CIRCULAR
Guidelines for procedures to enjoy assistance under Decision No. 16/2004/QĐ-TTg dated February 5, 2004 of the Government on assistance for households with two or more members unable to self-care due to the consequences of toxic chemicals used by the United States during the Vietnam War.
Pursuant to Decision No. 16/2004/QĐ-TTg dated February 5, 2004 of the Government on assistance for households with two or more members unable to self-care due to the consequences of toxic chemicals used by the United States during the Vietnam War, the Ministry of Labor, Invalids, and Social Affairs provides guidelines for procedures to enjoy assistance as follows:
I. DOCUMENTS AND PROCEDURES:
1. The head of the household shall submit an application to the People's Committee of the commune, ward, town (hereinafter referred to as the commune level) for consideration and recommendation to the People's Committee of the district, city district (hereinafter referred to as the district level).
A household under Decision No. 16/2004/QĐ-TTg dated February 5, 2004 of the Government consists of individuals sharing the same household registration, having blood relations, and meeting the provisions of the law.
2. The People's Committee of the commune:
a) Compile a list of households as stipulated in Point 1 of this Circular through the Commune Verification Board.
b) Establish a Verification Board consisting of: the Chairman or Vice-Chairman of the People's Committee as the Chairman of the Board, a labor, invalids, and social affairs officer as a permanent member, and other members representing the Women's Union, Veterans' Association, Red Cross, or Farmers' Union (if available). The Verification Board will review each case eligible for assistance according to Article 1 of Decision No. 16/2004/QĐ-TTg dated February 5, 2004 of the Government. The Verification Board operates based on majority rule with minutes (according to Model No. 01 attached to this Circular). In case of differing opinions, a secret ballot will be conducted; if more than half of the members agree, the Verification Board will compile a list of households recommended for assistance.
c) After the Verification Board approves, the Chairman of the People's Committee at the commune level shall issue a letter requesting the Chairman of the People's Committee at the district level to consider and decide. The letter must include the minutes of the Verification Board and a list of families applying for assistance (according to Model No. 02 attached to this Circular).
3. The Department of Labor, Invalids, and Social Affairs (or the Organization and Labor, Social Affairs Department) at the district level shall compile the list of households proposed by the People's Committee at the commune level and submit it to the Chairman of the People's Committee at the district level for decision (according to Models No. 03 and 04 attached to this Circular).
II. IMPLEMENTATION:
1. People's Committee at the commune level:
a) Maintain a record and implement monthly payments for beneficiaries decided by the People's Committee at the district level.
b) Report to the Department of Labor, Invalids, and Social Affairs (or the Organization and Labor, Social Affairs Department) those individuals no longer meeting the conditions for assistance.
2. Department of Labor, Invalids, and Social Affairs (or the Organization and Labor, Social Affairs Department) at the district level:
a) Guide and inspect the implementation of assistance policies for beneficiaries at the commune level.
b) Compile and report to the Chairman of the People's Committee at the district level to make decisions to terminate assistance for households no longer meeting the conditions.
3. Department of Labor, Invalids, and Social Affairs at the provincial level:
a) Annually, based on the number and level of assistance for each type of beneficiary, prepare a budget plan for assistance and send it to the Department of Finance and the Department of Planning and Investment for the Chairman of the People's Committee at the provincial level to decide.
b) Guide and inspect subordinate levels in organizing assistance for beneficiaries.
c) Report results periodically every three months, six months, and annually to the Ministry of Labor, Invalids, and Social Affairs.
III. EFFECTIVE DATE OF IMPLEMENTATION
1. This Circular shall take effect fifteen days after its publication in the Official Gazette.
2. During the implementation process, if there are issues requiring clarification or additional guidance, they should be reported to the Ministry of Labor, Invalids, and Social Affairs for timely explanation or supplementary guidance within their functions, duties, and authority.
