Decision No. 06/2006/QĐ-BLĐTBXH Amending and Supplementing Certain Provisions of the Regulations on Procedures for Establishing and Registering Vocational Training Activities for Colleges of Vocational Education and Intermediate Technical Schools issued together with Decision No. 05/2006/QĐ-BLĐTBXH dated July 10, 2006 of the Minister of Labor, Invalids and Social Affairs.

DECISION

Amending and supplementing certain provisions of the regulations on procedures for establishing and registering vocational training activities for vocational colleges and intermediate vocational schools issued together with Decision No. 05/2006/QĐ-BLĐTBXH dated July 10, 2006 of the Minister of Labor, War Invalids and Social Affairs

THE MINISTER OF LABOR, WAR INVALIDS AND SOCIAL AFFAIRS

Pursuant to the Education Law dated June 14, 2005;

Pursuant to the Labor Code on June 23, 1994, and the Law Amending and Supplementing Certain Provisions of the Labor Code on April 2, 2002;

Pursuant to Decree No. 29/2003/NĐ-CP dated March 31, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Labor, War Invalids and Social Affairs;

Pursuant to Decision No. 05/2006/QĐ-BLĐTBXH dated July 10, 2006 of the Minister of Labor, War Invalids and Social Affairs promulgating the regulations on procedures for establishing and registering vocational training activities for vocational colleges and intermediate vocational schools;

At the proposal of the Director General of the Vocational Training Administration,

DECISION:

Article 1. Amending and supplementing certain provisions of the regulations on procedures for establishing and registering vocational training activities for vocational colleges and intermediate vocational schools issued together with Decision No. 05/2006/QĐ-BLĐTBXH dated July 10, 2006 of the Minister of Labor, War Invalids and Social Affairs as follows:

1. Amend the content of point a Clause 2 Article 3 and point a Clause 2 Article 5 as follows:

"In accordance with the planning of the network of vocational training institutions;"

2. Amend and supplement the content of Clause 2 Article 4 as follows:

"Within twenty working days from the date of receiving complete valid files, the Ministry of Labor, War Invalids and Social Affairs shall take the lead and coordinate with the Ministry of Planning and Investment, the Ministry of Finance, the Ministry of Home Affairs, and relevant agencies to organize the examination of the establishment project feasibility study and other conditions specified in Article 3 of the regulations issued together with Decision No. 05/2006/QĐ-BLĐTBXH dated July 10, 2006, and submit to the Minister of Labor, War Invalids and Social Affairs for consideration and decision. In cases where the conditions for establishment are not met, a written response must be provided to the proposing agency, organization, or individual, specifying the reasons."

3. Amend and supplement the content of point b Clause 2 Article 6 as follows:

"Within twenty working days from the date of receiving complete valid files, the Department of Labor, War Invalids and Social Affairs shall take the lead and coordinate with relevant agencies to organize the examination of the establishment project feasibility study and other conditions specified in Article 5 of the regulations issued together with Decision No. 05/2006/QĐ-BLĐTBXH dated July 10, 2006, and submit to the Chairman of the People's Committee of the province."

Article 2. This Decision takes effect fifteen days after its publication in the Official Gazette.

Article 3. The Heads of Ministries, ministerial-level agencies, agencies under the Government, Leaders of central agencies of political and social organizations having intermediate vocational schools and vocational colleges under their jurisdiction; Chairmen of Provincial People's Committees; Directors of Departments of Labor, War Invalids and Social Affairs, Heads of the Office of the Ministry, Director of the Vocational Training Administration, Heads of agencies and units concerned are responsible for implementing this Decision./.
