The Minister of Construction hereby issues this Circular guiding competition and reward work in the Construction Industry as follows:, 2. This Circular applies to individuals and organizations of Vietnamese nationality, overseas Vietnamese, and foreign individuals and organizations who have made contributions to the construction and development of the Construction Industry in Vietnam.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

1. This Circular guides competition and reward work within the construction industry.

Article 2. Objectives of Competition and Reward Work

1. To create motivation to encourage collectives and individuals to engage in creative labor and successfully complete assigned tasks.

2. To recognize, commend, and honor achievements and provide material benefits to collectives and individuals with outstanding performance in competition movements contributing to the development of the Construction Industry.

1. Principles of Competition:

Article 3. Principles of Competition and Reward

c) The granting of competition titles must be based on competition movements; all collectives and individuals participating in these movements must register for competition, set goals, and establish targets; those not registering will not be considered for competition titles.

a) Voluntary, conscientious, public;

b) Unity, cooperation, mutual development;

2. Principles of Reward:

b) A single form of reward may be given multiple times to the same recipient; multiple forms of reward shall not be given for a single achievement;

a) Accurate, public, fair, timely;

d) Ensure gender equality in competition and reward activities;

c) Ensure consistency between the nature, form, and recipient of commendation.

d) Closely combine spiritual encouragement with material incentives.

e) Achievements made under difficult conditions and with significant impact shall be rewarded at a higher level. Emphasis should be placed on rewarding direct workers and individuals with many innovations in their work and duties;

g) When considering rewards for heads of agencies or units, their collective achievements must be taken into account;

h) For female leaders and managers, the tenure required for consideration of rewards can be reduced by three years compared to the general requirement;

In cases of rewarding economic and social achievements, if multiple collectives and individuals meet the criteria, preference should be given to selecting women and collectives with a female ratio of 70% or more for rewards;

i) For individuals, in one year, only one form of national-level reward or title "National Model Worker" and one form of ministry-level reward or title "Construction Industry Model Worker" (except in cases of exceptional rewards) may be proposed.

Article 4. Types of Awards

1. Award for Merit and Achievements is a form of award given to collectives and individuals who have achieved outstanding results in carrying out tasks for national construction and defense.

2. Specialized Award (or Campaign Award) đợt) is an award given to collectives and individuals who have achieved outstanding results after completing a campaign of competition initiated by the President of the State, the Prime Minister, the Minister of Construction, or heads of agencies and units.

3. Unexpected Award is an award given to collectives and individuals who achieve unexpected results in labor and production; bravery in rescuing people or state property (unexpected achievements are those made in unforeseen circumstances outside the normal work plan that the collective or individual must undertake).

4. Contribution Process AwardJune 2024; trình cống hiến is an award given to individuals who have participated in various revolutionary stages (holding leadership and management positions in state agencies, public institutions, political-social organizations) with outstanding contributions to the Party's and the nation's revolutionary cause.

5. International AwardNo.i ngoại is an award given to foreign collectives and individuals who have contributed to the development of the Construction sector.

Article 5. Responsibilities of Agencies and Units

1. The Minister of Construction initiates, directs, and organizes the implementation of competition movements within the Construction sector.

2. The Standing Committee of the Competition and Award Council of the Ministry has the responsibility to advise and propose to the Ministry's leadership on policies, contents, programs, plans, organization of implementation, mid-term reviews, final summaries, and inspections of competition and award activities; to propose awards and suggest innovations in competition and award activities.

3. Heads of agencies and units under the Construction sector are responsible for leading and coordinating with peer-level mass organizations to initiate, direct, and implement competition movements within their jurisdiction; actively identify and select collectives and individuals with meritorious achievements for awards or recommend higher authorities to grant awards; organize publicity, showcase exemplary models and spread advanced examples.

Heads of agencies and units under the Construction sector are accountable to the Competition and Award Council of the Ministry for competition and award activities within their managed units.

4. Heads of information, press, and publishing agencies under the Construction sector are responsible for proactively collaborating with the Standing Committee of the Competition and Award Council of the Ministry and mass media to promote competition and award activities; disseminate and showcase exemplary models and good deeds in competition movements.

Article 6. Rights and Obligations of Collectives and Individuals Receiving Awards

1. Rights of collectives and individuals receiving awards:

a) Collectives awarded commendation titles and forms of recognition have the right to retain and display them, use symbols of these forms of recognition on official documents of the unit; receive certificates of merit, certificates of recognition, and monetary or material rewards according to laws on competition and recognition.

b) Individuals awarded commendation titles and forms of recognition have the right to retain, display, and use material rewards; receive certificates of merit, certificates of recognition, and monetary or material rewards according to laws on competition and recognition; be considered for salary advancement ahead of schedule, priority for research, study, and training to improve professional skills both domestically and internationally; commendation titles and forms of recognition are among the bases for evaluating, planning, appointing, and reappointing cadres annually.

2. Obligations of collectives and individuals receiving awards:

Individuals and collectives recognized at all levels with commendation titles and forms of recognition have the obligation to properly manage awarded materials according to regulations.

Article 7. Authority to decide on awarding commendation titles and forms of reward

1. The authority to decide on awarding commendation titles and forms of reward from the President, Government, and Prime Minister shall be implemented according to Article 77 and 78 of the Law on Commendation and Reward dated November 26, 2003; Law No. 47/2005/QH11 dated June 14, 2005 amending and supplementing certain articles of the Law on Commendation and Reward; and Law No. 39/2013/QH13 dated November 16, 2013 amending and supplementing certain articles of the Law on Commendation and Reward.

2. The Minister of Construction decides to bestow:

a) The "Flag of Competition of the Ministry of Construction";

b) The title "Outstanding Labor Collective";

c) The title "Construction Industry Model Competitor";

d) The Merit Award of the Minister of Construction;

d) Commemorative Medal "For Construction".

3. Heads of agencies and units (having legal personality, having bank accounts, having separate seals) shall decide on awarding:

a) The title "Advanced Labor Collective";

b) The title "Model Worker at the Grassroots Level";

c) The title "Advanced Worker";

d) Commendation Certificate.

Article 8. Principles and procedures for award ceremonies

1. Principles:

a) Announcing and presenting commendation titles and forms of reward is an occasion to honor good people and deeds and exemplary models; it must be organized solemnly but must ensure effectiveness and practicality, avoiding ostentatious formalism and waste; when organizing, it should combine with other contents of the unit to save time and costs.

b) The ceremony for presenting Orders, Medals, State Honorary Titles, Ho Chi Minh Prize, State Prize, Flag of Excellence from the Government, and Certificates of Merit from the Prime Minister shall be carried out in accordance with the provisions of Government Decree No. 145/2013/NĐ-CP dated October 29, 2013 on commemoration days; presentation and reception ceremonies for forms of reward and commendation titles; diplomatic rituals and welcoming foreign guests.

2. Procedures for holding award ceremonies:

a) For Orders, Medals, State Honorary Titles, Ho Chi Minh Prize, and State Prize: After receiving the decision, the head of the unit shall develop a plan to organize the reception, report to the Minister of Construction; after receiving the directive of the Minister, the Standing Committee for Commendation and Reward of the Ministry will coordinate with the unit to organize the announcement and presentation.

b) For the Flag of Excellence from the Government, National Labor Medal, and Certificates of Merit from the Prime Minister: After receiving the decision, the head of the unit shall proactively develop a plan and organize the announcement and presentation to the collective and individual recipients.

c) For commendation titles and forms of reward within the authority of the Minister of Construction: The Minister shall delegate the heads of units to organize the announcement and presentation to the collective and individual recipients.

Article 9. Commendation and Reward Councils

1. Commendation and Reward Council of the Ministry of Construction:

a) The Commendation and Reward Council of the Ministry of Construction is an advisory body to the Minister regarding commendation and reward work in the Construction sector.

b) The Commendation and Reward Council of the Ministry of Construction shall be established by the Minister and shall include:

- Chairman of the Council: Minister of Construction;

- Vice-Chairman in charge of permanent duties: Deputy Minister responsible for commendation and reward work;

- Other Vice-Chairmen and members appointed by the Minister;

- Permanent member: Head of the Commendation and Reward Department.

c) The tasks and powers of the Commendation and Reward Council of the Ministry shall be implemented in accordance with Article 28 of Government Decree No. 65/2014/NĐ-CP.

2. Competition and Reward Councils at the grassroots level:

a) Organizations with legal personality, separate bank accounts, and seals must establish a Competition and Reward Council at the grassroots level.

For other organizations, the heads of agencies and units shall base their decisions on actual circumstances to establish Commendation and Reward Councils. In cases where councils are not established, the examination and recommendation for rewards shall be conducted by the heads of agencies and units in coordination with party committees and relevant mass organizations at the same level.

b) The grassroots Commendation and Reward Council is an advisory body to the heads of agencies and units regarding commendation and reward work.

c) The grassroots Commendation and Reward Council shall be established by the heads of agencies and units (having legal personality, having bank accounts, having separate seals) and shall include:

- Chairman of the Council: Head of the agency or unit;

- Vice-Chairman and members appointed by the head of the agency or unit.

d) The grassroots Commendation and Reward Council shall perform advisory functions for the heads of agencies and units regarding commendation and reward work and operate in accordance with the operational regulations issued by the Chairman of the Council.

Article 10. Initiative Council

1. Initiative Council of the Ministry of Construction:

a) The Initiative Council of the Ministry of Construction shall be established by the Minister's decision.

b) The composition, tasks, and principles of operation of the Initiative Council shall be decided by the Minister and implemented in accordance with Decree No. 13/2012/ND-CP dated March 2, 2012, of the Government promulgating the Charter on Initiatives (hereinafter referred to as Decree No. 13/2012/ND-CP), Circular No. 18/2013/TT-BKHCN dated August 1, 2013, of the Ministry of Science and Technology guiding the implementation of certain provisions of the Charter on Initiatives issued pursuant to Decree No. 13/2012/ND-CP dated March 2, 2012, of the Government (hereinafter referred to as Circular No. 18/2013/TT-BKHCN), and other relevant legal normative documents.

2. Initiative Council at the grassroots level:

a) The Initiative Council at the grassroots level shall be established by the head of the agency or unit at the same level.

b) The composition, tasks, and principles of operation of the Initiative Council at the grassroots level shall be stipulated by the head of the unit at the same level and implemented in accordance with Decree No. 13/2012/ND-CP, Circular No. 18/2013/TT-BKHCN, and other relevant legal normative documents.

Article 11. Fund for Competition and Awards

1. Sources and levels of contribution to the fund:

a) Sources of formation, levels of deduction for awards shall be implemented in accordance with Article 67 and Article 68 of Decree No. 42/2010/ND-CP and Circular No. 71/2011/TT-BTC dated May 24, 2011, of the Ministry of Finance guiding financial management and the implementation of competition and award systems.

b) Sources of funds for awards shall be implemented in accordance with Article 67 of Decree No. 42/2010/ND-CP and other relevant legal normative documents.

2. Management and use of the fund:

Implementation shall be carried out in accordance with Article 68, Article 69 of Decree No. 42/2010/ND-CP and other relevant legal normative documents.

3. Prize money accompanying commendation titles and reward forms:

a) Specific amounts of monetary rewards accompanying various commendation titles and forms of awards shall be implemented in accordance with Articles 70 through 76 of Decree No. 42/2010/ND-CP and other relevant legal normative documents.

b) At the same time point, for the same achievement, if an individual receives multiple commendation titles accompanied by different amounts of monetary rewards, they shall only receive the highest amount of monetary reward. (Example: In 2014, Mr. Nguyen Van A was awarded the title of Advanced Worker, then later received the title of Outstanding Soldier at the Grassroots Level in 2014, he would only receive the monetary reward for the title of Outstanding Soldier at the Grassroots Level in 2014).

c) At the same time point, if an individual achieves multiple commendation titles at different times, they shall receive monetary rewards for all those titles. (Example: In 2012, 2013, and 2014, Mr. Nguyen Van A was awarded the title of Outstanding Soldier at the Grassroots Level, and at the end of 2014, he was awarded the title of Outstanding Soldier in the Construction Industry, Mr. Nguyen Van A would receive monetary rewards for both the title of Outstanding Soldier at the Grassroots Level in 2014 and the title of Outstanding Soldier in the Construction Industry in 2014).

d) At the same time point, if an individual achieves both a commendation title and an award form, they shall receive monetary rewards for both the title and the award form. (Example: In 2014, Mr. Nguyen Van A was awarded the title of Outstanding Soldier at the Grassroots Level and also received a Merit Certificate from the Minister of Construction in the same year, Mr. Nguyen Van A would receive monetary rewards for both the title of Outstanding Soldier at the Grassroots Level and the Merit Certificate from the Minister of Construction).

Article 12. Management of competition and reward files

1. Files managed at the Ministry of Construction:

a) The Competition and Reward Board of the Ministry shall be responsible for managing and storing files related to competition titles and reward forms within the authority of the Minister and above, and all other files related to the competition and reward work of the Construction sector according to the regulations under the management authority and responsibility of the Ministry.

b) The file preservation system shall be implemented according to the regulations of the law on archives.

2. Files managed at agencies and units:

Heads of agencies and units under the Construction sector shall be responsible for organizing, managing, and storing all files related to the competition and reward work of their units according to the regulations.

Chapter II

FORMS, CONTENT OF COMPETITION AND STANDARDS

COMPETITION TITLES

Article 13. Forms of organizing competition

1. Competition is organized in the following forms:

a) Regular competition is carried out daily, monthly, quarterly, and annually to achieve set goals, targets, and work programs.

b) Periodic competition (by topic) is organized to implement key tasks and urgent matters at specific stages and timeframes determined.

Article 14. Content of organizing competition movements

1. Theme, name, goal, scope, and target group:

a) Competition movements must have memorable themes and names that are easy to implement.

b) Clearly define the goals, scope, and target groups of the competition, serving as the basis for building specific competition targets and contents. Determining the content and targets of the competition must be scientific and appropriate to the practical conditions of the agency or unit.

2. Develop plans and solutions for implementation; monitor, urge, inspect the process of implementation, and direct the competition movement.

3. Evaluate competition results:

a) For long-term competition periods (lasting one year or more), preliminary evaluations must be conducted halfway through; for short-term competition periods (less than one year) or each period (by topic), final evaluations must be conducted upon completion.

b) Select outstanding collectives and individuals in the competition movement for rewards or recommend them to competent authorities for rewards.

Article 15. Registration for competition

1. Annually, agencies and units under the Construction sector shall organize for collectives and individuals within their units to register for competition with specific contents, targets, and titles; compile and send these registrations to the Ministry of Construction (Competition and Reward Board) before March 15 each year.

2. For periodic or topic-based competition movements, agencies and units shall develop plans and send registration forms for competition to the Competition and Reward Board of the Ministry.

Article 16. Competition Titles

1. Honorary titles for collectives:

a) Flag of Government Competition;

b) Flag of Ministry of Construction Competition;

c) Excellent Labor Collective;

d) Advanced Labor Collective.

2. Honorary titles for individuals:

a) National Model Worker;

b) Construction Industry Model Worker;

c) Grassroots Model Worker;

d) Advanced Worker.

Article 17. Standards for the "Flag of Government Competition" title

1. The "Flag of Government Competition" title is awarded to collectives meeting the following standards:

a) They are the most outstanding collectives among those meeting the "Flag of Ministry of Construction Competition" standards;

b) They exceed all competition targets and complete assigned tasks comprehensively throughout the year;

c) They introduce new factors, models with effectiveness and exemplary value for nationwide learning;

d) Their internal unity is strong, and they comply well with Party policies and State laws;

e) They maintain regular, practical, and effective competition movements;

2. Collectives that are the most outstanding in topic-based competition movements initiated by the President or Prime Minister shall be evaluated and rewarded when preliminary or final reviews last five years or longer.

3. The number of collectives proposed for the award of the "Flag of Government Competition" title shall not exceed 20% of the total number of collectives receiving the "Flag of Ministry of Construction Competition" title.

Article 18. Criteria for the title "Flag of Excellence of the Ministry of Construction"

1. The title "Flag of Excellence of the Ministry of Construction" shall be awarded annually to collectives in the construction sector that meet the following criteria:

a) Being an outstanding collective in various fields, exceeding set competition targets and assigned tasks for the year;

b) Having new factors, effective models with exemplary characteristics for other collectives in the same field to learn from;

c) Internal unity, strictly adhering to Party guidelines, state policies, and laws;

d) Having a regular, practical, and effective competition movement.

2. The number of collectives proposed for awarding the "Flag of Excellence of the Ministry of Construction" shall be implemented according to the annual guidance of the Ministry.

Article 19. Criteria for the title "Outstanding Labor Collective"

The title "Outstanding Labor Collective" shall be awarded annually to collectives that meet the following criteria:

1. Being an outstanding collective selected among those that have achieved the title "Advanced Labor Collective";

2. Excellently completing assigned tasks for the year;

3. Having a regular, practical, and effective competition movement;

4. All individuals within the collective completing assigned tasks, with at least 70% of individuals achieving the title "Advanced Worker";

5. Having an individual who has achieved the title "Model Worker at the Base Level" and no individual being disciplined with a warning or higher;

6. Internal unity, strictly adhering to Party guidelines, state policies, and laws.

Article 20. Criteria for the title "Advanced Labor Collective"

The title "Advanced Labor Collective" shall be awarded annually to collectives that meet the following criteria:

1. Successfully completing assigned tasks for the year;

2. More than 50% of individuals within the collective achieving the title "Advanced Worker" and no individual being disciplined with a warning or higher;

3. Internal unity, strictly adhering to Party guidelines, state policies, and laws;

4. Having a regular, practical, and effective competition movement.

Article 21. Criteria for the title "National Model Worker"

1. The title "National Model Competitor" is awarded to individuals who meet the following criteria:

a) Having the most outstanding achievements, selected from individuals who have twice consecutively achieved the title "Model Worker in the Construction Industry";

b) Having research topics, innovations, technical solutions, management solutions, operational solutions, or applications of technological progress to increase labor productivity and work efficiency recognized by the Ministry's Innovation Council or scientific research topics at the Ministry level that have been accepted and proven highly effective with national impact.

2. The title "National Model Worker" shall be awarded after the second consecutive year of achieving the title "Model Worker in the Construction Industry".

Article 22. Criteria for the title "Model Worker in the Construction Industry"

1. The title "Model Worker in the Construction Industry" shall be awarded to individuals meeting the following criteria:

a) Having outstanding achievements selected from among those individuals who have continuously achieved the title "Model Competitor at the Grassroots Level" three times;

b) Having research topics, innovations, technical solutions, management solutions, operational solutions, or applications of technological progress to increase labor productivity and work efficiency, or scientific research topics that have been accepted and applied in practice recognized by the Ministry's Innovation Council or winning first place in Ministry-level or national competitions, having industry-wide impact.

2. The title "Model Worker in the Construction Industry" shall be awarded after the third consecutive year of achieving the title "Model Worker at the Base Level".

Article 23. Criteria for the title "Model Grassroots Soldier"

Clause 1. The title "Model Worker at the Grassroots Level" shall be awarded annually to individuals meeting the following criteria:

a) Being exemplary among individuals who have received the title "Advanced Worker";

b) Having creative ideas, technical solutions, management solutions, operational solutions, or application solutions for advanced technology to increase labor productivity, enhance work efficiency, or having research topics that have been accepted and applied in practice and recognized by the grassroots unit.

2. The assessment of the impact of creativity and research topics is conducted by the grassroots level Creativity and Science Council to assist the head of the agency or unit in considering and recognizing them.

3. Evaluation ratio: Not exceeding 15% of the total number of individuals awarded the title "Advanced Laborer".

Article 24. Criteria for the title "Advanced Laborer"

1. The title "Advanced Laborer" shall be conferred on individuals who meet the following criteria:

a) Successfully completing assigned tasks with high productivity and quality; for workers and those directly involved in production labor, they must achieve effectiveness in production labor.

b) Adhering well to the policies and guidelines of the Party, laws of the State, policies, regulations, and internal rules of the industry, unit, and locality; demonstrating self-reliance, solidarity, mutual assistance, and active participation in competitive campaigns.

c) Possessing good moral character and lifestyle.

d) Actively studying politics, culture, professional knowledge, and vocational skills.

2. Evaluation ratio: Not exceeding 80% of the total number of officials, civil servants, public employees, and workers in the unit.

Clause 3. For individuals who bravely rescue people or property leading to injuries requiring treatment and convalescence, the treatment and convalescence period shall be counted for the award of the title "Advanced Worker".

4. Individuals selected to participate in short-term training or development programs under 12 months, who comply with the regulations of the training or development institution, shall have their study time counted towards their service period at the agency or unit for evaluation of the title "Advanced Laborer". In cases where individuals are selected to participate in training or development programs for one year or more, comply with the regulations of the training or development institution, and achieve satisfactory academic results, they may be considered for the title "Advanced Laborer".

5. Maternity leave according to regulations shall be included in the evaluation period for the title "Advanced Laborer".

6. For individuals transferred to new positions: The new agency or unit is responsible for reviewing and voting on the title "Advanced Laborer" (in cases where the individual has worked at the previous agency for six months or more, the opinion of the previous agency must be obtained).

7. In cases where individuals are temporarily reassigned or seconded to other agencies or units, the review and voting for the title "Advanced Laborer" shall be conducted by the agency or unit that initiated the reassignment or secondment (with the opinion of the receiving agency or unit regarding the reassigned or seconded individual).

8. The title "Advanced Laborer" shall not be conferred in any of the following cases:

a) Newly recruited for less than ten months;

b) Absent from work for forty working days or more;

c) Disciplined with a warning or higher penalty.

Chapter III

FORMS, OBJECTS AND CRITERIA FOR REWARDS

Article 25. Forms of Reward

1. National-level reward forms:

a) Orders:

- Golden Star Order;

- Ho Chi Minh Order;

- Independence Order, First Class, Second Class, Third Class;

- Labor Order, First Class, Second Class, Third Class;

- Courage Order;

- Friendship Order.

b) Friendship Medal.

c) National Honorary Titles:

- Heroic Laborer Title;

- People's Teacher Title, Distinguished Teacher Title;

- People's Doctor Title, Distinguished Doctor Title.

d) Prestigious Awards:

- Ho Chi Minh Award;

- State Award.

đ) Certificate of Merit from the Prime Minister.

2. Ministry-level reward forms:

a) Commemorative Medal "For Construction";

b) Certificate of Merit from the Minister of Construction.

3. Organizational-level reward forms:

Commendation letter from the head of the agency or unit (having legal personality, bank account, and separate seal).

Article 26. Recipients and criteria for State Honorary Titles, high awards, medals, orders, and Certificates of Merit issued by the Prime Minister

Implementation shall be carried out in accordance with the provisions of the Law on Competition and Rewards, Government Decrees, and related legal documents.

Article 27. Commemorative Medal "For the Construction Industry"

1. Recipients for awarding:

a) Civil servants, employees, and workers who have worked and are currently working in the Construction Industry, with achievements and years of service, evaluated by their unit leaders as having successfully completed assigned tasks.

b) Civil servants, employees, and workers outside the Construction Industry who have made significant contributions to the development of the Construction Industry.

c) Foreign individuals or overseas Vietnamese who have achieved outstanding results and made significant contributions to the Construction Industry.

2. Criteria for awarding:

a) For individuals who have worked and are currently working in the Construction Industry, meeting one of the following criteria:

- Being conferred the title of Hero of Labor;

- Successfully completing assigned tasks and having years of service:

+ For males: Having continuously worked for 20 years in the Construction Industry or a total of 25 years of work, including 15 continuous years in the Construction Industry;

+ For females: Having continuously worked for 15 years in the Construction Industry or a total of 20 years of work, including 10 continuous years in the Construction Industry.

- Individuals working in the Construction Industry with particularly outstanding achievements, awarded commendations and rewards, with priority given to years of service calculated at the following coefficients:

+ Labor Order of Merit Class III or higher: coefficient 1.5;

+ National Model Worker, Distinguished Teacher, Distinguished Doctor or higher: coefficient 2.

Individuals achieving multiple honors will only be credited with the highest coefficient.

b) For individuals outside the Construction Industry, meeting one of the following criteria:

- Making significant contributions to the development of the Construction Industry;

- Proposing valuable topics or initiatives applied in the Construction Industry;

- Contributing positively to building and consolidating cooperative relationships between countries and international organizations and the Construction Industry of Vietnam, promoting the development of the Construction Industry of Vietnam.

3. For individuals who have retired from work, the agency managing retirement benefits is responsible for confirming and preparing files to submit to the Minister for consideration of awarding the Commemorative Medal "For the Construction Industry" according to regulations. In cases where the agency or organization has been dissolved or merged, the successor agency or organization is responsible for confirming and preparing files to submit to the Minister for review and decision.

Article 28. Certificate of Merit from the Minister of Construction

1. The "Certificate of Merit from the Minister of Construction" is awarded to exemplary units within the Construction Industry that comply well with the Party's policies and state laws, meeting one of the following criteria:

a) Outstanding achievements recognized in competition movements;

b) Achieving outstanding and sudden achievements with wide-ranging impact in each field of the Construction Industry;

c) Consistently excelling in performance for two consecutive years immediately preceding the year of nomination; maintaining internal unity, effectively implementing grassroots democracy; organizing effective competition campaigns; caring for the material and spiritual life of the unit; practicing thrift; fully implementing policies for members of the unit;

d) The Party organization and mass organizations being recognized as clean and strong for two consecutive years; promptly and thoroughly resolving complaints and petitions within their jurisdiction.

2. The "Certificate of Merit from the Minister of Construction" is awarded to exemplary individuals working in the Construction Industry who comply well with the Party's policies and state laws, meeting one of the following criteria:

a) Outstanding achievements recognized in competition movements;

b) Achieving outstanding and sudden achievements with wide-ranging impact in each field of the Construction Industry;

c) Consistently excelling in performance for two consecutive years immediately preceding the year of nomination, during which time they proposed and implemented two recognized and effective initiatives at the grassroots level.

3. The "Certificate of Merit from the Minister of Construction" is awarded to units and individuals belonging to professional associations, companies, and holding companies previously under the Ministry of Construction but now managed by the State Capital Investment Corporation, and to individuals outside the Construction Industry who have made significant contributions to its development.

Article 29. Commendation Certificate

The Commendation Certificate issued by the head of the agency or unit shall be implemented in accordance with Clause 42, Article 1 of the Law Amending and Supplementing Certain Provisions of the Law on Competition and Rewards in 2013.

Article 30. Reward for Contribution Process

The subjects, criteria, time, and procedures for considering rewards for contribution processes for individuals shall be carried out in accordance with the provisions of the Law on Competition and Rewards, Government Decrees, and related legal normative documents.

Chapter IV

PROCEDURES, FILES AND PROCESSES FOR CONSIDERING REWARDS

Article 31. Procedures for Recommending Rewards

1. Heads of agencies and units at all levels within the Construction sector shall have the responsibility to recommend rewards to competent authorities for individuals and groups under their management.

2. The level that manages organizational structure, cadres, civil servants, public officials, employees, and salary funds shall be responsible for rewarding or recommending rewards to competent authorities for the objects under its management.

3. The level that leads the initiation of competition movements shall select outstanding individuals and groups for rewards or propose to competent authorities for rewards.

4. Professional associations under the management fields of the Construction sector by the Ministry of Construction shall reward or recommend rewards to competent authorities.

5. For state-owned enterprises managed by the Ministry of Construction, the Ministry shall reward or recommend rewards to competent authorities, including enterprises that have transferred state capital to the State Capital Investment Corporation for management.

6. For individuals who are direct workers with outstanding exemplary achievements, the Vietnam Construction Union shall recommend the Ministry of Construction to award rewards during Workers' Month.

7. Units with foreign individuals participating in cooperation shall be responsible for recommending rewards for foreign collectives and individuals who have made significant contributions to the Construction sector.

8. Rewards for Ministry Leaders: The Ministry's Competition and Reward Board proposes commendation titles and forms to the Ministry's Competition and Reward Council.

9. When considering rewards for construction projects involving multiple participants, the units assigned to oversee shall be responsible for summarizing the competition movements and leading the consolidation of reward forms to the Ministry.

Article 32. Files for Proposing National Level Rewards

1. Files for Considering the Award of National Honorary Titles and High Prestigious Awards:

To be implemented in accordance with the Law on Competition and Rewards, Government Decrees, and related legal normative documents.

2. Files for Considering the Award of Orders of various types, consisting of four sets (originals), including:

a) The proposal letter from the unit accompanied by the list of collectives and individuals proposed for commendation;

b) The minutes of the meeting of the Competition and Commendation Council at the level proposing commendation;

c) Report on achievements of the collective or individual proposed for reward;

d) Confirmation from the Creative Ideas Council of the competent authority regarding creative ideas, solutions, and research topics of the individual proposed for reward;

đ) Confirmation of completion of tax obligations, social insurance, health insurance, and salary payments for the collective proposed for reward and the individual leader of the unit proposed for reward;

e) Agreement opinion of the local government (People's Committee of ward, commune) where the unit has its headquarters located for the collective proposed for reward and place of residence for the individual leader of the unit proposed for reward.

3. Files for Considering the Award of the "National Labor Medal" title, consisting of three sets (originals), including:

a) The proposal letter from the unit accompanied by the list of individuals proposed for commendation;

b) Minutes of the meeting of the Council and secret ballot results of the Competition and Reward Council proposing rewards;

c) Report on achievements of the individual proposed for reward;

d) Copy of decisions awarding commendation titles to the individual proposed for reward;

đ) Confirmation from the Creative Ideas Council of the Ministry regarding creative ideas, solutions, and research topics of the individual proposed for reward;

e) Confirmation of completion of tax obligations, social insurance, health insurance, and salary payments for the individual leader of the unit proposed for reward;

g) Agreement opinion of the local government (People's Committee of ward, commune) where the individual leader of the unit proposed for reward resides.

4. Files for Considering the Award of the "Prime Minister's Flag of Competition" title, consisting of three sets (originals), including:

a) The proposal letter from the unit accompanied by the list of collectives proposed for commendation;

b) Minutes of the meeting of the Council and secret ballot results of the Competition and Reward Council proposing rewards;

c) Report on achievements of the collective proposed for reward;

d) Confirmation of completion of tax obligations, social insurance, health insurance, and salary payments for the collective proposed for reward;

đ) Agreement opinion of the local government (People's Committee of ward, commune) where the unit proposed for reward has its headquarters located.

5. Files for Considering the Award of the "Prime Minister's Commendation Certificate" title, consisting of three sets (originals), including:

a) The proposal letter from the unit accompanied by the list of collectives and individuals proposed for commendation;

b) The minutes of the meeting of the Competition and Commendation Council at the level proposing commendation;

c) Report on achievements of the collective or individual proposed for reward;

d) Confirmation from the Creative Ideas Council of the competent authority regarding creative ideas, solutions, and scientific research topics of the individual proposed for reward;

đ) Confirmation of completion of tax obligations, social insurance, health insurance, and salary payments for the collective proposed for reward and the individual leader of the unit proposed for reward;

e) Agreement opinion of the local government (People's Committee of ward, commune) where the unit has its headquarters located for the collective proposed for reward and place of residence for the individual leader of the unit proposed for reward.

Article 33. Application for Merit Award at the Ministry Level

1. The application for considering the award of the "Ministry of Construction Flag of Excellence" includes 01 set (original copy), including:

a) The proposal letter from the unit accompanied by the list of collectives proposed for commendation;

b) The minutes of the meeting of the Competition and Commendation Council at the level proposing commendation;

c) Report on achievements of the collective proposed for reward;

d) Report on fulfilling state budget payment obligations, social insurance, and health insurance contributions of the collective being proposed for commendation;

đ) Opinion of agreement from the People's Committee of the province or city where the unit has its headquarters located (Department of Construction, Department of Urban Planning and Architecture of provinces and centrally governed cities);

2. The application for considering the award of the "Minister of Construction Commendation" includes 01 set (original copy), including:

a) The proposal letter from the unit accompanied by the list of collectives and individuals proposed for commendation;

b) The minutes of the meeting of the Competition and Commendation Council at the level proposing commendation;

c) Report on achievements of the collective or individual proposed for reward;

d) Confirmation from the Creative Ideas Council of the competent authority regarding creative ideas, solutions, and scientific research topics of the individual proposed for reward;

3. The application for considering the award of the "Construction Industry Labor Medal" includes 01 set (original copy), including:

a) The proposal letter from the unit accompanied by the list of collectives and individuals proposed for commendation;

b) The minutes of the meeting of the Competition and Commendation Council at the level proposing commendation;

c) Report on achievements of the collective or individual proposed for reward;

d) Copy of the decision to confer the title of "Labor Medal at the Base Level" of the individual being proposed for commendation;

đ) Confirmation from the authorized Expertise Council regarding the innovation, solution, or scientific topic of the individual being proposed for commendation;

4. The application for considering the award of the "Memorial Plaque for the Construction Cause" includes 01 set (original copy), including:

a) The proposal letter from the unit accompanied by the list of individuals proposed for commendation;

b) The minutes of the meeting of the Competition and Commendation Council at the level proposing commendation;

c) Brief list of the individual being proposed for commendation;

d) Summary of the work process of the individual being proposed for commendation (for individuals outside the Construction Industry);

5. The application for extraordinary commendation or for cases of commendation discovered by the head of the agency, organization, or unit (simplified procedure) includes 01 set (original copy), including:

a) The proposal letter from the unit accompanied by the list of collectives and individuals proposed for commendation;

b) The summary report on achievements of the directly managed agency or unit, clearly stating the actions, achievements, merits of the collectives and individuals proposed for commendation;

6. The application for commendation based on specific themes (or campaigns) includes 01 set (original copy), including:

a) The proposal letter from the unit accompanied by the list of collectives and individuals proposed for commendation;

b) The minutes of the meeting of the Competition and Commendation Council at the level proposing commendation;

c) Report summarizing the campaign activities according to the theme or campaign of the unit;

7. The application for commendation for long-term dedication includes 04 sets (original copies), including:

a) The proposal letter from the unit accompanied by the list of individuals proposed for commendation;

b) The minutes of the meeting of the Competition and Commendation Council at the level proposing commendation;

c) Report on the work process of the individual being proposed for commendation;

d) Copy of the confirmation of revolutionary veteran cadre or pre-revolutionary cadre (for revolutionary veteran cadres or pre-revolutionary cadres) of the individual being proposed for commendation;

đ) Certified copy of relevant documents: Decision on appointment to leadership positions, decision on salary increase, social insurance book, or party member history of the individual being proposed for commendation;

e) For those individuals who have retired, there must be a request for commendation letter;

8. The application for commendation for foreign collectives and individuals includes:

a) The proposal letter from the unit accompanied by the list of collectives and individuals proposed for commendation;

b) The minutes of the meeting of the Competition and Commendation Council at the level proposing commendation;

c) Report on achievements of the collective or individual proposed for reward;

d) Opinion of the International Cooperation Department (for national-level commendations);

đ) Quantity:

- Application for commendation at the Ministry level includes 01 set (original copy);

- Application for commendation at the national level includes 04 sets (original copies);

Article 34. Time for Receiving Applications for Commendation

Units send applications for commendation to the Ministry of Construction (Competition and Commendation Board) along with an email to the address: [email protected] (in .doc format for the report, list, and achievement report; in .pdf format for other related documents);

1. Commendation based on achievements and accomplishments (regular commendation):

a) For the title of National Labor Medal, Orders, Medals, and Prime Minister's Commendation:

- First round: Receive applications for commendation before March 15 each year (for the National Labor Medal considered in the first round each year);

- Second round: Receive applications for commendation before August 15 each year;

b) For commendation titles and forms within the authority of the Minister of Construction:

- Units within the industry: Receive applications for commendation before March 15 each year (for educational institutions, receive applications for commendation before August 15 each year);

- Units outside the industry: Receive applications 15 working days prior to the expected awarding date;

c) For the Government Flag of Excellence and the Ministry of Construction Flag of Excellence: Receive applications for commendation before November 15 each year;

2. Extraordinary commendation, commendation based on campaigns, and specific themes:

Units submit applications no later than 15 days after the collectives and individuals achieve outstanding results and complete the special projects;

3. Commendation for long-term dedication:

Receive applications for commendation annually;

4. Memorial Plaque "For the Construction Cause" awarded annually on April 29 and September 2:

a) First round: Receive applications before March 15 each year;

b) Second round: Receive applications before August 15 each year;

5. National Honorary Titles and High Prestigious Awards:

Implementation shall be carried out in accordance with the provisions of the Law on Competition and Rewards, Government Decrees, and related legal documents.

6. For applications for commendation that do not comply with regulations, the Competition and Commendation Board will notify and return the application to the unit.

Article 35. Procedure for State-level Commendation and Award Examination

1. For National Honorary Titles and High Prestigious Awards:

To be implemented in accordance with the Law on Competition and Rewards, Government Decrees, and related legal normative documents.

2. For Orders of various types, "Friendship Medal", title of "National Model Worker", "Flag of Competition of the Government":

a) Units submit commendation application files to the Ministry of Construction (Competition and Commendation Board) in accordance with regulations.

b) After receiving the files, the Competition and Commendation Board conducts examination, compilation, and submits to the Competition and Commendation Council of the Ministry for examination of the collective and individual commendation proposals.

For the forms of commendation such as the Independence Order (all classes), Heroic Labor Title, and National Model Worker Title: The Standing Committee of the Competition and Commendation Council seeks opinions from the Party Cadre and Civil Servants' Committee of the Ministry before submitting to the Prime Minister.

c) Based on the conclusions of the Competition and Commendation Council of the Ministry, the Competition and Commendation Board completes the file and submits it to the Prime Minister.

d) The Competition and Commendation Board announces the results of the commendation.

3. For "Prime Minister's Certificate of Merit":

a) Units submit commendation application files to the Ministry of Construction (Competition and Commendation Board) in accordance with regulations.

b) After receiving the files, the Competition and Commendation Board conducts examination, compilation, and submits to the Standing Committee of the Competition and Commendation Council of the Ministry for examination of the collective and individual commendation proposals.

c) Based on the conclusions of the Standing Committee of the Competition and Commendation Council of the Ministry, the Competition and Commendation Board completes the file and submits it to the Prime Minister.

d) The Competition and Commendation Board announces the results of the commendation.

Article 36. Procedure for Ministry-level Commendation and Award Examination

1. For titles of "Excellent Labor Collective", "Construction Industry Model Worker", Commemorative Medal "For the Construction Cause", and "Ministry of Construction Minister's Certificate of Merit":

a) Units submit commendation application files to the Ministry of Construction (Competition and Commendation Board) in accordance with regulations.

b) After receiving the files, the Competition and Commendation Board conducts examination, compilation of the commendation proposal files of the collectives and individuals and submits to the Minister for decision.

c) The Competition and Commendation Board announces the results of the commendation.

2. For the title of "Flag of Competition of the Ministry of Construction":

a) Units submit commendation application files to the Ministry of Construction (Competition and Commendation Board) in accordance with regulations.

b) After receiving the files, the Competition and Commendation Board conducts examination, compilation, and submits to the Competition and Commendation Council of the Ministry for examination of the collective and individual commendation proposals.

c) The Competition and Commendation Board announces the results of the commendation.

3. For exceptional commendations, periodic commendations, thematic commendations, or commendations for collectives and individuals outside the Construction Industry:

a) Units submit commendation application files to the Ministry of Construction (Competition and Commendation Board) in accordance with regulations.

b) After receiving the files, the Competition and Commendation Board conducts examination, compilation of the commendation proposal files of the collectives and individuals and solicits opinions from related units when necessary before submitting to the Minister for decision.

c) The Competition and Commendation Board announces the results of the commendation.

Chapter V

INSPECTION, VIOLATION HANDLING, COMPLAINT AND ACCUSATION RESOLUTION

Article 37. Inspection of Competition and Award Activities

1. The Competition and Commendation Board is responsible for inspecting competition and commendation work at units within the entire industry.

2. Heads of agencies and units under the Ministry are responsible for inspecting competition and commendation work at units under their management.

Article 38. Violation Handling

Implement according to Articles 96 and 97 of the Law on Competition and Commendation 2003; Articles 80 and 81 of Decree No. 42/2010/NĐ-CP; Articles 25 and 26 of Circular No. 07/2014/TT-BNV and other relevant legal normative documents.

Article 39. Complaint and Accusation Resolution

The Competition and Commendation Board is responsible for receiving, resolving complaints and accusations regarding competition and commendation work within its jurisdiction and coordinating with related functional units to inspect, verify, report, and submit for processing by the Chairman of the Competition and Commendation Council of the Ministry.

Chapter VI

IMPLEMENTATION

Article 40. Organization and machinery for implementing commendation and reward work

1. The Cadre and Civil Servant Department shall be the agency with the function of advising the Minister and the Commendation and Reward Council of the Ministry to direct and organize the implementation of commendation and reward work within the Construction sector.

2. The Commendation and Reward Board is a subordinate organization under the Cadre and Civil Servant Department, assisting the Director of the Cadre and Civil Servant Department in advising the Ministry's leadership on the management functions regarding commendation and reward work; it is responsible for monitoring, urging, inspecting, and periodically reporting the results of the commendation and reward work of the Sector to the Commendation and Reward Council of the Ministry.

3. Units under the Ministry shall arrange specialized staff to perform tasks related to commendation and reward work and advise the heads of units on such work based on their specific characteristics and practical situations.

4. Agencies and units shall implement administrative reform, apply information technology, and modernize management and the implementation of commendation and reward work.

Article 41. Reports on Commendation and Reward Work

1. Annually, in the first quarter, units shall summarize and evaluate the commendation and reward work of the previous year and submit reports to the Cadre and Civil Servant Department (Commendation and Reward Board) before March 31 each year for consolidation and management.

2. When launching and concluding each campaign, units shall be responsible for submitting reports to the Ministry’s Commendation and Reward Board for monitoring and as a basis for awarding rewards.

Article 42. Effective Date

1. This Circular takes effect from December 15, 2015.

2. Decision No. 34/2006/QĐ-BXD dated October 10, 2006 of the Ministry of Construction promulgating the Regulations on Commendation and Reward of the Construction Sector shall cease to be effective from the date this Circular takes effect.

Article 43. Responsibility for Implementation

1. Relevant organizations and individuals are responsible for implementing this Circular. Any difficulties arising during implementation should be promptly reported to the Ministry of Construction for consideration and resolution.

2. The Cadre and Civil Servant Department is responsible for guiding and inspecting the implementation of this Circular./.
