Pursuant to Decree No. 12/2002/NĐ-CP dated January 22, 2002 of the Government on surveying and mapping activities,
The Ministry of Natural Resources and Environment, the Ministry of National Defense, the Ministry of Public Security, the Ministry of Posts and Telecommunications issue guidelines for managing aerial photography work from aircraft and receiving, transmitting, and broadcasting surveying, mapping, and aerial imagery data as follows:
PART I
GENERAL PROVISIONS

These Circulars provide guidelines for managing aerial photography work from aircraft and receiving, transmitting, and broadcasting surveying, mapping, and aerial imagery data.
Thông tư này áp dụng đối với tổ chức, cá nhân có liên quan đến hoạt động kinh doanh đối tượng thủy sản nuôi chủ lực trên lãnh thổ Việt Nam.
2.1. State management agencies responsible for managing aerial photography work from aircraft and receiving, transmitting, and broadcasting surveying, mapping, and aerial imagery data.
2.2. Organizations and individuals within Vietnam and foreign organizations and individuals involved in aerial photography work from aircraft and receiving, transmitting, and broadcasting surveying, mapping, and aerial imagery data.
3. Responsibilities of Ministries for managing aerial photography work from aircraft and receiving, transmitting, and broadcasting surveying, mapping, and aerial imagery data.
3.1. Responsibilities of the Ministry of Natural Resources and Environment.
a) Establishing and promulgating technical regulations concerning aerial photography work from aircraft for surveying and mapping purposes; receiving, transmitting, and broadcasting surveying, mapping, and aerial imagery data;
b) Developing and implementing plans for aerial photography work from aircraft for surveying and mapping purposes serving civilian objectives under the jurisdiction of the Ministry of Natural Resources and Environment;
c) Approving plans for acquiring ground images from satellites for surveying and mapping purposes, and other civilian purposes related to the use of satellite ground images;
d) Approving planning, plans, and implementation of construction of satellite positioning stations, stations for receiving and transmitting surveying, mapping, and aerial imagery data serving civilian objectives under the jurisdiction of the Ministry of Natural Resources and Environment;
đ) Reviewing the content of surveying, mapping, and aerial imagery data listed in the Top Secret category in the Decision No. 212/2003/QĐ-TTg dated October 21, 2003 of the Prime Minister on the list of state secrets of the highest level in the field of natural resources and environment and Decision No. 919/2003/QĐ-BCA(A11) dated November 20, 2003 of the Minister of Public Security on the list of state secrets of the secret level in the field of natural resources and environment before transmission and broadcasting;
e) Inspecting the implementation of surveying, mapping, and aerial imagery projects and works under the jurisdiction of the Ministry of Natural Resources and Environment; inspecting the transmission and broadcasting of surveying, mapping, and aerial imagery data listed in the state secrets category managed by the Ministry of Natural Resources and Environment.
3.2. Responsibilities of the Ministry of National Defense
a) Inspecting the installation of aerial photography equipment on aircraft and monitoring the implementation of flights for civilian purposes;
b) Removing military targets from ground images taken from aircraft when they are used for civilian purposes;
c) Developing plans and promulgating technical regulations, organizing aerial photography work from aircraft and managing the reception, transmission, and broadcasting of surveying, mapping, and aerial imagery data for national defense, security, and combined purposes between national defense and economy, economy and national defense;
d) Reviewing the content of surveying, mapping, and aerial imagery data listed in the state secrets category managed by the Ministry of National Defense before transmission and broadcasting;
đ) Inspecting and implementing surveying, mapping, and aerial imagery projects and works for national defense and security; inspecting and supervising the transmission and broadcasting of surveying, mapping, and aerial imagery data listed in the state secrets category managed by the Ministry of National Defense;

3.3. Responsibilities of the Ministry of Public Security
a) Cooperating with the Ministry of Natural Resources and Environment and People's Committees of provinces and centrally governed cities in ensuring safety and security for surveying and mapping activities;
b) Cooperating with the Ministry of Posts and Telecommunications in ensuring safety and security for the transmission of surveying, mapping, and aerial imagery data;
c) Establishing regulations on the transmission and broadcasting of surveying, mapping, and aerial imagery data for security purposes;
d) Inspecting and supervising the management, use, and exploitation of materials within the scope of state secrets.
3.4. Responsibilities of the Ministry of Posts and Telecommunications
a) Managing and issuing permits for the use of radio frequency and wireless transmission equipment for agencies, organizations, and enterprises engaged in surveying and mapping to transmit surveying, mapping, and aerial imagery data;
b) Managing and issuing permits for the establishment of dedicated telecommunications networks for agencies, organizations, and enterprises engaged in surveying and mapping to transmit surveying and mapping, and aerial imagery data;
c) Inspecting and supervising the establishment of dedicated telecommunications networks, the use of radio frequencies and wireless transmission equipment in surveying and mapping activities according to the provisions of the law.
4. Responsibilities of organizations and individuals licensed for aerial photography work from aircraft and receiving, transmitting, and broadcasting surveying, mapping, and aerial imagery data
Organizations and individuals licensed for aerial photography work from aircraft and receiving, transmitting, and broadcasting surveying, mapping, and aerial imagery data shall be responsible for complying with the provisions in the license, using and submitting for storage the required documents as prescribed.
Chapter II
AERIAL PHOTOGRAPHY
1. Procedures for obtaining permission for aerial photography
1.1. Organizations proposing aerial photography from aircraft for surveying and mapping purposes must submit a request in writing to the Ministry of National Defense, a ministry equivalent to a ministry, or a government agency, or the People's Committee of a province or centrally governed city. In the request, the purpose, flight area, altitude, flight route, camera type, other equipment, time of photography, and take-off and landing airports must be clearly stated.

Within fifteen working days from the date of receipt of the agreement document of the Ministry of National Defense, the Civil Aviation Authority of Vietnam shall grant permission to civilian aircraft to conduct aerial photography flights.
2. AERIAL PHOTOGRAPHY
2.1. The aerial photography for surveying and mapping purposes shall be carried out based on the plan approved by the competent state agency.
2.2. The installation of equipment on aircraft for conducting photography must be inspected by the Ministry of National Defense before the flight.
2.3. The Ministry of National Defense manages products during the flight photography process, including original film and data collected during the flight photography prior to removing military targets. Organizations and individuals may only use the flight photography materials after the Ministry of National Defense has removed military targets.
2.4. Within thirty working days from the completion of each flight photography mission, the Ministry of National Defense is responsible for completing the removal of military targets from aerial photographs and data collected during the flight photography. After removing military targets, the Ministry of National Defense is responsible for transferring the aerial photographs to organizations and individuals.
Chapter III
DATA COLLECTION, TRANSMISSION, AND DISTRIBUTION OF SURVEYING AND MAPPING, AERIAL PHOTOGRAPHY
MAPS, AIRPHOTOGRAPHS
1. Surveying and Mapping, Aerial Photography Data
Surveying and mapping, aerial photography data specified in this circular are digitalized materials for data collection, transmission, and distribution.
2. Procedures for Issuing Licenses for Using Radio Frequency to Serve Data Transmission and Distribution
2.1. New issuance; extension; modification and supplementation of the content of the license for using radio frequency and radio transmitting equipment to serve data transmission and distribution shall be implemented according to the provisions of Decree No. 24/2004/NĐ-CP dated January 14, 2004, detailing the implementation of certain articles of the Ordinance on Posts and Telecommunications regarding radio frequencies.
2.2. Within twenty working days from the date of receiving complete valid documents, the Ministry of Posts and Telecommunications is responsible for issuing the license for using radio frequency according to regulations.
3. Review of Content of Surveying and Mapping, Aerial Photography Data Belonging to State Secret Documents Managed by the Ministry of Natural Resources and Environment Before Transmission and Distribution
3.1. When transmitting or distributing surveying and mapping, aerial photography data belonging to state secret documents managed by the Ministry of Natural Resources and Environment, organizations and individuals must submit a request for review to the Ministry of Natural Resources and Environment. The request must clearly specify the content of the data to be transmitted or distributed, the means and equipment for transmission and distribution, duration and time of distribution, recipients of the data, and purpose of use.
3.2. Within twenty working days from the date of receipt of the request, the Ministry of Natural Resources and Environment must provide a response in writing to the organization or individual. In case of disagreement, the reasons must be clearly stated.
4. Transmission and Distribution of Surveying and Mapping, Aerial Photography Data
4.1. The transmission and distribution of surveying and mapping, aerial photography data within the scope of state secrets managed by the Ministry of Natural Resources and Environment must have the written approval of the Ministry of Natural Resources and Environment.
The content of surveying and mapping, aerial photography data belonging to state secret documents when transmitted or distributed must comply with regulations on protecting state secrets.
4.2. Transmission and distribution stations may only transmit and distribute permitted content and must ensure the accuracy and authenticity of the data and signal transmission duration and time of the stations.
4.3. Transmission and distribution stations of surveying and mapping, aerial photography data must strictly adhere to the content of the license and registered transmission and distribution schedules; in case of interruption in transmission and distribution time, the unit responsible for transmitting and distributing signals and data must notify the direct state management agency and organizations and individuals who have registered for use. At least twenty days before any network configuration changes or cessation of operations, transmission and distribution stations of surveying and mapping, aerial photography data must report to the licensing authority under the Ministry of Posts and Telecommunications.
4.4. The transmission and distribution of surveying and mapping, aerial photography data for defense and security purposes shall be regulated by the Ministry of National Defense and the Ministry of Public Security.
Chapter IV
IMPLEMENTATION
1. This Circular shall take effect fifteen days after its publication in the Official Gazette.
2. Ministries, agencies at the level of ministries, government-affiliated agencies, People's Committees of provinces and centrally-administered cities; organizations and individuals involved in aerial photography activities and data collection, transmission, and distribution of surveying and mapping, aerial photography are responsible for implementing this Circular. Any difficulties encountered during implementation should be promptly reported to the relevant ministries for resolution./.
