Regulations on periodic reporting on the situation of information technology application in state agencies

Pursuant to Decree No. 64/2007/NĐ-CP dated April 10, 2007 of the Government on the application of information technology in state agency activities;
Pursuant to Decree No. 43/2011/NĐ-CP dated June 13, 2011 of the Government on providing information and online public services on electronic information websites or government portals of state agencies;
Pursuant to Decree No. 187/2007/NĐ-CP dated December 25, 2007 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Information and Communications, and Decree No. 50/2011/NĐ-CP dated June 24, 2011 of the Government amending Decree No. 187/2007/NĐ-CP;
At the proposal of the Director of the Department of Information Technology Application,
The Minister of Information and Communications issues this Circular regulating the periodic reporting system on the situation of information technology application in state agencies.
Article 1. Scope of Regulation and Applicability
This Circular regulates the periodic reporting system on the situation of information technology application for ministries, ministerial-level agencies, agencies under the Government, and provincial People's Committees directly under the Central Government.
Article 2. Content and Reporting Forms
1. The content of the report includes: information technology infrastructure; information technology application in state agency operations; provision of information on electronic information websites or government portals; provision of online public services; information security assurance work; mechanisms, policies, and regulations for information technology application; human resources and investment for information technology application.
2. The reporting forms include:
a) Report on the situation of information technology application for ministries, ministerial-level agencies, and agencies under the Government according to the form prescribed in Appendix I of this Circular;
b) Report on the situation of information technology application for provincial People's Committees according to the form prescribed in Appendix II of this Circular.
Article 3. Reporting Period and Deadline for Submission
1. The reporting period is one year, from January 1 to December 31 of the reporting year.
2. State agencies subject to this Circular shall submit their reports to the Ministry of Information and Communications before February 1st each year.
Article 4. Provisions on Submission of Reports
1. Forms of reports:
a) Reports shall be prepared and submitted in either paper form or electronic form;
b) Paper documents must bear the seal and signature of the head of the reporting agency;
c) Electronic documents must meet at least one of the following requirements:
- Sent via email from an email address confirmed in writing by the reporting agency. The reporting agency is responsible for notifying the email address used for submitting reports in case of any changes;
- Signed electronically by the head of the reporting agency using a digital certificate issued by an organization providing specialized digital signature verification services for agencies within the political system and sent via an official email with a ".gov.vn" domain name or through the electronic document management system of the reporting agency.
2. The reporting format prescribed in Clause 1 of this Article may be adjusted in accordance with regulations on exchanging electronic documents among state agencies from central to local levels over the network.

Article 5. Responsibilities of the Reporting Agency
1. Report fully, accurately, truthfully, and objectively all contents according to the reporting form prescribed in Clause 2, Article 2 of this Circular and bear legal responsibility for the reported contents.
2. Submit reports within the prescribed time limit.
Article 6. Responsibilities of related agencies
1. The Department of Information Technology Application shall be responsible for:
a) Developing reporting forms on the situation of information technology application in electronic document format and posting them on the Ministry of Information and Communications' and the Department of Information Technology Application's electronic information portals. Update the reporting forms in electronic document format when changes occur as prescribed by the Ministry of Information and Communications;
b) Compiling data, drafting, and submitting to the Minister of Information and Communications a report on the situation of information technology application, implementation of online public services, and operation of electronic information portals to report to the Prime Minister before April 30 each year.
2. The specialized units for information technology of ministries, ministerial-level agencies, and government agencies shall be responsible for advising, compiling, and drafting reports on the situation of information technology application in their respective ministries, ministerial-level agencies, and government agencies.
a) Taking the lead and coordinating with relevant agencies at the local level to review and evaluate the installation of public mailboxes and central mail boxes in the locality; requesting project investors, managers of urban areas and concentrated residential zones, management boards, or management and operation units of apartment buildings and office towers to comply with the provisions of this Circular;
a) Guide the relevant departments under the People's Committees of provinces and centrally-administered cities and the People's Committees of districts, counties, towns, and cities under provinces to provide data for building reports on the situation of information technology application in the People's Committees of provinces and centrally-administered cities;
b) Advise, compile, and draft reports on the situation of information technology application in localities.
Article 7. Effective Date
1. This Circular takes effect from May 1, 2013.
2. During the implementation process, if any issues arise or difficulties occur, the agencies need to promptly reflect them to the Ministry of Information and Communications for consideration, supplementation, and amendment./.
