CIRCULAR
Guidelines for amending and supplementing Clause 2, Section III, Part I of Circular No. 04/2008/TT-BNV
dated June 4, 2008, issued by the Ministry of Home Affairs guiding the functions, tasks, powers, and organizational structure of the Department of Home Affairs, the Home Affairs Office under the People's Committees at provincial and district levels

Pursuant to Decree No. 178/2007/NĐ-CP dated December 3, 2007, issued by the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;
Pursuant to Decree No. 13/2008/NĐ-CP dated February 4, 2008, issued by the Government stipulating the organization of specialized agencies under the People's Committees of provinces and centrally-run cities;
Pursuant to Decree No. 14/2008/NĐ-CP dated February 4, 2008, issued by the Government stipulating the organization of specialized agencies under the People's Committees of districts, towns, and centrally-run cities within provinces;
Pursuant to Decree No. 48/2008/NĐ-CP dated April 17, 2008, issued by the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Home Affairs;
The Ministry of Home Affairs guides the amendment and supplementation of Clause 2, Section III, Part I of Circular No. 04/2008/TT-BNV dated June 4, 2008, issued by the Ministry of Home Affairs guiding the functions, tasks, powers, and organizational structure of the Department of Home Affairs, the Home Affairs Office under the People's Committees at provincial and district levels (hereinafter referred to as Circular No. 04/2008/TT-BNV dated June 4, 2008, of the Ministry of Home Affairs) as follows:
I. CONTENT OF AMENDMENTS AND SUPPLEMENTS TO CLAUSE 2, SECTION III, PART I OF CIRCULAR NO. 04/2008/TT-BNV DATED JUNE 4, 2008 ISSUED BY THE MINISTRY OF HOME AFFAIRS
2. Organizational Structure of the Department:
2.1. Advisory and specialized units assisting the Director of the Department in performing state management functions, not exceeding nine units, including:
a) Office;
In cases where the Department of Finance has fewer specialized departments than those listed above, the provincial people's committee decides on adjustments to the names and functions of the departments to ensure comprehensive coverage of all areas under management and compliance with legal provisions.
c) Specialized and professional departments:
Based on the volume of work, nature, and characteristics of home affairs management in the locality, the Director of the Department of Home Affairs shall submit to the Chairman of the People's Committee at the provincial level for decision on the name and number of specialized and professional departments to cover areas such as organizational structure; staffing; salary; building of administrative bodies; cadres, civil servants, public officials; grassroots cadres and civil servants; training and capacity building for cadres and civil servants; administrative reform... in a streamlined, reasonable, practical, effective manner;
d) Department of Archival Management and Records;
đ) Board of Awards and Commendations;
e) Depending on the nature, characteristics, and requirements of each locality, the People's Committee at the provincial level shall decide to establish the Religious Affairs Board or the Chairman of the People's Committee at the provincial level shall decide to establish the Religious Affairs Department;
The Board of Awards and Commendations, the Religious Affairs Board (if established) is an equivalent agency directly under the Department with legal personality, having its own bank account and seal.
2.2. Affiliated Public Service Organizations of the Department:
- Provincial Archives Center (the Department of Home Affairs will take over the Provincial Archives Center under the People's Committee Office in its original form).
- The Director of the Department of Home Affairs shall submit to the People's Committee at the provincial level for decision on the establishment of other affiliated public service organizations of the Department in accordance with the provisions of the law.
II. EFFECTIVE DATE OF IMPLEMENTATION
This Circular shall take effect 15 days from the date of publication in the Official Gazette. Provisions in Circular No. 04/2008/TT-BNV dated June 4, 2008, of the Ministry of Home Affairs that are not amended or supplemented in this Circular remain in force.
During the implementation of this Circular, if there are any difficulties, organizations and individuals are requested to report to the Ministry of Home Affairs for study and revision./.
