CIRCULAR
Guidelines for Implementing Certain Provisions of Decree No. 106/2005/NĐ-CP dated August 17, 2005 of the Government
detailing and guiding the implementation of certain provisions of the Electricity Law on the protection of high-voltage power transmission line structures

Pursuant to Decree No. 55/2003/NĐ-CP dated May 28, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Industry;
Pursuant to Decree No. 106/2005/NĐ-CP dated August 17, 2005 of the Government stipulating detailed regulations and guiding the implementation of certain provisions of the Electricity Law on the protection of high-voltage power transmission line structures;
The Ministry of Industry issues guidelines for implementing certain provisions of Decree No. 106/2005/NĐ-CP dated August 17, 2005 of the Government stipulating detailed regulations and guiding the implementation of certain provisions of the Electricity Law on the protection of high-voltage power transmission line structures as follows:
1. Strengthening safety measures regarding electricity and construction for the section of overhead line specified in point a, Clause 2, Article 2 of Decree No. 106/2005/NĐ-CP shall be implemented as follows:
a) The cross-sectional area of conductors and lightning arresters shall not be less than that specified in the following table:

b) The safety factor of conductors and lightning arresters shall not be less than 2.5 and shall be calculated according to the formula below:

- KAT is the safety factor;
- sKĐ is the tensile strength of the conductor;
- sCD is the actual calculated tension of the conductor.
c) Conductors and lightning arresters shall not have joints. In case of conductors with a cross-sectional area of 240mm² or more, only one joint is allowed for each conductor within a span between two poles;2 d) Insulation must be arranged in double layers using two insulators of the same type and technical characteristics. If conductors and lightning arresters are mounted on suspension insulators, fixed support clamps must be used.
The safety factor of insulation: under normal operating conditions, it shall not be less than 2.7; under average annual temperature conditions without wind, it shall not be less than 5.0; under fault conditions, it shall not be less than 1.8.
The safety factor of accessories: under normal operating conditions, it shall not be less than 2.5; under fault conditions, it shall not be less than 1.7.
Specifically, the safety factor of the insulator foot under normal operating conditions shall not be less than 2.0; under fault conditions, it shall not be less than 1.3;
e) Poles must be made of steel or reinforced concrete. The safety factor of the pole, beam, and foundation shall not be less than 1.2;
f) Overloading operation of this section of the line is not permitted.
2. Protective conduit
specified in Clause 3, Article 2 of Decree No. 106/2005/NĐ-CP is a rigid plastic pipe or a metal pipe. 3. Technical standards and purposes of insulated conductors
a) They are overhead electrical conductors specifically designed for aerial lines, with an outer jacket capable of withstanding the phase voltage of the applied voltage level;
b) Insulated conductors must be mounted on insulators as if they were bare conductors;
c) Insulated conductors are used to reduce the width of the safety clearance zone for high-voltage power transmission line structures (hereinafter referred to as the safety clearance zone), reducing the number of trees that need to be pruned during construction and operation of the power transmission line.
4. Static clearance height according to inland waterway technical grade
specified in Clause 3, Article 3 of Decree No. 106/2005/NĐ-CP is defined in TCVN 5661-1992 Classification of Inland Waterways, specifically as follows: Grade of waterway

5. specified in point b, Clause 1, Article 5 of Decree No. 106/2005/NĐ-CP are trees of historical and cultural value recognized in writing by the People's Committee of the province or centrally governed city and must meet the following requirements: a) Trees must be cut and trimmed to ensure that the distance from any part of the tree to the conductor when the conductor is in its static position is not less than the values specified in the following table:

6. Fast-growing trees
specified in Clause 3, Article 5 of Decree No. 106/2005/NĐ-CP are trees that have regrown within a cycle of clearing the safety clearance zone and can cause power grid incidents. The cycle of clearing the safety clearance zone is once every three months.
7. Cutting and trimming trees to ensure safe distances
For trees inside and outside the safety clearance zone, they must be cut and trimmed to ensure safe distances as stipulated in Article 5 of Decree No. 106/2005/NĐ-CP. For trees of historical and cultural value or special significance, before cutting and trimming, the power transmission line management unit must negotiate with the direct managing authority of the tree. In case of disagreement, the power transmission line management unit must submit a written request to the provincial People's Committee for resolution.
During new construction or repair and replacement of high-voltage lines, to ensure safety during construction, the project owner may cut and trim some trees without violating the safe distance stipulated in Article 5 of Decree No. 106/2005/NĐ-CP, but must negotiate and compensate the tree owners according to the law.
8. A 0.5 meter distance
specified in Clause 4, Article 5 of Decree No. 106/2005/NĐ-CP is measured from the outer edge of the exposed part of the foundation or anchor above ground (for foundations or anchors protruding above ground) or from the outer edge of the fill at the base of the foundation or anchor adjacent to the natural ground surface according to design plans (for foundations or anchors buried underground). 9. Non-combustible materials
9. Non-combustible materials As defined at point a, Clause 1, Article 6 of Decree 106/2005/NĐ-CP, it is material that does not ignite, smolder, or undergo carbonization when exposed to fire or high temperatures.
10. Grounding As defined at point b, Clause 1, Article 6 of Decree 106/2005/NĐ-CP, shall be implemented as follows:
a) The roof covering, house frame, and metal fence shall be connected to grounding rods with grounding wires.
b) Grounding rods shall be made of round steel with a diameter of no less than 16mm or angle steel with dimensions of no less than 40 x 40 x 4mm; the length shall be no less than 1.0m placed vertically into the ground, with one end protruding above the ground from 0.1m to 0.15m; the location for placing the grounding rod shall not obstruct the users of the residential building or structure. Grounding wires may be made of round steel with a diameter of no less than 6mm; flat steel with dimensions of no less than 24 x 4mm; flexible copper wire with a cross-sectional area of no less than 16mm2; if the grounding wire is made of steel, it must be galvanized or coated with rust-proof paint;
c) The grounding wire shall be connected to the part of the grounding rod, roof covering, house frame, and metal fence that is above ground level using bolts or welding;
d) The owner and lawful user of the structure within the safety zone have the responsibility to manage the grounding system. Upon discovering damage or abnormal conditions, they must immediately report to the unit managing and operating the high-voltage power grid for coordination in resolution;
đ) The owner, management unit, and lawful user of newly constructed or renovated structures shall bear all costs for the installation, maintenance, and repair of the grounding system.
11. The placement of warning signs and markings as stipulated in Article 9 of Decree 106/2005/NĐ-CP shall be implemented as follows:
a) For overhead power lines, safety warning signs according to TCVN 2572-78 type 2aX must be fixed on the pole or printed directly onto the pole using a sign mold type 2K at a height of 2.0 to 2.5m facing towards where it can be easily seen. Safety warning signs must be placed or printed on all poles;
b) For underground power cables, markers or warning signs "ELECTRIC POWER CABLE" must be placed on the ground at the centerline of the cable trench. Markers or warning signs must be placed in locations that allow the cable route to be identified at all positions; the distance between adjacent markers or signs shall not exceed 30m;
c) For substations enclosed by a fence, safety warning signs according to TCVN 2572-78 type 1aX must be directly affixed to the door or gate of the substation;
d) For suspended substations, safety warning signs must be placed on the pole supporting the substation as specified for overhead lines;
đ) At substations, in addition to safety warning signs, fire safety warning signs must also be placed in accordance with laws on fire prevention and firefighting.
12. Regarding agreements when constructing or renovating houses or structures within the safety zone
a) The project investor, owner, or lawful user of the house or structure (hereinafter referred to as the structure) must submit a written request to the unit managing and operating the high-voltage power grid. The format of the request is specified in Appendix 1.
Within ten working days from the date of receipt of the request, the unit managing and operating the high-voltage power grid must conduct a site survey along the proposed construction or renovation section of the power line.

b) In cases where the relevant parties cannot reach an agreement, the matter shall be referred to the Industry Department for resolution;
c) The costs to ensure safety measures for electrical transmission lines (if any) shall be borne by the project investor and the owner of the facility.
13. Handling violations of regulations on the protection of high-voltage power grid safety
a) Upon discovering violations of regulations on the protection of high-voltage power grid safety, the entity managing and operating the high-voltage power grid shall immediately notify the organization or individual committing the violation; request them to cease such violations; and restore the initial state altered by their violations. The Notification Form is specified in Appendix 3;
b) If the organization or individual committing the violation continues to carry out such violations or fails to restore the initial state altered by their violations, the entity managing and operating the high-voltage power grid shall report to the competent state management agency to handle the case according to Decree No. 74/2003/NĐ-CP dated June 26, 2003 of the Government on administrative penalties for violations in the electricity sector and Circular No. 03/2003/TT-BCN dated November 19, 2003 of the Ministry of Industry guiding the implementation of certain provisions of Decree No. 74/2003/NĐ-CP dated June 26, 2003 of the Government on administrative penalties for violations in the electricity sector.
14. Responsibilities of the investor of high-voltage power grid projects and the entity managing and operating the high-voltage power grid
a) Prior to energization, the investor of the high-voltage power grid project must complete the relocation or renovation of houses and structures, and trimming of trees in accordance with Decree No. 106/2005/NĐ-CP. Unresolved issues must be documented, with consensus from the entity managing and operating the high-voltage power grid regarding the nature of the issues, remedial measures, and timeframe for resolution;
b) The investor of the high-voltage power grid project must hand over all relevant files related to compensation and support for the relocation and renovation of houses and structures within the protected zone of the high-voltage power grid to the entity managing and operating the high-voltage power grid.
15. Effective Date
This Circular shall take effect fifteen days from the date of publication in the Official Gazette and shall replace Circular No. 07/2001/TT-BCN dated September 11, 2001 of the Ministry of Industry guiding the implementation of certain technical contents stipulated in Decree No. 54/1999/NĐ-CP dated July 8, 1999 of the Government on the protection of high-voltage power grid safety.
During implementation, if any difficulties arise, they are requested to be reported to the Ministry of Industry for consideration and resolution./.
