CIRCULAR
Guidelines for Implementing the Mobile Allowance System
for Civil Servants, Government Employees, and Public Officials
Pursuant to Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on the salary system for civil servants, government employees, public officials, and military personnel; after consulting with the Ministry of Finance and relevant ministries and agencies, the Ministry of Home Affairs hereby provides guidelines for implementing the mobile allowance system for civil servants, government employees, and public officials as follows:
I. SCOPE OF APPLICATION
The mobile allowance applies to civil servants (including probationary civil servants), public officials, and individuals in their probationary or trial periods who are part of the payroll of state agencies and state-owned public institutions due to the nature and characteristics of their profession or work requiring frequent changes in workplace and residence, and unstable living conditions.
II. LEVELS AND ELIGIBLE RECIPIENTS FOR THE MOBILE ALLOWANCE
1. Amount of allowance:
The mobile allowance includes three levels: 0.2; 0.4; and 0.6 relative to the minimum wage.
Based on the minimum wage of 290,000 VND/month, the amounts of the mobile allowances implemented from October 1, 2004 are as follows:

Thông tư này áp dụng đối với tổ chức, cá nhân có liên quan đến hoạt động kinh doanh đối tượng thủy sản nuôi chủ lực trên lãnh thổ Việt Nam.
a) Level 1, coefficient 0.2 applies to those working at units:
Teams engaged in disease prevention, hygiene, planned childbirth, malaria, goiter control in midland areas;
Teachers and educational administrators (including those under contractual agreements within the staffing quota and those in their trial period) working in particularly difficult economic and social conditions regions, specializing in illiteracy eradication and universal education, spending at least 15 days per month visiting villages, hamlets, phums, and socs.
b) Level 2, coefficient 0.4 applies to those working at units:
Drilling and exploration teams of geological unions;
Survey and search teams of regional geological unions; Meteorological and hydrological survey and measurement teams;
Agricultural, forestry, irrigation, and fishery investigation and measurement teams;
Disease prevention, hygiene, planned childbirth, malaria, and goiter control teams in mountainous, highland, remote, and isolated areas;
Medical teams regularly dispatched to grassroots areas for health check-ups, treatment, and primary healthcare in mountainous, highland, remote, and isolated areas.
c) Level 3, coefficient 0.6 applies to those working at units:
Mineral resource survey and search teams of specialized geological unions;
National basic survey and measurement system construction, specialized-use basic survey and measurement system construction, topographic survey teams;
Forest survey teams;
Medicinal herb collection teams in high mountains, border areas, islands, and remote locations.
III. CALCULATION OF THE MOBILE ALLOWANCE PAYMENT
1. The mobile allowance is calculated based on actual days of mobility and paid concurrently with monthly salaries according to the following formula:

The mobile allowance is not used to calculate contributions or benefits under the social insurance scheme.
2. Individuals receiving the mobile allowance system shall not be entitled to travel expenses.
3. Sources of funding for the mobile allowance payment:
For individuals belonging to agencies and units fully funded by the state budget, the mobile allowance is paid from the state budget according to the current budget allocation hierarchy within the annual budget allocated to the agency or unit;
For individuals belonging to agencies implementing staff quota and administrative management cost contracts and public institutions implementing self-financing, the mobile allowance is paid from the contracted funds and self-financed resources allocated to the agency or unit.
IV. EFFECTIVE DATE OF IMPLEMENTATION
1. This Circular takes effect 15 days after its publication in the Official Gazette. It abolishes all guiding documents implementing Decree No. 25/CP dated May 23, 1993 of the Government regarding the mobile allowance system for civil servants, government employees, and public officials working in state agencies and state-owned public institutions.
2. The mobile allowance system stipulated in this Circular is effective from October 1, 2004. Heads of agencies and units directly managing civil servants, government employees, and public officials shall base the calculation and payment of the mobile allowance on the eligible recipients and funding sources specified in this Circular.
Civil servants, government employees, and public officials performing certain special professions or tasks (outside the provisions of this Circular) in state agencies and state-owned public institutions, who have been granted mobile allowances by authorized bodies and such allowances remain valid, shall continue to enjoy them until there is a change in the factors constituting the basis for granting the allowances; ministries, sectors, and localities shall compile reports to the Ministry of Home Affairs for monitoring and management.
Any supplementation of eligible recipients for the mobile allowance or adjustment of the mobile allowance levels stipulated in this Circular shall be proposed in writing by relevant ministries and sectors to the Ministry of Home Affairs for discussion and agreement with the Ministry of Finance to consider and resolve.
3. Individuals working under labor contracts performing jobs with mobile characteristics in state agencies and state-owned public institutions shall have the mobile allowance (if any) agreed upon in the labor contract.
4. Civil servants, government employees, and public officials working in Party, People's Council, and mass organizations' agencies and institutions shall implement the mobile allowance system according to the guidance of the Central Organization Department.
During implementation, if any difficulties arise, ministries, sectors, and localities shall report to the Ministry of Home Affairs for research and resolution.
