CIRCULAR

Guidelines for developing agricultural, forestry, and fisheries production plans and resettling residents in 61 poor districts

Pursuant to Decree No. 01/2008/NĐ-CP dated January 3, 2008, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;
Pursuant to Resolution No. 30a/2008/NQ-CP dated December 27, 2008 of the Government on the Program to rapidly and sustainably reduce poverty in 61 poor districts;
Pursuant to Decree No. 92/2006/NĐ-CP dated September 7, 2006 of the Government on the establishment, approval, and management of comprehensive socio-economic development planning, and Decree No. 04/2008/NĐ-CP dated January 11, 2008 amending and supplementing certain articles of Decree No. 92/2006/NĐ-CP;
The Ministry of Agriculture and Rural Development hereby provides guidelines for developing agricultural, forestry, and fisheries production plans and resettling residents in 61 poor districts as follows:

Part I

GENERAL PROVISIONS

I. SCOPE OF REGULATION AND APPLICABLE OBJECTS

2. Applicability: These guidelines provide guidance on the content, procedures for preparation, review, approval, and implementation of agricultural, forestry, and fisheries production plans and resettlement plans for 61 poor districts (hereinafter referred to as production and resettlement plans).

a. Objectives for the agricultural, forestry, and fisheries production plan

Provincial People's Committees with poor districts under the Program for Rapid and Sustainable Poverty Reduction in 61 Poor Districts according to Resolution No. 30a/2008/NQ-CP dated December 27, 2008 of the Government.

b. Objectives for the resettlement plan

- Households residing in difficult areas such as lacking land, water for production, water for daily use, infrastructure but unable to change crop structures, livestock breeds, or develop industries or receive investment support to stabilize the population.

- Households residing in areas frequently threatened by natural disasters or at high risk of natural disasters such as riverbank erosion, flash floods, landslides, subsidence, and tornadoes.

- Households residing scattered in critical and very critical areas of protective forests and special-use forests.

- Households currently residing in border communes.

II. PRINCIPLES FOR DEVELOPING AND IMPLEMENTING PLANS

1. Ensuring synchronization and consistency at commune, district, and provincial levels; meeting the objectives of the Program for Rapid and Sustainable Poverty Reduction in 61 Poor Districts; being suitable and leveraging local advantages; aligning with the overall socio-economic development strategy of the district, guiding agricultural, forestry, and fisheries development throughout the province and region; closely integrating economic and social development, environmental protection, and national defense and security.

2. During the process of developing and implementing plans in poor districts, it is necessary to mobilize and integrate various resources for development, involve multiple agencies and community groups to enhance commitment and responsibility. In resettling residents, priority should be given to areas frequently affected by natural disasters, areas at high risk of natural disasters, extremely difficult areas, and areas of strategic importance for national defense and security.

III. PERIOD OF PLAN DEVELOPMENT

The development of production and resettlement plans for poor districts will cover the period from 2010 to 2020, divided into stages: 2009-2010, 2011-2015, and 2016-2020.

Part II

CONTENTS, PROCEDURES FOR PREPARATION, APPROVAL, AND IMPLEMENTATION OF PRODUCTION AND RESIDENTIAL RELOCATION PLANS IN POOR DISTRICTS

I. CONTENTS OF THE PRODUCTION AND RESIDENTIAL RELOCATION PLAN

The contents of the production and residential relocation plan must include:

1. Evaluation and analysis of current agricultural, forestry, and fisheries development

- Evaluating and analyzing the current status and development process of the agricultural, forestry, and fisheries sectors within the district, including crop structure, livestock structure, forestry, and fisheries; the role and contribution of each component to the overall industry economy and job creation and income generation for rural residents.

- Analyzing and evaluating major products, main production areas, investments, technology, labor, production organization, and limitations affecting crop and livestock productivity, labor productivity, and income of agricultural workers.

- Analyzing and evaluating the current status of agricultural land use (agriculture, forestry, fisheries), including production area scale, crop area structure, area distribution, yield, and output.

- Evaluating the application of technology and techniques in agriculture, forestry, and fisheries production. Current service provision and technology transfer to producers, especially poor households. The system of agricultural extension services in the district and support for poor farmers. Evaluating the support for agricultural, forestry, and fisheries production, particularly for forest management contracts, forest allocation, and land allocation for commercial forest planting and benefit sharing from forest products.

- The current status of processing systems and scales of agricultural, forestry, and aquatic product processing facilities in the district; organization of processing, supply chain organization, and linkage between raw material producers and processing facilities.

- Analyzing and evaluating the current status of agricultural product market access and consumption capacity of the district.

2. Evaluation of current resident distribution

- Evaluating and analyzing the current status of residents in poor districts, particularly ethnic minority areas, difficult areas, disaster-prone areas, border areas, and critical and very critical areas of protective and special-purpose forests.

- Evaluating the results of recent five-year resident resettlement efforts, implementation scale, policies applied, investment capital, and factors influencing implementation.

- Determining the need for resident resettlement according to the categories and areas specified in Part I, Section 1, Point 2, Clause b of this Circular.

3. Establishing viewpoints and goals

- Accelerating improvements in the material and spiritual lives of poor people and ethnic minorities in poor districts, ensuring parity with other districts in the region by 2020. Supporting sustainable agricultural and forestry development, moving towards commodity production, and effectively utilizing local strengths. Implementing economic restructuring and effective organizational forms of production according to the plan. Building a stable rural society rich in ethnic cultural identity; raising public awareness, protecting the ecological environment; ensuring solid national defense and security.

- In 2010, reduce the poverty rate below 40% (according to the poverty standard prescribed in Decision No. 170/2005/QĐ-TTg dated July 8, 2005); basically complete the allocation of land and forests; provide food subsidies for people in areas where production organization is not possible, border regions to ensure their livelihoods. Create initial changes in agricultural, forestry, and fisheries production, rural economy, and improve the living standards of the people based on promoting agricultural production, protecting and developing forests; strengthen research and transfer of agricultural science and technology advancements, train farmers with the proportion of trained, instructed, and trained farmers reaching over 25%.

- In 2015, reduce the poverty rate to be equal to the average level of the province. Strengthen the capacity of the people and communities to effectively utilize essential infrastructure projects invested in, gradually leverage geographical advantages, and efficiently exploit natural resources; initially develop small and medium-scale commodity production, allowing farmers to conveniently access production services and product consumption markets. Agricultural labor should remain under 60% of total social labor; the proportion of rural laborers trained, instructed, and trained should reach over 40%.

- In 2020, reduce the poverty rate to be equal to the average level of the region. Solve basic issues related to production, employment, and income to improve the living standards of residents in poor districts by five to six times compared to the current situation. Agricultural labor should account for about 50% of total social labor. Continue training farmers, bringing the proportion of trained, instructed, and trained farmers to around 50%; approximately 50% of communes should meet the new rural standards. Develop a synchronized economic and social infrastructure structure in rural areas, primarily the irrigation system ensuring proactive irrigation and drainage for the entire paddy area capable of two crops, expanding irrigation for vegetables and industrial crops; provide clean drinking water for most rural residents.

4. Develop and select planning schemes

- Determine growth schemes and production structure schemes for each period.

- Determine schemes for resettling and rearranging the population.

- Evaluate the schemes and select those that are suitable for resource capabilities and other fundamental factors to meet requirements.

5. Specific planning arrangement

a. Agricultural production planning

- Determine the scale, structure, and distribution of major crop and livestock production zones within the district.

- Propose production models and organizational models for crop and livestock production in various regions and main production types.

- Determine the types of products and development scales of major crop and livestock products of the district and regions. For poor districts with complex terrain and fragmented areas, pay attention to local crops, livestock, specialty products, and easily transportable products to market.

- Determine the system of support services for agricultural extension, technology transfer to enhance the capacity of district agricultural extension stations. Determine the requirements for purchasing crop and livestock seeds, planting fodder for livestock, vaccines according to production support policies.

- Determine regions with potential for developing commodity agricultural production linked with product processing systems and regional raw material linkage mechanisms.

b. Forestry production planning

- Determine the structure of three types of forests in the district, including protective forests, special-use forests, and productive forests.

- For each type of forest and land designated for afforestation, determine the scale, area allocated to households for forest protection contracts, encirclement and regeneration of forests, forest care, and new planting areas; for natural productive forests planned to be allocated to households, before allocation, classify forests according to rich, medium, and poor stock levels.

- Propose production models and organizational models for forestry production suitable for local ecological conditions and market demand.

- Arrange the development of productive forest regions linked with the development of product processing and consumption systems.

c. Fisheries production planning

- Determine the scale, structure, and distribution of aquaculture production within the district.

- Propose production models and organizational models for fisheries production suitable for various regions and main production types; determine the direction of development for each region and appropriate organizational models.

- Determine the types of products and scale of major aquaculture products of the district combined with maintaining and protecting aquatic resources and diversifying farmers' income sources.

- Arrange the development of aquaculture production regions linked with the development of processing and consumption systems and regional raw material linkage mechanisms.

- Determine the volume of production support required and the provision of fisheries extension services and production seed support according to the Poverty Reduction Support Program.

d. Population resettlement planning

- Determine the number of households and individuals needing to be resettled and rearranged, categorized by target group, location, and resettlement form.

- Determine the list of resettlement areas in priority order, implementation progress by phase and year to select planning and resettlement schemes.

- Arrange infrastructure systems serving life and production in project-planned resettlement areas.

- Determine the progress schedule for population resettlement and rearrangement.

- Determine capital investment needs and categorize by source of investment.

6. Implementation measures for planning

a. Policy measures

- Land production support policy for poor districts as stipulated in Section II, Clause A, Point 2 of Resolution No. 30a/2008/NQ-CP dated December 27, 2008.

- Support policy through forest management contracts, forest allocation, and land allocation for planting in poor districts as stipulated in Section II, Clause A, Point 1 of Resolution No. 30a/2008/NQ-CP dated December 27, 2008.

- Development policy for agricultural, forestry, and fisheries production infrastructure systems for poor districts applicable to specific groups.

- Development policy for agricultural extension service systems and production technology transfer to support poor district farmers as stipulated in Section II, Clause A, Point 4 of Resolution No. 30a/2008/NQ-CP dated December 27, 2008.

- Policy to encourage the development of enterprises, cooperatives, cooperative groups, and farms investing in agricultural, forestry, and fisheries production, processing, and trade to contribute to product consumption, job creation, and income generation in poor districts as stipulated in Point 5 of Section II, Clause A of Resolution No. 30a/2008/NQ-CP dated December 27, 2008.

- Credit policy for producers in poor districts as stipulated in the points of Section II, Clause A of Resolution No. 30a/2008/NQ-CP dated December 27, 2008.

- Policy to promote training, vocational education, and technical training for producers as stipulated in Section II, Clause B of Resolution No. 30a/2008/NQ-CP dated December 27, 2008.

- Policy to strengthen cadres in poor districts including state management cadres and technical cadres as stipulated in Section II, Clause C of Resolution No. 30a/2008/NQ-CP dated December 27, 2008.

- Investment policy for infrastructure at village, commune, and district levels as stipulated in Section II, Clause D of Resolution No. 30a/2008/NQ-CP dated December 27, 2008.

- Land policies and direct support policies for households resettled, investment construction policies for infrastructure in areas planned for population resettlement, and other necessary policies as prescribed in Decision No. 193/2006/QĐ-TTg dated August 24, 2006 of the Prime Minister approving the Program on Population Resettlement in Disaster Prone Areas, Particularly Difficult Areas, Border Areas, Marine Islands, Free Migration, Weak and Very Weak Protective Forests, Strictly Protected Special Use Forests for the period 2006-2010 with orientation towards 2015, Decisions No. 78/2008/QĐ-TTg dated June 10, 2008; No. 160/2007/QĐ-TTg dated October 17, 2006; No. 120/2003/QĐ-TTg dated June 11, 2003; No. 24/2008/QĐ-TTg dated February 5, 2008; No. 25/2008/QĐ-TTg dated February 5, 2008; No. 27/2008/QĐ-TTg dated February 5, 2008.

b. Solutions regarding capital sources and capital mobilization

Capital for implementing production planning and population resettlement is mobilized from various sources: state budget, ODA, government bonds, investment credit, contributions from businesses and residents; capital for integration from existing programs and projects recorded in annual and five-year plans.

c. Implementation organization solutions

- Organizing the command and coordination body for implementation of the plan

- Operation mechanism and management of plan implementation

- Functions and tasks of agencies, units, and localities participating in plan implementation

- Steps and progress of plan implementation

- Inspection, monitoring, evaluation, and reporting mechanisms for plan implementation

II. STEPS FOR PLAN DEVELOPMENT

1. Drafting the outline and budget estimate for plan development, submitting to the competent authority for approval.

2. Implementing plan development including: Synthesizing research results; analyzing, evaluating, and forecasting; identifying advantages and difficulties; developing and selecting plan options.

3. Reviewing and approving the plan: Provincial People's Committees organize the review and approval of production planning and population resettlement in poor districts within their jurisdiction after obtaining unified opinions from the Ministry of Agriculture and Rural Development on objectives, directions, and organizational implementation solutions, and sending them to relevant ministries for consolidation.

Part III

ORGANIZATION AND IMPLEMENTATION

1. The Ministry of Agriculture and Rural Development:

- Guiding provincial people's committees in developing production planning and population resettlement, preparing investment projects for submission to the competent authority for approval; drafting annual and five-year investment plans for submission to the Prime Minister for approval.

- Coordinating with the Ministry of Planning and Investment and the Ministry of Finance in allocating funds for implementation in poor districts.

- Leading the coordination with related ministries and sectors in researching and adjusting policies for implementing production planning and population resettlement in poor districts.

- Directing localities to implement production planning and population resettlement according to annual and emergency plans due to natural disasters.

- Inspecting, supervising, and evaluating the implementation of production planning and population resettlement in poor districts.

2. Ministries: The Ministry of Planning and Investment, the Ministry of Finance, and related ministries shall perform the tasks assigned by the Prime Minister in Resolution No. 30a/2008/NQ-CP dated December 27, 2008 of the Government.

3. Provincial People's Committees:

- Preparing production planning and population resettlement, economic and technical reports, and investment reports for approval by the Chairman of the Provincial People's Committee; completing production planning and population resettlement by 2009.

- Developing plans for the development of production and population resettlement in poor districts from now until 2010, 2015, and 2020; annual plans and consolidating funding needs for submission to the Ministry of Agriculture and Rural Development, the Ministry of Planning and Investment, the Ministry of Finance, and the Ministry of Labor, Invalids, and Social Affairs for submission to the Prime Minister for approval.

- Integrating funding from programs and projects on their territory to implement production development and population resettlement.

- Strengthening management, inspection, and supervision of specific investment projects for production development and population resettlement on their territory.

This Circular takes effect 45 days from the date of issuance.

During implementation, if there are any difficulties, ministries, sectors, and localities should promptly report to the Ministry of Agriculture and Rural Development for study, supplementation, and amendment.
