments of Transport and Departments of Transport and Public Works shall be responsible for implementing, monitoring, inspecting, identifying, and handling violations of Decree No. 91/2001/NĐ-CP and this Circular within their functions and authorities.
Relevant organizations and individuals shall be responsible for implementing this Circular.
Any difficulties encountered during implementation should be reported to the Ministry of Transport for timely resolution./.
