PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

Article 3. Tasks, powers of the Statistics Office

7. Perform other tasks and exercise other powers as prescribed by law.

Article 4. Duties and Authorities of the Director of the General Statistics Office

1. Lead, direct, organize the implementation and inspect specialized statistical inspection work within the scope of management.

2. Report to the Director of the State General Statistics Office for handling overlapping authority, scope, objects, content, and time of inspection within the management scope of the General Statistics Office.

3. Decide on inspections according to the approved specialized inspection plan; conduct surprise inspections when signs of law violations are detected or at the request of the Director of the State General Statistics Office; assign civil servants to perform specialized statistical inspection tasks.

The inspection conducted by the specialized statistical inspection team from the General Statistics Office shall not exceed thirty days; in complex cases, it may be extended but not more than forty-five days. The duration of the inspection is calculated from the date of announcing the inspection decision to the end of the inspection at the inspected location. Extension of the inspection period is decided by the Director of the General Statistics Office.

4. Propose to competent state agencies to amend, supplement, or promulgate regulations in accordance with management requirements; propose suspension or revocation of illegal regulations discovered through inspection work.

5. Administering administrative penalties according to the provisions of law.

6. Perform other duties and authorities as prescribed by law, the Ministry of Planning and Investment, and the State General Statistics Office.

Article 5. Duties and Authorities of the Unit Advising Specialized Statistical Inspection Work

1. Take the lead and coordinate with related units within the agency to develop the inspection plan to submit to the head of the competent agency for approval.

2. Conduct inspections according to the plan, regular inspections, and surprise inspections when assigned by the direct supervisory agency's head.

3. Assist the direct supervisory agency's head in implementing complaint resolution and anti-corruption work; resolve complaints and accusations and prevent corruption in accordance with the law when assigned.

4. Assist the direct supervisory agency's head in summarizing, evaluating, and reporting on specialized statistical inspection work, complaint resolution, and anti-corruption efforts.

5. Assist the direct supervisory agency's head in monitoring, urging, and inspecting the implementation of inspection conclusions, recommendations, and decisions.

6. Handle violations of the law discovered through inspection work within their authority or propose to competent state agencies to handle them.

7. Perform other tasks assigned by the direct supervisory agency's head in accordance with the law.

Chapter III

INSPECTION PLAN OF THE GENERAL STATISTICS OFFICE; INFORMATION AND REPORTING SYSTEM FOR SPECIALIZED STATISTICAL INSPECTION WORK

Article 6. Development and Approval of the Annual Inspection Plan of the General Statistics Office

1. Based on guidelines from the State General Statistics Office, the Director of the General Statistics Office develops the annual inspection plan to submit to the Director of the State General Statistics Office before November 25 of the preceding year. The Director of the State General Statistics Office is responsible for reviewing and approving the inspection plan no later than December 15 of the preceding year.

2. When it is necessary to adjust the approved inspection plan, the Director of the General Statistics Office must report to the Director of the State General Statistics Office for supplementary approval.

3. The development and approval of the annual inspection plan shall be carried out in accordance with Circular No. 01/2014/TT-TTCP dated April 23, 2014, of the Government Inspectorate on the development and approval of inspection program orientations and plans.

4. The inspection plan specified in Clause 1 and Clause 2 of this Article shall be sent to the inspected entities and relevant agencies, organizations, and individuals.

Article 7. Information and Reporting System for Specialized Statistical Inspections

1. Regulations on Sending Inspection Conclusions

a) The inspection conclusions of specialized statistical inspections conducted by the General Statistics Office must be sent to the Inspectorate of the Ministry of Planning and Investment, the inspected entity, the head of the direct supervisory agency of the inspected entity (if any), and related agencies, organizations, and individuals.

b) The inspection conclusions of specialized statistical inspections conducted by the Statistics Bureau must be sent to the General Statistics Office, the inspected entity, the head of the direct supervisory agency of the inspected entity (if any), and related agencies, organizations, and individuals.

2. Regulations on Reporting Inspection Work, Complaint Resolution, and Anti-Corruption

The report on inspection work, complaint resolution, and anti-corruption is a document summarizing the situation and results of inspection work, complaint resolution, and anti-corruption activities of subordinate units under the General Statistics Office with functions, tasks, and authorities in inspection work, complaint resolution, and anti-corruption as prescribed by law.

a) Reporting Responsibilities

The Statistics Bureau is responsible for reporting to the General Statistics Office on its specialized statistical inspection work, complaint resolution, and anti-corruption activities; subordinate units under the General Statistics Office are responsible for reporting to the General Statistics Office on their complaint resolution and anti-corruption activities.

The General Statistics Office is responsible for compiling and reporting to the Minister of Planning and Investment and the Inspectorate of the Ministry of Planning and Investment on its specialized statistical inspection work, complaint resolution, and anti-corruption activities.

b) Types of Reports

Periodic Report is a quarterly, six-monthly, nine-monthly, and annual report on inspection work, complaint resolution, and anti-corruption.

Special Topic Report, Ad Hoc Report according to the requirements of the Minister, the Chief Inspector of the Ministry of Planning and Investment, and the Director of the General Statistics Office.

c) Content of Periodic Reports on Inspection Work, Complaint Resolution, and Anti-Corruption

shall be carried out according to the outline and forms specified in Appendix 1 issued together with this Circular.

d) Data Collection Period and Deadline for Submitting Periodic Reports

Quarterly Report I: Data collection period from December 10 of the previous year to March 9 of the reporting year. The General Statistics Office sends the report to the Inspectorate of the Ministry of Planning and Investment before March 15 of the reporting year. The Statistics Bureau sends the report to the General Statistics Office before March 10 of the reporting year.

Six-Monthly Report: Data collection period from December 10 of the previous year to June 9 of the reporting year. The General Statistics Office sends the report to the Inspectorate of the Ministry of Planning and Investment before June 15 of the reporting year. The Statistics Bureau sends the report to the General Statistics Office before June 10 of the reporting year.

Nine-Monthly Report: Data collection period from December 10 of the previous year to September 9 of the reporting year. The General Statistics Office sends the report to the Inspectorate of the Ministry of Planning and Investment before September 15 of the reporting year. The Statistics Bureau sends the report to the General Statistics Office before September 10 of the reporting year.

Annual Report: Data collection period from December 10 of the previous year to December 9 of the reporting year. The General Statistics Office sends the report to the Inspectorate of the Ministry of Planning and Investment before December 15 of the reporting year. The Statistics Bureau sends the report to the General Statistics Office before December 10 of the reporting year.

Chapter IV

e) Data Collection Period and Deadline for Submitting Ad Hoc Reports shall be carried out according to the requirements of the Minister of Planning and Investment, the Chief Inspector of the Ministry of Planning and Investment, and the Director of the General Statistics Office.

Article 8. Criteria for persons assigned to perform specialized statistics inspection tasks

1. Persons assigned to perform specialized statistics inspection tasks are civil servants within the establishment of the General Statistics Office and the Statistics Departments (hereinafter referred to as specialized statistics inspection civil servants).

2. Specialized statistics inspection civil servants must meet the following criteria:

a) Having the qualifications and standards prescribed for the rank of Statistician or higher, assigned to perform specialized statistics inspection tasks;

b) Having at least one year of professional work experience in the field assigned to perform specialized statistics inspection tasks;

c) Possessing inspection skills.

Article 9. Uniforms of specialized statistics inspection civil servants

1. Specialized statistics inspection civil servants belonging to the advisory units for specialized statistics inspection work of the General Statistics Office and the Statistics Departments shall be provided with uniforms.

2. The uniforms of specialized statistics inspection civil servants shall be implemented according to Circular No. 03/2010/TT-TTCP dated July 16, 2010, of the Government Inspectorate guiding the colors, materials, specifications, and management and use of uniforms for inspectors and staff members of state inspectorates.

3. The issuance of uniforms shall be carried out in accordance with Joint Circular No. 150/2007/TTLT-BTC-TTCP dated December 14, 2007, of the Ministry of Finance and the Government Inspectorate guiding the management and issuance system of uniforms for inspectors and staff members of state inspectorates.

4. The cost of making and equipping uniforms for specialized statistics inspection civil servants shall be funded from the state budget and allocated in the annual budget of the agency or unit.

5. The uniforms of specialized statistics inspection civil servants shall only be used when performing inspection tasks and on inspection sector holidays. Specialized statistics inspection civil servants have the responsibility to maintain the uniforms provided.

Article 10. Badges, signs, and identification cards of specialized statistics inspection civil servants

1. Badges of specialized statistics inspection civil servants

The badge is the emblem of specialized statistics inspection, the badge is sewn on the sleeve, attached to the peaked cap, printed on the sign.

The center of the specialized statistics inspection badge has the emblem of the Statistics sector on a dark blue background; above it is the phrase "GENERAL STATISTICS OFFICE" written in an arc, font Arial, all capital letters, yellow color; below it is the phrase "STATISTICAL INSPECTION" written horizontally, font Arial, all capital letters, red color; placed on gears and two golden ears of corn.

The badge is embroidered on fabric, attached to the left sleeve 80 - 100 mm away from the shoulder seam, shield-shaped, height 78 mm, width 70 mm, diameter of the Statistics sector emblem 21 mm, appropriate font size.

The badge is attached to the peaked cap made of brass, including: A round badge with a diameter of 39.53 mm, placed on a golden pine branch. The pine branch dimensions are height 55.25 mm, width 70.49 mm.

The badge is printed on the left side of the sign.

2. Sign of specialized statistics inspection

The sign of specialized statistics inspection (hereinafter referred to as the sign) is a symbol to identify the agency implementing specialized statistics inspection. The sign is attached to the left chest pocket.

The sign is made of brass, coated with glossy plastic, red flag background, length 80 mm, width 25 mm, divided into 2 sections: The left section has a square with a circular badge, diameter 23 mm; the right section, at the top, has the phrase "STATISTICAL INSPECTION," font Arial, all capital letters, yellow color, font size 12; below it is the Sign Number, font Arial, all capital letters, yellow color, font size 10.

The detailed design of the badge and sign of specialized statistics inspection is set forth in Appendix 2.

3. Identification card of specialized statistics inspection civil servants: Specialized statistics inspection civil servants use the identification card issued by the General Statistics Office.

4. When performing assigned tasks, specialized statistics inspection civil servants must wear their identification card and the specialized statistics inspection sign.

Article 11. License Plate Number

1. The license plate number consists of a series of symbols used to clearly identify the agency conducting specialized statistics inspection work.

a) The first two characters have a common code "A26" (the agency code of the Ministry of Planning and Investment as stipulated in Decision No. 93/2005/QĐ-BNV dated August 30, 2005 of the Minister of Home Affairs on the List of Codes for State Agencies).

b) The next two characters are "TK" (abbreviation for Statistics).

c) The following two characters are the province code recorded according to Decision No. 124/2004/QĐ-TTg dated July 8, 2004 of the Prime Minister on issuing the List and Codes of Administrative Units in Vietnam. For license plates managed by the General Statistics Office, these two characters are “00”.

d) The last two characters are the serial number of the license plate of the unit (starting from 01).

2. Specific license plate numbers for agencies and units are as follows:

- General Statistics Office: A26 - TK - 00 - serial number of the license plate;

- Provincial Statistics Office: A26 - TK - province code - serial number of the license plate.

Article 12. Management, Issuance, and Use of License Plates

1. License plates for specialized statistics inspectors are provided by the General Statistics Office. The quantity of license plates issued to each subordinate unit of the General Statistics Office is decided by the Director of the General Statistics Office.

2. The Head of the Legal Affairs and Statistics Inspection Department under the General Statistics Office is responsible for managing and issuing license plates to officials of the General Statistics Office when assigned specialized statistics inspection tasks.

3. The Director of the Provincial Statistics Office is responsible for managing and issuing license plates to officials of the Provincial Statistics Office when assigned specialized statistics inspection tasks.

4. Responsibilities of officials assigned to perform specialized statistics inspection tasks.

a) Attach the license plate on the left chest and wear the official identification card while performing specialized statistics inspection duties;

b) Return the license plate to the authorized person upon completion of the assigned specialized statistics inspection task.

Chapter V

IMPLEMENTING PROVISIONS

Article 13. Effective Date

This Circular takes effect from December 1, 2014.

1. The Minister, Heads of Ministries equivalent to ministries, Heads of government agencies, Chairmen of provincial People's Committees under the central government, and related agencies, units, and individuals are responsible for implementing this Circular.

1. The Inspector General of the Ministry, the Director of the General Statistics Office, the Heads of agencies and units under the Ministry of Planning and Investment, and related organizations and individuals are responsible for implementing this Circular.

2. In case of difficulties during implementation, organizations, units, and individuals should submit their opinions to the Ministry of Planning and Investment for review and resolution./.
